Abstract

Micro, Small, and Medium Enterprises (MSMEs) in the culinary sector are a key pillar of the Indonesian economy; however, many business owners neglect the legal protection of their intellectual assets, particularly trademarks. This paper examines the legal impact of the failure of culinary MSMEs to register their trademarks in a timely manner, which leads to disputes and financial losses. Using a qualitative case study of the Commercial Court Decision Number 79/Pdt.Sus-HKI/Merek/2024/PN Niaga Jkt.Pst, this research analyzes how Indonesia's trademark law system, which adheres to the first-to-file principle, grants supremacy of rights to the first registrant. The analysis shows that exclusive rights to a trademark arise from registration, not from prior use. The court rejected the arguments of "well-known mark" and "bad faith" submitted by the prior user due to a failure to present strong evidence in accordance with the procedural law of evidence. This ruling confirms that without registration, a business's legal standing is weak, even if it has built a brand reputation over a long time. In conclusion, legal certainty is only granted to parties who proactively register their trademarks with the Directorate General of Intellectual Property (DJKI). Therefore, early trademark registration is a crucial preventive step for culinary MSMEs to secure assets, avoid disputes, and strengthen their market position.

Abstract

This study aims to analyze the factors inhibiting the development of the creative economy in the Senggigi Beach Tourism Destination, West Lombok. The research is motivated by the declining competitiveness of the destination, limited innovation among creative economy actors, and increasing competition from emerging destinations such as the Mandalika Special Economic Zone. A descriptive qualitative method with a case study approach was employed. Data were collected through in-depth interviews, observations, and documentation involving 28 informants from various creative economy subsectors. Data analysis was conducted using a root cause analysis approach, including a Fishbone Diagram and thematic coding. The findings reveal that the main inhibiting factors originate internally, including low product innovation and differentiation, weak digital marketing, limited human resource competencies, and inadequate use of technology and business networks. External factors include the decline in tourist arrivals due to earthquakes and the pandemic, competition with modern destinations, shifting tourist preferences, and suboptimal government support. The interaction between these internal and external factors creates a stagnation cycle that hampers the growth of the creative economy in Senggigi. The study concludes that an integrated strategy is required, encompassing capacity building for creative actors, strengthening digital marketing, enhancing pentahelix collaboration, and repositioning Senggigi as a culture-based creative destination.

Abstract

This study aims to analyze the influence of financial literacy, motivation, environmental concern, and local ESG support on the intention and behavior of green investment among youth in North Lombok, particularly in the context of sustainable ecotourism development. The research employs a quantitative descriptive-verificative approach using Structural Equation Modeling – Partial Least Squares (SEM-PLS). A total of 100 respondents, aged 17–30 years from the subdistricts of Pemenang, Tanjung, and Kayangan, were selected through purposive sampling. The results indicate that all independent variables have a positive and significant effect on green investment intention, while investment intention strongly influences actual green investment behavior (β = 0.739; p < 0.001). Although 60% of respondents hold only a high school education and the overall human resource quality has not yet fully supported green investment practices, 74% expressed a high interest in participating in sustainable investment if accompanied by appropriate training and local government support. The model shows an R² value of 0.638 for investment intention and 0.571 for green investment behavior, with Q² = 0.462, indicating good predictive relevance. These findings emphasize the importance of strengthening green financial literacy, socio-economic motivation, and multi-stakeholder collaboration among government, communities, and educational institutions to enhance youth participation in sustainable investment and ecotourism development.

Abstract

Tax revenue is the main source of funding in various countries, including countries in Asia. However, in the Asian context, there are still some serious problems related to tax revenue, such as tax ratio problems and tax evasion. This study identifies the determinants of tax revenue in Asia over the period 2008-2023. We use the Generalized Method of Moments (GMM) model to analyze the results and find that foreign investment inflows and per capita GDP increase are the main sources of tax revenue increase compared to agriculture, manufacturing, and trade. For this reason, the government is expected to review the tax policies that have been issued to achieve a balance in state tax revenue.

Abstract

Global warming has had a significant impact on the local economy in Eastern Indonesia, a region encompassing East Nusa Tenggara, Maluku, North Maluku, Papua, and West Papua. This study aims to identify the specific impacts of global warming on key economic sectors and analyze adaptation strategies developed by local communities based on the framework of adaptive capacity theory. Using a qualitative literature study method with a systematic analysis of scientific publications, government reports, and policy documents over the past four years, this study found that global warming has had a serious impact on three sectors supporting the local economy: fisheries have experienced a 20-30 percent decline in catch due to coral bleaching and shifts in fish migration; agriculture has been disrupted by changing rainfall patterns, leading to uncertain planting seasons and increased pest infestations; and marine tourism has declined due to coastal ecosystem degradation. Communities have responded to these impacts through five main adaptation strategies: livelihood diversification, utilization of local knowledge and technological innovation, strengthening institutions and social networks, increasing access to finance and insurance, and developing value chains and market access. However, the effectiveness of these adaptation strategies remains constrained by a limited economic asset base, institutional weaknesses, knowledge gaps, limited innovation capacity, and weak coordination among stakeholders. This study concludes that increasing local economic resilience requires a holistic approach that simultaneously strengthens all five dimensions of adaptive capacity through infrastructure investment, institutional strengthening, human resource capacity building, and responsive policies, with active collaboration between the government, local communities, the private sector, and non-governmental organizations.

Abstract

Village development in Indonesia following Law No. 6 of 2014 positions Village-Owned Enterprises (BUMDes) as a strategic instrument for fiscal independence. This study aims to examine the relationship between BUMDes performance and Village Original Revenue (PADes) and its implications for community welfare, while considering the legal framework as a foundation. The research employs an associative quantitative approach using secondary data, including BUMDes financial reports, PADes realization, and welfare indicators, analyzed through linear regression and correlation. Findings reveal a significant positive relationship between BUMDes performance and PADes (R² = 0.46; p < 0.05), while PADes shows a moderate correlation with community welfare (r = 0.52). A normative legal analysis indicates that although regulations such as Law No. 6/2014 and Government Regulation No. 11/2021 provide strong legitimacy, implementation at the village level still faces technical and administrative challenges. In conclusion, BUMDes significantly contributes to PADes; however, welfare impacts require affirmative policies in PADes allocation and stronger institutional capacity at the village level.

Abstract

Analyze the efficiency levels of Himbara banks after receiving Rp200 trillion in funds from the Ministry of Finance. Compare the efficiency levels between Himbara banks in the periods before and after the fund placement policy. Identify internal factors that influence the efficiency of government fund management at Himbara banks. This study uses a quantitative approach with the non-parametric Data Envelopment Analysis (DEA) method. This approach was chosen because it can measure the relative efficiency between decision-making units (DMUs) without requiring specific production function assumptions (Charnes, Cooper, & Rhodes, 1978). DEA allows researchers to evaluate the ability of Himbara banks to efficiently convert inputs (resources) into outputs (intermediation results). The analysis was conducted for the period 2024–2025, covering conditions before and after the placement of IDR 200 trillion in funds from the Ministry of Finance. To analyze factors influencing efficiency, the Tobit regression model was used. Data Envelopment Analysis (DEA) results show that the Rp200 trillion injection of funds was only effective in increasing efficiency at already productive banks (BRI, Mandiri, and BTN), while BNI still exhibited inefficiency due to its inability to convert additional funds into proportional credit growth and interest income. This indicates the need for improvements in credit distribution strategies, operational cost management, and risk management so that the injection of public funds truly has an optimal impact on efficiency and economic growth. Tobit Regression results indicate that bank efficiency in Indonesia tends to increase if banks have strong capital adequacy, good asset quality, and optimal intermediation capabilities. Conversely, increasing NPLs and excessive asset expansion can be factors that reduce efficiency. Therefore, future banking policy strategies need to focus on improving asset quality, cost efficiency, and implementing effective governance across all bank scales

Abstract

This study aims to analyze the influence of green accounting, environmental corporate social responsibility (CSR), and eco-efficiency strategy on corporate sustainability performance in Indonesia. The research employed a quantitative approach using Structural Equation Modeling based on Partial Least Squares (SEM-PLS). Data were collected through a survey of 150 manufacturing and service companies that have implemented environmental reporting in their sustainability reports for the 2020–2024 period. The findings reveal that green accounting has a significant positive effect on sustainability performance, while environmental CSR strengthens this relationship through environmentally oriented social responsibility practices. Moreover, the eco-efficiency strategy plays a crucial role as a driver of resource efficiency in supporting long-term sustainability goals. The research model produced an R² value of 0.71, indicating that the combination of these three variables explains a substantial proportion of the variation in corporate sustainability performance. The implications of this study emphasize that the implementation of green accounting, environmental CSR, and eco-efficiency strategies not only enhances corporate reputation and regulatory compliance but also creates sustainable economic value for companies amid the green industrial transition era.
