Abstract

General elections in Indonesia have been held 12 times, namely in 1955, 1971, 1977, 1982, 1987, 1992, 1997, 1999, 2004, 2009, 2014 and 2019. And, the general election simultaneously and costing not a few lives occurred in 2019. Basically, the simultaneous general elections held in 2019 had many irregularities, especially the large number of members of ad hoc election organizers who fell ill and died. This happened in almost every region. Does the 2019 general election have anything to do with the increased workload of ad hoc election organizers due to the simultaneous implementation? Type of research uses normative legal research methods. It is called so, because normative research focuses on prescriptive research, using secondary data such as laws and regulations, legal theories, legal principles, and scientific works of legal scholars. The problems that occurred in the 2019 general election can be anticipated by making adequate regulatory modifications in order to create a rational, humane authority, and better election management than the previous period. There needs to be a guarantee of the quality of direct, general, free, secret, honest and fair elections. The implementation of simultaneous elections has provided a heavy workload, long implementation time and very tiring manual vote counting. Abstract

In the midst of political deadlock due to cartel and oligarchic practices, the Constitutional Court then made a breakthrough with the passing of Decision No. 60/PUU-XXII/2024 which changed the nomination threshold formula from a percentage of seats to a range of 6.5% to 10% adjusted to the number of Permanent Voter Lists in an electoral district. The breakthrough of the Constitutional Court made democracy in the regions return to bagkit, someone who used to have difficulty can now appear easily. The purpose of this article is to explain the regulative obstacles to the development of democratic elections and the implications of the Constitutional Court Decision No. 60 for efforts to build democratic elections. This research uses a normative approach. The results of the study found that the expansion of the meaning of elections by the Constitutional Court to include regional elections is something constitutional, because through Decision No. 55/PUU-XVII/2019 the Constitutional Court has laid an important foundation for the design of the model for organizing simultaneous elections. This has implications for the circulation of government in the regions, which previously could not be proposed by regional head candidates to be proposed. Abstract

Constitutional Court Decision No. 60/PUU-XXII/2024 changed the nomination mechanism for regional heads in Indonesia by canceling the nomination threshold provisions previously stipulated in Law No. 10 of 2016. The old provision required a political party or a coalition of political parties to win a minimum of 25% of the accumulated valid votes in the last general election to nominate a regional head pair. This requirement proved to limit the political participation of small parties that do not have seats in the Regional People’s Representative Council as well as independent candidates. With this new ruling, the Constitutional Court determined that the nomination requirement should be adjusted to the percentage of valid votes calculated based on the number of residents registered in the Permanent Voters List in each region, which better reflects political representation. This study aims to analyze the legal implications of the Constitutional Court’s decision No. 60/PUU-XXII/2024 on the political rights of regional communities. Through a legal research method using a statutory approach, conceptual approach and case approach, this research seeks to explain how the decision can expand political participation and improve representation in the regional head election process. In the context of social contract theory, this decision reflects a reinterpretation of the relationship between the state and citizens in terms of political participation. The state, through the Constitutional Court, demonstrates its commitment to protecting the political rights of its citizens by abolishing threshold provisions that are considered exclusionary. Thus, small parties and independent candidates have a greater opportunity to compete fairly, thereby expanding political representation and improving the quality of local democracy. Abstract

Constitutional Court Decision Number 70/PUU-XXII/2024 is the result of a judicial review of Law Number 10/2016 on the Second Amendment to Law Number 1/2015 regulating the minimum age limit for regional head candidates. The regulation is discriminatory because it limits the political participation of younger individuals. This article seeks to critically answer how human rights studies view the age limit in Constitutional Court Decision Number 70/PUU-XXII/2024. The method used in this research is a normative legal research method with an analytical-critical approach and case studies that prioritize human rights aspects. The Constitutional Court explained that although age restrictions can be justified, this policy must be evaluated periodically to ensure its relevance and suitability with the evolving social and political dynamics. The Constitutional Court also emphasized the importance of flexibility in this arrangement, in order to avoid age discrimination that could harm certain groups, especially the potential younger generation. Public policies must be responsive to demographic and social changes, including in terms of political participation. This policy should be aligned with the principles of equality and human rights, and should take into account the ability and integrity of candidates without being hampered by rigid age limits. Abstract

The lack of specific regulations regarding the protection of whistleblowers in Law Number 10 of 2016 and Law Number 7 of 2017, apparently intersects with the issue of mechanisms and procedures for the protection of whistleblowers. The guarantee of protection for whistleblowers in Law No. 31 of 2014 is only on criminal protection. Meanwhile, administrative and ethical violations have not been well accommodated. The focus of related research is to describe the role and responsibility of Election Supervisory Board (Bawaslu) in providing legal protection to the reporting witness during the trial process at Bawaslu. In addition, it is also to find a form of legal protection for the reporting witness during the process at the Bawaslu hearing. Bawaslu plays a role in law enforcement related to general election violations which are administrative, criminal, and code of ethics violations of election organizers. Responsible for handling reports and findings of general election violations by processing and following up in accordance with applicable procedures. Provide recommendations to the authorities to follow up on a violation. Resolving disputes over the electoral process involving election participants, election organizers, or other interested parties. Avoiding the reporting witness from feeling insecure which can also potentially affect public confidence in the integrity of the trial process in Bawaslu. Abstract

The introduction is that illustrates Indonesia as a democracy is facing an exciting new challenge. The democratic party which was originally separated in each region, will now be held simultaneously nationally in 2024. The purpose of this study is first, what are the dynamics of postponing regional head election in 2024 for 271 regions whose terms of office expire in 2022 and 2023 and second, what is the urgency of extending the term of office of the regional head until 2024. The research method used is normative juridical with the approach of legislation and phenomena, theories, concepts and legal principles. The study used is a literature study and analyzed descriptively qualitative with the use of primary data in the form of primary, secondary and tertiary legal materials. related to the extension of the term of office of the regional head until 2024. The results of the analysis obtained on these issues are known that first, the postponement of regional head election from 2022 and 2023 to 2024 will result in a vacancy in the position of regional head in 271 regions. Then, the appointment of acting regional heads who will lead for one to two years to provide uncertainty to democracy in the regions which raises many pros and cons for the policies taken, it is feared that it will harm the principles of regional autonomy. Second, to avoid the filling of acting regional heads in the 271 regions, more effective and democratic steps are needed, so that the acting heads who lead the regions for one to two years are expected not to reap different perceptions in the community. ___ References Books with an author: Amalia, L. Abstract

Corruption is a major challenge, especially in developing countries, which has a significant impact on the economy and politics. In Indonesia, this corruption problem has long occurred with one of the important points being the establishment of the Corruption Eradication Commission, and currently the independence of the Corruption Eradication Commission is actually decreasing. This article draws one formulation of the problem, namely how are the dynamics of the economy and politics in the grip of corruption in Indonesia? Through empirical research methods and theoretical approaches. The results of this analysis indicate that corruption has a very negative impact on the Indonesian economy and politics, damaging the economic structure, exacerbating social inequality, and weakening democracy and public trust. To overcome this, laws such as the Corruption Eradication Law, the State Finance Law, and the Election Law are important in creating a transparent and accountable government. Abstract

Progressive law demands more open-mindedness to the possibility of alternative solutions in solving legal problems. In this case, the application of restorative justice is expected to have a positive impact on justice, not only in the formal legal context, but also in a broader social context. The purpose of this paper is to analyze the changes to criminal law in Law Number 1 of 2023 (later referred to as the National Criminal Law). How the application of restorative justice in the National Criminal Law is viewed from the perspective of progressive law. The method used is descriptive-normative, by collecting normative legal data, such as laws or regulations, to identify and understand its application in practice. The results show that Restorative justice offers a more humanist approach in resolving criminal cases, which focuses not only on punishment, but also on restoring the relationship between the perpetrator, the victim, and the community. Articles in the National Criminal Law indicate the existence of restorative justice in Article 54, Article 132 Paragraph 1 Letter g, Article 82, Articles 76, 77, and 80 (Reason for Termination of Prosecution), 132 Paragraph 1 Letters d and e. Restorative Justice in the National Criminal Law with a progressive legal approach provides opportunities for non-criminal settlements (diversion), recognition of victims, restorative justice, settlement with a substantive justice approach, alternative criminal sanctions. Through the application of restorative justice, the Indonesian criminal justice system has the potential to focus more on recovery and rehabilitation, reduce the burden on the courts, and support the social reintegration of offenders, which will create a more harmonious and just society. ___ References Books with an author: Dahl, R. Abstract

There are widespread conflicts over water resources management in Indonesia, such as in the case of Sumur Tujuh Cikajayaan which involved the community, government and private sector in fighting over water management rights. This research uses a normative juridical method with a conceptual, theoretical and statutory approach related to water resources. Regulations that prioritize economic interests often ignore the rights of local communities and developed local wisdom, creating disharmony between customary law and positive law. The research results show that weak community involvement and minimal integration of customary law cause ecological injustice in water management. Therefore, strategies are needed to strengthen the role of communities and harmonize customary law and positive law to realize fair and sustainable water management. ___ Referensi Books with an author: Marzuki, P. Abstract

The appointment of journalists, especially in the field of legal coverage, is extremely urgent and has a wide- ranging impact on conveying information containing truth values, in order to realize a free and responsible press. The manifestation of this responsibility, however, is not accompanied by a system for the appointment of journalists, leading to the dissemination of information that triggers inaccuracies in news, resulting in legal claims, both criminal and civil. These claims continue to occur, and the number of journalists entangled in legal issues also continues to increase. All of this is caused by laxity, both in Law Number 40 of 1999 and in the Press Council Regulations, which do not regulate the standards for the appointment of the journalistic profession. This laxity has triggered the idea of creating a system for the appointment of legal journalists based on the affirmation of a profession that meets professional standards through an ideal model, the regulation of which lies within a legal framework. ___ References Books with an author: Gant, S.
