Abstract

Surat ijo awalnya hanya dibangun untuk karyawan pemerintah kota surabaya saja. Karena lahan-lahan surat ijo banyaknya dari tanah peninggalan pada masa penjajahan hindia belanda. Kepemilikan yang tidak jelas disuatu tanah yang terindikasi surat ijo maka akan diambil oleh pemerintah kota surabaya. Pemerintah kota surabaya melalu dinas pertanahan akan menyatakan bahwa tanah itu sebagai tanah hpl (hak pengelolaan lahan). Tanah maupun lahan yang berstatus hpl membuat ini sangat unik untuk dibahas, karena di dalam undang-undang pokok agraria (uupa) tidak mengenal tanah yang berstatus hpl maupun sertifikat ijo. Undang-undang pokok agraria (uupa) hanya mengenal adanya surat hak milik, hak guna bangunan, hak guna usaha. Disini akan lebih dibahas dari kacamata tata usaha negara, dan menjawab mengapa surat ijo hanya ada di kota surabaya saja.

Abstract

The concept of Dar al-Harb in classical Islamic jurisprudence represents a normative geopolitical construct rooted in a specific historical context, where the world was divided into the realm of Islam (Dar al-Islam) and the realm of hostility (Dar al-Harb). This classification significantly influenced the legitimacy of warfare and international relations in Islamic legal thought. However, modern global political realities have prompted a critical reassessment of this concept, particularly in relation to the contemporary framework of international law, which emphasizes sovereignty, civilian protection, and the prohibition of aggression. This study aims to explore the classical and contemporary interpretations of Dar al-Harb and to examine the normative intersections and conceptual divergences with the principle of state responsibility under international law. This research adopts a normative juridical approach, employing both comparative legal and conceptual methods. The data sources include secondary legal materials such as classical Islamic texts by scholars like Al-Shaybani, Al-Mawardi, and Ibn Taymiyyah, as well as international legal instruments including the UN Charter, the 1949 Geneva Conventions, and the 1998 Rome Statute. Data were analyzed qualitatively using deductive and inductive reasoning to identify doctrinal differences and potential areas for integration between the two legal systems. The findings reveal that while there are fundamental differences particularly regarding the legal basis of hostility and the authority to legitimize war there are also normative convergences, such as the protection of noncombatants and respect for human dignity. The ethical normative reinterpretation of Dar al-Harb illustrates the potential for Islamic legal values to contribute to the development of a more inclusive and just international humanitarian legal framework

Abstract

Tujuan dari penelitian ini adalah untuk mengamati bagaimana kebijakan pemerintah Kabupaten Pesisir Barat terkait keterbelakangan pekon dalam hal infrastruktur jalan yang menghubungkan Pekon Way Haru dengan pusat-pusat perdagangan, pemerintahan, dan kesehatan sangat memprihatinkan. Penelitian ini mengaplikasikan metode hukum yuridis normatif atau yang dikenal sebagai penelitian dogmatik hukum. Metode ini bertujuan untuk menganalisis norma-norma hukum yang ada serta mengevaluasi pelaksanaan ketentuan hukum tersebut dalam praktik yang sebenarnya. Poin utama dalam penelitian ini adalah kebijakan-kebijakan yang relevan dan konsep-konsep yang mendasari fenomena yang diteliti, terkait dengan politik hukum pembangunan di wilayah tertinggal. Berdasarkan hasil temuan penulis, hingga saat ini belum ada tindakan dari pemerintah kabupaten terkait infrastruktur jalan di pekon tersebut, yang menyebabkan masyarakat setempat tertinggal dalam berbagai aspek kehidupan.Kata Kunci : Politik Hukum, Pembangunan, Daerah 3T

Abstract

Panas bumi adalah energi yang berasal dari dalam bumi sebagai sumber energi yang terbarukan dan bersih. Indonesia menjadi salah satu negara yang memiliki sumber daya panas bumi yang dapat diubah menajadi energi yang alternatif sebagai pengganti bahan bakar fosil. Tujuan dari tulisan ini yaitu untuk mengetahui bagaimana pengelolaan sumber daya panas bumi oleh pemerintah dalam mendukung tujuan SDGs ke-7, yakni energi bersih dan terjangkau. Metode yang digunakan dalam penelitian ini adalah studi normatif dengan pendekatan perundang-undangan yang mengatur pengelolan energi panas bumi di Indonesia. Pengumpulan data menggunakan studi literatur dari junal yang digunakan sebagai referensi. Hasil kajian menunjukkan bahwa pengelolaan sember daya panas bumi masih perlu diperkuat meskipun adanya regulasi hukum agar energi panas bumi dapat optimal sebagai energi panas bumi yang terbarukan.

Abstract

Stunting is a condition of growth failure caused by chronic malnutrition and recurrent infections during the first 1,000 days of life, which has a serious impact on the quality of Indonesia's human resources. Stunting is not only a health issue, but also a violation of children's rights guaranteed by the constitution and national legal instruments. In this context, the state has a legal responsibility to ensure every child's right to nutrition and health in a comprehensive manner. An analysis of Presidential Regulation No. 72 of 2021 shows that national regulations have established strategies to accelerate the reduction of stunting, but they lack mechanisms for sanctions, oversight, and clear delineation of authority. Weak cross-sectoral coordination, low legal literacy among the public, and minimal public participation undermine the effectiveness of policies. To enrich the analysis, this study highlights best practices from Malaysia, Myanmar, and Thailand. These countries have successfully reduced stunting rates through a multisectoral, community-based, and rights-oriented approach. Their strategies include nutrition education, food security, women's empowerment, and interventions based on educational and social institutions. Without a strong and implementable legal framework, and without learning from successful global practices, Indonesia will struggle to achieve significant reductions in stunting. Therefore, strengthening legal policies and adopting international best practices are crucial to realizing the vision of Indonesia's Golden Generation 2045

Abstract

Perkawinan siri merupakan praktik perkawinan yang dilakukan secara agama tetapi tidak dicatat secara resmi oleh negara melalui Kantor Urusan Agama (KUA). Fenomena ini masih banyak terjadi di Indonesia dan menimbulkan berbagai persoalan hukum, salah satunya adalah status administrasi kependudukan anak yang lahir dari perkawinan tersebut. Penelitian ini bertujuan untuk menganalisis implikasi hukum dari perkawinan siri terhadap administrasi kependudukan anak dalam perspektif Undang-Undang Nomor 24 Tahun 2013, dengan studi kasus Putusan Pengadilan Agama No. 865/Pdt.P/2024/PA/CBN. Permasalahan utama yang dibahas adalah bagaimana kedudukan hukum anak hasil perkawinan siri dan bagaimana negara melalui putusan pengadilan memberikan solusi atas ketidakjelasan status hukum anak dalam administrasi kependudukan. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan sumber data diperoleh melalui penelusuran literatur dan dokumen hukum yang tersedia di internet, termasuk putusan pengadilan, artikel ilmiah, dan peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa anak hasil perkawinan siri sering kali tidak dapat memperoleh akta kelahiran karena tidak terpenuhinya syarat pencatatan perkawinan orang tua. Namun, melalui mekanisme isbat nikah, pengadilan memberikan legalitas terhadap perkawinan tersebut demi kepastian hukum bagi anak. Abstract

Business contracts are a crucial element in the economic activities of Indonesia; however, the existing contract law is still grounded in classical principles that do not fully accommodate the dynamics of modern business. This study employs a normative legal approach, utilizing legislative, conceptual, and case study methodologies. Data were collected through literature reviews, interviews with legal practitioners, and analyses of court rulings related to business contract disputes. The findings indicate that legal certainty in the enforcement of business contracts in Indonesia remains low, characterized by slow and inefficient enforcement processes. Issues of contract validity, particularly concerning language use and unfair clauses, frequently lead to legal uncertainty. Furthermore, advancements in technology and globalization necessitate a more responsive legal adaptation, including the recognition of electronic contracts

Abstract

Globalization is a social and cultural process that begins with the interaction of one nation with another. Globalization can be defined as a condition of interdependence within an international network encompassing transportation, distribution, communication, and economics that transcends national territorial boundaries. Pancasila is the source of all sources of law. Therefore, all legal products, whether laws or other legal products, must be in accordance with the values contained in Pancasila. The problem formulation that will be used as a framework in writing this research is as follows: How does economic globalization influence the concept of law enforcement in Indonesia? How is law enforcement viewed from the perspective of Pancasila justice? This research uses a normative juridical approach and is qualitative in nature with a descriptive method. The influence of economic globalization on national law enforcement in Indonesia is a complex and multidimensional phenomenon. The influence of globalization has been the main driver of change in the legal system and law enforcement in Indonesia, affecting regulations, policies, and legal practices in various fields. The rapid development and progress in various fields, such as the flow of trade, investment, and increasingly open information, have created new challenges in maintaining legal sovereignty and national interests. Law (in the context of law enforcement) and justice have Law (in the context of law enforcement) and justice play an important role in achieving the goals of Pancasila. With Pancasila in the legal system, we can build a solid foundation for achieving social justice and national progress. Law enforcement in Indonesia must reflect the values contained in Pancasila, which are then implemented in social, national, and state life, both at the national and international levels

Abstract

Indonesia, as a country based on the rule of law, places law at the foundation of every aspect of social, national, and state life. However, reality shows that the level of law violations among teenagers, especially high school students, is still quite high. One of the factors behind this is their lack of understanding of the law and lack of awareness of the consequences of their actions. This study aims to analyze the role of legal education in shaping legal awareness and supporting the law enforcement process from an early age. The research method used is a sociological juridical approach with data collection through direct interviews with high school students. The results show that legal education is not only important to be included in the school curriculum, but also needs to be implemented through legal counseling programs involving law enforcement officials and related agencies. Through the implementation of legal education, students can understand the values of justice, recognize prohibited and permitted acts, and internalize an attitude of legal compliance. Thus, legal education plays a strategic role in shaping a young generation that is legally aware and contributes to the creation of more effective law enforcement in Indonesia.

Abstract

This study analyzes various aspects that affect legal changes in the sociocultural context in Indonesia. Legal changes are often influenced by the social and cultural dynamics that develop in society. This study aims to understand how social and cultural factors such as traditional values, social norms, and customary customs affect the formation, application, and change of laws in Indonesia. The method used in this study is qualitative with a case study approach, which involves analysis of various legal sources, academic literature, and interviews with legal experts and community leaders. The results of the study show that the interaction between law and socio-cultural aspects creates a continuous adaptation process, where the law must be responsive to changes in values and norms that exist in society. In addition, the findings of this study also indicate that the active involvement of the community in the legislative process
