Abstract

ملحصمسؤلية الحكم النقلى على الراكب والموادها وتبديل خاسربن من الإهتمال في الركاب. تبحث هذه الكتابة عن الركاب تشتمل على تعريفات الركاب ، فرد ومفرود الركاب , أنواعها وصفاتها واهدافها وعلاقتها على الراكب ومواده ، وتبحث أيضا عن عقابة التي تخسر بها. تخسر عن الركاب على الراكب في الركابة منها : مسؤولية الركوبة عند تجد فيها الفاسد أو تفقد بسب الاهتمال عند الركابة والتحديدات المسؤوليات في الركابة . هناك عدة مسؤولية في الركابة للراكب وهي ومسؤولية من جهة الأخطاء والإهتمالات ، ومسؤولية من جهة الظن والمطلق . ومن ثم هذه المقالة تتكلم عن الحقوق والواجبات من الراكب ومركوبها.الكمات الرئيسية : مسؤولية الحكم ، مركوبة الراكب ، والإهتمال .         AbstrakPertanggungjawaban Hukum Pengangkutan Terhadap Penumpang Dan Barang Angkutan  Serta Ganti Kerugian Disebabkan Kelalaian : Artikel ini membahas tentang ruang lingkup pengangkutan termasuk definisi pengangkutan, objek dan pihak pengangkutan, jenis-jenis pengangkutan sifat dan tujuan pengangkutan serta kaitannya dengan penumpang dan barang angkutan, serta membahas tentang sanksi kerugian. Serta pertanggungjawaban pengangkutan ketika terjadi kerusakan serta kehilangan barang penumpang yang disebabkan kelalaian pihak pengangkut, dan batasan batasan yang termasuk dalam tanggungjawab pengangkutan.  Dimana terdapat beberapa jenis-jenis pertanggungjawaban yang dilakukan oleh pihak pengangkut yakni pertanggungjawaban pengangkutan dilihat dari kesalahan dan kelalaian, pertanggungjawaban karena praduga dan pertanggungjawaban mutlak. Selanjutnya berbicara tentang hak dan kewajiban para pihak.

Abstract

AbstractCharacter is the basic capital to build a high level of civilization, build a high civilization which is the education of noble character. Character education can be defined as a process of internalization main qualities into the child so that she can grow and develop into an adult human in accordance with the values of religion and culture. The establishment of an Islamic human character must be sourced from al-Quran?n as basic grip, and the Hadith of the Prophet as an explanatory / interpreter, and al-Ijtihad as human sight is not out of the essence of the Koran and the Hadith of the Prophet. Islamic teachings on character education is not just a theory, but the figure of the Prophet Muhammad appeared as an example (uswah hasanah) or paragon in the values of the noble character. Urgency national character building is the last bastion against the effects of globalization which is a non-physical force (soft power). Human resources pengetatahun only master the science and technology without having a moral conscience fortified with noble character would endanger the survival of the nation. Keywords: Education, and character  AbstrakKarakter adalah modal dasar membangun peradaban tingkat tinggi, membangun peradaban tinggi yang berkarakter mulia adalah dengan pendidikan. Pendidikan karakter dapat dimaknai sebagai suatu proses internalisasi sifat-sifat utama ke dalam diri anak sehingga ia dapat tumbuh dan berkembang menjadi manusia dewasa sesuai dengan nilai-nilai agam dan budaya. Pembentukan manusia berkarakter yang Islami harus bersumber dari al-Qur??n sebagai pokok pegangan, dan Hadis Nabi saw sebagai penjelas/penafsir, dan al-Ijtihad sebagai pandangan manusia yang tidak keluar dari esensi al-Qur??n dan Hadis Nabi saw. Ajaran Islam tentang pendidikan karakter bukan hanya sekedar teori, tetapi figur Nabi Muhammad saw tampil sebagai contoh (uswah hasanah) atau suri teladan dalam menginternalisasi nilai-nilai karakter mulia tersebut. Urgensi pembangunan karakter bangsa merupakan benteng terakhir terhadap pengaruh globalisasi yang merupakan kekuatan non fisik (soft power). Sumber daya manusia yang hanya menguasai ilmu pengetatahun dan teknologi tanpa memiliki kesadaran moral yang dibentengi dengan karakter mulia akan membahayakan keberlangsungan hidup bangsa dan negara. Kata Kunci: Pendidikan, dan karakter

Abstract

Ratéb Dôda Idi is one of the local wisdoms in Aceh Besar community in educating early childhood. They put their children to sleep in a swing and chant poem that contains the value of monotheism. Previous research explains, Ratéb Dôda Idi as childcare media, character building, and socio-cultural functions. At present, there are still parents who use Ratéb Dôda Idi as a medium for children's education, but some do not use it. Poem of Ratéb Dôda Idi is often contested, and the Aceh’s Tradition Council has done the training. This study aims to find answers to the poem of Ratéb Dôda Idi used as a medium of transferring monotheism value and how relevant it is to the future development of Islam in Aceh Besar. This research uses a qualitative approach and “social situation”, descriptive method, text analysis, purposive informants, interview technique snowball, and triangulation. The results of the study answer that: First, Ratéb Dôda Idi used as a medium of transferring monotheism value to children, with the reasons: (1) poem has become a tradition in society; (2) poem is entertainment for children and parents; (3) poem is appropriate to the child character; (4) rewarding those who read it. Second: Ratéb Dôda Idi is relevant to Islamic education, with reason: poem of Ratéb Dôda Idi and Islamic religious education both aim to form a pious man and virtuous character; (2) poem of ratéb dôda idi and Islamic education both contain monotheism, worship, and morals; (3) it is known that the role of parents in poem ratéb dôda idi is appropriate to Islamic teachings, namely the most responsible ones to children’s education is parents. Ratéb Dôda Idi needs to be preserved and adapted to the times. Ratéb Dôda Idi is an investment for children's education from now on in Aceh Besar community.

Abstract

Implementation of authentic assessment is motivated by the emergence of a curriculum change from KTSP curriculum into the curriculum 2013. Curriculum 2013 seeks to enhance authentic assessment standards that emphasize on learning outcomes. This study aims to determine the implementation of authentic assessment on the Curriculum 2013 in state senior high school / SMA Negeri 1 Hutabargot, Mandailing Natal district. The research applies a descriptive qualitative method. The research subject is a teacher of Islamic education in state senior high school / SMA Negeri 1 Hutabargot, Mandailing Natal district who is known as a State Civil Apparatus. Data are collected through observation, interviews, and documentation. The results reveal that the implementation of authentic assessment on the Curriculum 2013 is appropriate to its techniques, instruments, and processes. Attitude assessment is obtained from observation using a checklist, while knowledge assessment is obtained from verbal and written tests, and skills assessment is obtained from a test, a scale list.

Abstract

The application of an oral contract in buying and selling transactions in Palangka Raya City is a form of contract adopted from Banjar culture. Even traditional market players in Palangka Raya City, in particular, interpret the oral contract as something that is very principle, so that they consider a contract invalid if it is not stated verbally. This article explores the question of why the oral contract in buying and selling in Palangka Raya City is still being applied and how the oral contract law is in buying and selling transactions in Palangka Raya City. This research is qualitative research with a phenomenological approach. This study found that the application of oral contracts in buying and selling transactions in Palangka Raya City originated from the habits of Banjar tribe traders who trade in Palangka Raya City. This habit, then, develops into the habit of the local community, so it becomes a necessity to be implemented. The law of the oral contract in the transaction is valid in terms of Islamic law and civil law because it fulfills the requirements and is in harmony with the contract in buying and selling and is carried out voluntarily, is based on the principle of freedom of contract. There is a balance of achievement, and has legal certainty so that it binds both parties. The existence of this oral contract shows the legitimacy of legal norms, religious norms, and customary norms.

Abstract

The Kedah and Tabagsel Ulama Network in 1900-1950 was important to be discussed considering that there were some scholars from Tabagsel who were studying in Kedah. After that, they proceed to Mecca. After they returned to Indonesia they established a pesantren. Among them, Sheikh Ahmad Daud (1891-1981), Muhammad Mukhtar Harahap, founder of the Padang Padang Lawas al-Mukhtariyah boarding school, Sheikh Abdul Qadir Mandily, and Sheikh Juneid Thola from Kotanopan. For education experts in Malaysia mention that since 1924-1945 there was a golden age of Islamic education in Kedah. Many Ulama in Kedah came from Patani because of security factors that were not conducive, so they migrated to Kedah. Later, after the Tabagsel ulemas came back and established Islamic boarding schools in their respective regions, they gave colors to Islamic education for the community

Abstract

The purpose of study is to analyze the relationship of  Economic Growth, Fiscal Policies, and Demographic to  Islamic Human Development Index in Indonesia.  The analysis method used Granger Causality test in 33 representative provinces.   Taked sampling with Criteria Purporsive Sampling method. The results showed that there was relationship between Economic growth to Demographic and Islamic Human Development Index. There was  relationship between Demographic to IHDI and  fiscal policy in health and education. There was relationship of Fiscal Policy in health to Fiscal Policy in education. Recommendation of study was 1. Increasing economic growth with equity to support the maximalization  IHDI in each region. 2.  Optimizing Fiscal policies performance to improving public services in education and health so can be impact on the high IHDI distributed in Indonesia.

Abstract

The emergence of the paradigm that religious learning is not a graduation standard affects the learning of tahfizh al-Quran. So that teachers are required to be able to attract interest in tahfizh al-Qur'an at SMP IT Darul Hasan Padangsidimpuan. The use of multimedia is an option in arousing interest in learning. Burner and Edgar Dale stated that the use of interactive learning media will increase enthusiasm for learning and make it easier for students to understand learning material. Multimedia autoplay which integrates sound, images, video and text media is expected to help. the effectiveness of the process of learning tahfizh al-Qur'an. This study aims to develop learning tahfizh al-Quran based character building through multimedia autoplay in class of VIII SMP IT Darul Hasan Padangsidimpuan, because teaching and learning activities (KBM) use multi method and multimedia, but limited to the use of print media so that it seems less effective. This study also uses the method of development (research and development). Development of instructional media based on Multimedia-based Instructional Design model ADDIE (Assessment/Analysis, Design, Development, Implementation and Evaluation). The aim is to design effective and systematic learning. Media development through the situation analysis stage, media development and media creation, through design trials and subject trials. Types of qualitative and quantitative data. The data collection instrument used a trumpet and a test. Data analysis through descriptive and test data analysis. As many as 32 respondents had pre-test and post-test scores, deviation freedom 30, sig.2 tailled 0.000 with 95% confidence degree, while the pre-test mean score was 68.96, and post-test mean score was 82.90. The lowest score was pre-test 54, the highest was 82, the lowest score was 70 and the highest was 90. Based on these results, the student's score increased by 12.94 points or 18.49%

Abstract

The actual dynamic authenticity of social life often shows accusations that religion is a source of social friction, violence, or conflict. The spirit of the Koran shows an appreciative attitude, even inviting to the meeting point (common platform) of monotheism (tauhid) which is the basic teaching of the Torah, the Bible, and the Koran. This paper aims to explore the existence of non-Muslims from the perspective of the Koran, the variants, and principles of social harmony with them. This paper uses qualitative as a method and literature as an approach. From the perspective of the Koran, there are 3 variants of arranged interactions. First in trade relations, second in marital relations, and third in political relations. The three variants of interaction must be based on the principle of Ihsan (good behavior) and Adalah (fair). Implications of this research present the idea of a meeting point between religions. This meeting point is expected to eliminate the friction of exclusivity between religious communities to create harmony and peace.

Abstract

Istihsan is a form of ijtihad method by calculating the law of a problem so that it is better for certain reasons as long as it does not violate Islamic law. Istihsan based on the argument used is divided into three: first, switching from qiyas dzahir to qiyas khafi; second, switching from general propositions to specific characteristics; third from Kulli's law to exceptions to legal exclusion (exceptions). Meanwhile, based on the backrest taken by mujtahid divided into four types; istihsan qiyasi, istihsan nashi, istihsan bi al-’urf and istihsan dharuri. Earning cash in the form of cash is a new phenomenon that is still often debated about its legality as a solution of the Islamic religion. This paper explains the role of istihsan methodology in restoring contemporary economic activities in the form of productive endowments. Based on its practices and functions, cash waqf has enormous benefits for the economic progress of the community. With the analysis of the istihsan methodology, it can be seen that the cash waqf law is permissible to review using the istihsan bi al-’urf approach
