Abstract

This article provides an overview of the implementation of an employment agreement or employment contract in the business world that often causes interpretation. This research is based on normative legal research with qualitative research methods. The results of this study describe the causes of default in an agreement which as a result can harm the parties who bind themselves in an agreement. Settlement of default can basically be reached through several legal remedies such as sending a subpoena, negotiations to the lawsuit in the trial. As the decision of the panel of judges in a civil case between PT. Sukses Bintang Indonesia and PT. Ratu Intan Mining has resolved the dispute between the parties in accordance with the provisions of applicable regulations.

Abstract

A nominee agreement made by a notary is actually a form of legal smuggling, which is used for the benefit of a foreign party. Basically, a nominee agreement provides all authority that may arise in relation to national land law which cannot be owned by foreign parties, which is then given to native residents as recipients of power of attorney. There are problems that arise, namely the applicable legal provisions relating to the making of a deed of borrowing a notary's name, the responsibility of a notary in making a Nominee deed for a land rights agreement between local residents and foreign nationals. This research uses a type of normative legal research and is analytical descriptive, where this research uses premier data as complementary data using data collection techniques carried out by means of literature study, as well as qualitative data analysis. Deeds of borrowing names or nominees are legally permissible, especially in shareholder agreements, however, unlike land ownership in the country, making deeds of borrowing names by a notary is an act of smuggling agrarian law and is prohibited by law. Based on Article 21 paragraph (1), Article 26 paragraph (2) of Law Number 5 of 1960 concerning Basic Agrarian Regulations, it is stated that a nominee agreement is an invalid agreement because it does not comply with statutory provisions. As a Notary there are three types of responsibility, namely civil legal responsibility, criminal legal responsibility and responsibility through the notary's code of ethics. The legal consequences that arise regarding the making of deeds of nomination, land ownership agreements between local residents and foreign nationals, namely that the nominal agreement is null and void.

Abstract

: In reality, not all marriages can produce offspring, so various methods are used to obtain offspring, one of which is artificial insemination from sperm donated by another person. This then raises a big question mark regarding the inheritance status of children born from sperm donation. The research method used is normative juridical with a statutory approach and also a conceptual approach. The results of this study show that children resulting from artificial insemination using a sperm donor have full rights to inherit from their parents on the basis of mutual agreement between the husband and wife to include the child resulting from insemination via a sperm donor into their marriage, so that the child is considered a biological child. (legitimate child). Apart from that, children resulting from artificial insemination also have the right to inherit from their biological father, but this must be done by obtaining recognition and approval first.

Abstract

Penelitian berjudul “Ketidakpastian Hukum Pasal Multitafsir dalam UUJN mengenai Makna Notaris Pailit” ini mempergunakan metode penelitian hukum normatif dengan bertujuan untuk menganalisis makna pasal multitafsir dalam Undang-Undang Jabatan Notaris. Pasal multitafsir tersebut terdapat dalam Pasal 9 (1a) (pasal semmbilan ayat satu huruf a) serta Pasal 12a (pasal dua belas huruf a) mengenai pemberhentian Notaris akibat dikatakan pailit. Metode yang digunakan di penelitian ini adalah penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan, pendekatan konseptual, serta pendekatan kasus. Dalam penelitian ini kasus yang dianalisis adalah Putusan oleh Pengadilan Niaga yang berkedudukan di Surabaya dengan Nomor 20/Pdt.Sus-PKPU/2020/PN.Niaga.Sby. Hasil penelitian menunjukkan bahwa makna notaris pailit yang terkandung dalam Pasal 9 ayat (1) huruf a dan Pasal 12 huruf a tersebut mengandung makna ganda, yaitu seorang Notaris yang memiliki usaha di luar jabatannya kemudian usahanya tersebut dinyatakan pailit oleh putusan pengadilan atau Notaris dinyatakan pailit karena melakukan kelalaian berdasarkan Pasal 84 Undang-undang Jabatan Notaris, sehingga diharuskan untuk melakukan ganti rugi kepada para pihak/penghadap yang dirugikan. Kata “pailit” dalam Undang-Undang Jabatan Notaris lebih tepat apabila dirumuskan dengan kata “bangkrut”.

Abstract

This research aims to investigate the impact of technology and innovation on justice in law enforcement in the digital age. In the ever-evolving digital age, technological developments such as big data analytics, artificial intelligence, and digital forensics have transformed the landscape of law enforcement operations. This research outlines the positive and negative impacts of such technologies on justice in the legal system. The findings of the literature review indicate that the utilisation of technology in law enforcement has the potential to enhance the efficiency of investigations, evidence analysis, and detainee monitoring. However, there are also concerns related to the protection of privacy and the security of data that warrant consideration. Moreover, the unequal access to technology and data can pose a threat to the principles of justice. This research will enable the relevant stakeholders in law enforcement and public policy to comprehend the implications of technology and innovation for justice. Furthermore, it provides a foundation for future researchers to conduct more in-depth empirical research on these issues.

Abstract

Article 15 paragraph (2) letter a of Law Number 2 of 2014 Amendment to Law Number 30 of 2004 concerning the Position of a Notary that the Notary in his/her position has the authority to ratify signature and determine the exact date of the letter under hand, by registering it in a special book. A debt acknowledgment letter that already contains an element of default and gives rise to legal consequences can be executed with a deed of power of attorney to sell. 1) What is the process for making a debt acknowledgment letter as collateral for a debtor's debt in Padang City? 2) Why does the making of debt acknowledgment letters in Padang City tend to still be done privately and therefore require legalization by a notary? 3) What is the position of a power of attorney to sell that has been legalized by a notary regarding making a power of attorney deed to sell in the event of a dispute in Padang City? By using empirical juridical research methods, this research concludes that the process of legalizing a debt acknowledgment letter in Padang City is that the debt acknowledgment letter must be in the form of a private deed and can be agreed upon by the parties, then the debt acknowledgment letter is signed by the parties and legalized before a notary, the contents of which are the responsibility of both parties in the principle of agreement/consensus, the signing is ratified before a notary, the contents of which are the responsibility of both parties. In the process of legalizing a debt acknowledgment letter, the notary only witnesses the signing of the private letter on the same day, date, month and year at the time of legalization and then provides a legalization number, affixes a stamp/position seal to each page and records it in the private letter reportorium book. confirmed. The reasons debt acknowledgment letters in Padang City tend to still be done privately are: Factors from the community and Factors from the Notary. The position of a debt acknowledgment letter legalized by a notary regarding the making of a power of attorney deed to sell in the event of a dispute in the city of Padang, namely, a debt acknowledgment letter legalized by a notary can be used as evidence in court if a civil case occurs, and the additional guarantee of the sale power deed made before a notary is null and void. law if one of the parties to the agreement dies. Abstract

The fiduciary guarantee deed must be registered inaccordance with applicable laws and regulations within 30 (thirty) days after the deed is drawn up. However,there are times when the fiduciary deed is registered late by the notary or the parties. To overcome this delay, the notary makes a deed of confirmation to re-register the fiduciary guarantee deed that is registered too late. This study uses a type of normative legal research, using a statutory approach. The normative juridical approach is carried out by examining various formal legal rules such as laws, regulations, and literature that contains theoretical concepts related to the topic and problem of this research. The results of this study indicate that the validity of the affirmation deed made before a notary public due to the expiration date of the registration of the fiduciary deed is legally valid, but the existence of the affirmation deed cannot replace the position of the fiduciary deed because the contents of the affirmation deed and the fiduciary deed are very different. Delay in registeringthe deed has implications for defects in the fiduciary guarantee deed,making a new deed would be better done than using an affirmation deed that has no legal basis in the law. An affirmation deed made for a fiduciary guarantee that is registered too latecannot provide legal protection to the parties because a deed that is registered too late does not have an executorial title. The deed of confirmation of a fiduciary guarantee appears to accommodate a deed of fiduciary security that has passed the registration deadline. The technique for making a deed of confirmation of a fiduciary guarantee is still made before a notary and in the premise of the deed it is stated that a fiduciary deed has not previously been registered.

Abstract

Sektor properti saat ini sangatlah berkembang sehingga dapat memberikan kesempatan bagi warga negara asing yang berkedudukan di Indonesia untuk membeli properti untuk dijadikan sebagai tempat hunian di Indonesia. Penelitian ini bertujuan untuk mengetahui apa saja syarat-syarat yang harus dipenuhi oleh warga negara asing dalam membeli sebuah properti di Indonesia dan mengetahui perspektif hukum terhadap kepemilikan properti oleh warga negara asing di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan menggunakan bahan hukum primer dan bahan hukum sekunder yang kemudian dianalisis dengan penafsiran hukum terhadap peraturan-peraturan yang terkait. Bahan hukum sekunder berupa jurnal-jurnal hukum dan buku-buku literatur hukum, penjelasan undang-undang, dan internet. Metode pengumpulan data yang digunakan adalah studi dokumen. Studi dokumen merupakan kegiatan mengkaji data-data sekunder dengan menganalisa data tersebut menggunakan pendekatan kualitatif. Hasil penelitian ini menyimpulkan bahwa warga negara asing yang berkedudukan di Indonesia hanya dapat membeli properti dengan status hak pakai karena hak milik seutuhnya hanya dapat diperoleh oleh warga negara Indonesia sesuai dengan ketentuan Undang-Undang Pokok Agraria dan peraturan terkait lainnya. Abstract

The purpose of this research is to examine the implications of business law on the practice of business ethics in Indonesia. To achieve this, a library-based research methodology was employed, with relevant data being gathered from various sources of literature pertinent to the research topic. The results demonstrate that there is a significant influence exerted by business law upon business ethical practice in Indonesia. In essence, business law establishes the legal rights and obligations that arise from business agreements and business ties. Moreover, a variety of additional factors influence the implementation of business law in ethical and responsible business practices, including national development, business ethics, internal and external factors, and legal awareness. To address this issue, a number of potential solutions and recommendations have been put forth. These include the strengthening of regulations, more effective law enforcement, the provision of education and awareness, collaboration between the government and business leaders, greater transparency and accountability, and the creation of an independent oversight body. It is anticipated that the implementation of these solutions will create a fair, transparent and ethical business environment, which will positively influence economic development and the general welfare of the Indonesian population.

Abstract

Grant deed is an authentic deed made by Conveyancer which contains an agreement whereby the grantor, while still living, grants assets voluntarily and irrevocably for the benefit of the grantee who accepts such. Regarding the grant deed made by Temporary Conveyancer (Subdistrict Head), such deed should comply the formal and material terms of an authentic deed. One of the formal terms is the deed must be made before the parties and at least 2 witnesses. However, in practice, Temporary Conveyancer (Subdistrict Head) made the grant deed without the presence of parties and witnesses. This research analyzes the legal consequences of a grant deed made without the presence of the parties and witnesses as well as the responsibilities of the Temporary Conveyancer (Subdistrict Head) regarding the grant deed. This research was prepared using doctrinal research methods. The legal consequence of a Grant Deed made without the presence of the parties and witnesses is the deed loses its authenticity and causes the Grant Deed to be null and void. The Grant Deed made by Temporary Conveyancer (Subdistrict Head) without the presence of the parties and witnesses in accordance with statutory regulations, may be subject to administrative sanctions, civil sanctions and criminal sanctions.
