Abstract

This research aims to examine the implementation of the conditional financing agreement applied by PT. Permodalan Nasional Madani (PNM) Mekaar in Pakong Village, Pamekasan, and review its conformity with Islamic law (Fiqh Muamalah). This practice involves providing micro-business capital loans (qardh) to pre-prosperous women, who are required to pay weekly installments over 50 meetings in one year. Customers are also charged a service fee/compensation fee (balas jasa) channeled through the Account Officer. Using a descriptive analytical qualitative field research method, this study found that the implementation of this agreement fulfills the pillars (rukun) and principles (asas) of contracts in fiqh muamalah. From the perspective of Islamic law, the additional charges (compensation/administrative fees) imposed on the customer in the qardh contract are considered permissible when viewed from the perspective of the elements of sharia financing, which acknowledges the compensation (ujrah) charged by the capital owner (PT. PNM Mekaar/muqridh) to the customer (muqtaridh). The researcher concludes that this micro-business capital financing practice is generally in accordance with sharia law provisions

Abstract

This research is motivated by the rampant issues regarding mental health that occur at this time. This study aims to analyze how the process of internalizing the values of mauizah hasanah as a means of Islamic therapy and students' learning motivation. The research approach used is qualitative with a literature study method, data collected from literature that discusses mauizah hasanah, Islamic psychotherapy and learning motivation using Miles and Huberman's descriptive-analytical analysis which includes data reduction, data presentation and conclusion drawing and verification. The findings of this research are that the process of internalizing value has three stages initiated by Muhaimin, namely transformation of value, transaction of value and transinternalization of value. This research shows that the internalization of the value of mauizah hasanah not only plays a role as a psychological healing based on Islamic spirituality, but also fosters students' motivation to learn based on their moral and spiritual awareness. The implications of this study include theoretical enrichment for Islamic psychology and practical recommendations for Islamic educators and counselors to internalize the values of mauizah hasanah into the context of therapy or learning. Further research is suggested to test the application of these mauizah hasanah values empirically through direct practice or education in schools

Abstract

Hukum pidana dalam melakukan pemidanaan memiliki tujuan untuk mencapai keadilan, dimana peran hakim sangat menentukan efektifitas pemidanaan yang akan dijatuhkannya terhadap seorang pelaku tindak pidana. Saat ini, Indonesia memiliki pembaharuan hukum pidana yang terdapat dalam KUHP baru yakni Azas Rechterlijk pardon yang merupakan pedoman pengampunan hakim. Penelitian ini adalah penelitian hukum normatif dengan pendekatan filosofis, historis, perundang-undangan, pendekatan konseptual dan pendekatan kasus. Pendekatan-pendekatan konseptual digunakan untuk memahami secara presisi dan akurat terkait azas rechterlijk pardon yang digunakan oleh prinsip hukum dalam undang-undang maupun doktrin para ahli hukum. Hasil dari penelitian ini menerangkan bahwa Azas rechterlijk pardon dalam KUHP yang baru merupakan gagasan baru yang berisi ketentuan mengenai pedoman pengampunan hakim atau kewenangan hakim dalam memberi maaf atau memaafkan orang yang melakukan tindak pidana. Kajian hukum islam yang diterangkan dalam Al’quran dan hadist berkaitan dengan teori pemidanaan yang bersifat teori relatif (Deterrence), teori ini memandang pemidanaan bukan sebagai pembalasan atas kesalahan si pelaku, tetapi sebagai sarana mencapai tujuan bermanfaat untuk melindungi masyarakat menuju kesejahteraan. Hal ini relevan dengan sudut pandang hukum progresif yang mana dalam hukum pidana Islam pemaafan hakim berlaku bagi jarimah ta’zir.

Abstract

Penelitian ini membahas dinamika rezim otoritarian Orde Baru dan kontroversi wacana penetapan Soeharto sebagai pahlawan nasional di tengah catatan pelanggaran HAM pada 1998. Melalui pendekatan kualitatif-deskriptif dan studi kepustakaan, kajian ini menelusuri karakter politik Orde Baru yang ditandai oleh sentralisasi kekuasaan, kontrol militer, pembatasan kebebasan sipil, serta praktik KKN yang mengakar. Analisis kemudian berfokus pada rangkaian pelanggaran HAM menjelang kejatuhan Soeharto, termasuk kerusuhan Mei, kekerasan seksual, pembunuhan massal, serta penculikan aktivis pro-demokrasi. Temuan penelitian menunjukkan bahwa upaya mempromosikan Soeharto sebagai pahlawan nasional tidak dapat dilepaskan dari upaya rekonstruksi memori sejarah yang berpotensi memutihkan tindakan represif negara. Karena itu, kajian ini menegaskan pentingnya integritas sejarah, transparansi, dan penghormatan terhadap korban sebagai fondasi etis dalam merumuskan kebijakan kepahlawanan, sekaligus menjaga nilai-nilai demokrasi dan HAM pada era reformasi.

Abstract

The digital transformation of Islamic preaching has significantly reshaped the role and authority of kyai within contemporary religious landscapes. This study examines how kyai utilize social media to strengthen public trust and analyzes its impact on the reputation of pesantren as well as broader public perceptions. Employing a literature review method based on academic publications from the last three years (2022–2024), the study identifies three key areas of focus: first, the shift from traditional face-to-face da’wah toward digitally mediated practices that are more flexible, interactive, and capable of engaging diverse audiences across generations; second, the communication strategies employed by kyai to build public trust through authenticity, consistency, and ethical communication; and third, the institutional and social implications of kyai’s digital presence in enhancing pesantren legitimacy, strengthening organizational branding, and fostering healthier digital religious environments. The findings demonstrate that the digital visibility of kyai not only expands their religious authority but also positions pesantren as adaptive and relevant Islamic educational institutions in the era of technological modernization. This study underscores the importance of digital literacy for kyai as a strategic requirement for sustaining public trust and maintaining credible religious communication in the digital age.

Abstract

This study examines the transformation of Kyai leadership within the pesantren tradition amid the rising influence of digital media, using the controversy surrounding Trans7’s Xpose Uncensored episode on Pesantren Lirboyo as a critical case. this research analyzes how Kyai leadership is constructed, contested, and recontextualized in the era of viral media. Findings reveal four key transformations. First, despite media pressure, Kyai authority in Lirboyo remains anchored in charismatic moral–spiritual leadership while adapting to media logic through ethical and calm communicative strategies, consistent with Hjarvard’s (2008) theory of the mediatization of religion. Overall, this study demonstrates that the leadership of Kyai in the digital era is simultaneously charismatic, adaptive, and dialogical, reflecting a harmonious integration of pesantren tradition with contemporary media culture. The Lirboyo case serves as evidence that religious authority in Indonesia is undergoing significant transformation, not through erosion, but through strategic negotiation within the logic of viral digital communication

Abstract

This study explores the symbolic, digital, and sociopolitical dimensions of kyai leadership in contemporary pesantren culture, focusing on how the figure of the kyai is framed through the lens of the Javanese Satria Piningit archetype, digital media virality, and community crisis management. Using a qualitative phenomenological approach, data were collected from 31 informants consisting of santri, alumni, community leaders, and pesantren administrators across three pesantren in East Java. The findings reveal that the kyai is widely perceived not merely as a religious authority but as a symbolic embodiment of hidden moral leadership. Informants consistently described the kyai as humble, spiritually ascetic, and quietly influential—traits strongly aligned with the cultural memory of the Satria Piningit. The second finding shows that kyai leadership in the digital era is shaped by dynamics of visibility, viral content, and moral representation. Participants noted that social media platforms often amplify both the authority and vulnerability of the kyai, creating a dual pressure to maintain authenticity while navigating online controversies. The third finding demonstrates that pesantren communities rely heavily on the kyai during moral, social, and political crises; the kyai becomes a stabilizing moral compass whose decisions significantly influence community cohesion. Overall, this study concludes that kyai leadership today is a hybrid model that combines spiritual charisma, cultural symbolism, and digital-era moral negotiation. These findings contribute to a deeper understanding of religious leadership in Southeast Asian Muslim communities and illustrate how traditional authority adapts within modern sociotechnical environments..

Abstract

This article examines the dual role of the kyai as both religious scholar (ulama) and political authority (umara) in contemporary Indonesia. Drawing on conceptual and descriptive-analytic methods, it analyzes al-Ghazali’s classical political theory on the unity of religion and state, contrasting it with modern secularism which advocates for institutional separation between the two. In Indonesia, various kyai have served as public officials—regents, governors, legislators, and ministers—creating a complex interplay between moral-religious legitimacy and administrative-political responsibility. This dual role brings both opportunities and vulnerabilities, such as potential conflicts of interest, misuse of religious symbolism, and shifting public perceptions of pesantren. The presidency of Abdurrahman Wahid (Gus Dur) serves as a central case study demonstrating how a religious intellectual reshapes political ethics and governance. The article concludes with a reflection on the challenges posed by recent PBNU conflicts, modernization, and public accountability within the frameworks of al-Ghazali’s thought and secular critiques.

Abstract

Peningkatan kinerja karyawan dalam koperasi syariah tidak hanya fokus pada pencapaian target-target finansial, namun juga harus sejalan dengan nilai-nilai Islami. Penelitian ini dilatarbelakangi dengan masih minimnya studi empiris yang membahas peran budaya kerja Islami sebagai strategi penguatan kinerja karyawan, khususnya di BMT UGT Nusantara Cabang Riam Durian. Penelitian ini bertujuan untuk mengkaji penerapan budaya kerja Islami dan peningkatan kinerja karyawan BMT UGT Nusantara Cabang Riam Durian. Metode penelitian dengan pendekatan kualitatif dengan teknik pengumpulan data melalui wawancara semi terstruktur, observasi lapangan dan triagulasi sumber. Adapun narasumber dalam penelitian ini terdiri dari pimpinan cabang dan karyawan operasional. Temuan penelitan menunjukkan bahwa penerapan budaya kerja Islami melalui praktik-praktik kegiatan Islami seperti gerak batin, pengajian, khatam Al Qur’an, telah berhasil menginternalisasikan nilai STAF (Shiddiq, Tabligh, Amanah dan Fathonah) ke dalam diri masing-masing karyawan, budaya musyawarah serta teladan dari pimpinan dapat meningkatkan kinerja karyawan. Peningkatan kinerja tercermin dari kualitas kerja yang lebih baik, pencapaian target kuantitas kerja, terbentuknya tim yang solid berlandaskan ukhuwah Islamiyah, serta munculnya inisiatif dan motivasi kerja yang didasarkan pada kesadaran spiritual. Penelitian ini menyimpulkan bahwa budaya kerja Islami tidak hanya berfungsi sebagai identitas organisasi, tetapi juga berperan sebagai strategi yang efektif dan berkelanjutan dalam meningkatkan kinerja karyawan di BMT UGT Nusantara.
