Abstract

Mangrove sebagai salah satu unsur ekosistem yang bermanfaat bagi masyarakat khususnya di wilayah pesisir Bangka Belitung. Namun lambat laun terjadi degradasi wilayah mangrove yang berubah menjadi kegiatan ekonomi masyarakat yang secara tidak langsung menggerus kemanfaatan mangrove. Pengelolaan dan pemanfaatan lahan dalam wilayah hutan mangrove di provinsi Bangka Belitung seakan tidak maksimal dalam mengatur tata ruang sehingga vegetasi mangrove terancam rusak. Penelitian ini bertujuan untuk memberikan analisis terkait pengelolaan dan pemanfaatan lahan hutan mangrove dalam perspektif hukum. Jenis penelitian yang dilakukan adalah yuridis normatif dengan metode penelitian kepustakaan. Hasil penelitian menyimpulkan bahwa perlu adanya kebijakan kemitraan antara pemerintah, masyarakat dan stakeholder dan adanya kebijakan terkait penegakan hukum yang tegas terkati pengelolaan dan pemanfaatan lahan hutan mangrove di Bangka Belitung.

Abstract

The problem of euthanasia has existed since the health community was facing an incurable disease, while the patient was already dying and torturing. In such situations, it is not uncommon for patients to beg for relief from this suffering and do not wish to have their life extended. This is where the term euthanasia appears, which is letting go of one's life in order to be free from suffering or to die properly. This study aims to determine the concept of freedom to live, human freedom to choose and review legal norms in Indonesia and several other countries. However, in its application there is a dilemma, which is considered contrary to the right to life if euthanasia is carried out. This research is a legal research with an approach obtained by examining library materials or secondary data or what is called normative legal research or literature law research. The approach in research uses aConceptual Approach, which is an approach that departs from the views or doctrines that develop in legal science to build legal arguments when solving legal issues at hand. From this legal research study, it can be concluded that the presence of euthanasia is considered a human right in the form of the right to die which is considered to bring happiness and pleasure to him. Eutanasia when viewed from the aspect of criminal law and human rights in Indonesia are still having a debate that has not found the end, for the provision of human rights by the opposition national laws, especially the Criminal Code so there needs to be development of the law on regulation of euthanasia in Indonesia by taking into account medical factors normative.

Abstract

AbstractThe background to the formation of a law is inseparable from the legal politics of a country. So it can be said that the law is one of the legal products in which the law is a political product of a country. Law Number 17 of 2012 concerning Cooperatives is one of the political products of the Indonesian government. The law was passed on October 29, 2012, promulgated on October 30, 2012, and entered into force on the date of promulgation. However, not long ago in effect, that is, only within 1 (one) year for 7 (seven) months, Law Number 17 of 2012 concerning Cooperatives was declared not to have binding legal force by the Constitutional Court through the decision of the Constitutional Court Number 28 / PUU- XI / 2013 dated May 28, 2014 because it was proven to conflict with the 1945 Constitution. This study aimed to analyze the decision referred to concerning the political politics of establishing Law Number 17 of 2012 concerning Cooperatives. Keyword: Political Law, Judicial Review, Decision of the Constitution Court. AbstrakLatar belakang pembentukan undang-undang tidak terlepas dari politik hukum suatu negara. Sehingga dapat dikatakan bahwa undang-undang merupakan salah satu produk hukum dimana hukum tersebut merupakan produk politik suatu negara. Undang-Undang Nomor 17 Tahun 2012 tentang Perkoperasian merupakan salah satu produk politik pemerintah Indonesia. Undang-Undang tersebut telah disahkan pada tanggal 29 Oktober 2012, diundangkan pada tanggal 30 Oktober 2012, dan mulai berlaku pada tanggal diundangkan. Namun, belum lama berlaku, yakni hanya dalam kurun waktu sekitar 1 (satu) tahun 7 (tujuh) bulan, Undang-Undang Nomor 17 Tahun 2012 tentang Perkoperasian dinyatakan tidak mempunyai kekuatan hukum mengikat oleh Mahkamah Konstitusi melalui putusan Mahkamah Konstitusi Nomor 28/PUU-XI/2013 tanggal 28 Mei 2014 karena terbukti bertentangan dengan Undang-Undang Dasar 1945. Penelitian ini bertujuan untuk menganalisis putusan dimaksud dikaitkan dengan politik hukum pembentukan Undang-Undang Nomor 17 Tahun 2012 tentang Perkoperasian. Kata Kunci: Politik Hukum, Pengujian Peraturan Perundang-undangan, Putusan Mahkamah Konstitusi.

Abstract

Penelitian ini dilakukan dengan melakukan studi perbandingan antara Indonesia, Amerika dan Australia yang bertujuan untuk mengetahui pengaturan hukum di masing-masing negara. Teori hukum yang dipergunakan adalah Teori Kepastian Hukum menurut Gustav Radburch. Penelitian ini merupakan penelitian hukum normatif yang menggunakan data sekunder yang terdiri atas bahan hukum primer, sekunder dan tersier. Pengumpulan data dilakukan melalui studi kepustakaan. Data sekunder dianalisis menggunakan metode perbandingan hukum dengan analisis kualitatif deskriptif. Berdasarkan penelitian diketahui bahwa Hukum Amerika merupakan pengaturan hukum yang sangat tepat dalam mengatur merek dan desain industri berbentuk tiga dimensi. Selanjutnya diikuti oleh Australia, dan Indonesia. Indonesia dapat menggunakan hukum Amerika dan Australia sebagai contoh baik dalam memberikan kepastian perlindungan bentuk tiga dimensi.

Abstract

Pelaksanaan otonomi daerah memberikan keleluasaan kepada Pemerintah Daerah untuk meningkatkan Pendapatan Asli Daerah (PAD) melalui pajak daerah dan retribusi daerah. Namun, kreativitas Pemerintah Daerah yang berlebihan telah menimbulkan akses negatif bagi iklim usaha. Pelaku usaha mengeluhkan banyak pungutan liar yang tidak jelas landasan hukumnya.Berbagai peraturan daerah tentang pajak dan retribusi tumpang tindih dengan peraturan pusat, merupakan beban yang besar bagi dunia usaha.Penelitian ini bertujuan untuk memberikan kepastian hukum dari ketentuan penetapan pajak dan retribusi daerah bagi pelaku usaha.Jenis penelitian yang akan dilakukan adalah yuridis normatif dengan metode penelitian kepustakaan. Hasil penelitian menyimpulkan bahwa perlu adanya intervensi pemerintah pusat untuk mengatur kembali kewenangan pemungutan pajak dan retribusi daerah melalui sinkronisasi kebijakan dengan pajak pusat.Kata kunci :pajak daerah; retribusi daerah; otonomi daerah; kepastian hukum; iklim usaha. AbstractThe implementation of regional autonomy provides flexibility to local governments to increase regional indigenous revenue (PAD) through regional taxes and regional retribution. However, the creativity of the excessive regional government has led to negative access to the business climate. Businesses complained of many illegal levies that are unclear to their legal bases. Various regional regulations on taxes and retribution overlap with the central regulations, is a huge burden for the business world. This research aims to provide legal certainty from the provisions of tax assignment and regional levy for business actors. The type of research that will be conducted is normative juridical with the literature research method. The results concluded that there needed to be a central government intervention to re-arrange the tax collection authority and regional retribution through policy synchronization with central taxes.Key words: local tax; regional levy; regional autonomy; legal certainty; business climate.

Abstract

AbstractThe ‘rights’ and ‘equality’ arguments have been widely used in the last couple of years by the same-sex marriage supporters in claiming the legalization of same-sex marriage. The principle of equality in same-sex marriage legalization claims is closely related with the concept of human rights on the ground that the principle of equality is considered as one of the most important principles in the said concept. The decision of the Supreme Court of the United States of America in Obergefell et al. v. Hodges, Director, Ohio Department of Health is the latest decision concerning the legalization of same-sex marriage that changes radically the legality of same-sex marriage in the United States and may affect other nations. This research analyzes the said Decision, specifically on the application of the principle of equality. This research also analyzes the same-sex marriage issue in Indonesia from the perspective of universality and cultural relativism of human rights. The conclusion of this research is that the principle of equality in the Decision of the Supreme Court of the United States of America was not correctly applied and therefore it cannot be used in the same-sex marriage claims. And in Indonesia, it can be concluded that from the perspective of universality and cultural relativism of human rights, same-sex marriage cannot be legalized.Keywords: human, rights, same-sex, marriage, equality, universality, cultural, relativism.

Abstract

Nowadays, Indonesia as a developing country has been developed in various sectors. Globalization is a process of organizational change from the function of capitalism which is marked by the emergence of the integration of markets and transnational companies and the lagging of supranational institutions. With this, it is possible for it to affect the work patterns of Indonesian society. For this reason, a further legal remedy will be needed if the party that feels disadvantage is not satisfied with the outcome of the dispute resolution that arises due to the development of globalization. The intended legal remedies are administrative efforts as referred to in Article 48 of Law Number 51 of 2009 concerning Amendments to Law Number 9 of 2004 concerning Amendments to Law Number 5 of 1986 concerning State Administrative Court (PTUN). The aim of this article is to find out the authority for dispute resolution of State Administrative Court (PTUN) toward dismissal with no reverence verdict and dispute resolution efforts for State Administrative Court (PTUN) toward dismissal with no reverence verdict. Juridical normative is applied as research method. This research concludes that dispute resolution on personnel is done through the State Administrative Court except it is caused by violations of the disciplinary rules of the State Civil Apparatus which will be resolved through administrative appeals to the Court of Civil Service.

Abstract

ABSTRACTIn Indonesia, the protection of children's rights is regulated in Law Number 23 of 2002 as amended by Law Number 35 of 2014 concerning Child Protection. Background of the issuance of Law Number 23 of 2002 as amended by Law Number 35 of 2014 concerning Child Protection for the Indonesian State to ensure the welfare of all its citizens, including protection of children's rights which are human rights as contained in the 1945 Constitution and the UN Convention on the Rights of the Child.Dating is a relationship between a man and a woman colored by intimacy where each other engages in feelings of love and acknowledges each other as partners. Whether we realize it or not, at this time many teenagers who are dating often commit bad behavior in dating relationships, one of which is violence in dating.Keywords: Children, Dating Violence.
