Abstract

This research aims to examine the position and authority of constitutional institutions in maintaining democratic stability and constitutional supremacy in Indonesia, especially in the context of the potential paradox of sovereignty that can arise from the role of law testing. In particular, the study highlights how the judiciary functions as a guardian of constitutional values, but at the same time risks exceeding the limits of authority that could disrupt the principle of checks and balances and government stability. This study uses normative legal methods with a doctrinal approach combined with bibliometric analysis through the VOSViewer application to map the trends of literature and related legal references. The results of the study show that the institution plays a crucial role in correcting policies that are not in line with the 1945 Constitution. However, its final and binding authority has the potential to create tensions with the executive and legislative institutions and create far-reaching legal uncertainty. Therefore, it is necessary to strengthen supervisory mechanisms, increase transparency, and develop cross-institutional constitutional dialogue to ensure the balance of power in a democratic constitutional system.

Abstract

The rise of cases requesting validation/itsbat nikah at the Pasuruan Religious Court signals that there are still many people who are less or not even aware of the importance of marriage registration at the Office of Religious Affairs (KUA). The research method used is normative legal research, using statutory, conceptual, and case approaches. The result of this study is the consideration of the Panel of Judges in deciding case number 0360/Pdt.P/2022/PA.Pas related to the decision to reject the marriage validation/itsbat nikah case against the ratio decedendi and the legal consequences for the wife and child is that the formal requirements carried out by both parties are not fulfilled. So that the legal consequences related to the rejection of the application for itsbat nikah by the judge against unregistered siri marriage are losses for the wife and children, including: difficulty obtaining the right to maintenance, joint property in the event of a divorce or the right to inheritance if the husband dies, the child will also find it difficult to get recognition from his father in the birth certificate.

Abstract

Divorce affects the economic resilience of families, especially for single mothers. Single mothers have to play a dual role as breadwinners and take care of their children without the help of their ex-husband. This research aims to analyze the effect of divorce on economic resilience and efforts to maintain the economic resilience of single mother families after divorce. The method used in this research is a systematic literature review based on big data of 600 research articles published between 2019-2024 via publish or perish Crossref, Google Scholar and OpenAlex with VOSviewer visualization. The articles used to analyze the problems in this research were 13 articles based on keyword criteria that represented the research problem. From the thirteen articles used in the systematic literature review, it was found that divorce had a negative effect on the financial condition of single mothers who had limited resources, did not have a permanent job or during their household ties depended on the results of their husband's work. Single mothers face many difficulties because they have to do everything alone at home, including meeting the daily needs of themselves and their children. Single mothers make various efforts to maintain the family's economic resilience through economic activities in the form of selling goods or services, working as company employees, laborers, household assistants and even becoming migrant workers

Abstract

This article is to analyze the value of the benefits of mediation in child custody cases.This research is normative research with a statutory approach and a conceptual approach. Types and sources of legal materials are primary legal materials, secondary legal materials and tertiary legal materials. Searching for legal materials uses the literature study method to search for legal materials, including regulations governing mediation, child custody, journals and literature books. The collected materials are then inventoried and identified and all existing legal materials are systematized. The results of the research show that the integration of mediation is based on the provisions of Article 130 HIR & Supreme Court Regulation No. 1 of 2016 concerning Mediation Procedures in Court requiring that cases be resolved through mediation including child custody. This method of resolving cases will prioritize the interests of the child because it is through a peace agreement which is confirmed by a deed. peace will enable joint parenting of children, this method will provide benefits in the child's growth and development even though the parents are divorced

Abstract

This research discusses the application of diversion in the juvenile justice system in the KendarI prosecutor's office This research uses normative legal research methods, namely by examining library materials which are secondary data. In this case normative legal research is research conducted with a focus on positive law in the form of legislation. The data used is secondary data from primary legal materials and secondary law. The research used is descriptive analysis, with a normative juridical approach in the legal references used referring to primary law and secondary legal materials, namely Law number 11 of 2012. About the juvenile justice system and related legislation. The results of the research used are qualitative descriptive research. The application of Diversion in the Juvenile Criminal Justice System at the Kendari District Court has been successfully carried out in juvenile criminal cases with sharp weapons / fire cases by going through the preparation stage, the judge's determination stage, the consultation stage, the agreement stage carried out by peaceful means between the two parties without any compensation. Diversion which is peaceful without loss by referring to the resolution of conflicts between children in conflict with the law through processes outside the criminal justice system, with the aim of achieving peace without causing harm to all parties, especially children and victims.

Abstract

This research aims to examine and analyze the responsibilities of the Sub-district Head as the Temporary Land Deed Making Officer (PPATS) in making the deed of transfer of land rights, as well as to review its implementation from the perspective of positive law and Islamic law. The sub-district head who is given the authority as a Temporary PPATS has a legal responsibility in ensuring the validity of the deed made, both administratively and substantially. However, in practice, obstacles and inconsistencies are often found between implementation in the field and applicable normative provisions. This study uses an empirical legal approach with a qualitative descriptive method. Primary data was obtained through interviews with the Sub-district Head, officials of the National Land Agency (BPN), notaries/PPAT, community leaders, and Islamic legal experts. Meanwhile, secondary data is obtained through a study of laws and regulations, legal literature, and relevant fiqh books. Data analysis is carried out qualitatively through the stages of data reduction, data presentation, and conclusion drawn. The results of the study show that the responsibility of the Sub-district Head as a Temporary PPATS has not been fully carried out optimally, especially in terms of mastery of the substance of agrarian law and understanding of the values of justice in Islamic law. From a positive legal perspective, the deed of transfer of rights made by the Sub-district Head has legal force as long as it meets the formal and material requirements. Meanwhile, from the perspective of Islamic law, the principles of justice, honesty, and agreement of the parties are the main basis in ownership transactions. Therefore, the synergy between positive legal rules and Islamic legal values needs to be improved to realize fair, transparent, and dignified land practices

Abstract

Handling social conflicts in urban areas requires a police approach that is not only repressive, but also preventive and participatory. Community Policing is a police strategy that emphasizes the partnership between the National Police and the community in maintaining security and social order. However, in practice, the implementation of Community Policing in urban areas still faces various challenges, such as low public trust in the authorities, lack of citizen participation, and weak consistency of implementation in the field. This research aims to examine the role of Community Policing revitalization in building civilization and social order through increasing trust and collaboration between the National Police and urban communities. Using a qualitative approach and case studies in several major cities in Indonesia, this study found that Community Policing revitalization based on transparency, two-way communication, and community empowerment has been proven to be able to improve the performance of the National Police and strengthen a sense of security and togetherness in urban environments. The results of this study recommend strengthening the capacity of POLRI personnel in social communication, developing a sustainable community participation system, and policy reforms that support long-term collaboration between officials and city residents. Thus, Community Policing is not only a security strategy, but also an important pillar in the development of an inclusive and orderly urban civilization.

Abstract

Penelitian ini bertujuan untuk menganalisis peranan Sentra Penegakan Hukum Terpadu (Gakkumdu) Kota Parepare dalam memproses pelaporan dugaan pelanggaran pidana penggunaan ijazah palsu pada Pemilihan Kepala Daerah (Pilkada) Kota Parepare Tahun 2024. Fokus kajian diarahkan pada mekanisme penanganan pelaporan, koordinasi antar lembaga dalam Sentra Gakkumdu (Bawaslu, Kepolisian, dan Kejaksaan), serta kendala-kendala yang dihadapi dalam proses penegakan hukum pemilu. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan jenis penelitian deskriptif. Data diperoleh melalui wawancara mendalam dengan pihak Gakkumdu, dokumentasi, dan studi pustaka. Hasil penelitian menunjukkan bahwa Gakkumdu Kota Parepare memiliki peran strategis dalam menyelidiki dan menindaklanjuti laporan dugaan ijazah palsu, namun terdapat sejumlah kendala seperti keterbatasan waktu penanganan, kurangnya bukti awal dari pelapor, serta hambatan teknis dalam verifikasi dokumen ke institusi pendidikan. Meskipun demikian, Gakkumdu dinilai telah berupaya optimal melalui koordinasi lintas lembaga dan penggunaan mekanisme hukum yang tersedia. Penelitian ini merekomendasikan penguatan kapasitas investigasi, peningkatan literasi hukum masyarakat, serta perbaikan sistem verifikasi dokumen sebagai upaya mendukung penegakan hukum pemilu yang adil dan transparan.

Abstract

Perkawinan di bawah umur masih menjadi fenomena hukum dan sosial yang marak di Indonesia meskipun telah terjadi perubahan batas usia minimal melalui Undang-Undang No. 16 Tahun 2019. Penelitian ini bertujuan untuk menganalisis secara yuridis praktik perkawinan anak dalam perspektif hukum pidana Indonesia. Pendekatan yang digunakan adalah yuridis normatif dengan mengkaji regulasi seperti KUHP, UU Perlindungan Anak, dan UU Perkawinan. Hasil penelitian menunjukkan bahwa praktik dispensasi kawin yang longgar serta lemahnya penegakan hukum mengakibatkan hukum pidana belum berfungsi efektif sebagai instrumen perlindungan anak. Selain itu, pertanggungjawaban pidana terhadap pihak selain pelaku utama, seperti orang tua, penghulu, dan tokoh masyarakat, belum diterapkan secara konsisten meskipun memiliki dasar hukum yang jelas. Penelitian ini menekankan perlunya penafsiran progresif, penegakan hukum yang lebih tegas, dan sinergi antar lembaga guna mewujudkan perlindungan maksimal terhadap anak. Dengan demikian, hukum pidana tidak hanya sebagai alat represif, tetapi juga preventif dalam mencegah dan menindak praktik perkawinan anak.

Abstract

The need for a judicial system that is not only legal-formal but also substantive and just has become increasingly urgent amidst the ongoing crisis of integrity and public trust in modern judicial institutions. This research stems from the urgency to re-explore the realities of the pre-Islamic Arab judicial system and the system during the time of Prophet Muhammad (PBUH), which emphasized transcendental justice, ethics, and the values of public interest (maṣlaḥah). The study aims to examine the characteristics of the judicial systems in pre-Islamic Arabia and during the Prophet's era, as well as how the principles and methods applied in that context can be compared to and contribute to the development of modern judicial systems. The method used in this study is normative legal research based on library research, employing historical, conceptual, and comparative approaches. Data were collected from primary sources such as the Qur’an and Hadith, as well as secondary sources including classical and contemporary works on Islamic law and judicial systems. The study finds that the judicial system during the Prophet’s time was not formally institutionalized, yet it already embodied fundamental principles of modern justice—such as impartiality, presumption of innocence, equality before the law, and a substantive form of appellate review. Prophet Muhammad (PBUH) applied six main methods for resolving disputes: iqrār (confession), bayyinah (evidence/witness), yamin (oath), qasāmah (collective oath), firasah (judicial intuition and reasoning), and ṣulḥ (mediation). These methods demonstrate that the Prophetic system was flexible, contextual, and highly responsive to the social dynamics of the time. In conclusion, the Islamic judicial system during the Prophet’s era is not merely a historical legacy but a paradigmatic model that remains relevant for strengthening contemporary legal systems. Integrating the ethical and transcendental values of the Prophetic model into modern judiciary is believed to enhance the trajectory of law toward dignified and humanistic justice.
