Abstract

This study aims to analyze the legal position of SEMA No. 3 of 2015 as a basis for termination of employment due to serious misconduct and to assess the application of the principle of legal certainty in resolving termination disputes based on Supreme Court Decision Number 684/K/Pdt.Sus-PHI/2015. The research employs a normative juridical method using statutory and conceptual approaches, as well as analysis of court decisions as jurisprudential legal sources. The findings indicate that the application of SEMA No. 3 of 2015 has the potential to weaken the principle of due process of law if serious misconduct is not proven through an adequate judicial mechanism. Therefore, the resolution of termination disputes must prioritize juridical proof as the primary instrument to ensure legal certainty and the protection of workers’ rights. The study concludes that the legal status of SEMA No. 3 of 2015 is limited as an internal judicial guideline and is not part of the hierarchy of laws and regulations under Law Number 12 of 2011; thus, it cannot override decisions of the Constitutional Court of Indonesia, which are final and binding. In cases of termination due to serious misconduct, legal certainty requires the employer to fully prove the grounds for dismissal; otherwise, the termination shall be declared unlawful. Abstract

This study aims to analyze the concept of a decent wage for workers in Micro and Small Enterprises and to examine the role of the state in ensuring the fulfillment of wage obligations by employers in accordance with Government Regulation Number 36 of 2021 concerning Wages. This research employs a normative juridical method with statutory, conceptual, and Constitutional Court decision approaches, particularly those emphasizing the importance of procedural and substantive justice in wage determination. The findings indicate that wage regulation for workers in Micro and Small Enterprises under Government Regulation Number 36 of 2021 does not fully reflect the concept of a just and decent wage, as it places greater emphasis on business flexibility and capacity rather than on fulfilling workers’ decent living needs. The study concludes that a decent wage for workers in Micro and Small Enterprises should be interpreted proportionally, while still guaranteeing minimum standards of workers’ welfare without neglecting business sustainability. Furthermore, the role of the state should not be limited to that of a regulator, but also as a protector and facilitator through the formulation otove policies, effective supervision, capacity-building facilitation, and participatory wage-setting mechanisms in order to achieve a fair balance between the protection of workers’ rights and the sustainability of Micro and Small Enterprises within the framework of a welfare state. Abstract

This study aims to analyze how social motives, including motives (past experiences) and to motive (social and psychological goals), influence the use of sneakers as a form of self-identity in urban communities in South Jakarta. The research method uses a qualitative approach with Alfred Schutz's phenomenological design. Data was collected through in-depth interviews, participant observation, and documentation of informants who are active sneaker users in the Blok M, Cipete, and Fatmawati areas, using purposive and snowball sampling techniques. Data analysis was conducted using the interactive model of Miles and Huberman. The results show that motive is formed from past emotional experiences, social environmental influences, and first experiences using branded sneakers that shape preferences and consumption habits. Meanwhile, to motive is driven by the desire to gain social recognition, build self-image, and be accepted in the community. These two motives interact in shaping the meaning of using sneakers as a symbol of self-identity. The conclusion of this study confirms that sneakers are no longer merely a functional necessity, but rather a symbolic communication medium in building social identity. This study contributes to the development of the phenomenology of consumption by emphasizing the relevance of Schutz's theory in understanding contemporary urban consumption culture. Abstract

The objective of this study is to examine changes in public housing policy and to explain why the Simple Rental Apartment Complexes (Rusunawa) in DKI Jakarta became a significant phenomenon in the urban planning of Jakarta in the early 21st century. The methodology employed in this study is a historical research method with a social history approach, which encompasses four stages: heuristics, source criticism, interpretation, and historiography. The results of the study indicate that Rusunawa in DKI Jakarta represent a continuation of the concept of vertical housing dating back to the New Order era, which evolved into an instrument for the redevelopment of slum settlements during the Reform era while also serving as part of the transformation of spatial governance in Jakarta. The study’s conclusions suggest that the construction of Rusunawa tends to prioritize the achievement of physical targets over the socio-economic preparation of residents. Rusunawa have not yet fully met the needs of the low-income population (MBR) as their intended beneficiaries. Keywords: Low-Income Communities (MBR), Public Housing, Rusunawa, Social History, Urban Planning.

Abstract

The purpose of this study is to analyze the dynamics of social conflict in Manggarai and assess the suitability of the Reconciliation and Peace Village Program, or Kampung Redam, as a community-based public policy response. This study employed a mixed-methods policy analysis with a predominantly qualitative design. Data were obtained from resident surveys, interviews, monitoring minutes, and program documents. The analysis was conducted using a framework analysis to map the roots of the conflict based on the social-ecological model, conflict transformation, collaborative governance, and policy instrument mix, as well as a simple realist evaluation to understand the relationship between context, policy mechanisms, and expected outcomes. The results indicate that the conflict in Manggarai was formed through the interaction of unemployment, school dropouts, residential density, weak family supervision, youth group solidarity, external provocation, regional stigma, and conflict escalation through social media. Each region exhibited a different configuration of problems. RW 02 was relatively conducive due to strong community coordination, while RW 03, RW 04, RW 05, and RW 012 exhibited a variety of economic, family, security, digital, and psychosocial issues. The most dominant trend in these results is the emergence of a transformation of conflict from physical violence to digital conflict through live broadcasts and the monetization of violent content. The conclusion suggests that Kampung Redam needs to be designed as a context-based, adaptive policy. The implication is that conflict management requires a combination of security instruments, alternative education, trauma recovery, economic empowerment, digital literacy, housing improvements, and cross-sectoral collaborative governance. Keywords: Collaborative Governance, Conflict Transformation, Public Policy, Urban Social Conflict.

Abstract

This study aims to examine the process of Christianization in the Malang residency in the 20th century, which is related to Dutch colonial practices. This study uses a historical method, this study has several stages, namely heuristics, criticism, interpretation, and historiography. The results of this study indicate that Christianization in Malang cannot be separated from the long history of the arrival of Catholics with Portuguese traders in Maluku in 1511 and the spread of Christianity (Protestantism) through the activities of the VOC in the 19th century. This study focuses on the development of Christianity in Malang which was influenced by European migration, infrastructure development, and socio-political changes during the colonial period. Through cultural and educational acculturation carried out by the Dutch colonial government became the main strategy in the spread of this religion. The Immanuel Protestant Church of West Indonesia (GPIB) Malang, which was founded in 1861, is an important symbol of Christianization in Malang and until now functions as a service center for Christian congregations. This study concludes that the colonial government and missionary institutions worked together to integrate Christianity into the social and educational structures in Malang, which not only increased the Christian population but also formed a sustainable religious community through the establishment of churches, especially Immanuel Church, as one of the symbols of this change. Keywords: Christianization, Church, Dutch Colonialism and Malang.

Abstract

This research is motivated by the value-action gap phenomenon among students, where high cognitive knowledge about the environment does not correlate with actual daily behavior. This study aims to analyze the implementation of Project-Based Learning (PjBL) with the theme "Sustainable Lifestyle" in Social Studies learning and its impact on forming students' Green Behavior at SMP Nusaputera. This study employs a descriptive qualitative approach with data collection techniques through participant observation, in-depth interviews, and documentation studies. The results indicate that PjBL, through poster investigation projects and tree planting, successfully transformed learning from passive to contextual. There was a shift in student motivation from external compliance to internalized awareness, marked by the emergence of ecological intelligence and empathy for the environment. The findings also confirmed a transfer of learning where environmental care behavior was carried over to the home, validating the synergy of the Tri-Center of Education (Tri Pusat Pendidikan) between school and family. However, this study noted challenges in the peer group realm, where peer hegemony that is permissive towards littering still hinders collective behavioral change. The study concludes that PjBL is effective in forming civic competence according to NCSS standards but requires sustainable social engineering to strengthen communal impact. Keywords: Green Behavior, Project-Based Learning (PjBL), Social Studies Education, Tri-Center of Education, Value-Action Gap.
