Abstract

Salah satu upaya untuk meningkatkan derajat masyarakat ditengah kehidupan bersosial adalah dengan memberikan pemahaman dan kesadaran untuk menerapkan kepatuhan terhadap aspek-aspek yang berlaku ditengah masyarakat. Pada penyelenggaraan kegiatan pengabdian ini yakni masyarakat dibekali pengetahuan, pemahaman serta kesadaran tentang tiga aspek yakni aspek hukum, aspek kesehatan dan kewirausahaan. Metode yang digunakan yakni pemberian teori dan tanya jawab langsung. Hasil dari kegiatan ini yakni adanya peningkatan pengetahuan individu maupun kelompok masyarakat tentang kesadaran hukum, pentingnya menerapkan pola hidup bersih, serta antusias masyarakat untuk mau memulai berwirausaha.

Abstract

Pandemi Covid-19 yang telah berlangsung selama beberapa tahun, menimbulkan tekanan dan efek di semua sektor, baik secara global maupun domestik. Dampak dari Pandemi Covid 19 ini menyebabkan lumpuhnya sendi – sendi perekonomian bangsa. Matinya mata pencaharian sebagian masyarakat menyebabkan banyak masyarakat yang kehilangan mata pencaharian. Dalam rangka mendukung kebijakan keuangan negara dan guna melakukan penyelamatan ekonomi nasional, Pemerintah menjalankan Program PEN. Program PEN dimaksud bertujuan untuk melindungi, mempertahankan dan meningkatkan kemampuan ekonomi para pelaku usaha dari sektor riil dan sektor keuangan dalam menjalankan usahanya. Pasal 11 ayat (7) Perpu Nomor 1 Tahun 2020 mengamanatkan pelaksanaan Program PEN diatur lebih lanjut dengan Peraturan Pemerintah. Jenis penelitian yang digunakan yaitu penelitian sosiologi atau penelitian hukum sosiologi ataupun bisa juga penelitian lapangan, karena di lakukan dengan melihat secara nyata keadaan serta fakta-fakta yang terjadi di sekitar masyarakat. Bagaimana Konstruksi Hukum Dana Pemulihan Ekonomi Nasional Bisa Bermanfaat Untuk Bisa Mendorong Tumbuhnya Usaha-Usaha Industri dan Pembangunan Infrastruktur. Menurut hasil pemeriksaan Badan Pemeriksa Keuangan (BPK) terdapat 6 temuan masalah dalam penerapan dana PEN sehingga menghambat penggunaan dana PEN untuk bisa mendorong Tumbuhnya Usaha-Usaha Industri dan Pembangunan Infrastruktur pasca pandemic Covid 19.

Abstract

The aim of this research is to find out how criminal law regulates and recognizes the spread of hoaxes in the context of election campaigns and to find out how prevention efforts and legal education can be improved to reduce the spread of hoaxes during election campaigns. In this research, the researcher used a normative research method, namely a research method that aims to analyze, interpret and evaluate applicable law or legal principles by referring to theory, doctrine, statutory regulations, court decisions and other legal sources. Social media is the easiest place to share and get various information about the latest things that are currently being discussed and paid attention to by the public. However, as explained previously, not everyone can use social media well and wisely. This can be seen from the rise of hoax news spread on various social media platforms, be it Facebook, Instagram, WhatsApp, Twitter and so on.

Abstract

Power sharing vertically in a unitary state has its consequence for the existence of the environment of both central and local governments. By the existence, another consequence appears which is the relationship between central government and local government in order to avoid the overlap of the authority implementation. One of the crucial aspects in democratic state of law (democratischerechtsstaat) is legality principle (legaliteitsbeginsel). It means that each legal action of the government should be based on the applicable laws and regulations or the authority given by the applicable regulations. The problem statements and the aims of this research are to find out the authority of the Government Officials in running the government affairs and to investigate the meaning of delegating and mandating conducted by the government officials. Authority is the formal power owned by administration boards and/or officials or other state administrators to act in public law report including some competences. The basic principles of authority are first, the administration officials act and make decision based on their authority; second, the authority to use should be accounted for and tested by both legal norm and legal principle. Delegation is defined as delegating authority from the higher board and/or government officials to the subordinates in which the responsibility and liability is switched completely to the delegates. Mandate does not contain the transfer of authority. It is only the mandator gives his/her authority to another person (mandatary) to make decision or take actions on his/her behalf.

Abstract

The aim of the research is to determine and analyze the concept of protecting women victims of sexual violence in terms of human rights in Indonesia's positive legal system. And to find out and analyze the form of state responsibility in protecting women victims of sexual violence in terms of human rights in Indonesia's positive legal system. The type of research, namely Normative Juridical, is legal research that places law as a building system of norms. The legal materials used in this research come from primary legal materials obtained directly from legal materials, both primary legal materials and secondary legal materials. In this case the author will try to collect information that is relevant to the topic or problem being researched, as well as examine in depth the information collected and synchronize it with the main problem in this thesis. The concept of protecting women victims of sexual violence in terms of human rights in Indonesia's positive legal system is that victims have the right to obtain their rights which are generally regulated in Article 5 of Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection. Witnesses and victims also have the right to receive medical assistance, rehabilitation, compensation and restitution. Forms of State Responsibility in Protecting Women Victims of Sexual Violence In terms of Human Rights in Indonesia's Positive Legal System, namely that the State has the responsibility to provide protection and a sense of security to its citizens. In this case, especially for women who are victims of sexual crimes.

Abstract

Berlakunya Undang-Undang Nomor 30 Tahun 2014 tentang Adminstrasi Pemerintahan memberikan angin segar bagi para pencari keadilan dalam ruang lingkup Tata Usaha Negara. Dengan adanya Undang-Undang ini pula telah memperluas access to justice bagi pencari keadilan di Peradilan Tata Usaha Negara dengan cara membuka ruang-ruang tertutup yang sebelumnya tidak dapat dimasuki oleh para pencari keadilan. Sehingganya bagi warga masyarakat/Badan Hukum yang merasa dirugikan terhadap Keputusan Tata Usaha Negara dapat mengambil upaya Hukum administrasi. Dengan begitupula kita dapat mengetahui proses penyelesaian sengketa administrasi dengan  memperoleh sumbangsih berupa pengetahuan sekaligus menjelaskan secara definitif suatu sengketa Tata Usaha Negara dapat diselesaikan melalui mekanisme Pengadilan, atau  melalui upaya administratif terlebih dahulu. Adapun Tujuan dilakukanya penelitian ini untuk mengetahui dan menganalisis Upaya Administrasi dan Peradilan dalam sengketa Keputusan Tata Usaha Negara.

Abstract

This study analyzes the operationalization of Gorontalo customary law as a living constitution within the framework of Islamic Constitutional Law in two different demographic contexts: a Muslim majority society in Gorontalo Province (98.1%) and a Muslim minority enclave in Ternate Tanjung Sub-District, Manado City (86.7% at the sub-district level and 31.9% at the city level). Using a socio-legal comparative research approach, this study examines how adat-Islamic constitutional norms function, adapt, and obtain legitimacy within different constitutional structures. Data were collected through in-depth interviews with four key informants, comprising two Gorontalo customary leaders and two Manado community leaders. The findings demonstrate that the principle "Adati hula-hulaa to Syara’, Syara’ hula-hulaa to Qur’ani" functions as the basic norm (substantive grundnorm) of Gorontalo Islamic Constitutional Law that remains stable across demographic contexts. However, the constitutional operationalization mechanism undergoes transformation. In the Muslim majority context, customary law operates formally through the Buwatulo Taulongo institution, which enjoys dual legitimacy, both customary and state, thereby forming a local living constitutional order. Conversely, in the Muslim minority context, customary law operates flexibly-informally through family deliberation and ad-hoc mediation by sub-district officials, imams, and the Office of Religious Affairs. This transformation is not degradation, but rather constitutional rearticulation aligned with the principles of Fiqh al-Aqalliyyat: yusr, maslahah mursalah, muwatanah, and tadarruj. This research develops a layered Living Fiqh al-Aqalliyyat model from an Islamic Constitutional Law perspective, expanding the concept of a living constitution from temporal adaptation to demographic adaptation, particularly in the context of domestic Muslim minorities in Eastern Indonesia.
