Abstract

Children who are in conflict with the law even though they are suspected of havingcommitted a crime, are still entitled to protection by the state. However, in the current digitalera, there are violations of the confidentiality of children’s identities that are in conflict with thelaw. The problems examined in this study regarding the protection of the personal informationof children in conflict with the law in the digital space and the legal consequences if there isdissemination of the personal information of children in conflict with the law in the digital space.In this study using normative legal research methods with statutory approaches,conceptual approaches and case approaches, which then the results found in this study areexplained descriptively.The results of this study are legal protection for children in conflict with the law based onseveral principles, one of the principles is the principle of the best interests of the child which ismanifested in the form of avoiding publication of the child’s identity. Furthermore, the Law on theJuvenile Criminal Justice System stipulates that the identity of a child in conflict with the law mustbe kept confidential in reporting in print or electronic media. Based on this, the disseminationof personal information of children in conflict with the law in digital spaces such as on socialmedia is prohibited by laws and regulations as a form of legal protection for children in conflictwith the law. The legal consequences for someone who is proven to have disseminated personalinformation of a child in conflict with the law in the digital space are criminal sanctions andfines, which can be imposed on individuals and corporations as legal subjects recognized in theJuvenile Criminal Justice System Act

Abstract

estorative justice is a new approach in solving criminal cases. This approach emphasizes theinvolvement of the parties, whether victims, perpetrators, or related parties, with processes and goals thatseek recovery, and not just retaliation. The restorative justice (RJ) approach in practice in Indonesia wasfirst recognized within the scope of juvenile justice, but developments in the police, prosecutors also applythe RJ approach in the settlement of criminal acts that are resolved outside the court. The fact is that thearrangements in each of these institutions have different stages and their completion and supervision onlyinvolve one administering agency. Even though referring to the concept of an integrated criminal justicesystem that law enforcement agencies must have integration and synergy. So it becomes important whenthere is a settlement of a case using a restorative justice approach that is carried out outside the court toask for a court order to guarantee legal certainty. In the discussion it was found that the mechanism forimplementing the RJ has not yet been regulated in the form of a comprehensive regulation in the form of alaw so there is concern that it will have a level of disparity in its implementation. The results of this studyindicate that the settlement of criminal acts outside the court is regulated in the form of laws as in thejuvenile justice system and agreements for settlement of criminal acts must be determined in the form ofcourt orders.

Abstract

There is negligence of the pharmaceutical industry and BPOM as drug producers and drugsupervisors. Thus causing Atypical Kidney Injury (AKI) in children. Therefore, these parties must beaccountable for their mistakes according to Indonesian Health Law. The formulation of the problem in thisstudy is legal consequences in cases of solvent drug contamination and how is the criminal responsibility ofthe pharmaceutical industry and BPOM related to liquid drug pollution according to health law in Indonesia?This research uses normative legal methods with a statutory approach that is associated with the legalissuesbeing discussed. The legal materials used are primary and secondary legal materials.The results of this study are: first, the criminal responsibility imposed on the pharmaceutical industryis regulated in Article 196 and Article 201 paragraphs (2) and (3) of Law Number 36 of 2009 concerningHealth, then the second for the criminal responsibility of BPOM is regulated in Article 359 and Article 360paragraph (1) of the Criminal Code (KUHP).

Abstract

Debitur adalah sebutan bagi perusahaan atau individu yang berhutang uang kepadalembaga lain. Jika utang dalam bentuk pinjaman dari lembaga keuangan, maka debitur disebutsebagai peminjam. Lain halnya jika utang dalam bentuk sekuritas, maka debitur disebut sebagaipenerbit. Secara hukum, seseorang yang dengan sukarela menyatakan kebangkrutan juga dianggapsebagai debitur. Secara umum, debitur adalah pihak yang berhutang kepada orang lain ataupihak lain. Istilah lain dari debitur adalah peminjam. Mereka biasanya akan menerima sesuatudari kreditur atau pihak yang meminjamkan. Akan ada akad yang mana seorang peminjam harusberjanji untuk membayar atau mengganti sesuatu di masa yang akan datang sesuai ketentuan.Pinjaman yang nantinya bisa peminjam terima kadang memerlukan sebuah jaminan atau agunanuntuk bisa pihak kreditur terima. Jaminan ini akan menjadi penghubung dan bukti ikatankepercayaan dari kedua belah pihak. Jika nanti seorang debitur gagal membayar sesuai tenggatwaktu yang sudah peminjam sepakati bersama kreditur, maka jaminan itu bisa pindah tanganatau tersita oleh pihak yang memberikan pinjaman. Beda lagi ceritanya kalau seorang peminjambisa mengembalikan pinjaman ke kreditur sesuai dengan perjanjian, maka aset yang jadi jaminanakan kembali padanya. Jaminannya bisa dalam bentuk benda bergerak atau aset berharga sepertisertifikat tanah sampai deposito di bank. Dalam hal ini orang dikatakan sebagai debitur adalahorang atau perorangan yaitu dalam hal ini baik laki-laki maupun perempuan dapat dinyatakanpailit oleh pengadilan jika tidak mampu membayar hutang kepada satu atau lebih kreditur.Perserikatan-perserikatan atau perkumpulan-perkumpulan yang bukan badan hukum sepertimaatschap, firma dan perkumpulan komanditer, perseroan atau perkumpulan-perkumpulan yangberbadan hukum seperti Perseroan Terbatas (PT), Koperasi dan Yayasan

Abstract

Regional property in the form of land must be certified in the name of the localgovernment, as in the registration of land rights for local governments in the form of usage rightsor management rights. After the issuance of Government Regulation Number 18 of 2021, landwith the status of usage rights cannot be transferred, especially usage rights for period of time aslong as they are used. The legal ratio for prohibition on the transfer of Regional Property becausethe limitations attached to usage rights owned by the local government are Public Use Rights withthe implication is only right to use not rights of disposal. So it is suggested for the management ofRegional Property by Traditional Villages it would be possible to use the mechanism for utilizationof Regional Property in accordance to the Laws and Regulations.

Abstract

Along with the rapid development in the Ubud area, it must also be balanced with the developmentof accessibility that can support tourist comfort. Efforts made by the government such as providing centralparking and taking strict action against violators who still use the road as a parking lot in the Ubud tourismarea have also not been able to overcome this problem. The problems discussed in this study, namely: howis the gianyar district regulation number 57 of 2018 regarding management and engineering of traffic androad transportation and parking in the ubud tourism area and what are the inhibiting factors and effortsmade in the implementation of the gianyar district regulation number 57 of 2018 regarding managementand engineering of traffic and road transportation as well as parking in the tourism area of ubud. Theresearch used in this study is based on empirical juridical research which is also known as field research.The results of the research are that the implementation of the Gianyar Regional Regulation Number 57 of2018 has not gone well due to the many parking problems and the lack of parking facilities in the Ubudarea. Factors that influence the implementation of the Perbup are internal and external factors as well asthe efforts made by dividing the personnel of the Transportation Agency in Gianyar at several points in theUbud area. The suggestion submitted was the need for firmness from the Perbup implementing agency andvillage officials in the Ubud tourism area to help regulate parking.

Abstract

Based on Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA) inarticle 1 paragraph 2 it is stated that a child in conflict with the law is a child who is 12 (twelve) yearsold, but not yet 18 (eighteen) years old who is undergoing treatment. his criminal period at The SpecialChild Development Institution. The issue of violations committed by children in conflict with the law at TheSpecial Child Development Institution. is nothing new, while the types of disciplinary violations can bedivided into 7 (seven) categories, namely: Legal Discipline, Moral Discipline, Environmental Discipline,Discipline of Goods and Equipment, Discipline of Ethics and Courtesy of Association, Discipline of MoneyCirculation and Discipline of Service. The implementation of guidance for Children in Conflict with theLaw who violates discipline is aimed at building positive behavior for children, protecting the safety of children, officers and the community. The coaching atmosphere that is carried out is directed at a model that encourages positive behavior, and does not only focus on the application of sanctions asa consequenceof negative behavior. The main factors found as obstacles in the implementation of guidance for Childrenin Conflict with the Law at The Special Child Development Institution Class II Karangasem are limitedfacilities & infrastructure, as well as efforts that have been made to minimize these obstacles, namelysubmitting a budget for the procurement of facilities &infrastructure and collaborating with relevantagencies.

Abstract

In terms of needing land, from the legal provisions, not many people know how to obtain it andwhat is the evidence. If the land in question has the status of property rights, it will be easy to know thatthe land in question can be controlled and used indefinitely. But for someone who is going to buy land,knowledge of these things. The land mafia can be outside or inside. The type of research used is empiricallegal research. The nature of the research used is descriptive. The data collection techniques used are fieldstudy techniques and library study techniques. The data processing technique uses a qualitative descriptivetechnique. From the results of data collection and analysis, the conclusions are explained as follows:Obstacles in the implementation of registration of property rights to land at the Tabanan Regency LandOffice are caused by Government policy factors regarding tax obligations in land registration activities,Factors Lack of understanding the function and use of certificates, Assumption factors Communitiesneed expensive fees to carry out land registration, the assumption is that it takes a long time in obtainingcertificates, the assumption is that the basis for land rights owned is very strong, the publication system isnegative. Countermeasures such as: counseling/socialization on the benefits of Land Registration, carryingout the implementation of land registration with PRONA and PRODA in order to raise public awarenessand the weak economic group can obtain guarantees of legal certainty of land rights. Village regulations are defined as statutory regulations which regulated by the Village Headafter being discussed and agreed with the Village Consultative Body. Abstract

Pertumbuhan ekonomi yang pesat serta kompleks melahirkan berbagai bentuk kerjasama bisnis. Kerjasama bisnis yang terjadi sangat beraneka ragam tergantung pada bisnis apa yang sedang dijalankan. Saat ini kontrak bisnis bidang penanaman modal asing banyak yang dibuat oleh sub divisi negara dan perusahaan negara disatu pihak dengan perusahaan swasta asing dilain pihak. Dengan diratifikasinya Konvensi Washington 1965 oleh Undang-undang No. 5 tahun 1968 sebenarnya tidak ada alasan bagi investor untuk meminta jaminan yang lebih dari negara penerima modal (host country), karena tindakan pemerintah (Indonesia) terhadap para investor tidak perlu dikhawatirkan lagi. Tarik-menarik soal perluasan akses investasi lintas negara menjadi isu yang tidak pernah habis untuk dibicarakan. Konvensi Washington 1965 telah memberikan peran yang sangat besar bagi negara-negara berkembang, khususnya Indonesia dalam meningkatkan arus penanaman modal. Sedangkan arbitrase ICSID dibentuk dan dirancang sebagai penyeimbang keinginan-keinginan antara negara penerima modal dengan investor asing juga yang menyediakan mekanisme penyelesaian sengketa hukum yang efektif dibidang penanaman modal asing.Salah satu sengketa penanaman modal asing antara pemerintah dengan penanam modal asing diluar sektor minerba yang pada akhirnya diselesaikan melalui jalur arbitrase internasional, dalam hal ini ICSID (Interntional Centre for Settlement of Investment Disputes), adalah sengketa antara Amco Asia Corporation vs pemerintah Indonesia yang diselesaikan melalui arbitrase internasional, yaitu arbitrase ICSID.
