Abstract

The number of poor people in Indonesia in 2023 will reach 25.90 million people, this is a quite serious problem for the country. Zakat is a means of mutual cooperation that can help this imbalance. Internet penetration in North Sumatra is the highest on the island of Sumatra based on the APJII survey in early 2024, this is the spearhead of all types of digitalization applications. This fact makes us aware that the potential for zakat should increase further and make it easier for BAZNAS North Sumatra Province to collect funds. This research aims to measure the effectiveness of implementing digitalization in compiling and reporting accounting. The data collection method uses researchqualitatively based with a phenomenological approach.Based on the research results, the implementation of digital fundraising can be said to be effective, but it is not yet effective in targeting accuracy, one of which is due to a lack of social engagement on social media. For fund accounting, which is a reporting rule for non-profit organizations, BAZNAS North Sumatra Province has implemented regulations with PSAK 109 and reporting has been digitized and automated.

Abstract

The discourse on the relationship between religion and the state in the context of the implementation of Islamic law in Indonesia is an issue that will never go stale. This article aims to examine the relationship between Islamic law and state law from a paradigm theoretical perspective on the relationship between religion and the state, a study of the thoughts of Indonesian thinker Prof. Arskal Salim. The type of method used is qualitative, data comes from library materials, the main data is the book "Challenging the Secular State; The Islamization of Law in Modern Indonesia” by Prof. Dr. M. Arskal Salim GP, M.Ag. The data is read, analyzed, separated and categorized and then analyzed using descriptive analysis and content analysis. The research results show that Prof. Arskal Salim in his book raises five issues related to the dynamics and discourse of the relationship between religion and the state in the form of the application of Islamic law in state law in Indonesia. The five issues are the dialectic of the concept of sharia and the issue of the nation state, the dialectic of the formalization of Islamic law and the issue of nationalism, the implementation of Islamic law in the Pancasila state constitution, legislation and the formalization of Islamic law in national law, the formalization of Islamic law in Aceh from the beginning of independence to the reform era. Based on the theoretical analysis of the paradigm of relations between religion and the state, namely the integralistic, symbiotic and secularistic paradigms, a fourth new typology was discovered, namely symbiotic-integralistic which is a combination of the symbiotic and integralistic paradigms. This symbiotic paradigm applies throughout Indonesia, and the integralistic paradigm only applies in Nangroe Aceh Darussalam Province.

Abstract

Procreation has been considered the noblest purpose of marriage as it ensures the continuation of human existence on Earth. However, a new trend has emerged among young couples known as “childfree”, where individuals or couples consciously choose not to have children after marriage. This research aims to examine this phenomenon. What is the status of marriage with the condition of being childfree? And how valid is such a contract according to the principles of Islamic jurisprudence (Fiqh)? To achieve these objectives, the researcher employed a qualitative descriptive methodology, using literature review as the primary data collection method, focusing on relevant sources related to the topic. The findings of this study indicate that the condition of being childfree in marriage contradicts the objectives of Islamic law, which emphasize procreation and the preservation of lineage. Making a deliberate decision not to have children without any legitimate reason or physical limitations constitutes an act that exceeds the boundaries set by religious teachings. Moreover, it is considered impermissible to prohibit what Allah has made permissible, which includes having children and preserving lineage. As the condition is invalid, the parties involved in the marriage contract are not obligated to fulfill this requirement, and the marriage contract remains valid.

Abstract

This article contends that the principle of mu'âsyaroh bil ma'rûf has been inadequately interpreted, primarily due to its frequent application solely to men, resulting in the neglect and discrimination against women in conceptual formulation and validation. By positioning both men and women as equal participants in defining maqâshid al-syarî'ah, a fairer understanding of mu'asyaraoh bil ma'ruf can be achieved. This qualitative research seeks to redefine the interpretation of mu'âsyarah bil ma'rûf in the Qur'an through the Maqâshid Syarî'ah cum-Mubâdalah approach, integrating the critical concept of mashâlih al-'ibâd in kulliyât al-khams and the Mubâdalah perspective. The Maqâshid al-Syarî'ah cum-Mubâdalah methodology entails merging Maqâshid al-Syarî'ah theory with a perspective emphasizing mutual respect between genders. This study adopts a library research methodology. The findings reveal that, through the Maqâshid al-Syarî'ah cum-Mubâdalah approach, it can be inferred that: 1) mu'asyarah bil ma'ruf extends beyond marital relations to encompass interactions that uphold human values for all individuals; 2) apart from hifdz al-nafs (preservation of life), mu'asyarah bil ma'ruf also encompasses other elements including hifdz al-din (preservation of religion), hifdz al-mal (preservation of wealth), hifdz al-'aql (preservation of intellect), and hifdz al-nasl (preservation of lineage); 3) adherence to the five elements of maqashid sharia is obligatory for both parties engaging in interactions, rather than being imposed solely on one party.

Abstract

The Qur'an, as the word of Allah SWT, establishes many dictions when visualizing heaven, one of which is Jannah. Jannah is also one of the dictions that Rasulullah SAW chose when explaining to his friends about heaven. However, the term jannah in the Koran does not always mean heaven, sometimes it means garden. Departing from these two meanings, the mufassir disagrees regarding the meaning of Jannah in the QS. al-Baqarah: 35. This verse tells the story of the Prophet Adam who lived in Jannah. In this case, al-Qurṭubī very harshly criticized those who said Jannah in the QS. al-Baqarah: 35 is not heaven. The argument is built on three reasons, namely that someone who enters heaven will not come out of it, Satan cannot enter heaven, and there is no taklīf in heaven. This research aims to determine al-Qurṭubī’s critical analysis of the interpretation of Jannah in the QS. al-Baqarah: 35. This type of research is qualitative with a critical discourse analysis approach which is enhanced by literature review. The result, firstly, according to al-Qurṭubī, Prophet Adam's stay in heaven was indeed temporary. His expulsion from heaven is a scenario that Allah SWT has prepared. Second, Satan's entry into heaven is not impossible. Third, the absence of taklīf applies when all the inhabitants of heaven have entered it as a reward for what they have done in the world.

Abstract

This research aims to explore the communication strategies implemented by Public Relations of LPPOM MUI North Sumatra in socializing halal certification to MSME in Medan City. This study also aims to assess the level of effectiveness of this communication strategy. In the context of processing halal certification, which has significant relevance to products circulating in the Medan City community, a strategic communication approach was taken by LPPOM MUI North Sumatra to MSME traders in this region. This research uses a qualitative approach with the Grounded Research method, which allows researchers to conduct in-depth interviews with key sources. The research sources consisted of the Head of Public Relations of LPPOM MUI North Sumatra and three MSME traders operating on Jl. Tuasan, Medan City. The research results show that North Sumatra LPPOM MUI Public Relations uses various media such as print media, online media and social media in its communication strategy. However, the level of MSME product registration to LPPOM MUI North Sumatra shows a decline every year, with no registration in the 2022-2024 period. These findings indicate that the communication strategy implemented by the Public Relations of LPPOM MUI North Sumatra has not been effective in increasing awareness about halal certification among MSME traders, especially on Jl. Tuasan, Medan Tembung District. The implication is that MSME traders do not understand the process of processing halal certification both online and offline.

Abstract

In Indonesia, nationalist consciousness has recently been facing many problems, threats, and concerns about daily life security. The threat has shifted from armed threats to threats of poverty, ignorance, backwardness, hunger, diseases for which no cure has been found, scarcity of employment opportunities, unemployment everywhere, arbitrary actions of those in power, crime, SARA, national disintegration, anti-nationalist terrorism, narcotics trafficking. Illegal drugs are troubling the future of the younger generation. One of those who got the effect was ethnic Chinese residents. This research was conducted with the ethnic Chinese locus in the Indonesian Chinese Islamic Association of Jember, focusing on how the Jember ethnic Chinese Muslim community views nationalism. What is the process of instilling nationalist values among the ethnic Chinese Muslim community of Jember? This research aims to trace the nationalism of the ethnic Chinese Muslim community in Jember towards Indonesia and the process of instilling nationalist values among them so far. This research uses a qualitative paradigm with a narrative research approach. The results of this research show that the nationalist values of Jember's ethnic Chinese Muslim community have been ingrained since birth because the Jember Chinese Muslim community was born in Indonesia, not in China. Ethnic Chinese who were born in Indonesia to Chinese citizens in China are called overseas, which is why they are considered not to be genuine Chinese citizens because they were not born and distributed in the land of their ancestors. Nationalism is not just a saying; nationalism is a necessity that Jember's ethnic Chinese Muslims firmly hold. His nationalist experience was formed by practising the values of Pancasila. Forms of instilling and strengthening nationalism among member ethnic Chinese Muslims by holding regular discussions, mutual respect, tolerance, participating in state activities, cooperation and defending the country.

Abstract

The Qur'ān that is present in social media by involving meaning tends to lead to commodification efforts. The @hijabalila account as a Muslim women's clothing sales account uses the meaning of the Qur'ān as a means of advertising its commodities. The meaning made by the @hijabalila account is adjusted to marketing interests by using language narratives. The adjustment of meaning to the marketing interests of the @hijabalila account ignores other forms of meaning of the criteria for women's clothing which has an impact on changing the function of the Quran as a commodification tool. So, this research focuses on examining how the process of commodification of the Quran is used as an advertisement for women's clothing on the @hijabalila account. This research was applied using a qualitative method of literature review obtained from data sources related to research with the theory of Vincent Mosco's political economy approach. As a result, the commodification process carried out by the @hijabalila account can be seen from three sides. First, the @hijabalila account gives meaning to the Qur'an adjusted to the goods sold and used as content. Second, besides utilising the interpretation of the Qur'an to attract audiences, the @hijabalila account also uses Isntagram as a medium for marketing expansion. Third, there is a process of production and reproduction through the formation of meaning in the verses of women's clothing by the @hijabalila account to the audience.

Abstract

This study explores the integration of local traditions within Islam through an examination of the Turun Mani tradition among the Gayo community in Central Aceh. This tradition represents a unique implementation of the Aqiqah ritual, incorporating local cultural elements and reflecting harmony between Islamic teachings and local customs. The research aims to examine the practice of the Turun Mani tradition, understand the Gayo community's perception of hadiths related to Aqiqah, and analyze the quality of the referenced hadiths. Employing a qualitative method with a living hadith approach, this study involves in-depth interviews with selected informants, including religious leaders, cultural figures, and practitioners of the tradition, as well as literature reviews of hadiths and primary texts. The findings reveal that the Turun Mani tradition adapts local cultural elements—such as the Begenap ritual, bathing the newborn with coconut water and kaffir lime, and protective prayers—while preserving the essence of Aqiqah. The Gayo community’s understanding of the hadiths underlying this tradition is largely inherited and lacks critical examination of the hadiths' authenticity. The Turun Mani tradition not only reinforces local wisdom but also supports the primary objectives of Maqāṣid al-Syarī‘ah, such as protecting faith, life, lineage, and intellect. Despite challenges posed by modernization, the tradition endures as a manifestation of harmony between religion and culture. This research contributes to the study of living hadith and the relationship between Islam and local traditions in Indonesia.

Abstract

Psychological violence in the household is a criminal offense that has not been explained with certainty. The PKDRT Law itself only explains the formulation of the consequences of psychological violence. Thus, it is important to create a typology of this form of psychological violence. This is also the case in Islam. This research aims to analyze the typology of psychological violence from the perspective of maqashid sharia. The type of research used is normative legal research with a conceptual approach. The results show that in the perspective of maqashid sharia, the creation of a typology of psychological violence in the household is a necessity that brings maslahah. In the level of benefit, the determination of this guideline becomes very important and occupies the hajjiyat level because it is related to the need to create convenience in overcoming difficulties. In the context of psychological violence, the difficulty that arises is how to detect the form of psychological violence itself. The creation of guidelines regarding the typology of psychological violence creates legal certainty for perpetrators and victims, realizing justice and legal protection for victims.
