Abstract

Pembuktian dalam hukum acara ekonomi syariah tidak selamanya menganut asas Actori Incumbit Probatio. Terdapat lex specialist terhadap ketentuan ini berdasarkan Fatwa DSN Nomor 105/DSN-MUI/X/2016 tentang penjaminan pengembalian modal pembiayaan mudharabah, musyarakah dan wakalah bil istitsmar. Penelitian ini bertujuan untuk mengeksplore norma pembuktian terbalik dalam fatwa DSN tersebut. Metode yang digunakan bersifat normatif law dengan pendekatan analisis substantif. Hasil penelitian menunjukkan konstruksi hukum pembuktian terbalik yang dibangun dalam fatwa DSN Nomor 105/DSN-MUI/X/2016 berawal dari prinsip tanggungjawab mutlak (strict liability) yang lahir dari perjanjian antara pemilik dan pengelola modal. Penerapan hukum pembuktian terbalik bertujuan memberikan perlindungan hukum kepada pemilik modal (Sohibul Mal) dan menjaga sistem keuangan dari tindak kejahatan perbankan dan perbuatan melawan hukum pengelola modal (Mudharib).

Abstract

The problem with the norms of Article 8 of Law Number 10 of 1998 mentioned above is that if the debtor defaults, the bank basically can and take the guarantee provided by the creditor as repayment of the debt. But whether the implementation can run that easily, because the debtor himself also has rights that are respected as well, and how the execution process is so that each party, both debtors and creditors in this case the bank is not harmed by its interests, especially regarding guarantees in the form of land encumbered with Dependent Rights. The research method used is qualitative. The results showed that if the debtor defaults, the creditor (bank) basically can and take the guarantee provided by the debtor as repayment of the debt. Right of Liability is a security right for debt repayment, the object of the right of liability is the right to land in accordance with the Basic Agrarian Law, the right of liability can be imposed on the right to land, but it can also be charged along with other objects that are an integral part of the land, with the debtor's default then the creditor reasons to request that the right of liability be auctioned as a step of execution.

Abstract

The aim of this research is to determine and analyze the influence of brand equity, product quality and price on purchasing decisions both partially and simultaneously. The approach used in this research is an associative approach. The population in this study were all people who purchased Cardinal Formal products at PT. Matahari Department Store Medan Mall . The sample in this study using the Lemeslow formula was 96 people who purchased Cardinal Formal products at PT. Matahari Department Store Medan Mall . Data collection techniques in this research used interview techniques, documentation studies, observations and questionnaires. The data analysis technique in this research uses Multiple Linear Regression Analysis Test, Hypothesis Test (t Test and F Test), and Coefficient of Determination. Data processing in this research used the SPSS ( Statistical Package for the Social Sciences ) software program version 24.00. The results of this research prove that partially and simultaneously brand equity, product quality and price have a significant effect on purchasing decisions for Cardinal Formal products at PT. Matahari Department Store Medan Mall

Abstract

This study aims to determine whether the leadership style and organizational culture influence employee motivation at Sampali Asri PT Kurnia Medan. This research using descriptive data analysis, multiple regression analysis with t-test (test partial), F test (simultaneous test) and test the coefficient of determination (R2). This research test equipment using multiple linear regression model. The conclusion that can be drawn from the test results, the stimulatory and partial leadership style and organizational culture influence employee motivation. The implications of the results of this research are able to explain that leadership and organizational culture are closely related to motivation, because the success of a leader in moving other people to achieve the goals that have been set is very dependent on authority, and also the leader in creating motivation within each person. Subordinate.

Abstract

The benefits of therapy in overcoming spiritual problems experienced by Muslims in the millennial era is a study that is said to be going viral. The occurrence of spiritual problems stems from the loss of Godly values caused by Muslims themselves, who are always moving further and further away from the center of existence. For this reason, there is no better alternative in responding to the spiritual problem that has given rise to various spiritual illnesses today, except that millennial humans must return to the center of existence. The basic assumption about humans consisting of physical and spiritual aspects, material and spiritual, is a complete dimension that can be an alternative for millennial humans to overcome spiritual illnesses. The two actually go hand in hand, complementing each other. Through the spiritual dimension, humans are required to return to the center of existence through iktikaf in the mosque or also looking for a teacher whose spirit reaches the Prophet, so that in this iktikaf we get guidance that can cleanse the soul which, if done with sincerity, the heart is capable of musyahadah (witnessing) and ma'rifah (knowing everything that is not visible. From the external side, knowledge of Sufism is part of self-enlightenment which must be done with effort, serious effort towards the spiritual aspect.

Abstract

Parents are the first people who play a very big role in building a child's life. Parents are the initial social environment known to the child, the figures who determine the quality of a child's life, and the figures closest to him, both physically and psychologically. Therefore, parents must pay more attention to the parenting style given to children to shape character from an early age, so that after the child grows up, he will grow into a human being with the character that is expected. The aim of this research is to find out parenting patterns in the formation of Islamic character in early childhood through independent learning activities at Ra Al-Ikhlas Konggo, Deli Serdang Regency. Meanwhile, the benefit of this research is as a contribution of thought to help parents solve problems related to authoritarian parenting patterns in shaping the character of early childhood. The method in this research is descriptive qualitative. The results of this research are that parents' parenting patterns have formed the character of early childhood, and the parenting pattern applied is a democratic parenting pattern, because a democratic parenting style pays attention to and respects children's freedom. Factors that influence the development of children's Islamic character formation include internal and external factors.

Abstract

Penelitian ini berawal dari Ekonomi digital yang saat ini sedang berkembang pesat di seluruh dunia, termasuk Indonesia, terbukti dengan meningkatnya jumlah pengguna internet. Di era revolusioner kita saat ini, ekonomi digital merupakan proyeksi talenta baru yang dapat menginspirasi daya saing. Ada banyak tantangan dalam menghadapi transformasi ekonomi digital, seperti regulasi yang tidak jelas, masalah perpajakan, persaingan yang tidak sehat, dan tidak ratanya digitalisasi. Jika tantangan tersebut di tinjau dari pendidikan dan keterampilan maka bisa diuraikan menjadi kesenjangan keterampilan, adanya perubahan dalam kebutuhan tenaga kerja, dan rendahnya literasi digital. Tentunya hal-hal tersebut terjadi karna adanya kekurangan dari infrastruktur teknologi, akses internet yang terbatas dam rendahnya kualitas akses internet, namun dari pada itu ini semua adalah proses yang berkelanjutan. Penelitian ini merupakan studi pustaka dan merupakan hasil pemikiran peneliti. Jenis data menggunakan data sekunder dengan pendekatan kualitatif.  Program-program pendidikan digital dalam upaya untuk meningkatkan akses internet di daerah terpencil harus didorong melalui kolaborasi antara platform e-commerce, s-commerce, dan pemerintah. Ini menjadi langkah konkret untuk menjaga perkembangan ekonomi digital yang berkelanjutan.

Abstract

The main objective of this research is to examine the impact of Relationship Marketing on customer loyalty, with customer happiness as a mediating factor, in the context of PT. Multipower Teknologi Nusantara is a company operating in the technology sector in Indonesia. Both directly and indirectly. This research uses quantitative methodology and statistical analysis, namely the use of partial least squares structural equation models (PLS-SEM) to carry out route analysis, including latent variables. Research findings show that Relationship Marketing has a statistically significant and beneficial impact on customer loyalty in the PT industry. Multipower Teknologi Nusantara The impact of Relationship Marketing on PT Multidaya customer satisfaction Teknologi Nusantara is profitable and statistically significant. The impact of customer satisfaction on customer loyalty among PT Multidaya customers Teknologi Nusantara is positive and strong. There is no visible mediating or moderating effect of customer satisfaction on the relationship between Relationship Marketing and customer loyalty. The resulting corrected R-square value for the customer satisfaction variable is 0.375. This means that Relationship Marketing accounts for 52.5% of the variation in client loyalty. Therefore, the model is categorized as moderate.

Abstract

The purpose of this study is to analyze the role of zakat organizations in LazisMu and LazisNU in empowering mustahik. This research focuses on the two main zakat organizations in Indonesia, LazisMu and LazisNU, which come from Muhammadiyah and Nahdlatul Ulama. The role of LazisMu and LazisNU in managing zakat funds, distributing to mustahik, and implementing empowerment programs. This research uses a qualitative approach by using literature study as the main method. The results show that transparency and accountability in zakat management are essential to maintaining public trust. Zakat is not only responsible for managing and distributing funds, but also for bringing about social and economic change. There is evidence that LazisMu and LazisNU are actively implementing Mustahik empowerment programs. These programs include business capital, skills training, educational support, and health support. More than that, this research also found some problems such as transparency, accountability, and sustainability of the programs, although they are successful in various aspects. Therefore, this research provides a basis for exploring how zakat organizations can overcome these problems to achieve the goal of Mustahik empowerment. This research is expected to provide useful information for related parties, academics and practitioners in an effort to improve the role of zakat management organizations in helping disadvantaged people

Abstract

The Purpose of the Research: Describing and Analyzing Efforts in Cultivating Noble Morals Among Students of Private Islamic Senior High School Tarbiah Islamiyah in Hamparan Perak Subdistrict, Deli Serdang Regency. The Process of Cultivating Moral Values at Madrasah Aliyah Tarbiyah Islamiyah Hamparan Perak: Methods, Supporting Factors, and Challenges. Qualitative Research on Moral Values Cultivation at Madrasah Aliyah Tarbiyah Islamiyah Hamparan Perak. The research results indicate that the implementation of planting moral values at Madrasah Aliyah Tarbiyah Islamiyah Hamparan Perak has been carried out well as expected, reflected in the daily behavior of students, including manners in communicating with teachers, friends, and the surrounding community. Supporting factors include cooperation between the madrasah and the dormitory, as well as collaboration with subject teachers and class advisors. Meanwhile, inhibiting factors include lack of support from families and the environment as well as peer influence among students.
