Abstract

Perempuan dalam kehidupan rumah tangga kerap diposisikan sebagai the second creation. Terbukti dengan tingginya angka diskriminasi pada perempuan disektor privat, termasuk pada ranah reproduksi perempuan dalam rumah tangga. Tulisan ini mengkaji pemikiran Husein Muhammad dan Masdar Farid Mas’udi tentang hak-hak reproduksi perempuan dalam keluarga dengan menelaah karya tulisnya. Keduanya merupakan cendikiawan nusantara yang menjungjung tinggi hak hak perempuan ditinjau dari kacamata teks keagamaan. Pemikiran Husein Muhammad disandarkan pada membandingkan pendapat-pendapat para ahli fiqh kemudian diambil yang sesuai dengan konteks masyarakat saat ini dan menitik beratkan pada aspek kemashlahatan. Adapaun Masdar Farid Mas’udi lebih menitik beratkan pada maqhasid al-nash dari pada zawahir al—nash. Merka sepakat bahwa Hak-hak reproduksi perempuan dimulai sejak hak memilih pasangan, hak menikmati hubungan seksual, hak menolak kehamilan, hak menggugurkan kandungan. Husein menambahkan pada hak nafkah jaminan kesehatan sedangkan Masdar menambahkan hak bercerai untuk perempuan.

Abstract

This article discusses about the tradition of war in traditional marriages of the Banyuwangi Osing community. The majority of the people of Osing Banyuwangi are Muslims. However, they also very closely adhere to the cultural traditions inherited from their ancestors, including customs in marriage, one of which is the tradition of war of death. The purpose of this study is to analyze in depth about the customs that develop in the Banyuwangi Osng community. The method used is qualitative, using a sociological approach to Islamic law. The results of the research show that the war-war tradition in the traditional marriage of the Osing Banyuwangi community with a sociological theory approach with Talcott Parsons' AGIL paradigm, the authors can conclude that the existence or continuity of this tradition can still continue until now, due to the balance (balancing) formed in it. Various structures or components found in the Osing Banyuwangi community maintain mutual equilibrium (there is continuous interaction between components that reinforce each other), so that a balance occurs (balancing). Therefore, the author can conclude that the tradition of war of departure is a valid urf whose existence can still be maintained and practiced by the people of Osing Banyuwangi. Artikel ini membahas tentang tradisi perang bangkat dalam perkawinan adat masyarakat osing Banyuwangi. Masyarakat osing Banyuwangi mayoritas beragama Islam. Namun, mereka juga sangat erat memegang adat kebudayaan warisan para leluhurnya, termasuk adat dalam perkawinan, salah satunya tradisi perang bangkat. Tujuan penelitian ini adalah untuk menganalisa secara mendalam tentang adat yang berkembang di masyarakat osng Banyuwangi. Metode yang digunakan adalah kualitatiif, dengan menggunakan pendekatan sosiologi hukum Islam. hasil penelian menunjukkan bahwa radisi perang bangkat dalam perkawinan adat masyarakat osing Banyuwangi dengan pendekatan teori sosiologi dengan paradigma AGILnya talcott parsons, dapat penulis simpulkan bahwa eksistensi atau keberlangsungan tradisi tersebut masih bisa berlangsung sampai sekarang, dikarenakanadanya keseimbangan (balancing) yang terbentuk didalamnya. Berbagai struktur atau komponen yang terdapat di masyarakat osing Banyuwangi saling menjaga equilibrium (terjadi interaksi terus menerus antar komponen yang saling menguatkan), sehingga terjadi suatu keseimbangan (balancing). Oleh karena itu, dapat penulis simpulkan bahwa tradisi perang bangkat merupakan urf sahih yang keberadaannya msaih dapat dipertahankan dan dipraktikkan oleh masyarakat osing Banyuwangi.

Abstract

This study explores the tradition of beras kafarat (expiation rice) in Tebing Tinggi Village, Kerinci, as a local Islamic practice conducted by families of the deceased as a substitute for unfulfilled prayers. Using a descriptive qualitative method with a case study approach, data were collected through observations and interviews with five key informants directly involved in the tradition. Findings show that although the term kafarat in classical Islamic jurisprudence refers to specific legal penalties such as for oaths or fasting violations, the Tebing Tinggi community uses it symbolically to represent charitable acts intended to support the deceased spiritually. The practice reflects deep-rooted social solidarity and spiritual responsibility, where the act of sharing rice after Friday prayers becomes a meaningful ritual of religious and communal unity. Despite challenges from modernization and generational shifts, the tradition persists through adaptive strategies, value-based education, and community engagement. This study contributes to the discourse on Islamic law by contextualizing local cultural practices within the broader framework of sharia, highlighting the importance of preserving meaningful traditions that align with core Islamic values.

Abstract

This study examines the dynamics of domestic violence (DV) in the context of Muslim families with a focus on the understanding and implementation of the rights and obligations of husbands and wives according to Islamic family law. The approach used is qualitative with case studies. This study involved in-depth interviews with victims, perpetrators, and religious figures and Islamic legal experts, as well as observations of the mediation process and resolution of domestic conflicts. Data analysis was carried out through data reduction, display, and verification to ensure the validity and reliability of the findings. The results of the study indicate that inequality in the fulfillment of the rights and obligations of husbands and wives is the main factor triggering domestic violence, and the implementation of Islamic family law within a positive legal framework can strengthen protection for victims. These findings provide new insights into preventing and handling domestic violence through an approach based on Islamic values and enrich the perspective of Islamic family law in the context of legal plurality in Indonesia. Abstract

This study aims to examine the authority of local governments and to identify an ideal regulatory model for community-based coastal area protection and management. This is crucial as most of these islands are small and rich in natural resources with high economic potential. Ironically, according to data from the World Bank and Statistics Indonesia (BPS), coastal communities remain largely impoverished. The study focuses on two main issues: (1) the extent of local government authority in regulating community-based coastal protection and management, and (2) the ideal regulatory model. Using normative legal research, the findings indicate that local governments hold such authority under laws including the 1945 Constitution, Law No. 1/2014, Law No. 23/2014, and relevant ministerial regulations. The ideal model is a regional legal policy (local regulation) specifically ensuring community participation in managing coastal resources to alleviate poverty and promote justice and welfare.

Abstract

This study aims to examine the halal certification application procedure for Korean cuisine products at LPPOM MUI East Java and assess its legality from the perspective of Islamic law. The research employs a qualitative method with a descriptive-analytical approach. The findings indicate that halal certification aligns with the 1945 Constitution and is supported by legal frameworks such as Law No. 8 of 1999, Law No. 18 of 2012, Law No. 33 of 2014, and Presidential Instruction No. 2 of 1991. Halal certification has become mandatory due to changes in the composition of food, medicine, and cosmetics. The application procedure includes HAS training, implementation of the halal assurance system, document preparation, registration, monitoring, field audits, and certificate issuance.

Abstract

Agreements found on online shopping websites, known as digital contracts, are binding for parties involved in electronic commerce. These include not only the business actors but also the platform providers acting as facilitators. Digital contracts often contain standard clauses unknowingly agreed upon by consumers. According to Article 1, point 17 of the ITE Law, electronic contracts are agreements made via electronic systems. Standard clauses are governed by Law No. 8 of 1999 on Consumer Protection. The rise of online commerce demands legal certainty to protect consumer rights. Consumer protection under the law ensures legal assurance for consumers in electronic transactions.

Abstract

The main objective of this research is to provide a deeper understanding of the relationship between the legislature and the executive in the implementation of oversight, as well as to identify the challenges faced by the legislature in carrying out the oversight function. This research uses a normative approach, descriptive analytical in nature. The results of the study the authority of the DPR in overseeing government policies, whether through working meetings, interpellation, the right of inquiry, and oversight of state financial management, is an integral form of oversight in ensuring government accountability and transparency. However, in practice, legislative oversight faces a number of significant challenges. One of the main challenges is the dominance of executive power in the presidential system of government, which often hampers the effectiveness of parliamentary oversight. Tensions between the legislature and the executive, as well as the politicisation of oversight influenced by the political interests of certain parties, are factors that reduce objectivity in carrying out legislative oversight functions. In addition, the capacity of human resources in the DPR is also an obstacle, where limited knowledge, skills, and a lack of competent expert staff prevent optimal oversight. To strengthen legislative oversight, efforts are needed to increase the capacity of human resources in the legislature, both through the recruitment of competent expert staff, ongoing training, and increased transparency in the management of the state budget. Strengthening the oversight functions of the DPR, as well as the involvement of the media and the public in oversight, are also solutions that can improve the effectiveness of oversight of executive policies. With these measures, it is hoped that the DPR can better perform its functions, ensure more transparent, accountable and pro-people government policies, and realise a more democratic and corruption-free government. Overall, despite the challenges in legislative oversight, the legislature still has an obligation to perform its oversight function optimally. Strengthening the capacity of the legislature as well as efforts to increase transparency in executive policies are key to realising better governance in Indonesia

Abstract

Penelitian ini bertujuan untuk menjawab tiga hal utama: pandangan hukum pidana terhadap masalah lingkungan seperti penambangan emas tanpa izin (PETI), solusi preventif dari perspektif etika, serta peran pemerintah dalam penyelesaiannya. Pendekatan yang digunakan adalah kualitatif dengan pendekatan yuridis-empiris. Sumber data berasal dari bahan tertulis (buku, jurnal, artikel), baik data primer maupun sekunder. Sanksi pidana bagi pelaku PETI berupa pidana penjara dan denda, serta pidana tambahan atau tindakan administratif sebagaimana tercantum dalam Pasal 119 Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Manusia harus menyadari fungsi dan tanggung jawabnya dalam kehidupan, sehingga kesadaran moral menjadi langkah preventif terhadap kerusakan lingkungan. Pemerintah perlu berperan aktif melalui pendampingan, bantuan teknis, pembiayaan, serta kemudahan akses legalisasi agar pelaku PETI dapat beralih ke usaha yang sah.

Abstract

This research aims to analyse the role of Constitutional Law (HTN) in regulating higher education in Indonesia, especially in maintaining the balance between academic freedom and state supervision. The method used in this research is the normative juridical method, which focuses on the study of legislation related to higher education as well as legal practices applied in Indonesia. The analysis is conducted on Law No. 12/2012 on Higher Education and Law No. 20/2003 on the National Education System, as well as other implementing regulations. The results show that HTN has two main roles in higher education in Indonesia. First, HTN acts as an instrument that regulates and supervises higher education institutions to ensure education remains in accordance with national goals and the basic principles of the state. Second, HTN also serves to protect academic freedom, which is a fundamental right guaranteed by the constitution. However, tensions often arise between the academic freedom that must be protected and state supervision aimed at maintaining the quality of education. In the discussion, it was found that while state supervision is essential to maintain the relevance and quality of higher education, overly restricted academic freedom can stifle innovation and creativity in education. Therefore, wise policies are needed to create a healthy balance between state oversight and academic freedom. Thus, higher education in Indonesia can serve as a means for the nation's progress without sacrificing the freedom of thought that is essential for the development of science.
