Abstract

In this study, the main problem is the concept of wills wajibahah which is not yet known in classical fiqh, as well as the lack of provisions in Indonesian legislation that can be used by judges to decide cases of wills wajibahah. As a result, judges in religious courts have struggled to resolve cases of wajibah wills brought before the court. The purpose of this study is to analyze the juridical basis of judges in the Religious Courts in Indonesia in granting the right of compulsory bequest to non-Muslim heirs. The approach used in this research is content analysis. The source of information used is Decision Number 263/Pdt.G/2007/PTA.Sby the decision is then analyzed using the content analysis method. The data used is secondary data consisting of primary legal materials in the form of decisions of Religious Courts in Indonesia regarding mandatory wills, as well as secondary and tertiary legal materials. Data analysis was conducted using qualitative normative analysis method. The findings of this study indicate that the ijtihad of judges in religious courts is based on juridical foundations which include the Law (UU), Compilation of Islamic Law (KHI), verses of the Qur'an, hadith, opinions of scholars, fiqh rules, Maqasid Sharia rules, and qiyas.

Abstract

This article explores the concept of ukhuwah wathaniyah (national brotherhood) as envisioned by Hadratussyaikh KH. M. Hasyim Asy'ari, a prominent Indonesian religious figure. It also examines the critical need for character education for students in the current era. The research employs a literature study method, analyzing Hasyim Asy'ari's works, particularly those collected in "Irsyād as-Sārī Fī Jam'i al-Muṣannafāt asy-Syaikh Hāsyim 'Asy'arī," along with other relevant documents such as manuscript books and his speeches, as well as books about him. An interpretive approach is used to understand the social and historical contexts that influenced Hasyim Asy'ari's thought, in order to unveil his concept of ukhuwah wathaniyah education. The research findings classify Hasyim Asy'ari's concept of ukhuwah wathaniyah education as consisting of politics based on Islam, a spirit of nationalism as the basis of ukhuwah wathaniyah, and a spirit of building unity as the foundation of ukhuwah wathaniyah

Abstract

This research discusses the situation where many pilgrims do not have tashrih in performing Hajj. Where the purpose of this study is to determine the correlation of tasrih to the mandatory requirements of Hajj and the position of the predicate status of the pilgrims. The research method used is qualitative, namely literature with an explanatory approach. The primary data source is Law No. 8 of 2019 concerning the Implementation of Hajj and Umrah (PIHU). Data was collected with documentation and conclusions were drawn with descriptive analysis techniques. The research findings state that tasrih is an official permit issued by the government of Saudi Arabia for pilgrims who want to visit Raudhah in the implementation of Hajj. If pilgrims do not have tasrih, they will be arrested and deported by the Saudi Arabian authorities because they do not have complete administrative requirements as a mandatory requirement for Hajj participants in carrying out their religious rituals. Regarding the title of mabrur Hajj, they are literally not included in the category because they performed Hajj fraudulently or illegally. However, those who are fortunate enough to perform Hajj without this authority (tasrih), their Hajj is still considered valid

Abstract

This study aims to explore the teachings of resilience in the story of Prophet Musa's mother as presented in the Qur'an, specifically Q.S Al-Qashash [28]: 7-13, and its urgency for single mothers in the modern era. This narrative contains values of steadfastness, trust in Allah, and strategies to face life's challenges that are relevant to single mothers. Through a thematic approach, this research identifies elements of resilience that can be applied in the daily lives of single mothers. The analysis is conducted using thematic interpretation methods and linked to contemporary social contexts. The findings reveal that the resilience values taught through the story of Prophet Musa's mother can provide inspiration and practical guidance for single mothers in facing various life challenges, such as overcoming economic difficulties, independently educating children, and maintaining psychological well-being. In conclusion, the teachings of resilience in the Qur'an are relevant and significant in supporting single mothers to lead more meaningful and productive lives.

Abstract

This research aims to investigate the impact of religious sounds in Bantul on the quality of daily life of local residents, especially in the context of noise originating from mosques as prayer spaces. Noise generated from prayer spaces which seem taboo in discussions in society has created new discussions. A qualitative approach was used in this research with data collection carried out by observation and interviews with several communities in Bantul. This research is to reveal the impact of religious sounds in Bantul worship spaces. The results of the research show that religious sounds in prayer rooms cause ongoing problems for the surrounding community related to excessive loudspeakers, such as disturbing individuals' privacy for resting, doing assignments and other activities that require peace. In conclusion, the impact of noise from the Worship Room reduces comfort and interferes with individual activities such as resting and studying. There needs to be stricter regulations regarding the use of loudspeakers and volume limits. Apart from that, the noise management strategy must involve various parties to evaluate the intensity and pattern of noise and provide education to the congregation and mosque administrators so that good communication can be created and does not harm any party.

Abstract

This article discusses the visualization of the Ayat al-Kursi (Verse of the Throne) on the pulpit chair in the Quwwatul Islam Mosque in Yogyakarta. The ornamentation of Ayat al-Kursi in the form of a chair signifies that the Quran has entered the realm of aesthetic dimensions. The decorative carving of Ayat al-Kursi displayed by the author is a result of the reception of a fusion between Javanese and Kalimantanese artistry with the Quran. In this context, the author employs Alfred Schlutz's theory to elucidate two phenomena, namely the because motive and the in-order-to motive. The findings of this research are twofold. Firstly, the inclusion of Ayat al-Kursi as an ornament on the pulpit chair is because this verse possesses extraordinary meaning and content, explicating the magnificence of Allah over all of His creations. Secondly, it serves as a reminder to the preachers and congregants to always remember Allah SWT and His omnipotence, as well as to encourage the congregants to frequent the mosque for worship. Thus, the presence of the Ayat al-Kursi ornament on the chair not only signifies aesthetic values but also holds a profound history and encapsulates religious values found within the Quran.

Abstract

This article explores the reform of Islamic educational thought and practice through a comparative analysis of Muhammad Qasim Zaman's perspectives on the Middle East and South Asia. The method used in this research is qualitative, using content analysis techniques on Zaman's book, Modern Islamic Thought in a Radical Age: Religious Authority and Internal Criticism, as well as Zaman's other books and writings. The analysis focuses on how religious authority, the role of clerics, and political engagement affect Islamic educational institutions and discourses. The findings show that Zaman presents a critical reflection on the intersection between tradition and modernity in both regions, demonstrating how educational reforms were shaped by debates between traditionalist and modernist currents. These dynamics contributed to the formation of new educational models-such as reformed madrasas and integrated universities-that sought to integrate classical Islamic knowledge with modern sciences. This study highlights Zaman's contribution to understanding the trajectory of Islamic education reform in different socio-political contexts.

Abstract

The customary practice of keduhei sudih kawan in traditional marriage ceremonies in Sebukar Village is considered a fundamental and mandatory ritual. However, there are no positive legal norms that explicitly recognize customary traditions as formal requirements for the validity of marriage. This study aims to examine the legal status and provide a juridical analysis of the keduhei tradition in the context of Indonesian customary law. This study employs an empirical juridical approach, utilizing data collection methods that include observation and in-depth interviews with members of the Sebukar Village Customary Council (Lembaga Kerapatan Adat Desa, LKAD). This research is prescriptive, with data processed systematically through editing and analyzed qualitatively. The results show that keduhei not only functions as a complement to the ceremony but also as an important legal affirmation in marriage based on customary norms, so it has a strong legal position. However, some elements of the custom, such as certain requirements and sanctions, can conflict with the provisions of national law, so a balance between customary law and national law is needed to ensure its sustainability and legal coherence.

Abstract

The purpose of this study is to explore the strategies and models of implementation of maqashid sharia in education. The context of this study focuses on educational institutions in Indonesia, considering that this country has the largest Muslim population in the world and a diverse education system. The unit of analysis used includes various components of education, namely educators, students, learning materials, learning media, and learning methods related to the implementation of maqashid sharia. The research used is a qualitative research approach, the type of which is a literature study. By using a qualitative research method or approach, the researcher conducted an analysis in a descriptive manner. The results of the study are that the five aspects of maqashid sharia, namely hifzh al-Din, hifzh al-Naf, hifzh al-'Aql, hifzh al-Nasl and hifzh al-Mal can be integrated with learning components, namely educators, students, learning materials, learning media and learning methods. The concept of Maqashid Sharia provides a strong foundation in designing an education system that is not only oriented towards academic achievement, but also pays attention to spiritual, moral, and social aspects. By applying the principles of Maqashid Syari'ah, education can be an effective means of forming individuals who are knowledgeable, faithful, and pious.

Abstract

Pesantren plays an important role in Islamic education in Indonesia. However, in the modern era, pesantren face challenges in adapting traditional values ​​with formal education and modern technology. This study aims to examine the reform of pesantren in Sidosermo, Surabaya, in integrating traditional values ​​with the modern education system. The research method used is a mixed methods method with an exploratory approach. Qualitative data were obtained through in-depth interviews, participant observation, and document studies, while quantitative data were collected through surveys and analyzed using statistical regression. The results showed that teaching methods had the most significant influence on the level of pesantren adaptation (β = 3.906), followed by teacher qualifications (β = 3.740) and facilities and infrastructure (β = 1.581). The support of ulama played a major role in pesantren reform (Sig. = 0.007), although in some cases it can be an obstacle if it is not in line with modernization policies. The conclusion of this study is that pesantren reform must be carried out gradually with an inclusive approach, involving all stakeholders so that it can be widely accepted without eliminating the identity of the pesantren. This study is expected to contribute to the development of sustainable pesantren education policies in the modern era.
