Abstract

Nikah di bawah tangan atau nikah tidak dicatat merupakan isu hukum keluarga kontemporer yang masih dipraktekkan oleh masyarakat. Penelitian ini dilakukan di Kecamatan Peusangan Siblah Krueng, Bireun. Masalah yang ingin diteliti adalah apa saja dampak dan pengaruh perceraian dari nikah di bawah tangan terhadap pengasuhan anak di Kecamatan Peusangan Siblah Krueng, Bireun, dan bagaimana tinjauan hukum Islam terhadap perlindungan hukum anak akibat perceraian dari perkawinan di bawah tangan. Penelitian ini masuk dalam studi kasus (case study). Hasil penelitian menunjukkan bahwa perceraian dari nikah di bawah tangan terhadap pengasuhan anak di Kecamatan Peusangan Siblah Krueng, Bireun memiliki dampak negatif terhadap pengasuhan anak. Dua kasus ditemukan seorang ayah tidak menafkahi anak, tidak memberikan biaya pengasuhan, dan tidak merawat anak dengan baik. Menurut hukum Islam anak akibat perceraian dari perkawinan di bawah tangan tetap harus diberikan perlindungan hukum, khususnya bagi kedua orang tuanya. Islam memandang pernikahan di bawah tangan tetap sah, dan anak yang dihasilkan juga sah. Orang tua dari pasangan nikah di bawah tangan wajib melindungi anak dengan memberikan perawatan, pembiayaan, nafkah, kesehatan dan pendidikan anak, meskipun keduanya telah bercerai.

Abstract

Children with disabilities are vulnerable to poor treatment and the growth will be very difficult in a community environment. Therefore, it must be a child with a disability given the attention of the local government to provide protection for the child's disability. This research is categorized as field research Research) and Library Research, is a type of qualitative research. The results of this research show, based on data obtained from the social service city of Banda Aceh, currently the city of Banda Aceh there are 467 children with disabilities with the category of 7 types of disabilities, of the 7 types of disability that most of the levels are Tuna Runggu and Tuna. In the management of children with disabilities, the Government of Banda Aceh carried out several activities in terms of social assistance fund Rp. 4 million (four million rupiahs) per year, the establishment of a disabled child Family Communication Forum (FKKADK) and the provision of disability aids for children with disabilities according to their degree of disability. The efforts of the activities undertaken by the Government of Banda Aceh are in accordance with the provisions of article 8 of the Candy PPPA number 4 year 2017 about special protection for children with disabilities who said that the implementation of special protection for children with disabilities in the form of activities to be a reference for the area in drafting the action plan is adjusted to the condition, the situation, needs, and capabilities of the area and with the appropriate implementation on the article with article 90 of law number 8 year 2016 social rehabilitation, social protection, social empowerment, and social security. In the implementation of child protection with disabilities in Banda Aceh in accordance with the provisions of Islamic law relating to maqasid sharia.

Abstract

This study discusses the way in determining ‘illat through the munasabah method proposed by Imam al-Ghazali in the perspective of Islamic law. The study focuses on two main problems: the identification of ‘illat through munasabah and the legal formulation to utilize hikmat to obtain ‘illat according to al-Ghazali. This normative legal research used a legal history approach as an analytical tool to examine the Islamic scholars’ thoughts on concepts, theories and ways of doing istinbath. The study concluded that according to al-Ghazali there are three kinds of munasabah in determining ‘illat, consisting of munasib mu’atstsir, munasab mula’im, and munasib gharib. In munasib mu’atstsir, there is no issue found in seeking ‘illat because the ‘illat is understood directly from the nash or ijma’. Therefore, munasabah is no longer needed in the determining ‘illat. Here, the munasabah method focuses on munasib mula’im and munasib gharib in identifying ‘illat. Munasib mula’im seeks for the genus ‘illat, an ‘illat drawn from every event that has been predetermined by the nash, by examining the same hikmah in each of the events. Such hikmah is then used as the genus ‘illat which will later be applied as qiyas for other events that have been legally stipulated by the nash. On the other hand, munasib gharib seeks for the species ‘illat, an ‘illat obtained from an event that has been predetermined by the nash, with no comparison found in other events. ‘Illat determined from munasib gharib is also hikmah, having no concrete nature. In the perspective of legal history, this method of seeking ‘illat is inseparable from kalam and philosophy as was the development of the Islamic sciences at the time. As such, this had also affected al-Ghazali’s mastery in Islamic law as well as in other Islamic disciplines.

Abstract

Religious tourism objects in Indonesia are attractive destinations and have the potential to be fully developed. This study is an analysis of Islamic economic law on the arrangements of religious tourism in Indonesia, especially in South Sulawesi. The research method used to examine this problem is field research, utilizing interview, questionnaire, and observation techniques. This study concludes that there are dimensions of Islamic economic law in setting religious tourism. Although there is a difference of opinion on whether or not religious tourism is allowed, it should be noted that religious tourism provides benefits such as increasing the country’s foreign exchange income and developing the community economy. Thus, it is necessary that the government makes regulations that emphasize the purpose of opening religious tourism to the public, including the rights and obligations of managers and visitors, as well as relevant warnings and signs. The regulations have multiple functions, including to improve the economy, to increase the number of visitors, to guarantee the protection of the right to access while maintaining the teachings of their respective religions, to eliminate doubts about the occurrence of deviations of purpose, and to strengthen inter-religious unity. The concept that can be carried out in managing religious tourism objects of different religions is by making rules that integrate arrangements for the benefit of fostering inter-religious relations so as to create harmony in a Pancasila-based society. In the study of Islamic economic law, the arrangements of religious tourism objects will have an impact on creating harmony between religious communities, increasing people’s income, opening up employment opportunities, and strengthening the unity of the nation and the people.

Abstract

Islamic banks in channeling funds to the public with two types, namely financing with the profit sharing system and financing with the sale and purchase system with deferred payment. Revenue sharing system is a system that includes procedures for the distribution of results of operations between the fund provider and the fund manager. The system of buying and selling with deferred payment is a system with profit margins, namely by implementing a system of buying and selling at a bank as a seller or by appointing a customer to be used as a bank agent to make purchases of goods and then selling the goods to customers at the agreed base price and profit. In practice, financing through Islamic banks does not rule out the possibility of problems, such as defaults such as the case in the Muara Enim Religious Court.

Abstract

The rate of underage marriage in Gorontalo is very high, even though religion, customs and state laws prohibit it. The results of the direct interviews conducted and the observations made indicate that poverty, low levels of education and matchmaking myths may have caused this increase. Furthermore, the increasingly high level of promiscuity and weakened socio-cultural ties have led to an increase in the number of extramarital pregnancies, and forced marriage is unavoidable to maintain the dignity of the community. It was discovered that most married couples do not wed legally until they have problems in their marriage and seek a divorce. Moreover, women must also be responsible for their life choices because this paper shows that poor service practices have caused underage women to be objectified by physical, social and symbolic violence. The unavailability of a support system from the government and society makes a partner rely on the kindness of his or her parents. Therefore, it was suggested that government intervention, in the form of prevention and support systems for underage married women, must be integrated with the role of the community and religious leaders.

Abstract

This study examines the urgency and relevance of ḥifẓ al-lisān to be included as a part of al-ḍharūriyyāt from the five main points (al-ḍharūriyyāt al-khams) which have to be maintained and is the main level in the study of maqāṣid al-sharī'ah. The transformation of ḥifẓ al-lisān as maqāṣid al-sharī'ah al-ḍarūriyyah has a pivotal role in today's contemporary era. This study only focus on two important aspects such as how ḥifẓ al-lisān is being used as an important part of maqāṣid al-sharī'ah in the al-ḍharūriyyāt and to what extent the urgency and relevance of ḥifẓ al-lisān as maqāṣid al-sharī'ah in the contemporary era. This study employed inductive analysis as a method of analysis. The sources are books related to maqāṣid al-sharī'ah written by Islamic jurists. The results of this study reveal that ḥifẓ al-lisān is suitable and urgent to be included as a part of maqāṣid al-ḍarūriyyah based on the arguments of aqli and naqli as well as phenomena that occur in the today’s contemporary era. Ḥifẓ al-lisān is necessary to do in terms of harmonizing   life of society, nation and state. However, by ignoring ḥifẓ al-lisān has an impact on the emergence of negative attitudes such as provocation, slander, sarcasm, racism, spreading hoax news, hate speech and others. This negative attitude must be stopped because it certainly creates mafsadat for the community, nation and state.

Abstract

The research problems addressed in the article are the background story behind Ibn al-Muqaffa’s proposal for taqnīn, the historical background of the creation of the Islamic law codification in Indonesia, and the synchronization of ibn al-Muqaffa’s idea for taqnīn with the codification of Islamic law in Indonesia. The current study aims to unravel the view of Ibn Al-Muqaffa, an Islamic figure, about taqnīn. A biographical study was conducted by doing library research, especially on Ibn Al-Muqaffa’s proposal for taqnīn. The data collection procedure was divided into three parts i.e., orientation, exploration, focus-oriented research. Biographical research is part of a qualitative study that uses data analysis techniques and literature study as the qualitative data analysis as well as content analysis through the historical and textual approach. The results of the study reveal the method of law implementation before and during the lifetime of Ibn Al-Muqaffa which could be described as chaotic, with one of the reasons was because, at the time, the court had not possessed the statute that governed the legal activities other than the Islamic jurisprudence (fiqh) which was used by the judges in accepting, examining, and deciding on cases addressed to them. Therefore, every judge took a decision based on their own ijtihad (an Islamic legal term referring to independent reasoning or the thorough exertion of a jurist's mental faculty in finding a solution to a legal question). Ibn Al-Muqaffa advised the Khalifa Abu Jakfar Al-Manshur to compile the correlated legal reasonings in Islamic jurisprudence in which to be implemented and to be applied as the binding legal force in the form of statutory law which was regulated nationally and to be used as guidance by all the judges without no exception. The codification of Islamic law in Indonesia has received a constitutional status based on philosophical, sociological, and juridical reasons. The researchers closely examine three types of Islamic legal laws i.e., Act number 7 of 1989, Act number 3 of 2006, and Act number 50 of 2009 concerning Religious Courts, Act number 41 of 2004 concerning Waqf (Endowment), and Act number 21 of 2008 concerning Sharia (Islamic) Banking. Taqnīn (the codification of Islamic law) must be adjusted to demands of the present time in which it is implemented and in accordance with the specific fields of law, for example, taqnīn for Civil Law, Criminal Law, Family Law, Judicial Law, State Administrative Procedure Law, State Administrative Law, And State Finances.

Abstract

A concept of rights and obligations will work when there is a balance between the two. Malahat theory is an intra doctrinal reform for the realization of humane legal norms. However, in reality, this concept is not easy to implement. It is said that a woman is made as to the subordinate in the family and sometimes there is no justice for her. At this time, women not only play a role as housewives but also help earn money for the family. What becomes a problem is how to reinterpret the equitable distribution of household rights and obligations. This study aims to describe the rights and obligations of husband and wife by maintaining the values of justice. This research is library research that discusses the husband's income for his wife, who is also the breadwinner. The paradigm of the husband is the leader of the household, and the wife is the housewife is something that spurs Muslim feminists to reinterpret. It is because wives are no longer only responsible as housewives, but more than that, they also help make a living in the household. Then, the concepts of justice, equality, ukhuwah islamiyah and mu'asyarah bil ma'ruf must be prioritized for the benefit and the formation of a sakinah, mawaddah wa rahmah in a family. It needs to be reconsidered if we want to make it a new fiqhparadigm.

Abstract

This study discusses an analysis of the hadith about the characteristics of women and its implications for Islamic law. This article uses a study of the sanad (chain) and matan (wording or contents) of a hadith. It uses the theory of ma'anil hadithor science that discusses the meanings of a hadith, which allows the emergence of a textual and contextual understanding of a hadith. The understanding of a hadith is analyzed from the Islamic law perspective. This study concludes that the sanad (chain) and matan (wording or contents) of this hadith are authentic. The Sanad (chain) is authentic because it continues to the Messenger of Allah, the narrators are fair, dhabit and there is no zyudz or illat found. Nevertheless, this hadith should be understood contextually or symbolically-metaphorically, although there are scholars who understand it textually or literally. The content of the hadith teaches humans that when dealing with women, they should be careful and treat them wisely because their character and nature are like crooked ribs. They should neither be treated harshly because it will break, nor left unnoticed because it will make them go astray. However, the hadith cannot be understood textually because it leads to women subordination; the hadith should be interpreted contextually instead, and by so doing women will be treated equally and fairly. Therefore, it is important to understand this hadith contextually to allow a fair treatment for women and with dignity because it will affect the interpretation of the Islamic law and Islamic teachings in general are maintained.
