Abstract

Child marriage remains a persistent issue in Probolinggo Regency, posing risks to children’s well-being and raising complex legal, religious, and socio-cultural challenges. This study aims to explore how the values of love and tolerance in Islamic law, along with local wisdom, can be harmonized to address the practice of child marriage. Employing a normative-empirical approach, the research analyzes classical and contemporary Islamic legal sources, especially through the lens of maqāṣid al-sharī‘ah and integrates field data gathered from interviews and observations. Findings reveal that child marriage in the region is often driven by economic hardship, cultural norms, and religious misinterpretation. Islamic law, when viewed contextually, offers a strong foundation for child protection as a central objective. Moreover, local wisdom that emphasizes social harmony, compassion, and deliberation serves as a potential entry point for legal reconstruction. The discussion proposes a model of harmonization between Islamic legal principles and cultural practices, rooted in love and tolerance, as a strategic solution to reduce child marriage. The study recommends community-based legal education that integrates religious values and cultural sensitivity to prevent child marriage effectively.

Abstract

Water conservation amid the climate crisis requires a holistic approach based on eco-mysticism that integrates ecological knowledge with cultural and spiritual values. This study examines the role of local eco-mysticism as a basis for water conservation at Sendang Tawun, Ngawi. The research focuses on ritual practices and local beliefs of the Tawun community in preserving water sources. The aim is to understand the relationship between mystical rituals, customary prohibitions, and environmental conservation efforts. The method employed is qualitative research with a case study approach through in-depth interviews, participatory observation, and documentation. Data were obtained from traditional leaders, local communities, officials, vendors, and visitors. The findings show that local eco-mysticism is manifested through the Keduk Beji ritual and prohibitions against taking turtles, fish, and plants from the spring area. These beliefs are grounded in ancestral reverence, faith in spiritual guardians, and fear of misfortune. Such practices have proven effective in sustaining water sources, preserving traditions, and promoting tourism-based economies. Thus, eco-mysticism can serve as a model of culturally rooted water conservation.

Abstract

This study examines the phenomenon of Jamaah Kerukunan (Jamkur), a local religious community in Ranubedali Village, Lumajang, Indonesia, comprising members with diverse educational and religious backgrounds. The research aims to analyze how this community fosters social and religious cohesion through structured weekly activities, including congregational prayers, collective dhikr, and monthly thematic sermons. Adopting an ethnographic approach, the study utilizes participant observation, in-depth interviews, and documentation to capture the symbolic meanings behind these communal practices. The findings reveal that Jamkur serves as an embodiment of local wisdom that effectively promotes solidarity, compassion, and tolerance within a pluralistic rural Muslim society. By implementing a rotating meeting system and voluntary contributions, the community establishes a symbolic commitment to unity that transcends individual differences in religious understanding. Consequently, Jamkur provides an inclusive, egalitarian learning space that mitigates social friction. Ultimately, the community represents a practical model of Islam rahmatan lil-‘alamin (Islam as a blessing to all creation), demonstrating how localized religious institutions can maintain social harmony and peace in a contemporary Indonesian context.

Abstract

Criminal law reform through the ratification of the new Criminal Code is an important milestone in the journey of national law reform. These changes do not only concern the legal-formal aspect, but also demand adjustment to the social and cultural values that live in society. In the pluralistic context of Indonesia, the enforcement of justice cannot be separated from local wisdom and moderate religious values. This research aims to examine how local wisdom and moderate Islamic principles can be integrated as the basis for the formation of criminal justice in the new Criminal Code. The method used is normative-juridical legal research with a legislative, conceptual, and value approach. The results of the study show that the new Criminal Code recognizes living law, which is a law that grows from social practices, customs, and community beliefs. Local wisdom emphasizes the value of deliberation, balance, and the restoration of social relations, while moderate Islam prioritizes tolerance, balanced justice, and compassion in the legal process. The integration of the two opens up opportunities for criminal law reform that is more adaptive to social change, as well as affirming the role of law as a means of building harmony and strengthening human values in a diverse society.
