Abstract

This study aims to find a legal pattern for the distribution of inheritance in the Banjarmasin community which was submitted through the Banjarmasin Religious Court Judge. the problem to be achieved is how the ability of judges to decide cases about inheritance in 2016-2017. This research is literature with the document data on decisions about inheritance analyzed through a juridical-normative approach and processed through descriptive analytic normative-qualitative followed by a usul approach to the results of the distribution of inheritance. This correlation will result in the professionalism of judges from aspects of understanding, mastery, and juridical skills. The results of the study found that the ability of judges in understanding decisions was very good in examining the problems of determining the heirs proposed. The judge's proficiency in using Laws and KHI about inheritance is also in accordance with the results obtained. The ushul approach found that the concept of Radd from jurisprudence is given to furudh dzil except husband and wife, while KHI is for all heirs. Likewise, joint property disputes, it was found that the concept of al-‘urf is part of juridical considerations. Keywords: Professionalism, judge, inheritance, usul

Abstract

This study investigates the roles and contributions of female scholars (ulama) in South Kalimantan, specifically in the cities of Banjarmasin, Banjarbaru, and the Tapin district, through the lens of prophetic feminism. The research employs a qualitative field study approach, gathering data through interviews, observations, and document analysis. The results highlight the profound impact these female scholars have had in religious education, social initiatives, and organizational involvement. By integrating the three main principles of prophetic feminism—structural-transcendental epistemology, the concept of worship within feminist movements, and the interconnection of divine and human consciousness—the study reveals how these scholars bridge theoretical and practical aspects of feminism within their communities. The findings underscore the importance of recognizing and documenting the contributions of female scholars as part of Islamic heritage, advocating for gender equality through education, and fostering a more just and harmonious society through actions rooted in compassion and wisdom..

Abstract

In the context of the ongoing digital transformation of education, particularly in Islamic higher education in South Kalimantan, Indonesia, the integration of information and communication technology (ICT) presents both opportunities and challenges. This study aims to evaluate the implementation of online learning in three Islamic universities during the COVID-19 pandemic, focusing on how Islamic values and Banjar local wisdom are integrated into digital education. A qualitative case study approach was used, employing the CIPP (Context, Input, Process, Product) evaluation model. Data were gathered through interviews, observations, and document analysis from lecturers, policymakers, and students at UIN Antasari Banjarmasin, STAI Rasyidiyah Khalidiyah Amuntai, and STAI Al-Falah Banjarbaru. The findings reveal varied levels of preparedness and success in implementing online learning, with UIN Antasari demonstrating a more comprehensive approach, supported by better infrastructure and effective digital platforms. In contrast, private institutions faced challenges related to internet access, limited human resources, and inadequate technological infrastructure. Despite these disparities, all institutions made efforts to incorporate Islamic values such as ta'awun (mutual assistance) and akhlaq (good character), along with Banjar local wisdom, into their pedagogical approaches. The study highlights the importance of continuous evaluation and investment in infrastructure to ensure that digital transformation in Islamic higher education remains inclusive, culturally relevant, and aligned with local values.

Abstract

This study evaluates the role of Posbakum (Legal Aid Post) at the Faculty of Sharia UIN Antasari in legal services at the Religious Courts in South and Central Kalimantan. Findings indicate that the Posbakum's role is not yet optimal, prompting the LKBH management to propose measures such as enhancing the quality of staff, adjusting the number of staff and salaries, and improving collaboration with relevant stakeholders. Financial constraints and stagnation in collaboration were identified as obstacles, limiting the effectiveness of Posbakum staff. Optimization efforts require additional funding, accreditation, and active collaboration with other organizations. Partnerships are considered a solution for accelerating accreditation and expanding services, emphasizing the importance of financial support, enhanced collaboration, and increased resources to enable Posbakum to play an optimal role in providing legal services to the community.

Abstract

Economic inequality significantly influences consumer behavior, especially within culturally unique communities like the Muslim Banjar community in South Kalimantan, Indonesia. This study aims to explore the psychological and cultural impacts of economic inequality on consumer preferences, particularly toward advertising appeals emphasizing personal control. Using experimental methods involving 653 participants across five studies, the research reveals that higher economic inequality evokes financial threat perceptions, reduces a sense of control, and increases preferences for empowerment-focused advertisements. The findings further indicate that cultural values, such as family solidarity and religious beliefs, moderate these effects, mitigating the adverse impacts of inequality. The implications suggest a dual approach in advertising strategies—emphasizing both personal and collective empowerment—to address consumer needs in economically unequal societies. These insights provide valuable guidance for marketers and policymakers in crafting culturally sensitive and effective interventions.

Abstract

This research explores the Sultan Adam Law (UUSA) in the Kingdom of Banjar during the Dutch colonization and the reign of Sultan Adam (1825-1857). The UUSA, as a political law, reflects national law and the Shafi'i school of jurisprudence, despite being considered customary law. Islamic teachings, especially through the UUSA and the Book of Sabilal Muhtadin, are integrated into customary law due to literacy limitations. Sultan Adam, through structural governance reforms, implemented Islamic principles in Banjar society, with UUSA serving as a crucial foundation. This research highlights the contribution of UUSA in depicting the integration of Islamic law in the Kingdom of Banjar and recognizes its historical impact in the study of customary law.

Abstract

This study explores the resilience of female workers in Banjar society in South Kalimantan, particularly in three key regions: Banjarmasin, Martapura, and Bati-bati. In Banjar society, working women play a crucial role in supporting both family and community economies. This study highlights the various challenges and opportunities faced by female workers, including online motorcycle taxi drivers (ojol), traditional food vendors, and agricultural laborers. Using a qualitative approach, the study finds that the primary motivation for Banjar women to work is to support their families economically, avoid financial dependency, and maintain social dignity. Despite facing numerous challenges such as harsh working conditions and social stigma, Banjar women persist with resilience and family support. The findings indicate that women’s work in Banjar society is not merely an economic activity but also a vital aspect of social and cultural resilience.

Abstract

This study examines the phenomenon of child labor in South Kalimantan, focusing on the underlying economic and social factors that drive children into the workforce. The research employs a qualitative approach, utilizing interviews and field observations in Banjarmasin and Martapura. Findings indicate that child labor is primarily driven by economic hardship, with children engaging in various jobs such as street vending, entertainment, and market labor to support their families. Despite legal protections, many children face difficulties in accessing education due to their work commitments. The study highlights the urgent need for government intervention, emphasizing policies that balance economic support for families while ensuring children's right to education. The implications of this research suggest a more comprehensive social protection strategy and increased public awareness to address child labor effectively.

Abstract

The Hikayat Banjar manuscript is an ancient handwritten manuscript that contains important historical information to be studied. This manuscript is key in the study of the social history of the Banjar kingdom and in this research is used as the main material for exploring the Islamic history of the archipelago. The research on the Hikayat Banjar manuscript can be considered to bring new nuances to the discourse on the history of Islam in the archipelago. This research is a qualitative study using a philological approach in which researchers will conduct manuscript inventory, manuscript description, manuscript & text comparison, to present text editing before analyzing it. Since in this research the Hikayat Banjar is positioned as a source of Islamic history, the researcher seeks to examine in detail Islamic data related to normative teachings and Islamic culture which can then be translated into an analysis of social history and the history of Islamic institutions. From the research on these 2 reviews of the Hikayat Banjar, Islamic factors were found in the form of; 1) Arabic words or sentences and, 2) There is Islamic content in the arrangement of the Hikayat Banjar episodes which are detailed in the following phases; a) Pre-Islamic phase b) Introduction of Islam phase c) Formation phase of Islam in the Banjar Kingdom, and d) Post-Islamization phase, and 3) The Walisongo story in the Hikayat Banjar.

Abstract

The interpretation, understanding, and practice of Islam have always been subject to diversity, with some adherents adopting a rigid, textual, and even "ferocious" stance, leading to their characterization as intolerant, extreme, radical, and even terrorist. In contrast, others adopt a softer, more flexible, and contextual approach. A pivotal factor influencing this distinction is the method of information acquisition. The Generation Z (Gen-Z) cohort, born between 1995 and 2012, is currently entering the prepubertal and pubertal phases of self-identity exploration and ideological turmoil. As the digital generation, they are immersed in an era of abundant information, including that pertaining to Islam. On the one hand, this heightened religious consciousness motivates Gen-Z to strive for piety by studying Islam through various means; on the other hand, the pursuit of piety is rigid and not local, suggesting a religiousness that is also radical.This research was conducted in South Kalimantan among a sample of Gen-Z aged 18-24 who are students. The objective of this study is to ascertain the degree to which Gen-Z in South Kalimantan appreciate and actualize wasathiyah Islam, or, conversely, whether they are religious but radical.This research is of an exploratory nature, employing a field study approach.The data collected through questionnaires addressed the level of religious consciousness, the manner in which values and Islamic teachings are lived, the means of expressing Islam, and the sources of Islamic learning utilized.The data was analyzed through simple statistical calculations and presented descriptively as a measurement of central tendency. The results indicate that, in general, Gen-Z members do not recognize the radical tendencies in their views and attitudes, particularly within a Muslim-majority community.
