Abstract

Quran was sent down for the humanity, its consequently guiding to drive justice, dignity and a mercy of the universe. This paper tried to discribe of the triangle of text, reader and author in islamic legal opinion. The cource strictly to differ where are authoritative and authoritarian in the same time. Here is Khaled Khaled as a prominent moslem thinker standing consistantly  in front line againts wahabism on its fatawa or islamic legal opinions. Khaled offers methodology of how to interpret of the meaning of the law texts, it is hermeneutic. The characteristics of this kind of methodology is that there is closed relation to the author, text, context, and interpreting of reader. So, the meaning of Islamic law texts can be classified into two categories, authoritarianism and authoritative meaning.

Abstract

As one of the tests, achievement test has to be qualified. A qualified test will be able to give the information about teaching correctly. If the achievement test is less qualified, the information related to students’ sucesss to achieve the instructional objective will also be less qualified. It means the test has to meet the characteristics of a good test. In fact, there has not been any effort yet to identify the quality of the achievement test which is used in Intensive English program. It means the information of the test quality cannot be found yet. Therefore, researchers are interested in analyzing the quality of achievement test for students in Intensive English program of IAIN Samarinda. Design of this research belongs to Content Analysis. Subject of this research is English achievement tests and 28 to 30 students were involved in the process of try out. Data were collected through three steps. Data were analyzed based on validity, reliability, and item quality. Finding of the research reveals 60 % of the tests have a good construct validity justified by related theories. It was found 55% of the tests have a good content validity. Reliability coefficient of the first tests format is 0, 65 and the second tests format shows 0, 52. Calculation of item difficulty shows 68% of the test items were between 0,20 – 0,80. The estimation of item discrimination shows 73% of the test items were between 0,20 – 0,50. While calculation of distracter efficiency shows 65% of the distracters were effective to distract the test takers.

Abstract

Penelitian ini hadir dalam rangka untuk memotret progress pendidikan serta upaya-upaya yang dilakukan oleh pemerintah dan masyarakat setempat dalam mengembangkan pendidikan di perbatasan dengan berbagai kompleksitasnya. Penelitian ini adalah penelitian lapangan (field work research) yang mengambil fokus penelitian pada sekolah-sekolah di wilayah perbatasan Kalimantan Timur, yang memfokuskan penggalian datanya pada strategi sekolah dalam melakukan pengembangan, strategi membangun kemitraan, pola pendidikannya serta faktor-faktor yang menjadi kendala. Dalam mengumpulkan data, penulis menggunakan 3 teknik, yakni observasi, wawancara dan dokumentasi. Setelah data terkumpul selanjutnya penulis menganalisis data dengan menggunakan model analisis interaktif Milles and Hubberman dengan alur: reduksi data, display data dan data conclutions. Berdasarkan hasil temuan dan pembahasan pada bab sebelumnya, maka penulis dapat mernaik kesimpulan sebagai berikut: Strategi yang dikembangkan yaitu boarding school. Model penyelenggaraan pendidikan di sekolah tersebut telah memadukan dua kategori yakni sekolah formal dengan asrama. Strategi sekolah dalam membangun kemitraan yakni dengan mengembangkan 4 hal, yaitu: relevansi yaitu, bahwa pendidikan yang diselenggarakan dapat menjawab kebutuhan masyarakat terhadap bentukan siswa ketika mereka bersekolah baik pada aspek kognitif, afektif dan psikomotorik. Kualitas yaitu sekolah dapat menghadirkan model penyelenggarakan pendidikan yang dapat merubah anak didik menjadi lebih baik, dalam konteks pendidikan perbatasan pemberdayaan anak dengan ragam keilmuan serta menumbuhkan rasa cinta tanah air. Otonomi kelembagaan yaitu sekolah menjadi dapat menjadi pelopor kepedulian terhadap nasib dan masa depan anak-anak perbatasan untuk memperoleh pendidikan yang layak dan bermutu. Pola pendidikan yang diterapkan antara lain: pendidikan boarding school, pendikan wawasan kebangsaan, dan kegiatan ekstrakurikuler. Faktor-faktor yang menjadi kendala dalam mengembangkan sekolah yaitu faktor geografis, minimnya tenaga pendidik dan kependidikan yang profesional, ketersedian sapras yang kurang memadai, dekadensi cinta tanah air, problem religiusitas serta minimya dukungan dari pemerintah pusat dan daerah.

Abstract

The students of Arabic Education at State Institute of Al-Qur’an study Ilmu Bayan in order to understand about the beauty and majesty of Al-Qur’an verses, language style, Arabic expression, and to compose the right and good sentences. But, in the fact, learning of Ilmu Bayan cannot comply all of those criterion. There are many problems in this case such as: Students have difficulties to remember the rules of Ilmu Bayan and they try to compare Ilmu Bayan study to Indonesian language study. The learned book is using Arabic language without any translation and it’s also dominated by Arabic poem which is difficult to understand. Based on those data, the researcher develops a teaching book based on contractive analysis.This research use qualitative and quantitative approach with research and development method. The result of this research are: 1 contrastive analysis between Ilmu Bayan style of language and Indonesian style of language, 2 Product, that is a teaching book of Ilmu Bayan for STIQ Amuntai students. So that the steps to arrange the book are: need analysis, collecting data, product design, validating product, revise product, expediency test of product, revise of expedience test of product, effectiveness test of product, revise product, 3 Teaching book arranged by researcher is effective in learning Ilmu Bayan, known by comparing control and experiment group posttest result, that is T counting (4,36) more than T table (1,71) and T table (2,42).

Abstract

Persoalan kewarisan selalu menarik untuk dipelajari dan dikaji, khususnya kewarisan yang ada di Indonesia. Hal ini terjadi karena masyarakat Indonesia sangat dinamis dalam masalah kewarisan, di samping banyaknya pilihan yang ada dan berkembang di masyarakat. Paling tidak ada tiga (3) pilihan ketika ingin membagi harta warisan; (1) berdasarkan hukum Islam, (2) berdasarkan hukum adat, (3) berdasarkan KUH Perdata. Karena masyarakat sangat banyak, peneliti hanya memilih ulama yang juga merupakan bagian dari masyakat untuk dijadikan obyek dalam penelitian ini. Dipilihnya ulama dalam penelitian ini, karena di satu sisi mereka mengetahui tentang hukum kewarisan berdasarkan hukum Islam, tetapi di sisi lain mereka juga hidup dalam masyarakat yg sangat plural. Apakah keilmuan mereka tentang hukum kewarisan Islam dapat mewarnai tentang tata cara pembagian harta warisan dalam keluarga mereka ataupun ketika mereka diminta masyarakat untuk menyelesaikan persoalan kewarisan ? ataukah justru para ulama tersebut mengambil jalan damai, asalkan keluarga tetap utuh dan kemaslahatan keluarga tetap rukun. Dari 15 ulama yang diwancarai, dapat ditipologikan kepada tiga cara pembagian waris di kalangan ulama di Samarinda, yaitu berdasarkan hibah, faraid, dan musyawarah keluarga.

Abstract

This research is based on the phenomenon that community service activities carried out by Perguruan Tinggi Agama Islam (PTAI) from more or less the same year have not been linked to the results of research in the social religious field. As a result, the relevance, benefits, and contribution of PTAI to the community become less visible. This research is a field work research. Partisipatory Action Reseacrh analysis was used in this study. The results of this study are 1) Strategy to build public awareness about clean living in the environment is done by inviting them to work together to clean the environment starting from cleaning the mosque, TPA, Mushalla, and educational institutions around. 2) Strategies to develop a community mindset can realize the potential of nature and the surrounding human resources to be processed through socialization on the use of the natural environment, including household waste, training in making paving blocks from plastic waste, and processing waste into compost. 3) Strategy to build active communication between citizens and the government with assistance to citizens, and 4) Strategy to build a spirit of diversity in the community.

Abstract

Demands for graduates of quality educational institutions increasingly urgent, in addition to competition between educational institutions also educational institutions must meet minimum graduation standards. This study uses a qualitative approach using data collection techniques, observation, interviews and documentation. Based on the findings, the authors conclude as follows: Education Quality Improvement Strategies at SDIT Cordova Samarinda and SDIT YABIS Bontang in terms of the input strategy adopted, namely the selection of Human Resources through a rigorous selection process in accordance with specified criteria; procurement of public utilities and insfrastructures are very complete; partnership support through collaboration with school committees and related foundations and educational institutions; funding guarantees obtained from stakeholders and the integration of the national curriculum, integrated Islamic school network and foundation, In the aspects of the strategic process adopted, namely optimizing the process of decision making, institutional management processes, program management processes, teaching and learning processes, and monitoring and evaluation processes. With a note that the teaching and learning process has the highest level of importance compared to other processes. While increasing the output aspect taken is to improve academic achievement by optimizing existing components and strive to produce quality graduates and increase non-academic achievements by seeking to produce students who have Islamic characters and excel in the arts, sports and extracurricular fields.

Abstract

The implementation of legislation either nationally or internationally linked to the implementation of restorative justice as one of the alterntif in the process of implementation of conviction against children in conflict with the law had been applied, but the case has not yet been thoroughly and still limited at the law enforcement officers and observers who are committed and integrity as well as having the attention to this problems. The implementation of restorative justice which is applied at each level of the process of criminal justice in the form of taking back the children to their parents, versioned by handing the children to Panti Sosial Marsudi Putra (PSMP), and the implementation of social integration through giving CB, CMB, and PB for children who are already serving imprisonment. Some obstacle factors the implementation of restorative justice as one of the alternatives in the implementation of conviction against children in conflict with the law, including physical building facilities and non-physical facilities and legal substance. It is because restorative justice has not been expressly regulated, even though in the law nomer 11, 2012 concerning about the Child Criminal System has been regulated but until now it has not been declared valid. The other factors are legal structure and legal culture.

Abstract

The at-tartil method is a guidebook in learning to read al-quran directly (without spelling) and enter or practice the reading of tartil in accordance with the rules of ulumut tajwid and ulumul ghorib This At-tartil book emerged because it was motivated by unrest among the NU Sidoarjo scholars more precisely the NU Syuriah Branch of Sidoarjo, because at the beginning of the 80-90s various kinds of books were studied in the Koran but not accompanied by the teachers skills in operating books the book. This At-Tartil Method uses a drill technique. The type of research that will be used in this study is to use the Posttest Only method. This study involved two groups, namely the experimental group and the control group, both of whom received the same learning treatment process in terms of content, purpose and teaching material. Referring to the results of data analysis from the results of the research that has been done, obtained t-count value of 22.0503 and t_table value of 1.684. This means that t count> t table then Ho is rejected; Ha accepted. It can be stated that the experimental group and the control group have significant average differences, with this indicating that the use of the At-Tartil method is effective in the learning of PTKI Tahsin Al-Qur'an students in East Kalimantan.

Abstract

Legalization of Waqf Assets in Samarinda is an attempt to find out the concept of safeguarding waqf property in national legal representation which is manifested in the reality of waqf property in Samarinda. This study uses qualitative approach. In the real term, the legalization effort is carried out by accurately documenting it, either in the form of a waqf pledge deed, replacement deed or in the form of a waqf land certificate. The efforts to realize the legal status of waqf assets are a form of realization of benefit. Actually, this becomes the task of managements gather with other relevant agencies, namely the Ministry of Religion, the Indonesian Waqf Board, and the National Land Agency. The strategy adopted is to register, administer, announce the existence of waqf property and monitor it. While the challenges faced when seeking the legality of waqf assets include a lack of awareness about the legal status of waqf in the community. Also the lack of human resources that needs to be improved in competence, as well as the number of managements that have not been registered at the Indonesian Waqf Board. Whereas the opportunity is the existence of established regulations related to waqf, starting from the registration of waqf assets, management, supervision and even productivity, namely Law Number 41 of 2004 concerning Waqf.
