Abstract

Social security is a constitutional right inherent in every citizen and is guaranteed by the 1945 Constitution of the Republic of Indonesia. As a state based on law that adheres to the principles of a welfare state, Indonesia has a constitutional obligation to provide a fair, inclusive, and non-discriminatory social security system for all workers. However, in its implementation, disparities in social security protection between formal and informal workers persist. This article aims to analyze the position of social security as a constitutional right within Indonesia’s national legal system and to identify the legal and policy measures undertaken by the government to address such disparities. This study employs a normative juridical research method using statutory and conceptual approaches through an examination of primary, secondary, and tertiary legal materials. The findings indicate that inequality in social security protection for informal workers is influenced by several factors, including unstable income conditions, limited regulations specifically governing the legal status of informal workers, low levels of social security literacy, as well as administrative and bureaucratic barriers in the participation process. Therefore, strengthening explicit regulatory frameworks, adjusting contribution payment schemes to be more flexible, and enhancing public outreach alongside simplifying administrative procedures are necessary to achieve equitable social security protection in accordance with constitutional mandates. Keyword: Social security, constitutional rights, informal workers, BPJS Employment, social justice

Abstract

Abstract: Construction projects are inseparable from various risks that may affect project performance. This study aims to analyze the factors influencing construction risk using the Partial Least Squares–Structural Equation Modeling (PLS-SEM) approach. The research examines nine independent variables, namely force majeure, material, equipment, labor, construction, contractual, design and technology, management, and environmental impact, on construction risk factors. Data were collected through questionnaires distributed to respondents involved in construction projects. The analysis results indicate that material, equipment, labor, and management variables have a direct influence on construction risk factors, while force majeure, construction, contractual, design and technology, and environmental impact do not show significant effects. These findings suggest that effective management and proper resource control play a crucial role in minimizing construction risks. The results of this study are expected to contribute to improving risk management strategies in construction projects. Keywords: Construction risk, PLS-SEM, project management, construction factors, risk analysis.

Abstract

Waterlogging problems in urban areas are generally caused by the inability of drainage systems to accommodate runoff discharge and are also influenced by soil infiltration characteristics. Jalan Vilaku Indah, Surau Gadang Subdistrict, Padang City, is one of the areas that frequently experiences inundation during rainfall events. This study aims to evaluate the performance of the existing drainage system and to analyze the soil infiltration rate in controlling waterlogging. The methods employed include hydrological analysis to determine design rainfall and design flood discharge, hydraulic analysis using EPA SWMM 5.2 software, and soil infiltration rate testing using the double ring infiltrometer method at nine test locations. The results of the hydrological analysis indicate that the 50-year return period design flood discharge (Q50) is 0.067 m³/s. The hydraulic simulation results using EPA SWMM show that in several channel segments, the water level rises beyond the storage capacity, with the simulated peak discharge reaching approximately 0.097 m³/s, thereby causing overflow and inundation on the roadway. The infiltration test results indicate that the final infiltration capacity (Fc) ranges from 48 mm/h to 192 mm/h, with an average value of 101.33 mm/h, which is classified as a fast infiltration class. These findings indicate that the waterlogging problems at the study site are caused by the limited capacity of the existing drainage system and changes in land use. Keywords: urban drainage, design flood discharge, infiltration rate, EPA SWMM.
