Abstract

The designation of a warning as the principal punishment in Article 72 of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System raises normative issues that conflict with the purpose of sentencing and the principle of the best interests of the child. This study employs a normative juridical method with a comparative approach, examining the procedure for issuing warning sanctions in Queensland, Australia. The analysis reveals that issuing warnings through a formal judicial process has the potential to cause psychological trauma and social stigma for children, thereby hindering their social reintegration. Consequently, there is a need to reconstruct the warning mechanism to be more oriented toward the best interests and future of children, while also strengthening legal protection for minors within Indonesia's criminal justice system.

Abstract

Detention of children in the context of self-defense (noodweer) remains unregulated explicitly in Indonesia's juvenile criminal justice system. Although Article 49 of the Indonesian Penal Code (KUHP) recognizes self-defense as a justifying or excusing ground, children may still be subjected to detention under general procedural provisions in the Criminal Procedure Code (KUHAP). This creates legal uncertainty and increases the risk of disproportionate treatment. This study employs a normative juridical method with a comparative approach, analyzing the German legal system, which limits juvenile detention and emphasizes psychological, educational, and proportionality considerations. The findings show an urgent need for Indonesia to formulate specific legal norms on the suspension of detention for children who commit acts of self-defense. Such reform is crucial to uphold children's rights, prevent criminalization, and support restorative justice principles and humane treatment in the juvenile justice process.

Abstract

The Hajj and Umrah pilgrimages are spiritual obligations for Muslims that require not only physical and financial readiness, but also compliance with legal regulations, including international health aspects. The COVID-19 pandemic has led to the implementation of strict regulations, including vaccination requirements and quarantine documents for pilgrims. The issuance of health quarantine documents is not immune to criminal acts involving the forgery of such documents to facilitate the departure process, whether physically or electronically. The forgery of quarantine documents has serious implications under Indonesian criminal law, particularly regarding public health protection. This paper aims to analyze the forms of criminal liability for perpetrators of quarantine document forgery in the context of Hajj and Umrah travel, as well as to examine future policies on criminal sanctions. The research method used is normative legal analysis with a legislative and conceptual approach, analyzed through a literature review of primary, secondary, and tertiary legal sources. The research findings indicate that the forgery of quarantine documents constitutes a criminal offense regulated under Article 263 of the Criminal Code, Article 391 of the New Criminal Code, and Article 444 of the Health Law. Criminal punishment for perpetrators is not only repressive but also serves a preventive function to safeguard the collective safety of the international community. Criminal liability may be imposed on the principal perpetrator and accomplices, with an emphasis on the element of intent as a violation of the fundamental values of human rights in the field of health

Abstract

This study aims to analyze the role of farmer corporate governance in agroforestry activities and its implications for strengthening food security in Indonesia. Data collection techniques included literature studies from books, national journals, articles, and previous theses related to this research. The results indicate a synergistic relationship between farmer corporate governance and agroforestry success. A strong relationship is believed to enhance cooperation, strengthen interactions, reduce transaction costs, and guarantee a stable market. Corporate governance fosters organized management, including the development of partnerships between farmers and downstream industries, thereby encouraging better market access and strengthening the bargaining position of agroforestry farmers. Well-managed farmer corporations typically include technical and managerial training for farmers, aimed at fostering the adoption of appropriate technology and effective business management, supporting agroforestry farmer independence in production, financing, and marketing. This, in turn, strengthens agroforestry business resilience and long-term prospects for success, both directly and indirectly.

Abstract

This study examines the interrogative lawsuit in Jordanian law through a descriptive-analytical approach, focusing on its legal nature and defining it as a preventive judicial action aimed at clarifying the plaintiff’s legal position without claiming a right or enforcing an obligation. The lawsuit relies on a potential interest to avoid future legal disputes. The research highlights the absence of explicit legislative provisions regulating this lawsuit in the Jordanian Civil Procedures Law, which hinders its acceptance and effectiveness. Judicial practices vary between acceptance, rejection, and caution regarding this lawsuit. The study calls for legislative reform to explicitly regulate the interrogative lawsuit with clear conditions for acceptance to ensure preventive justice and legal stability. It also recommends enhancing judicial and doctrinal efforts to activate the role of this lawsuit in protecting rights before disputes arise.

Abstract

Nursing services delivered to patients are reflected in the work performance of nurses. Achieving optimal work performance remains a challenge, as several factors influence it, including leadership behavior and job satisfaction. Addressing these challenges requires appropriate interventions, particularly in strengthening leadership behavior and enhancing job satisfaction to improve nurses’ performance. The aim of this study was to examine the influence of leadership behavior and job satisfaction on the work performance of inpatient nurses. This study employed a non-experimental, cross-sectional analytic design. Logistic regression analysis was conducted using SPSS version 24.0 to assess the influence of the independent variables (leadership behavior and job satisfaction) on the dependent variable (work performance). Data were collected through questionnaires administered to 39 inpatient nurses at Harapan Mulia Cibarusah Cikarang Hospital. The findings revealed a significant effect of leadership behavior on work performance with a p-value of 0.009 (p < 0.05) and an Odds Ratio (OR) of 12.818, indicating that nurses experiencing poor leadership behavior were 12.818 times more likely to have low work performance compared to those under effective leadership. Job satisfaction also had a significant effect on work performance, with a p-value of 0.048 (p < 0.05) and an OR of 7.051, meaning that nurses with low job satisfaction were 7.051 times more likely to have poor work performance compared to those who were satisfied. The R-square value obtained was 0.607, signifying that leadership behavior and job satisfaction collectively explained 60.7% of the variance in work performance, while the remaining 39.3% was influenced by other unexamined factors. Among the two variables studied, leadership behavior exerted the strongest influence on nurses’ work performance, as indicated by its higher OR compared to job satisfaction. It is recommended that hospital management strengthen leadership practices among ward heads and consistently attend to the job satisfaction of inpatient nurses, thereby fostering constructive improvements in work performance.
