Abstract

Occupational Safety and Health (OSH) is a fundamental right of every worker that must be guaranteed through an adequate legal protection system. In the midst of the development of industrial area of Batam City as a national strategic area, the complexity of work relationship and high level of work risk become a challenge in the implementation of OHS protection. This research is motivated by the in-creasing number of work accidents in the industrial area of Batam City, which shows a gap between legal arrangements and implementation of labor protection. The purpose of this study is to analyze the ap-plicable legal arrangements related to OHS protection, assess the implementation of legal protection of workers in the field, and identify obstacles and strategic efforts that need to be made in the context of legal protection. The methods used in this research are normative juridical and empirical juridical ap-proaches, with data collection techniques through literature studies and interviews with relevant parties, including the Kepri Provincial Manpower Office, industrial companies, K3 training institutions, and K3 practitioners. The analysis was conducted by referring to the statute approach and socio-legal ap-proach, based on John Rawls' theory of justice, Lawrence M. Friedman's legal system theory, and Sudikno Mertokusumo's theory of legal certainty. The result shows that although the normative regu-lation on OSH protection is quite complete, its implementation in Batam City still faces various ob-stacles, such as lack of supervision, low legal awareness, and weak deterrent effect from legal sanctions. Comprehensive reform of OSH regulation, capacity building of labor inspectors, and synergy between government, employers, and workers in building OSH conscious culture are needed.

Abstract

Legal matters concerning the status of children born out of wedlock remain intricate and necessitate specialized treatment within the national legal framework, particularly with the safeguarding of children's civil rights. A legal measure to secure recognition for children born out of wedlock involves applying to the establishment of parentage in the Religious Court. This study seeks to examine the legal foundations and procedures for applications concerning the status of out-of-wedlock children presented to the Batam Religious Court. It aims to assess the implementation and legal ramifications of the court's rulings on the legal status of these children and their implications for the children's civil rights, while also formulating legal solutions to enhance protection for children born outside of wedlock. This study employs normative juridical and empirical juridical methodologies by analyzing laws and regulations, specifically Constitutional Court Decision No. 46/PUU-VIII/2010, alongside five rulings on child origin cases from the Batam Religious Court as primary data sources. The theoretical framework employed includes Justice Theory as the overarching theory, Legal System Theory as the intermediary theory, and Maslahah Mursalah Theory as the practical application theory. The research findings indicate that the Batam Religious Court typically dismisses applications about a child's lineage in the absence of acceptable marital evidence under Islamic law, despite the presence of biological evidence such as DNA test results. Consequently, the child fails to establish a civil relationship with their father and forfeits certain essential legal rights. Consequently, the alignment of Islamic law, national law, and population administration law is essential, along with the formulation of a national Standard Operating Procedure that prioritizes child protection and non-discrimination principles.

Abstract

This study aims to analyze the effect of workload, compensation, and career development on job satisfaction and performance of employees at the Public Works and Public Housing Agency of the Anambas Islands Regency. The research method used a quantitative approach with saturated sampling techniques on 163 employees consisting of 122 men (74.8%) and 41 women (25.2%). Data were collected through a questionnaire using a Likert scale and analyzed using Structural Equation Modeling (SEM) with a Partial Least Square (PLS) approach. The results showed that of the 10 hypotheses tested, 7 were accepted and 3 were rejected. Workload had a significant positive effect on job satisfaction (β=0.377; p=0.018), compensation had a significant positive effect on job satisfaction (β=0.311; p=0.022), but career development did not have a significant effect on job satisfaction (β=0.301; p=0.084). Career development has a significant positive effect on employee performance (β=0.305; p=0.000), while workload and compensation do not have a direct effect on employee performance. Job satisfaction has a very significant effect on employee performance with the highest coefficient (β=0.778; p=0.000). Mediation analysis shows that workload (β=0.293; p=0.011) and compensation (β=0.242; p=0.025) affect employee performance through job satisfaction, but career development does not mediate through job satisfaction. This study confirms that job satisfaction is the main predictor of employee performance, so organizations need to prioritize strategies to increase job satisfaction through the optimization of challenging workloads, improvements to the compensation system, and the revitalization of career development programs to optimize employee performance in public services in the fields of infrastructure and spatial planning.

Abstract

This study analyzes the influence of government roles, leadership, and destination image on the competitive advantage of Kutuh Tourism Village, Badung Regency. The research employed a quantitative approach, with data collected through questionnaires administered to key stakeholders, and analyzed using Structural Equation Modeling (SEM) with SmartPLS 3.0. The findings indicate that the government role has a positive and significant effect on competitive advantage (t-statistic = 2.71; original sample = 0.800), suggesting that regulatory support, infrastructure development, and promotion enhance destination competitiveness. Destination image also shows a positive and significant effect (t-statistic = 2.22; original sample = 0.805), confirming that positive tourist perceptions strengthen competitive advantage. Conversely, leadership has no significant effect (t-statistic = 0.71), indicating the need to improve local leadership capacity. The R-Square value of 0.741 indicates that the three variables collectively explain 74.1% of the variance in competitive advantage, while the Q-Square value of 0.711 demonstrates high predictive relevance. These findings provide practical implications for destination development, emphasizing that synergy between government support and destination image enhancement is a key driver for sustainable competitiveness, with leadership remaining a strategic potential that should be optimized.

Abstract

The rapid development of information technology has transformed business transaction patterns in Indonesia through e-commerce, fintech, and digital banking. While providing efficiency and accessibility, this digitalization poses significant legal challenges, particularly regarding the regulation of electronic contracts and consumer protection. Electronic contracts are recognized as valid under the ITE Law and the Civil Code, but practices for proving party identity, the validity of digital signatures, and return and refund mechanisms still create legal uncertainty. For consumers, default in e-commerce transactions, information asymmetry, and low legal literacy are key obstacles, while oversight of digital business actors and law enforcement are suboptimal. Regulatory gaps, including those concerning the protection of personal data and cross-border transactions, further reinforce the need for legal improvements. This study uses a normative juridical method with a statutory and conceptual approach, examining the ITE Law, the Consumer Protection Law, the Government Regulation on Electronic Transactions (PPPSTE), and relevant legal literature to analyze these dynamics and challenges. The results of the study indicate the need to update legal norms, strengthen oversight, and improve public digital and legal literacy to create a fair, safe, trustworthy, and sustainable digital business ecosystem in Indonesia.

Abstract

Ragunan Wildlife Park (TMR) is one of the largest zoos in Indonesia which is a public body managed by the DKI Jakarta local government facing challenges in managing staff occupational safety risks, especially those who interact directly with dangerous animals. Some of the accidents that occurred showed that the existing safety procedures were not fully effective. This study aims to evaluate the implementation of ISO 31000-based occupational safety risk management in TMR and provide recommendations for improvement of existing systems. This study uses a qualitative approach with a case study design, involving interviews with staff, direct observation, and document analysis related to risk management implemented in TMR. The data obtained were analyzed using the ISO 31000 framework to assess the effectiveness of risk management and identify areas that need to be improved in occupational safety procedures. The results show that TMR has identified a wide range of safety risks, such as wild animal attacks, work equipment accidents, and fire risks. The implementation of ISO 31000 in risk management helps improve safety procedures by improving staff training, the use of appropriate personal protective equipment (PPE), and regular risk evaluation. However, there are still challenges in terms of communication between staff, supervision, and readiness to face emergency situations. The implications of this study show that the application of ISO 31000 can be a more systematic basis in managing safety risks in TMR. This research makes an important contribution to improving staff occupational safety and provides recommendations for more effective risk management, which in turn supports the smooth operation and sustainability of conservation programs at TMR.
