Abstract

In a company, it is very crucial to have a Supervisory Management which is authorized to supervise the operational activities of a company. Which will later become a benchmark for a company that is good or not. Supervisory Management is also important for its role in the company, where majority ownership of the company is owned by individuals. For this reason, so that companies can contribute to increasing the APBD, good corporate governance is needed. Including in terms of employee morale at work, planning, employee abilities. This article reviews Supervisory Management Planning in Companies: Commitment and Planning Affecting Supervision Management in Companies, namely: a study of Human Resource Management literature. The purpose of writing this article is to hypothesize the influence between variables to be used in further research. The results of this literature review article are: 1) Commitment has an effect on Supervisory Management in the company and 2) Planning has an effect on Supervision Management in the company.

Abstract

The era of Technology 4.0 triggers the emergence of a recent pattern in society known as the digital economy in the people's daily buying and selling process. The digital economy itself adopts the use of information and communication technology innovations that give rise to a variety of products, production processes and new services. Changes in the process of producing goods and distributing them become critically dependent on the use of information technology and electronic media. One of the goods that has experienced a shift in distribution is narcotics. Narcotics transactions are facilitated via online and payment via transfer, so that sellers and users do not need to meet face-to-face to conduct transactions. The legal vacuum of online narcotics transactions causes Indonesia to not yet have a complete and clear legal rule regarding the eradication of narcotics through cyberspace. This study aims to analyze the existing legal regulations in Indonesia for narcotics offenders and providers. Through this research, it is expected to obtain a legal vacuum in the narcotics trade through the internet and provide ideas and ideas to fill this void.

Abstract

This study aims to discover and analyze how the Financial Services Authority regulations and the Bank Indonesia regulations relate to information technology-based money lending and borrowing activities in the implementation of fintech peer-to-peer lending, particularly for Paylater users who feel disadvantaged by seeing what it looks like and how the explanation of the regulations regulate fintech, so that many consumers continue to feel disadvantaged. In addition, how is the supervision provided by the Financial Services Authority to administrators of peer-to-peer lending activities in accordance with the governing laws and regulations? In this study, we used a normative juridical research type with a statutory approach (the statute approach) and a case approach (the case approach) by conducting a literature study. The results of this study explain that the form of regulation on fintech peer-to-peer lending is regulated in Financial Services Authority Regulation Number 77/POJK.01/2016 concerning information technology-based money lending services and Bank Indonesia Regulation Number 19/12/PBI/2017 concerning the implementation of financial technology, and Government Regulation Number 82 of 2012 concerning the implementation of electronic systems and transactions, with arrangements for organizers to record, a regulatory sandbox, registration, and licensing to the Financial Services Authority. That the cases that occurred, as seen through the existing arrangements, continue to fail to accommodate the cases encountered by consumers. Regarding this action, the supervision provided by the Financial Services Authority is in the form of pre-operational supervision and supervision during operations, but there are obstacles in supervision, namely the absence of the Financial Services Authority's fintech department to resolve all problems from the Financial Services Authority's side, and at the supervision stage, it is not able to adapt to innovation so quickly.

Abstract

Concerning the food consumed, there are factors that influence the decision to consume the food. Sometimes, in choosing food, taste is the main factor that drives this consumption behavior; on the other hand, it can be less concerned with the halal aspect. Muslim consumers guided by Islamic law should pay close attention to the halal aspect of the product and hope that every product they consume fulfills the halal criteria. Paying attention to the MUI halal label on food product packaging is one way to determine whether a product is safe and halal. But unfortunately, not all people are equipped with knowledge about the halalness of a product to gain the benefit and pleasure of Allah SWT. The purpose of this is to do this considering that not all Muslims understand that what they consume is not halal according to sharia law. Besides that, it is also necessary to provide understanding, affirmation, and knowledge to producers to protect the rights of Muslim consumers. As a country with the largest number of Muslims in the world, producers should be more concerned with achieving the safety and comfort of Muslim consumers. The most important thing for producers to know is that halal certification and labeling are not only for the safety of Muslim consumers but also provide economic benefits for producers.

Abstract

Democracy means that sovereignty is in the hands of the people. Elections are a form of implementation of popular sovereignty. The people are given the freedom to choose their own leaders, both in the executive and legislature. In democracies the ruler is entrusted only part of the power of managing the state by the people. After the people are given freedom in choosing the ruler, the next stage is the involvement and participation of the people in formulating and overseeing various forms of policies born by the government,including other public bodies. Law No. 14 of 2008 concerning Public Information Disclosure is the embodiment of the substance of democracy. Especially when it comes to public information oversight. In democracies, the right to obtain public information is a human right and information disclosure is an important feature of a democratic state upholding the sovereignty of the people to realize good state administration. LawNumber 14 of 2008 concerning the Openness of Public Information has historically been motivated by the rolling out of reforms in the Unitary State of the Republic of Indonesia. Reforms that were more than a decade old at that time have brought about changes in the country's system of government. This law was passed on April 30, 2008 and came into force from 2 years of promulgation, namely on April 30, 2010. Then an Information Commission institution was formed as the implementer of this law. Both at the central and provincial and district/city levels. In West Sumatra itself, the Information Commission has been running for two periods, namely 2015-2019 and 2019-2023. Currently, the selection process for members of the Regional Information Commission of West Sumatra Province for the 2023-2027 period is being carried out. Research method with a descriptive qualitative approach.

Abstract

The legal system of intellectual property rights in Indonesia requires the registration of marks regulated in Article 1 paragraph 5 of the Trademark Law, namely, the right to a mark is an exclusive right granted by the state to registered trademark owners for a certain period of time by using the mark themselves or giving permission for others to use it. The emphasis in the article is that the right to a mark is created due to registration and not because of the first use, as stipulated in Law Number 20 of 2016 concerning Marks and Geographical Indications. Intellectual Property Rights have provided legal protection for individuals who have made discoveries or inventions, putting these individuals in the position of holders of Intellectual Property Rights and granting them exclusive rights to reproduce, manufacture, sell, and distribute his inventions. Apart from giving exclusive rights to inventors, intellectual property rights also provide protection for brand holders, which are usually used to describe reputation (quality), indicating differences between one company and another regarding the existence and goods it produces.

Abstract

The rule of law concept that has developed in Indonesia is a modern rule of law concept that has a distinctive feature compared to the concept of a rule of law state that developed before. However, in the development process, it is difficult to escape from the sparks of thinking about the concepts of "the rule of law" and "rechtsstaat". The ideal Indonesian legal state concept has the following characteristics: The administration of the state and government is always based on the values of Pancasila and the 1945 Constitution of the Republic of Indonesia. The state places the constitution, laws and statutory regulations as guidelines that must be obeyed in every life; The principle of legality is the main thing that must be guided by state and government administrators. Making law a means of realizing a welfare state and a democratic state; "The state recognizes and operates a power-sharing system and has checks and balances with each other." There is an independent and impartial judiciary that guarantees justice for everyone, including against abuse of authority by those in power; There is protection of Human Rights that is in balance with the obligations of Human Principles; The existence of democratic principles in the life of society, nation and state; There is a balance, harmony and harmony between rights and obligations; Recognition and realization of the principle of "good governance": realization of justice, order, legal certainty, benefit, welfare, and happiness for every citizen.

Abstract

Most of Arabs people has spoken Arabic for communication. The Arabic word has a meaning to express feelings and interact socially. Lexical meaning in Arabic word has related to a specific of gender and a characteristic of living organism. The purpose of this study was to observed several meanings from the Arabic words and their relationship. In this study, semantic approach are used to analyze words lexically to find the meanings that indicate the characteristics and gender of living organism. The study found that the Arabic word has a real and a derivative meaning. As in the word father which in Arabic means Al-Abu, but it has a derivative meaning rooster. A rooster have similar character and behavior as a father in the role of the group and family member. Derivative meaning and reak meaning show that have a close relationship observed from characteristic and behavior of a living organism.

Abstract

The crime of sexual violence in Indonesia is in an emergency phase. The massive number of reports of cases of sexual violence has created its own paranoia for the community, especially in terms of the process of handling cases of sexual violence in Indonesia. This study aims to analyze cases and phenomena of sexual violence in Indonesia and to carry out a normative approach as a study of handling cases of sexual violence. The research method used is normative legal research and the method of analyzing literature and case studies of sexual violence in Indonesia. The results of this study indicate that cases of sexual violence have evolved along with the times. The emergence of gender-based cyber sexual violence (KSBG), abortion cases, and efforts to handle cases using the Alternative Dispute Resolution (ADR) system are injustices to victims. Settlement of cases of sexual violence must be in accordance with Law Number 12 of 2022 concerning Crimes of Sexual Violence, namely the implementation of a legal judicial process.

Abstract

This study looked at the relationship between performance and motivation and discipline at Radjak Hospital Salemba. This study used quantitative data collected through a Likert scale with the SPSS version 23 program. Data were collected from 221 patients at Radjak Hospital Salemba. This hospital is located in the northwestern part of Indonesia and is staffed by local residents. This research uses quantitative descriptive research. A population of 221 people was tested using the Slovin sample formula, and at least 69 people were included in the sample. The results are positive, with a Sig Value of 0.259 and a T-Test Result of 0.040. Additionally, 3. Based on the results of multiple linear regression, work motivation and work discipline have a positive effect on employee performance. This influence can be seen in the constant values ??of 0.797 and 0.259 for positive work motivation and work discipline, respectively. In addition, the Sig T test shows that the two characteristics of work ethics have a significant effect on employee performance with values ??of 0.040 and 0.000 respectively. Work motivation and discipline also affect employee performance by 69.4% which is explained from the results of the R square test. The remaining 30.6% due to this influence is caused by other factors not examined in this study.
