Abstract

This paper examines Asy Syatibi's legal reasoning of istiqra al-ma'nawy (thematic induction) and its impact on Indonesia's indigenization and contextualization of Islamic law. The reasoning model of Istiqra al-Ma'nawy Asy Syatibi was the study's first focus. Hazairin and Hasbi Ash Shiddiqiey are efforts to indigenize and contextualize Islam through the use of Istiqra al-Ma'nawy's method in Islamic legal reasoning. Doctrinal or normative legal research with a philosophical viewpoint A documentation model is used to collect data. This study's analytical method uses interpretive, idealistic, and holistic meta-logic. The notion of "natural law" from Islamic and customary law was applied to assess the facts. This study found that istiqra al-ma'nawy Asy Syatibi's reasoning formulation is based on a maslahah approach-based interpretation model, its idealization model is oriented toward text and context integration (tahqiq al-manath), and its holistic model is operationalized hierarchically from the top down (min al-a'la ila al-adna) and from the bottom up (min al-adna ila al-a'la). The integration and connectivity between anthropological studies of the bilateral kinship system of most Indonesian races and Asy Syatibi's legal reasoning influenced Hazairin's indigenization and contextualization of Islam. Hazairin abstracts the universal ideals in the Islamic system of inheritance via istiqra al-ma'nawy. Istiqra al-ma'nawy was used by Hasbi ash Shiddiqiey to reconcile puritanism and contextualism. The Istiqra al-Ma'nawi method strikes a balance between how law is defined (hukm taklify) and how law is made.

Abstract

This paper aims to study and analyze the history and role of the Barmak family in the Abbasid Dynasty government in Baghdad (786-803). The method used in this research is historical research. The historical method here is the process of testing and analyzing critically records and relics of the past. This study concluded that the Barmak family was the first non -Arab person to have the highest authority in the government affairs of the Abbasid Dynasty. This family controlled the government affairs of the Abbasid Dynasty from 786 AD to 803 M.45, namely in the five periods of the Caliph Abbasid. Namely during the time al-Saffah, al-Mansur, al-Mahdi, al-Hadi, al-Rashid. The Barmak family occupied the honorable position during the Abbasid Caliph. The wheels of government and the Caliphate Bureau of the Abbasid Dynasty were carried out by the Vice -Agency (Minister). The family of the Barmak whose family head was Khālid was appointed as Wazir by Al-Mansur and his descendants of Yahya, Fadhl, and Ja'far Ibn Barmak held that position under the Caliphs. The Barmakiah family are all famous for smart and smart people. This family succeeded in making the Caliph Harun al-Rashid the best caliph in the Abbasid era and succeeded in bringing the kingdom to reach a golden age. The fate of this family ended tragically, since 187 H/803 AD the direction of Al-Rashid's policy changed by massacre to the Barmak people which resulted in imprisonment of Yahya and Al-Fadhl, and the execution of Jaʿfar Ibn Barmak.

Abstract

This article seeks to evaluate the extent of Abu Al-Barakat Al-Baghdadi's contribution to Islamic philosophy. Al-Baghdadi, a critic of philosophy among scientists, has a marginal role in the history of Islamic philosophy due to his greater recognition in the field of science. This article aims to examine Al-Baghdadi's ideas in Islamic philosophy. Through descriptive and analytical methods, this study concludes that al-Baghdadi made a significant contribution to the advancement of Islamic philosophy. His ideas on God, the human soul, and science became a point of reference for numerous Islamic philosophers of his time. It is worth noting that al-Baghdadi can be regarded as a key figure in the field of Islamic philosophy.

Abstract

This research problem includes five approaches, namely: the foundation of educational management from a pedagogical perspective; goal-oriented educational management; process-based education management; results-oriented educational management; and education management based on Total Quality Management (TQM). This research aims to find out five approaches to these problems and at the same time overcome them by obtaining final results in the research. The research method used in the research is descriptive qualitative with literature review techniques. The overall results of this research include five approaches, namely: the foundations of educational management from a pedagogical perspective including learning theory, curriculum development, guidance, educational management, and evaluation of learning outcomes; a goal-oriented approach includes integration towards achieving educational goals with mission, background, scenarios, resources, and feedback; a process-based approach includes planning, organizing, workforce placement, directing, coordinating, reporting, and funding; a results-oriented approach includes student learning achievements by paying attention to real results such as measurable skills and knowledge; and an approach based on Total Quality Management (TQM) in education includes continuous improvement involving cooperation from all educational institutions with a focus on customer satisfaction and continuous quality improvement through implementation. The conclusions in this research state that the pedagogical perspective has approaches that provide a solid foundation for improving the quality of educational management.

Abstract

The Qur'an is a scripture revealed by Allah to the Prophet Muhammad in Arabic very clearly and clearly, which is held as a guide to life by Muslims. The Qur'an has a rich variety of stylistic styles, including the true and majazi styles. True style refers to words that have original meanings as stipulated in the Qur'an. Majazi is the transfer of the basic meaning of a word to another meaning with a specific purpose or reason, or an expansion of the scope of meaning from its original meaning. This research uses librarry research that relies on data from various sources such as books, journals, and books relevant to the research focus and uses descriptive analysis methods, so as to explain clearly about the muamalah verses in the Qur'an, the study of the true lafaz and majazi translation of the Ministry of Religious Affairs of the Republic of Indonesia. This study has conclusions about the theory of translation of the Qur'an, the Verse About Muamalah, the Qur'an provides the basis, principles, laws, and ethics related to muamalah or socioeconomic interaction. The verses of the Qur'an discuss economics, transaction ethics, property, usury, buying and selling, ijarah, accounts receivable, wadi'ah, ariyah, wakalah, kafalah, shirkah, and mudarabah. Understand the difference between lafaz hakiki and majazi and ways to identify them.

Abstract

Discussion of shari'ah which is a reference to divine decrees as "standard operational procedures" and fiqh which is a sub-foundation of shari'ah in the form of interpretation at the next level as a product of anthropological subjectivity, requires the formulation of rules so that the product of legal understanding does not go off the rails of shari' at. Meanwhile, the idea of renewing the rules of fiqh, which leads to changes in the formulation of the main rules of fiqh, will give rise to methodological problems which are feared to deconstruct the established formulation. The main objective of Islamic law is to realize the ideals of human benefit which are based on the values of social justice as God's creatures. The ideals of Islamic social justice at the level of implementation are reflected in the juridical-normative provisions in both the Qur'an and al-Hadith, the basis of which are the values of equality (al-musawah), justice (al-'ilah) and freedom ( al-hurriyah). Islamic Sharia is a concept of religious teachings that regulates all dimensions of human life. Thus, Islamic law is a comprehensive concept of life. However, the legal provisions in both the Qur'an and al-Hadith are mostly stated in common language (mujmal) so that they require ijtihad. Therefore, it is very possible or even inevitable that there will be a diversity of interpretations of religious texts.

Abstract

When a divorce occurs between a husband and wife, it creates obligations that must be obeyed by a husband and wife, and these obligations include the former husband being obliged to provide a gift that must be given to the former wife who has been divorced. This article aims to examine the husband's responsibilities towards his wife and children after divorce. The existence of divorce does not mean the release of the husband's responsibility to provide responsibilities to the ex-wife, be it iddah maintenance, mut'ah, and child maintenance, provided that it is in accordance with the husband's ability. This research is a type of empirical juridical research, or called field research, which examines the applicable legal provisions and what happens in reality in society. Empirical juridical research is legal research on the enactment or implementation of normative legal provisions in action on each specific legal event that occurs in society. The results of this study indicate that the husband is responsible for the former wife and children after divorce in the Religious Court, that the former wife must receive maintenance in the form of mut'ah, iddah maintenance, madhiyah maintenance, and for children's rights or child maintenance. The husband is obliged to provide maintenance to the child in the future, and the prosecution system is every month until the child is 21 years old or has grown up. This policy is carried out to provide justice for wives who are divorced by their husbands.

Abstract

The difference between the determination of the beginning of the month is a problem that until now can lead to disputes in the community. Especially the differences between Islamic mass organizations in Indonesia. The formulation of the problem in this study are; 1) What is the interpretation of the hilal verses from the perspective of the Ministry of Religion and LIPI's interpretation? 2) How is the implementation of the interpretation of the hilal verses by the Ministry of Religion in determining the beginning of the Hijriyah month?. This research is in the form of library research using the method of presenting descriptive and analytical data. The determination of the beginning of the lunar month in the interpretation of the Ministry of Religion of the Republic of Indonesia and LIPI provides an understanding that the moon provides several benefits for the inhabitants of the earth as its mother planet. RI Ministry of Religion and LIPI share the benefits of the moon for human life on earth for 3 things; 1) Moon as a satellite of the earth, 2) Moon as a tidal mover, 3) Moon as a time maker.

Abstract

The focus of this research is to examine and criticize the hadiths contained in the MI class I Al-Qur'an Hadith textbook. The aim of this research is to find out the hadiths contained in the MI class I Al-Qur'an Hadith textbook, both from editorial and translation aspects, explanation of the meaning and values ​​contained in the hadith, even in terms of the quality of the hadith as outlined in textbooks. The research method in this article uses a qualitative approach, with the type of library research or literature study (library research). The data collected will be processed and analyzed in depth using the takrijul hadith and ma'anil hadith methods. The results of this research show that: When referring to the principles of textbook development, this book is not yet proportional. Because the material outlined in the book is not balanced between aspects of the Koran and aspects of hadith; The hadiths contained in the book can be confirmed to be the hadiths narrated by Muslim imams. Because there is no difference between sanad and matan from Muslim shohih books and scriptures.

Abstract

This research was raised based on problems related to social criticism in the poem Fairy Tale of a Sun Picker by Indah. The method the researcher used in the research was descriptive qualitative with a literary sociology model approach. The results of this research include six data findings related to social criticism in the poem Fairy Tale of a Sun Picker by Indah, namely about: humans who look cynically; scavengers looking for used mineral water bottles, traveling salesmen with dirty towels, and officials who are clever with words; humans who throw rubbish carelessly; paid public toilets used by market workers, as well as the sweat mixed with sadness from an elderly grandfather whose child committed suicide; the arbitrary behavior of the rulers towards the people; and plastic rice which was once distributed illegally in Indonesia. The conclusion of this research states that the literary sociology model can examine the social criticism contained in the poem Fairy Tale of a Sun Picker by Indah in depth.
