Abstract

Abstract The main problem in this research is How is the Tradition of Pilgrimage to the Grave After the Wedding Day in the Perspective of Islamic Law (Case Study in Bitowa Village, Manggala District, Makassar City). The main problem is divided into two sub-problems, namely 1) What is the public's view of the tradition of visiting the grave after the wedding day in Bitowa Village, Manggala District, Makassar City?, 2) How is the tradition of visiting the grave after the wedding day in the perspective of Islamic law in Bitowa Village, Manggala District, Makassar City. The results of this study indicate that the tradition of visiting the grave after the wedding day is carried out in the Bitowa Village community with the procedures carried out during a grave pilgrimage such as visiting family graves, preparing all preparations before leaving for a grave pilgrimage such as (pots filled with water; flowers; and leaves). pandanus), greet the grave experts, pour water and sow flowers and pandan leaves on the visited graves, face the Qibla when praying at the visited graves, send prayers to the deceased by reciting short suras closed with Surah al-Fatihah. And the wisdom that can be taken is that we always remember that living humans will inevitably experience death, as a mirror to increase the deeds of worship to Allah SWT, and ask Allah for forgiveness for the sins of the deceased through prayer. In Islam the pilgrimage to the grave is a prescribed worship and of course it must be in accordance with what was taught by the Prophet Muhammad, so the grave pilgrimage carried out by the people of Bitowa Village can be done as long as no one violates sharia such as asking for something at the grave. Abstract

Abstract The core of the problem discussed is about the Songkabala Tradition from the Perspective of Islamic Law (Case Study in the Batulabbu Community, Bantaeng Regency. The type of research used in this research is qualitative. The sources of this research are community leaders, traditional leaders, religious leaders and several related institutions. Songkabala which is understood by the Batulabbu community is prayer, barazanji and shalawat. The goal is to ask Allah SWT for protection from reinforcements and dangers. Songkabala in Batulabbu community there are two, namely songkabala 10 muharram and songkabala Dangerous appalili, for the implementation of 10 muharram it is carried out in the mosque and for danger appalili carried out at the house of the residents who carry it out. In the implementation also has its own differences. Songkabala is still maintained by the Batulabbu community and has a great influence in the village. The view of Islamic law in terms of songabala processions such as praying for protection and safety for songkabala is not contradictory because this is intended for Allah SWT. The view of Islam in terms of public relations to the songkabala tradition here, Islam does not prohibit, on the contrary, it is to strengthen ties of friendship. The view of Islamic law in terms of food and ingredients, Islam does not recommend preparing certain foods and ingredients. Abstract

Abstract The main problem of this research is what is the role of the penghulu in determining the guardianship of daughters born out of wedlock? The sub-problems are: 1. How to determine guardianship of a girl born as a result of pregnancy outside of marriage in the KUA, Kahu District, Bone Regency? 2. What are the considerations of the penghulu in determining guardianship of a girl born as a result of a pregnancy outside of marriage at the KUA, Kahu District, Bone Regency? This research is a field research using qualitative methods, in which the research focuses on the results of data collection from predetermined informants. The approach used in this thesis research is descriptive-qualitative because the data needed and used by researchers is in the form of information distributions that do not need to be quantified. The results of the research are the guardianship rights of girls who were born as a result of pregnancy outside of their parents' marriage, the head of the KUA Kahu District gave it to the guardian judge, because the child was only assigned to his mother and her mother's family. The implication of this research is that it is hoped that the head of the KUA or as the head of the Kahu sub-district, Bone Regency, maximizes efforts to determine marriage guardians for girls born as a result of pregnancies outside of marriage, and can minimize pregnant marriages outside of marriage. Abstract

This research includes field research or Qualitative Field Research. The research is obtained from primary data sources and legislation. The approach used in this research is a syar'i juridical and empirical approach. The results of this study indicate that sitting in the case in this decision, that is, it is legally and convincingly proven to violate the 1st Criminal Code Article 279 paragraph (1), with the impact that the second wife does not get a living from the defendant but the child from the marriage continue to earn a living because it is the defendant's obligation based on Law Number 35 of 2014 amendments to Law number 23 of 2002 concerning child protection. In Islamic law a marriage can be carried out as long as it fulfills the requirements and pillars that have been explained, without any recording by the State, while in the decision No.17-K PM.III-16/AD/I/2020 and in the trial process there were witnesses. who is a guardian or witness in the consent process but in other cases, the defendant hides his identity regarding the defendant who already has a legal wife and is registered by the State.

Abstract

Abstrak Pokok permasalahan di skripsi ini adalah Penegakan Hukum Di Lingkungan Peradilan III-16 Makassar Terhadap Pelanggaran Fidusia Dalam Perspektif Hukum Islam. 1) Bagaimana proses penyelesaian perkara fidusia dilingkungan peradilan Militer III-16 Makassar, serta sanksi yang dijatuhkan, 2) Bagaimana pandangan hukum islam terhadap penyalahgunaan fidusia, yang terjadi di Lingkungan Militer. Hasil penelitian dari skripsi ini adalah, tindak pidana fidusia termuat dalam Undang-Undang Fidusia dimana fidusia merupakan orang perseorangan atau badan hukum pemilik subjek jaminan Fidusia (UUF Pasal 1 ayat 5),dan Fidusia adalah orang perseorangan/ badan hukum yang piutangnya dijamin oleh Fidusia (pasal 1 ayat 6 UUF). Tindak Pidana Fidusia termuat dalam Undang-Undang Fidusia dimana fidusia merupakan orang perseorangan atau badan hukum pemilik subjek jaminan fidusia (UUF Pasal 1 ayat 5), dan fidusia adalah orang perseorangan/badan hukum yang piutangnya dijamin oleh fidusia (Pasal 1 ayat 6 UUF) . Subjek jaminan fidusia adalah segala sesuatu yang dapat dimiliki dan dialihkan, seperti barang berwujud, terdaftar, tidak terdaftar, bergerak, real estat, dan tidak dapat digadaikan dengan hak tanggungan atau barang yang telah menjadi fidusia harus dialihkan dan diganti oleh pemberi fidusia. Kata Kunci: Fidusia, Pengadilan Militer III-16 Makassar, Hukum Islam.

Abstract

In practice, it is often found that a marriage without registration is made, in order to make the marriage legal in the state and have legal power, it is possible to apply for an Isbat of Marriage so that the marriage of siri can be determined by the Isbat of Marriage to the Religious Courts, so that marriages that are held in a serial manner can be legalized. So that when the Religious Courts have received the application for Isbat Marriage, the Office of Religious Affairs can record the marriage and obtain a marriage certificate as proof of the legality of the marriage. Applications for Isbat Marriage submitted can sometimes be rejected with certain considerations by the Panel of Judges in the Religious Courts. So that it will make marriages carried out in a serial manner still have no legal force. The author has examined the Legal Basis and Judges' Considerations in Granting the Application for Marriage Isbat as an Effort to Legalize Siri Marriage at the Makassar Religious Court Class IA and the View of Islamic Law on the Legalization of Siri Marriage through the Practice of Isbat Nikah at the Makassar Religious Court Class IA. The type of research in this thesis is descriptive qualitative in the form of field research or Field Research which focuses on collecting and data information found in the field, using a normative and juridical syar'i approach which aims to obtain law empirically by going into the field. The data collection methods used are observation, interviews, and documentation. With data processing and analysis techniques, it is carried out through three stages, namely data reduction, data presentation, and drawing conclusions. The results showed that the main considerations made by the judge in the results of the study were that the judge's considerations in granting the application for the practice of siri marriage isbat, namely the marriage has fulfilled the requirements and the pillars of marriage, that it is true that the applicant is married and there is no previous marriage bond, that the applicant is not blood related. which can prevent his marriage and to take care of other documents related to the interests of the applicant. And according to Islamic law, isbat marriage is allowed in Islamic law because it is a marriage ratification that has been carried out in accordance with his religion and belief but is not recorded at the office of religious affairs and the authorized marriage registration officer. Abstract

Abstract The main problem in this study is how the public's understanding of the mustahiq of receiving zakat fitrah to mosque priests and traditional birth attendants in Bontoa, Bontoa Village, Minasatene District, Pangkep Regency. Furthermore, this sub-problem is divided into three parts, namely. This study uses a qualitative field research method (field research) / field research that is descriptive in nature, with the research approach being an empirical juridical approach, Pangkep Regency still applies the tradition handed down from their ancestors, namely giving zakat fitrah to mosque imams and traditional birth attendants as well as to the poor. They do this because the community's understanding of mustahiq is still very lacking, besides that it is also a form of gratitude for the Bontoa people for the help given to them. According to the view of Islamic law, the acceptance of zakat fitrah to the Imam of the mosque is not yet valid because it is not classified in the context of fisabilillah. And the acceptance of zakat firah against traditional birth attendants is not valid, because it is not included in the mustahiq category. Abstract

Pokok penelitian ini adalah Tinjauan Hukum Islam dan Hukum Positif Tentang Dampak Penelantaran Anak Akibat Perceraian Orang Tua (Studi Kasus Kecamatan Bungoro Kabupaten Pangkep). Pokok permasalahan terdiri dari dua sub masalah yaitu: 1). Bagaimana pandangan hukum hukum mengenai penelantaran anak ditinjau dari persfektif hukum positif dan hukum islam? 2). Bagaimana dampak penelantaran anak akibat perceraian orang tua di Kecamatan Bungoro Kabupaten Pangkep? Penelitian ini merupakan penelitian lapangan (field research). Metode pengumpulan data dalam penelitian ini melalui observasi dan wawancara. Adapun hasil penelitian ini menunjukkan bahwa: 1). Pandangan Hukum tentang penelantaran anak ditinjau dari persfektif hukum positif merupakan perbuatan yang termasuk dalam tindak pidana, karena jelas orang tua korban menelantarkan anak dan ini merupakan tindak pidana menurut peraturan perundang-undangan yang mengatur tentang perlindungan anak, yaitu Undang-Undang Nomor 35 Tahun 2014 dan juga dalam Kitab Undang-Undang Hukum Pidana, dijelaskan mengenai ancaman hukum pidana penjara dan denda, Sedangkan Penelantaran Anak ditinjau dari persfektif hukum islam merupakan perbuatan yang dilarang syara “jalan” tetapi tidak diancaman dengan suatu hukuman dalam Al-Qur’an atau Sunnah Rasul dpat dipandang sebagai jarimah ta’zir karena perbuatan tersebut nyata merugikan pelakunya atau orang lain

Abstract

Kekerasan dalam rumah tangga adalah tindak kekerasan berupa kekerasan fisik, psikis, sesksual dan penelantaran rumah tangga. Bentuk perlindungan terhadap perempuan korban KDRT di Kabupaten Bone berupa pendampingan dalam melaporkan kasus, juga pemberian pidana bagi pelaku.Kasus KDRT tahun 2019-2020 yang masuk di Kepolisian dan diteruskan ke Pengadilan hanya sedikit. Pokok masalah yakni bagaimana bentuk perlindungan terhadap perempuan korban KDRT di Kabupaten Bone dan juga apa kendala perlindungan hukum terhadap perempuan sebagai korban kekerasan dalam rumah tangga di Kabupaten Bone serta perlindungan hukum terhadap perempuan korban KDRT perspektif hukum Islam. Penelitian ini merupakan penelitian lapangan, menggunakan pendekatan normative dan yuridis. Adapun hasil penelitian menunjukkan bahwa kendala yang dihadapi aparat hukum cukup minim, namun tentu ada beberapa kendala seperti korban enggan menceritakan masalah secara menyeluruh dan berkas yang kurang lengkap. Upaya perlindungan yang diberikan aparat hukum yaitu perlindungan nyata bagi korban seperti pendampingan dan perlindungan berupa restoratice justice yang berkaitan dengan hukum Islam yaitu perdamaian. Implikasi penelitian ini adalah aparat hukum hendaknya memproses kasus hingga ke pengadilan dengan memberikan pidana kepada pelaku. Agarperlindungan hukum dirasa maksimal. Abstract

Abstract The subject of this research is the role of the PPA Unit in the application of the principles of Restorative Justice in criminal acts with child offenders in Makassar. This research is a field research using syar'i, theological and normative juridical approaches. The results of this study indicate that in the implementation of Restorative Justice the PPA Unit Polrestabes Makassar only acts as a mediator and facilitator. There are two driving factors for the PPA Unit, namely internal factors including the integrity and capability of the PPA Unit and external factors including collaboration between the PPA Unit and related agencies to facilitate the application of Restorative Justice principles in case resolution. The view of Islamic law relating to Restorative Justice is in line with Islamic teachings because basically the concept of Restorative Justice places more emphasis on solving problems in a family manner. The PPA unit should carry out studies and education related to the principles of Restorative Justice to the community so that cases of child crimes can be resolved amicably. The PPA Unit must also improve the understanding and capability of the PPA Unit apparatus by holding training on case resolution based on the principles of Restorative Justice.
