Abstract

Child marriage remains a persistent social challenge in Indonesia. Law Number 16 of 2019, amending the 1974 Marriage Law, emerged from complex social and legal dynamics. This paper investigates the interplay between these dynamics and Islamic legal principles. It examines the high prevalence of child marriage and divorce, alongside existing legal frameworks and their alignment with global norms like human rights, equality, and child protection. By analyzing these factors, the paper sheds light on the motivations behind Law No. 16/2019. The law serves not only as a control mechanism but also potentially as a tool for social reconstruction, aiming to foster a more progressive Indonesian society that prioritizes the maturitas (maturity) of individuals entering marriage.

Abstract

Many ways can be done to develop the economic potential that exists in the community, one of which is by establishing a Sharia Cooperative. The Indonesian Ulema Council of South Kalimantan (MUI Kal-Sel) considers that the welfare of the people will increase if the potential possessed by Islamic cooperatives is developed properly and correctly. Therefore, MUI Kal-Sel through its institution, namely the Pusat Inkubasi Bisnis Syariah  (PINBAS) seeks to realize this by conducting various activities that can motivate people to want to establish Islamic cooperatives. PINBAS Kal-Sel considers that the mosque is a gathering place for Muslims and has a clear and large mass so that the potential it has is very large for the economic development of the people if each mosque can establish and manage Sharia Cooperatives. On this basis, this study aims to determine the development strategy of mosque-based Islamic cooperatives by the Pusat Inkubasi Bisnis Syariah   (PINBAS) of the Indonesian Ulema Council of South Kalimantan as well as the strengths, weaknesses, threats and opportunities of these strategies. This type of research is field research or field research and is descriptive in nature. The data sources in this research come from informants and documents and are collected using interview techniques and documentary studies. The data obtained is then processed with editing, categorization and interpretation techniques. The data obtained is then analyzed qualitatively descriptive. The development strategy of mosque-based Islamic cooperatives by the Pusat Inkubasi Bisnis Syariah   (PINBAS) of the Indonesian Ulema Council of South Kalimantan can be seen in three aspects, namely aspects of planning, implementation and evaluation. There are three strength factors, 4 weakness factors, five opportunity factors and two threat factors that influence the selection of mosque-based Islamic cooperative development strategies by the Pusat Inkubasi Bisnis Syariah   (PINBAS) of the Indonesian Ulema Council of South Kalimantan.

Abstract

Abstract: Ghararwain inheritance is a special case of inheritance in Islam that has a fixed heir structure and deviates from faraidh (inheritance law). The application of its calculation method can disadvantage the mother's inheritance rights in two situations. Amidst the issue of gender equality, various perspectives from different professions, expertise, and viewpoints show diverse responses, yet adaptive to change. This ijtihadi product, although possessing wisdom related to maqashid al sharia (the objectives of Islamic law), needs to be reconsidered for its use as a provision for inheritance settlement in positive law in Indonesia, especially concerning the tsuluts al baqi portion (one-third of the remaining estate) which serves as a privilege in the Ghararwain case. Abstract

Batamat Qur'an is a tradition that is deeply rooted in the soul of the Banjar people; in its development, it also experiences friction with social, economic, political, and even technological factors. This paper explains the variety, dynamics, and sustainability of this tradition in Tanah Banjar. By using Blumer's symbolic interactionism, some of the essential findings of this study are as follows. In terms of purpose, batamat is divided into batamat kanakan, batamat Pangtin, batamat maniga hari, batamat tadarusan, and batamat for certain purposes such as business blessings or part of a test. Meanwhile, in terms of excitement, the model of batamat is divided into traditional Banjarese one, TPA/TPQ style, ordinary, and online. The various traditions of the Banjarese batamat explain the social, economic, and political dynamics of the Banjar people. The different offerings, attributes, meanings, and functions of the batamat itself reflect the personality of the agrarian Banjar community that puts forward Islamic values ​​that are understood traditionally, even to the point of taking root in the world of politics. While continuing this tradition amid the information technology era, it seems that it can still survive with some critical notes. The urgency of maintaining the batamat practice is undoubtedly a big question in the Banjar community as the leading actor in the tradition. Moreover, other models of khatam al-Quran are familiar in Banjar society, along with the increasingly diverse models of teaching the Koran that continue to emerge

Abstract

This study examines the integration of Islamic educational values within the Babilangan tradition (a name based compatibility assessment) used by the Banjar Muslim community to evaluate the potential marriage partners. This research applies a qualitative field method, data were collected through interviews with tuan guru (religious teacher) who possess sanad (a chain of knowledge transmision) and individuals who have experienced in the Babilangan process. The findings indicate that the practice is rooted in classical Islamic texts and can only be performed by those with proper scholarly transmisions, not by ordinary people even if they own the book. When unfavorable results arise, solutions are offered by the scholars or explained in the book. The tradition reflects core Islamic educational values such as respect for scholars (ta’zhim), social connectedness (silaturrahim), and charitable giving (sadaqah). As long as the tradition is understtod as a cultural effort (ikhtiar) and not as a way to determine fate. Babilanagn can be seen as a form of local wisdom that aligns with the spirit of Islamic education.

Abstract

Despite ongoing debates around the legitimacy and theological implications of wifiq Khotam Sulaiman, its symbolic use remains prevalent in various religious and cultural contexts, including among Javanese Muslims. This study aims to (1) explore the embedded meanings behind the symbols contained in wifiq Khotam Sulaiman and (2) examine the basis of public belief and trust in its spiritual efficacy. Employing a descriptive qualitative method, this research analyzes primary textual and visual data from wifiq artifacts, supported by interviews and observations within Javanese Muslim communities. The findings reveal that wifiq Khotam Sulaiman contains seven core symbols, each representing key aspects of Prophet Sulaiman’s character and divine attributes, including references to asma’ al-a‘ẓam (the Greatest Name of God). Furthermore, public belief in the wifiq is rooted in inherited spiritual traditions that regard it as a medium of divine assistance—without attributing intrinsic power to the object itself, thus maintaining theological monotheism. Theoretically, this study contributes to the field of Islamic semiotics and symbolic theology by offering a detailed interpretation of understudied esoteric symbols. Practically, it provides insights for scholars, religious leaders, and cultural practitioners to better understand how sacred symbols function in everyday spiritual life without breaching Islamic doctrinal boundaries.

Abstract

This study examines Islamic political ethics in the thought of Mohammad Natsir and Sekarmadji Maridjan Kartosuwiryo through a philosophical-comparative approach. The two figures represent opposing poles in the discourse on Islam and the state in Indonesia, Natsir with his inclusive constitutional-democratic approach, and Kartosuwiryo with his exclusive theocratic-revolutionary vision. The study focuses on the construction of political ethics in their views on democracy, power, law, and plurality within the context of the modern state. This research employs a qualitative method based on library research, with thematic analysis of primary and secondary works by both figures. A philosophical approach is used to explore the moral-political dimensions of ethics, including the normative basis of political action, the legitimacy of authority, and the relationship between religion and the state. The findings reveal fundamental differences: Natsir perceives democracy as an ethical and constitutional means to promote Islamic values peacefully, while Kartosuwiryo considers only a theocratic system based on sharia as legitimate, rejecting democratic states entirely. These differences are also reflected in their concepts of power, law, and plurality Natsir emphasizes inclusivity and public ethics, while Kartosuwiryo adopts an exclusive and confrontational stance. This study not only clarifies the divergent paradigms of postcolonial Islamic political ethics in Indonesia but also offers theoretical contributions to understanding the relevance of constitutional versus revolutionary approaches in contemporary Islamic politics.

Abstract

The history of Islamic dissemination in Banua Lima particularly along the Batang Alai River Basin in Barabai remains poorly documented, resulting in a fragmented understanding of early Islamization in the upstream region compared to the more extensively recorded coastal areas. This study aims to reconstruct the development pattern of Islam in Banua Lima by examining historical traces, the role of sacred mosques, local religious figures, and the acculturation of pre-Islamic traditions. Employing a historical-social approach with heuristic, verification, interpretation, and historiographical stages, data were collected through archival studies, oral histories, site observation of heritage mosques, and documentation of cultural rituals. The findings indicate that Islam spread through three fundamental mechanisms: the establishment of mosques as centers of religious activities, the empowerment of local figures as key agents of da'wah, and the integration of indigenous traditions such as Baayun Maulid and Batumbang—into Islamic practice. Heritage mosques in Palajau, Banua Halat, Banua Lawas, and surrounding areas serve as material evidence of the da'wah mission led by Khatib Dayan. The study concludes that the Islamization process in Banua Lima was peaceful, adaptive, and collaborative, forming a da'wah model that remains contextually relevant for contemporary local communities. Further research and preservation of historical mosques and cultural traditions are recommended as strategic efforts to maintain the Islamic historical legacy in South Kalimantan.

Abstract

The practice of prohibiting married couples from living together after the marriage contract but before the walīmat al-‘ursy (commonly known as nikah gantung) remains socially binding in Hamayung Village, Hulu Sungai Selatan. This practice has generated controversy because it delays the exercise of spousal rights and obligations that, under Islamic law, should take effect immediately upon the conclusion of the marriage contract. As such, nikah gantung reflects a tension between the legal certainty of Islamic law and the dominance of customary norms as living law. This study aims to assess the compatibility of nikah gantung with Islamic legal principles through the frameworks of ‘urf and maqāṣid al-sharī‘ah. The research adopts a normative Islamic legal (juridical-fiqhiyyah) method combined with a socio-legal approach, drawing on classical and contemporary fiqh literature, usul al-fiqh sources, statutory regulations, and limited field data to contextualize the practice. Data are analyzed qualitatively through takyīf fiqhī, evaluation of ‘urf, and maqāṣid-based assessment. The findings indicate that postponement of post-contractual rights may be permissible when it is voluntary and grounded in legitimate shar‘i excuses; however, the practice in Hamayung Village is collective, coercive, and reinforced by social sanctions, effectively transforming the recommended walīmat al-‘ursy into a de facto legal condition. Consequently, this practice cannot be classified as ‘urf ṣaḥīḥ and contradicts legal certainty and family welfare. The study recommends strengthening legal awareness and repositioning customary norms to align with the objectives of Islamic law.

Abstract

Education is the main foundation in building the character and identity of a nation, especially during the challenges of increasingly rapid globalization. This research aims to explore the integration of Islamic values and local wisdom through the Ngejot and Megibung traditions in Bali, which can enrich the educational curriculum and form a harmonious and tolerant student character. The research method used is a qualitative descriptive study with a literature review approach, which includes the analysis of texts and contexts related to the Ngejot and Megibung traditions and the Islamic values contained in them. This research also emphasizes the role of the community in preserving traditions as part of education based on local wisdom. The results of the study show that education based on local wisdom can improve students' understanding of cultural identity and relevant social values. The Ngejot and Megibung traditions not only function as social practices but also as practical educational tools in instilling the values of solidarity, tolerance, and cooperation. The study also identified challenges in integrating local and Islamic values into the educational curriculum, including a lack of understanding among education managers and the community. Therefore, this study recommends the development of a pedagogical integration model that prioritizes the interaction between Islamic values and Balinese Hindu traditions, as well as strategies to overcome existing challenges. These findings are expected to make a new contribution to the development of education that is inclusive and relevant to the local cultural context, as well as a reference for educators and policymakers in designing curricula rooted in local wisdom and Islamic values.
