Abstract

This study aims to analyze the ideology of Freedom of Learning in music learning through the integration of pedagogic competence, professional adaptation, and autonomy of cultural arts teachers as a framework for the development of contextual learning practices. The research method uses a descriptive qualitative approach through literature study and conceptual analysis of educational policies, pedagogic theories, and contemporary music learning practices. Data analysis was carried out thematically to identify the relationship between educational ideology, teacher professionalism, and music learning dynamics. The results of the study show that the ideology of Merdeka Belajar strengthens the role of teachers as reflective agents who have the freedom to design creative learning strategies based on local culture and the needs of students. The integration of pedagogic competencies and adaptive professionalism enhances learning flexibility, student active participation, and meaningful, student-centered musical experiences. This study concludes that the ideology of Independent Learning functions as a pedagogic paradigm that supports the development of innovative, contextual, and transformative music learning models in contemporary cultural arts education strategies based on local culture and the needs of students. The integration of pedagogic competencies and adaptive professionalism enhances learning flexibility, student active participation, and meaningful, student-centered musical experiences. Abstract

This study aims to analyze the legal position of SEMA No. 3 of 2015 as a basis for termination of employment due to serious misconduct and to assess the application of the principle of legal certainty in resolving termination disputes based on Supreme Court Decision Number 684/K/Pdt.Sus-PHI/2015. The research employs a normative juridical method using statutory and conceptual approaches, as well as analysis of court decisions as jurisprudential legal sources. The findings indicate that the application of SEMA No. 3 of 2015 has the potential to weaken the principle of due process of law if serious misconduct is not proven through an adequate judicial mechanism. Therefore, the resolution of termination disputes must prioritize juridical proof as the primary instrument to ensure legal certainty and the protection of workers’ rights. The study concludes that the legal status of SEMA No. 3 of 2015 is limited as an internal judicial guideline and is not part of the hierarchy of laws and regulations under Law Number 12 of 2011; thus, it cannot override decisions of the Constitutional Court of Indonesia, which are final and binding. In cases of termination due to serious misconduct, legal certainty requires the employer to fully prove the grounds for dismissal; otherwise, the termination shall be declared unlawful. Abstract

This study aims to analyze the concept of a decent wage for workers in Micro and Small Enterprises and to examine the role of the state in ensuring the fulfillment of wage obligations by employers in accordance with Government Regulation Number 36 of 2021 concerning Wages. This research employs a normative juridical method with statutory, conceptual, and Constitutional Court decision approaches, particularly those emphasizing the importance of procedural and substantive justice in wage determination. The findings indicate that wage regulation for workers in Micro and Small Enterprises under Government Regulation Number 36 of 2021 does not fully reflect the concept of a just and decent wage, as it places greater emphasis on business flexibility and capacity rather than on fulfilling workers’ decent living needs. The study concludes that a decent wage for workers in Micro and Small Enterprises should be interpreted proportionally, while still guaranteeing minimum standards of workers’ welfare without neglecting business sustainability. Furthermore, the role of the state should not be limited to that of a regulator, but also as a protector and facilitator through the formulation otove policies, effective supervision, capacity-building facilitation, and participatory wage-setting mechanisms in order to achieve a fair balance between the protection of workers’ rights and the sustainability of Micro and Small Enterprises within the framework of a welfare state.
