Abstract

This paper examines the development of labour protection laws in Indonesia following the implementation of the Labour Creation Act No. 11 Year 2020. This research is motivated by the controversy and dispute that emerged due to the changes in employment regulation introduced by the law. The new provisions in this law are believed to have negative effects on workers in terms of their pay, working hours, and termination conditions, as compared to the level of protection offered by the Employment Act No. 13 of 2003. This study aims to explore how the legal protection for workers can be maximized following the implementation of the Labour Creation Act. Additionally, it seeks to determine whether joint employment agreements can effectively remedy any deficiencies in the existing legislation. This study employs normative legal research methods, including approaches such as the analysis of legislative regulations, literature review, and case studies. Data is gathered by examining documents and then examined using qualitative methods to determine the effects of regulatory changes on labour protection. Additionally, potential solutions are identified through the use of joint employment agreements. The research findings indicate that the Labour Creation Act generates controversy and conflict between workers and entrepreneurs, particularly on the curtailment of workers' rights. The primary finding of this study is that a collabourative agreement, established in accordance with Article 1338 of the Convention along with Article 1320 of this Convention, can serve as a potent mechanism to rectify the deficiencies in the Creation of Works Act. Nevertheless, a robust and proactive labour union is necessary to guarantee that the agreement offers sufficient safeguards for workers. Hence, enhancing the influence of labour unions and promoting equitable bargaining processes are crucial in attaining a harmonious equilibrium between employers' interests and the safeguarding of workers' rights.

Abstract

The illicit trafficking of drugs among young people is an action that does not match the norms and social values that apply in citizens. Deviations are intertwined if a person or group of people does not comply with the norms and values that have been in force in citizens. The trigger for the formation of drug trafficking among young people is caused by some aspects of internal aspects and external aspects. Narcotics illicit trafficking policies make homes a methamphetamine factory in the Batam City area, including its own policies Implementation of narcotics illicit trafficking, supervision of police investigators in implementing the application of narcotics illicit trafficking on narcotics illicit trafficking carried out by internal supervisors namely P4GN and BNN, so that the investigation conducted by investigators in the illicit trafficking of this narcotics is protected from unwanted deviations. Supervision efforts carried out by investigators are expected that the implementation of this policy can be felt by the community. However, in the surrender it is expected to be assisted by the external supervision of the National Police and also from the community itself. Because the perpetrators of the illicit trafficking of narcotics are victims who are in dire need of supervision, so they can return with a life that is free from narcotics, and it is very necessary to support family and community supervision in the perpetrators.

Abstract

Tunjangan Hari Raya is a non-basic wage that is expressly regulated in the Labor Law as one of the rights that must be received by workers. With the development of technology, the emergence of online application-based transportation then raises a new legal issue regarding the rights of online motorcycle taxi drivers as working partners with online-based transportation providers to receive Hari Raya allowances. So it is necessary to analyze the working relationship between online ojek drivers and online-based transportation provider companies to determine whether online ojek drivers are entitled to holiday allowances. This study will formulate two problems: how is the legal basis for the provision of holiday allowance as a worker's right within the framework of labor law in Indonesia, and how is the legal position of online ojek drivers in employment relations according to the Labor Law.

Abstract

This research examines the regulations and implications of Law No. 1 of 2023 concerning the Criminal Code (KUHP 2023). The study focuses on the application of sentencing guidelines and the authority of judicial pardon, as well as its impact on judges' performance. KUHP 2023, which replaces the Dutch colonial Criminal Code, was created to reflect the dynamic developments in law, society, and technology, as well as the Indonesian legal philosophy based on Pancasila and the 1945 Constitution. The new sentencing guidelines detailed in Article 54, Paragraph (1) of KUHP 2023 are expected to assist judges in considering proportional punishments, while judicial pardon provides flexibility in handling minor cases. This research employs a normative juridical method and secondary data, including legislation, court decisions, and legal literature, to analyze the implementation of sentencing guidelines and judicial pardon, and their implications in Indonesia's criminal procedure law.

Abstract

This study aims to analyze the legal liability of business actors in fulfilling the obligation of halal certification and distribution permits from the National Agency of Drug and Food Control (BPOM) for food products distributed in Indonesia. Halal certification and distribution permits are two essential instruments to ensure the safety, quality, and halal status of products in circulation. Using a normative juridical approach and literature study, this research examines the legal provisions regulating these obligations, including Law Number 33 of 2014 on Halal Product Assurance, Law Number 36 of 2009 on Health, and other implementing regulations. The results indicate that business actors bear both preventive and repressive responsibilities in ensuring that their products are safe and halal for consumption. Failure to fulfill these obligations may lead to administrative or criminal sanctions and negatively impact consumer rights. Therefore, active roles from the government and relevant institutions are necessary to promote awareness, supervision, and legal enforcement to increase business compliance with the applicable regulations.

Abstract

This study aims to create and evaluate interactive PowerPoint learning media used to help fifth grade students at SDN 2 Gumulan to understand lessons more easily and improve learning outcomes. The problems faced are low learning motivation and monotonous teaching methods for science. As a solution, interactive PowerPoint media is used for fifth grade science material, Chapter 6 "Indonesia is Rich" with the topic "How is My Indonesia?". This study uses the ADDIE model, which consists of five stages: analysis, design, development, implementation, and evaluation. The results of the study showed that this media was very feasible to use, with a feasibility value of 92% from material experts and 88% from media experts. This media has also proven effective because it can increase student learning scores by 65% ​​from pre-test to post-test. In addition, students feel more enthusiastic and interested when learning using this media. However, this study still has shortcomings, such as only being conducted in one school, only covering one topic, and the time is short. For this reason, further research is needed with more participants and a longer time so that the results are stronger and more comprehensive.

Abstract

This study aims to examine the implementation of the concept of the Sakinah Family as formulated by the Muhammadiyah Tarjih Council in the Muhammadiyah community in Kuala Lumpur, Malaysia. The study used a qualitative descriptive approach with data collection techniques through observation, interviews, and documentation of 45 informants from various family backgrounds. The results of the study indicate that the theoretical understanding of Muhammadiyah residents of the concept of the Sakinah Family is still limited, with only 11% of informants formally familiar with the concept. However, their family life practices reflect values ​​that are in line with the principles of the Sakinah Family, such as reading the Qur'an together, regular Islamic studies, and choosing monogamy as the ideal form of family. The main challenges in implementing this concept include low conceptual literacy in the perspective of Tarjih Muhammadiyah and adaptation to different local cultures. This study recommends strengthening conceptual education through community-based programs such as seminars, learning modules, and academic discussions to improve understanding and application of the Sakinah Family concept in a global context.

Abstract

Evaluation is a crucial component in the development and implementation of quality-based curricula. This study explores the effectiveness of various evaluation methods, including formative, summative, and authentic assessments, in measuring curriculum success. The results indicate that formative assessment positively contributes to students' understanding, while summative assessments often fail to accurately reflect students' abilities. Authentic assessments have proven to enhance student motivation and preparedness for real-world challenges. Student involvement in the evaluation process, the use of evaluation data for continuous improvement, and teacher training in diverse evaluation methods are key factors in enhancing evaluation effectiveness. This research emphasizes the importance of selecting appropriate evaluation methods aligned with curriculum objectives to achieve optimal educational outcomes. Thus, the findings provide valuable insights for curriculum development and evaluation practices in educational institutions.

Abstract

This research aims to develop a hexahelix collaborative event model for organizing Karimba Fest 2024 in Tanjung Belit, Riau. The research method uses a qualitative approach with data collection techniques through participatory observation, in-depth interviews, and Focus Group Discussion (FGD). The results showed that collaboration involving the government, entrepreneurs, communities, independent institutions, media, and academics in planning, implementing, and evaluating events contributed to the successful organization of Karimba Fest 2024. The collaborative event model developed consists of stages: 1) identification of hexahelix potential and needs; 2) formation of collaborative work teams; 3) participatory event planning; 4) collaborative event implementation; and 5) participatory monitoring and evaluation. This research contributes a collaborative event model that can be applied in developing hexahelix-based tourism events with an impact on environmental and cultural preservation.

Abstract

Cryptocurrency has emerged as a global innovation since the launch of Bitcoin in 2009, underpinned by blockchain technology that offers enhanced efficiency and transparency. Despite its potential, cryptocurrency presents complex legal challenges, particularly concerning its regulatory status. In Indonesia, cryptocurrency faces a dual regulatory framework: it is prohibited as a means of payment by Bank Indonesia pursuant to Law No. 7 of 2011 on Currency, yet simultaneously recognized as a tradable investment commodity by the Commodity Futures Trading Regulatory Agency (Bappebti). This study aims to analyze the implications of this duality for Indonesia’s national regulatory system. Using normative legal research and a statutory approach, the study reveals significant legal uncertainty arising from institutional regulatory inconsistencies. Such uncertainty may impede innovation and compromise consumer protection. Therefore, regulatory harmonization is essential to ensure legal certainty and adaptability, drawing on the theories of legal certainty and progressive law.
