Abstract

This research is motivated by the many forms of criminal acts at each stage of the General Election, one of which can occur at the stages of registration, verification and determination of political parties as potential election participants, as well as different law enforcement mechanisms for election crimes and other criminal acts. It is important to carry out this research with the aim of finding out criminal acts that arise during the stages of registration, verification and determination of political parties as candidate participants in the election and to find out the law enforcement process for criminal acts that occur. The method used in this research is empirical normative which was carried out with literature studies and field studies carried out by the Kolaka Regency Integrated Law Enforcement Center. The results of the research show that the criminal aspects at the stages of Registration, Verification and Determination of Candidates for Election Contestants include criminal acts regulated in the provisions of Article 518 of Law Number 7 of 2017 concerning General Elections (not following up on the findings of Bawaslu, Provincial Bawaslu and/or Regency Bawaslu/ City in carrying out verification of political parties as candidates for Election Contestation), Article 263 of the Criminal Code (Forgery of Documents) and Article 67 of Law Number 27 of 2022 concerning Protection of Personal Data (UU PDP) as well as law enforcement for election crimes is different from criminal acts in general, which using the concept of speedy trial. The things that differentiate include the mechanism for investigation, prosecution and trial which is carried out quickly, can be carried out without the presence of the defendant (in absentia), and legal action can only be taken at the appeal level. In the implementation of handling election crimes at the Kolaka Regency Gakkumdu Center, starting from the Report/Findings Stage, Initial Study, First Discussion, Clarification, Study of suspected violations, Second Discussion, Plenary Meeting, Investigation, Third Discussion, and Prosecution.

Abstract

Riset ini dilandasi atas kemauan buat penuhi keinginan yang mendesak negeri buat ikut serta dalam akad bidang usaha global, tetapi belum seluruh akad bidang usaha international yang terdapat bisa menata ikatan diartikan. Riset ini bertabiat yuridis normatif dengan pangkal hukum inferior yang setelah itu ditafsirkan. Tata cara pengumpulan informasi yang dipakai dalam riset ini merupakan dengan riset akta. Analisa informasi tidak bisa dilepaskan dari bermacam pengertian. Ada pula pengertian yang dipergunakan dalam penyusunan ini merupakan pengertian pandangan hukum serta keterkaitan kontraktual ialah dengan mengamati akad bidang usaha global dari bidang batas serta jenjang pembuatan dan akibatnya untuk kemajuan hukum nasional. Dari ulasan bisa disimpulkan yang dibilang akad bidang usaha global merupakan akad yang terbuat oleh poin hukum global, angkat tangan pada hukum nasional serta melahirkan hak serta peranan. Akibat Pengesahan Akad Global kepada Hukum serta keterkaitan kontraktual wajib memandang peran negeri serta akar dari perjanjian bidang usaha global. Kewenangan yudikatif senantiasa bisa melandaskan argumentasi hukum.

Abstract

Advances in digital technology have brought massive changes to various aspects of life, including managing natural resources in renewable energy. Digital technology has become one of the strongest drivers for the energy transition goal. In light of this potential, various government policies are currently underway to facilitate the expansion of these resources. Initially, this expansion initiative appears to be a sound and perfect plan, as the transition towards renewable energy will significantly affect environmental conservation efforts, bolstered by digitalization in the energy management sector. Holistically, there appears to be some confusion from both social and economic perspectives, and particularly from a legal perspective at the regulatory level. Objective of this research is to investigate the relationship between advancements in digital technology on renewable energy expantion. Additionally, it aims to investigate the legal barriers that hinder efforts to expand renewable energy in the country, and to explore the significance of paradoxes in this process. This research was conducted principles of law, synchronisation regulations, historical legal analysis, and comparative jurisprudential study. The findings of the research indicate that digital technology, or digitization, in the management of renewable energy provides a significant positive contribution in terms of improving safety, production processes, increasing access, and sustainable management. On the other side, renewable energy regulations have not been able to accommodate the country's expansion efforts and potential. There are still many legal, social, economic, and environmental conflicts in this process.

Abstract

This research critically examines Indonesia's land bank regulations, introduced under the Job Creation Law to boost investment, but which risk promoting land grabbing, particularly affecting farming and indigenous communities. The study's novelty lies in its focus on assessing the compatibility of land bank policies with Indonesia's agrarian legal framework through the lens of legal utilitarianism. By employing normative research methods, including theoretical and regulatory analysis, the study identifies significant legal flaws in both the legislative process and the content of the regulations. These issues undermine the principles of agrarian justice, particularly in ensuring equitable land ownership rights. This research offers urgent recommendations to policymakers, advocating for the protection of vulnerable communities from the adverse effects of land bank policies.

Abstract

Pelatihan ini bertujuan untuk meningkatkan pemahaman tenaga kerja informal mengenai penyusunan kontrak kerja dan perlindungan hukum yang terkait dengan hak-hak mereka. Sektor informal di Indonesia, yang mencakup mayoritas tenaga kerja, masih menghadapi tantangan dalam hal perlindungan hukum akibat ketidakpahaman mengenai pentingnya kontrak kerja. Pelatihan yang menggunakan metode partisipatif ini diikuti oleh 30 peserta dari berbagai sektor informal dan mencakup modul pengenalan hukum ketenagakerjaan, simulasi penyusunan kontrak kerja, serta perlindungan hukum bagi pekerja informal. Hasil pre-test dan post-test menunjukkan peningkatan signifikan dalam pengetahuan peserta. Simulasi yang dilakukan juga menunjukkan bahwa peserta mampu menyusun kontrak kerja yang memadai dengan bimbingan fasilitator. Meskipun hasilnya positif, beberapa tantangan, seperti literasi hukum yang rendah, masih menjadi kendala. Oleh karena itu, diperlukan program lanjutan untuk memastikan tenaga kerja informal dapat menerapkan pengetahuan mereka dalam melindungi hak-haknya secara hukum.
