Abstract

Akta Perdamaian (Acte van Dading) diatur dalam Peraturan Mahkamah Agung Republik Indonesia No. 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan (“Perma No. 1/2016”). Perma No. 1/2016 diundangkan sebagai salah satu komponen reformasi birokrasi Mahkamah Agung Republik Indonesia yang bertujuan untuk mencapai tujuan mewujudkan badan peradilan indonesia yang agung adalah mediasi sebagai alat untuk meningkatkan akses masyarakat terhadap keadilan sekaligus melaksanakan asas penyelenggaraan peradilan yang mudah, cepat, dan murah. Dalam pelaksanaan Perma No. 1/2016, Majelis Hakim yang memeriksa dan mengadili suatu perkara di tingkat pertama pada peradilan umum maupun peradilan agama wajib memberitahukan kepada Para Pihak untuk menempuh Mediasi pada hari sidang yang telah ditentukan dan dihadiri oleh Para Pihak. Pada proses Mediasi, Mediator memberi kesempatan yang sama kepada Para Pihak, baik Penggugat maupun Tergugat, untuk mengajukan tawaran perdamaian dengan itikad baik kepada pihak lawannya. Tawaran perdamaian ini nantinya akan dibahas pada saat proses Mediasi untuk menentukan apakah Kesepakatan Perdamaian antara Para Pihak dapat tercapai atau tidak. Ketentuan di atas berlaku pada saat pemeriksaan perkara di tingkat pertama, baik pada peradilan umum ataupun peradilan agama. Dalam tingkat pertama, Para Pihak memiliki hak untuk mengajukan tawaran perdamaian kepada Mediator pada saat proses Mediasi yang diwajibkan oleh Perma No. 1/2016. Akta perdamaian agar mempunyai kekuatan hukum selanjutnya dituangkan dalam putusan oleh hakim yang menangani perkara tersebut. Pada akta perdamaian melekat kekuatan hukum, hal ini diatur dalam Pasal 130 ayat (2) dan (3) HIR yang meliputi putusan tersebut disamakan dengan putusan yang telah berkekuatan hukum tetap, mempunyai kekuatan eksekutorial, dan terhadap akta perdamaian tidak dapat dibanding ataupun kasasi. Berdasarkan kekuatan hukum tersebut penulis menilai bahwa akta perdamaian merupakan cerminan asas keadilan yaitu prosedural dan substantif.Kesepakatan/akta perdamaian mengakhiri perkara. Kesepakatan/akta perdamaian harus mengakhiri perkara secara tuntas dan keseluruhan. Tidak adalagi yang disengketakan karena semuanya telah diatur dan dirumuskan penyelesaiannya dalam akta tersebut. Selama masih ada yang belum diselesaikan dalam kesepakatan maka akta perdamaian tersebut mengandung cacat formil. Kesepaktan/akta perdamaian dibuat dalam bentuk tertulis. Hal ini dinyatakan dalam Pasal 1851 KUH Perdata dan Pasal 11 ayat (1) PERMA Nomor 1 Tahun 2016 “Persetujuan tidak sah melainkan jika dibuat secara tertulis”. Berdasarkan Pasal tersebut tidak dibenarkan kesepakatan perdamaian yang disampaikan secara lisan.

Abstract

This research was conducted using a qualitative approach with a descriptive method, in determining the researcher's informants using purposive sampling methods and techniques. Data collection techniques are carried out by interviews, observations, and documentation. In testing the validity of the data, the researcher used the triangulation method. Meanwhile, the data analysis technique uses data reduction, data presentation, and conclusion. The results of the study show that although this program has great potential to support farmers, several challenges such as limited resources, lack of understanding of farmers, and suboptimal coordination between implementing parties are still obstacles. To increase the effectiveness of the program, it is recommended that there be increased socialization, training for implementers, and strengthening coordination between all related parties. In addition, there is a need for policies that are more responsive to the social and economic conditions of farmers so that this program can provide maximum benefits. Thus, it is hoped that the AUTP program can continue to develop and have a significant positive impact on farmers in Junjung Sirih District, Solok Regency.

Abstract

This study aim to develop an educational game-based learning assessment assisted by Quizwhizzer that is valid and practical for learning assessment activities. It is a research and development with the ADDIE model. The sample of this research were economics teacher and students in senior high schools in Padang. The data were collected using validation sheets and questionnaires. It were analyzed using statistic descriptive. The results show that the product is valid and practical for economics learning.

Abstract

This research aims to determine the influence of religiosity and peers on academic dishonesty students at the Department of Economic Education, Faculty of Economics and Business, Padang State University. The type of research used is Quantitative Descriptive. The population in this study were active students of the Department of Economic Education, Faculty of Economics and Business, Padang State University, class 2019-2022. Non – sampling method Probability Sampling. The sampling technique used is Purposive Sampling, Data collection was carried out by distributing questionnaires directly and through google form. Questionnaires were distributed to 80 students of the Department of Economic Education, Faculty of Economics and Business, Padang State University. The data analysis technique used was multiple linear regression analysis using SPSS 21. The results of this study show that there is an influence of the variables religiosity and peers significantly towards academic dishonesty to students of the Department of Economic Education, Faculty of Economics and Business, Padang State University. The results of the F test simultaneously show that religiosity and peers together have a significant effect on academic dishonesty. The coefficient of determination value shows that religiosity and peers are able to influence the dependent variable, namely academic dishonesty amounting to 35.6%.

Abstract

This research was conducted with the aim of analyzing how electronic service quality, electronic trust, price influence customer loyalty, with customer satisfaction as a mediator in the Lazada application. The subjects of this research are Gen Z in Padang City. The sampling technique uses purposive sampling. The number of samples used was 180 respondents. Data was collected through a questionnaire with a Likert scale, then analyzed using SmartPLS 4.1 software. The results of this research show that electronic service quality, electronic trust, and price have a significant effect on electronic customer satisfaction and loyalty. However, electronic trust does not have a significant effect on electronic customer loyalty. E-customer satisfaction mediates the relationship between E-service quality, E-trust, price and e-customer Loyalty.

Abstract

Logistics has evolved along with increasing consumer behavior. A country's logistics performance is usually measured using the Logistics Performance Index (LPI). LPI is a tool for assessing the efficiency and sustainability of national or regional logistics systems. Indonesia still faces various challenges in the logistics sector. With the rapid growth of e-commerce and the need for fast delivery, the logistics industry in Indonesia is experiencing a significant transformation. This research aims to determine the influence of discipline and work motivation in the logistics sector on the performance of PT Jasa Mandiri Utama employees. Quantitative research methods. Primary data for respondent employees of PT. Main Mandiri Services via Google Form. Data analysis using SmartPLS software. The research results show that discipline has a positive effect on employee performance and work motivation has a positive effect on employee performance.

Abstract

This research aims to determine the effect of e-modules based on problem based learning (PBL) assisted by the Smart Apps Creator (SAC) application on student learning motivation. This type of research is a quasi-experiment with a population of class IX students at SMA N 1 Guguak District. Sampling used purposive sampling technique. The total sample was 66 class XI students at SMAN 1 Guguak District who were divided into 2 groups, namely 32 for the control class group and 34 for the experimental class group. Based on the results of the data using the normality test and homogeneity test, the results obtained were that the data had a normal distribution and homogeneous variance. Then proceed with hypothesis testing using the independent sample t-test posttest data from the student learning motivation questionnaire (experiment and control). The result obtained was 0.004 < 0.005 so Ho was rejected. So it is concluded that there is a significant influence of the use of PBL based e-modules assisted by SAC applications on student learning motivation

Abstract

This research is in the background by many university graduates who have not yet got a job after graduation. This occurs because there is a gap between the education system and the world of work which results in university graduates being produced not in accordance with the required workforce. For this reason, researchers are interested in knowing the influence of digital literacy and career planning on the work readiness of students of the Faculty of Economics and Business, State University of Padang. This study aims to analyze the influence of digital literacy and career planning on the work readiness of students of the Faculty of Economics and Business The type of research used is causal associative research with a quantitative approach. The population in this study is active S1 students of the Faculty of Economics and Business, State University of Padang with a sample of 356 respondents using proportional random sampling techniques. Data collection in this study is by using a questionnaire. The data analysis techniques used are divided into descriptive analysis, inductive analysis, and multiple linear regression analysis. The results of this study show that the positive and significant influence between digital literacy and career planning on job readiness. This means that the better digital literacy and career planning, the better the job readiness of students will be as well.

Abstract

This study examines the influence of trust, perceived usefulness, perceived ease of use, perceived risk and perceived security on the continuance intention of ShopeePay e-wallet with consumer attitude and consumer engagement as mediators. An online survey was conducted to collect data from 202 Shopeepay users in Padang City. Data analysis used Partial Least Squares Structual Equation Modeling (PLS-SEM) to evaluate the relationship between variables. The results showed that Trust and Perceived Risk each had no significant effect on Consumer Attitude. In addition, Perceived Usefulness, Perceived Ease of Use, and Perceived Security were found to have a positive and significant effect on Consumer Attitude. Furthermore, consumer attitude was found to have a positive and significant effect on Consumer Engagement. And Consumer Engagement was found to have a positive and significant effect on Continuance Intention. Finally, Consumer Attitude was found to have a positive and significant effect on Continuance Intention.

Abstract

The increasing competition in the online transportation industry has led to a growing trend of switching intention among Generation Z users, particularly in urban areas like Padang. This study aims to analyze the influence of Perceived Value, Customer Trust, and Price on Switching Intention through Customer Satisfaction among Maxim application users. Using a quantitative research method, data were collected through a survey distributed to Generation Z respondents in Padang who actively use the Maxim application. The study employed Partial Least Squares – Structural Equation Modeling (PLS-SEM) for data analysis. The findings indicate that Perceived Value and Customer Trust positively influence Customer Satisfaction, which in turn reduces Switching Intention. Meanwhile, Price significantly affects Customer Satisfaction, but in some cases, a higher price may increase the likelihood of switching if not accompanied by quality service. Furthermore, Customer Satisfaction acts as a crucial mediating variable, strengthening or weakening the relationship between Perceived Value and Price with Switching Intention. These findings contribute to a better understanding of consumer behavior in the digital transportation sector, highlighting the importance of maintaining customer satisfaction to ensure long-term loyalty. Future research is encouraged to explore additional factors such as brand loyalty, user experience, and service differentiation strategies
