Abstract

Sexual violence represents one of the gravest offenses against human dignity, imposing severe psychological, bodily, and societal repercussions on victims. Within Indonesia, incidents of sexual violence have exhibited a persistent upward trajectory annually, although prior legal frameworks have been deemed insufficient in affording adequate safeguards for those affected. The Criminal Code (KUHP), inherited from the colonial period, confines its provisions to rape and indecent assault in a highly restricted manner, thereby excluding myriad manifestations of sexual violence from penal sanctions. Such normative deficiencies necessitated the promulgation of Law No. 12 of 2022 concerning Sexual Violence Offenses (UU TPKS) as a dedicated statute designed to address legislative lacunae and bolster comprehensive victim protections. This research seeks to scrutinize the mechanisms of legal safeguards extended to sexual violence victims pursuant to UU TPKS, alongside evaluating the degree to which said regulation delivers juridical predictability and equity for victims in the framework of Indonesia's material criminal law. Normative juridical inquiry is adopted herein, incorporating statutory analysis and case-based examination. Primary legal materials encompass pertinent statutes and judicial rulings, whereas secondary materials include academic publications, peer-reviewed journals, and doctrinal expositions relevant to the research theme. The outcomes of this investigation reveal that UU TPKS heralds substantial advancements in the architecture of juridical safeguards for sexual violence victims. Key innovations encompass broadening the conceptualization and ambit of sexual violence offenses to encompass nine distinct categories, formal acknowledgment of victims' entitlements, institutionalization of support and rehabilitation protocols for victims, and fortification of victim-oriented procedural norms. Nonetheless, implementation encounters multiple obstacles, notably the alignment of provisions between UU TPKS and the revised Criminal Code (Law No. 1 of 2023), coupled with the preparedness of enforcement agencies to enforce the novel statute uniformly.

Abstract

The transformation of modern social structures has encouraged changes in gender roles within contemporary Muslim families, particularly in dual-income families where both husband and wife actively participate in productive economic activities. These changes have created new dynamics in family maintenance relations, which were previously constructed based on patriarchal structures that positioned men as the primary breadwinners. This study aims to analyze the transformation of gender roles and maintenance fulfillment in dual-income families from the perspective of international human rights law. This research employs normative legal research using conceptual, statutory, and international human rights approaches. Legal materials were obtained from international human rights instruments, national regulations, Islamic family law literature, and relevant previous studies. The findings indicate that the transformation of dual-income families has shifted maintenance relations from unilateral patterns toward more participatory and cooperative relationships. However, patriarchal social structures continue to place women in double burden situations due to their simultaneous involvement in productive and domestic work. From the perspective of international human rights law, this condition demonstrates the importance of strengthening substantive equality principles and promoting a more proportional distribution of family responsibilities. Therefore, reconstruction of maintenance relations based on shared family responsibility is necessary to establish family relations that are more just, participatory, and oriented toward the protection of human rights within modern families.

Abstract

This study analyzes Teddy Indra Wijaya’s communication style and leadership as Cabinet Secretary within the context of governmental political communication. It employs a case study method with a qualitative descriptive approach to gain an in-depth understanding of communication patterns, leadership style, and the meanings embedded in bureaucratic governance practices. The theoretical concept used is Ramlan Surbakti’s theory of legitimacy, which views legitimacy as public acceptance and recognition of government authority, decisions, and policies. Based on this framework, communication that is firm, structured, and hierarchical is understood not only as a mechanism for delivering instructions, but also as an effort to build work order, strengthen cabinet coordination, and maintain public recognition of governmental authority. The findings show that Teddy’s communication style tends to be bureaucratic and top-down, with implications for political message control, internal consolidation, and the formation of an image of a responsive and controlled government. These findings indicate that in strategic office, political communication serves as an important instrument for strengthening institutional legitimacy and maintaining public trust in the government.

Abstract

The development of the digital economy in Indonesia has had a significant impact on business competition practices, especially through e-commerce platforms. Digital business models loaded with network effects and dominance of large platforms pose new problems in the enforcement of business competition laws. Satjipto Rahardjo's progressive legal approach can be an alternative to dealing with this complexity. This approach views law not only as a set of rules, but as a tool to achieve justice and improve public welfare. Using this approach, the law enforcement of business competition in the digital era is not only oriented towards legal certainty, but also towards the protection of small business actors, consumers, and the sustainability of the digital economic ecosystem.

Abstract

Law Number 17 of 2025 on the 2026 State Budget maintains the twenty percent minimum threshold for education spending, yet channels most of that allocation to finance the Makan Bergizi Gratis (MBG) program, raising a constitutional problem that touches the imperative character of Article 31(4) of the 1945 Constitution. This study assesses the constitutionality of charging MBG financing to the education budget while clarifying the limits of the legislature's authority to interpret the scope of education mandatory spending. Employing normative legal research with statutory, conceptual, historical, and case approaches, it draws on the doctrine of constitutional mandatory spending and the theory of the Constitutional Court as a negative budgeter. The findings show that nominal fulfillment of the twenty percent threshold does not legitimize a cross-sectoral diversion of purpose; charging MBG to the education budget is unconstitutional in its allocation because nutritional benefits are not constitutive of education as confined by the Court to education directly enjoyed by the public. The legislature lacks authority to redefine a constitutional mandate through an appropriations law of an administrative (beschikking) character, whereas the Court may correct the allocation as a negative budgeter through a conditionally constitutional ruling. The novelty lies in reading the diversion as constitutional distortion and offering a purpose-fidelity test, an operationalization of the budget specialty principle (specialiteitsbeginsel) in the constitutional domain as a parameter for assessing expenditures counted as education budget. Abstract

Abstract : Corruption in Indonesia has caused substantial financial losses to the state and is classified as an extraordinary crime. Law No. 31 of 1999, as amended by Law No. 20 of 2001 concerning the Eradication of Corruption, places greater emphasis on the use of criminal law instruments. Consequently, the recovery of assets derived from corruption has not been carried out effectively. This study examines the concept, requirements, and legal basis for filing civil claims as a mechanism to recover assets obtained through corruption. Abstract

Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan belum mengatur secara eksplisit hak ganti rugi pasien akibat keterlambatan pelayanan, sehingga memicu kekaburan norma dan ketidakpastian hukum. Penelitian yuridis normatif bertipe kepustakaan ini mengkaji permasalahan tersebut melalui pendekatan perundang-undangan, kasus, dan konseptual. Hasil penelitian menunjukkan bahwa Pasal 305 ayat (1) lebih menitikberatkan pada aspek kelalaian medis. Hal ini memunculkan empat bentuk kekaburan norma—yakni kekaburan substansi, cakupan, relasional, dan akibat hukum—yang berujung pada ketidakseragaman kompensasi otonom di berbagai fasilitas kesehatan. Melalui analisis teori kepastian serta perlindungan hukum, dan perbandingan dengan sistem No-Fault Compensation di Selandia Baru, disimpulkan bahwa rekonstruksi norma sangat mendesak. Revisi Pasal 305 ayat (1) direkomendasikan dengan mengintegrasikan frasa "keterlambatan pelayanan medis", mendefinisikan keterlambatan operasional, mengatur batas waktu standar, serta menetapkan besaran kompensasi minimum. Langkah ini krusial guna menjamin kepastian hukum pasien dan menjadi pedoman penyusunan kebijakan internal fasilitas pelayanan kesehatan.

Abstract

The increasing number of International Environmental Agreements (PLIs) has prompted the development of various efforts to assess the effectiveness of global environmental governance. Most research focuses on measuring agreement success through indicators of performance, compliance, and observable environmental achievements. However, academic attention to evaluation strategies used to define and measure effectiveness is still relatively limited. As a result, the epistemological assumptions and political implications inherent in evaluation practice often go unnoticed. This article aims to critically analyze the various strategies for assessing the effectiveness of International Environmental Agreements and examine how different evaluation paradigms result in different understandings of effectiveness. The research uses a qualitative approach with a meta-methodological analysis design supported by document analysis of evaluation reports, policy documents, and academic publications, with the Montreal Protocol and the Convention on Biological Diversity (CBD) used as illustrative cases. The results of the study identified three main paradigms in effectiveness evaluation, namely rationalist-positivistic, constructivist-processual, and critical-reflective. Each paradigm prioritizes different forms of evidence, indicators of success, and governance priorities, resulting in an effectiveness narrative that is not always in line. These findings suggest that effectiveness cannot be understood as a fully objective and neutral condition, but rather as a construct formed through methodological choices, epistemological assumptions, and power relations inherent in evaluation practice. As a conceptual contribution, this article offers a Reflexive Evaluation Framework that integrates the dimensions of environmental outcomes, institutional learning, and justice and transformation to produce an evaluation approach that is more reflective, multidimensional, and sensitive to the complexities of global environmental governance.

Abstract

Partner notification in cases of sexually transmitted infections (STIs) and HIV has become an increasingly relevant ethical and legal issue in Indonesia following the enactment of Law Number 17 of 2023 on Health and the 2024 Technical Guidelines for Partner Notification of People Living with HIV (PLHIV), as it creates a dilemma between the obligation to maintain medical confidentiality and the responsibility to prevent transmission to partners. This study aims to analyze the ethical and legal foundations of assisted partner notification (APN) implementation in Indonesia and to identify the model most consistent with bioethical principles and applicable regulations. A normative juridical approach using systematic review methods was applied to literature retrieved from PubMed, Scopus, SciSpace, and Google Scholar, as well as relevant national regulatory documents, covering publications from 2012 to 2025. The findings reveal three APN models practiced in Indonesia—patient referral, provider referral, and dual referral—with dual referral receiving the highest acceptance among stakeholders. Bioethical principles (autonomy, beneficence, non-maleficence, and justice) together with the applicable legal framework provide conditional justification for the disclosure of medical confidentiality in the interest of public health. Voluntary, consent-based dual referral APN is the model most compatible with ethical and legal values in Indonesia, provided that technical regulations and healthcare provider capacity are strengthened.

Abstract

Temuan arkeologi pangkalan angkatan laut era Kekaisaran Parthia di Minab, Provinsi Hormozgan, Iran, memberikan perspektif baru mengenai perkembangan strategi geopolitik maritim pada masa kuno. Penelitian ini bertujuan menganalisis persamaan dan perbedaan strategi maritim Parthia, Sriwijaya, dan Majapahit melalui pendekatan sejarah komparatif dalam konteks Jalur Sutra Maritim. Penelitian menggunakan metode kualitatif dengan memadukan pendekatan sejarah komparatif, geografi militer, dan analisis multidisipliner terhadap sumber arkeologis, epigrafis, tekstual, serta literatur sejarah maritim. Analisis difokuskan pada tiga variabel utama, yaitu penguasaan maritime chokepoint, fungsi pangkalan laut sebagai instrumen geopolitik, dan hubungan antara kekuatan ekonomi dengan perlindungan militer di laut. Hasil penelitian menunjukkan bahwa ketiga peradaban mengembangkan infrastruktur maritim di lokasi strategis untuk mengendalikan jalur perdagangan, memproyeksikan kekuatan militer, dan mendukung stabilitas ekonomi melalui pengawasan pelayaran serta fungsi fiskal. Meskipun memiliki model kekuasaan yang berbeda—Parthia berorientasi pada pertahanan pesisir, Sriwijaya menerapkan sistem thalassocracy, dan Majapahit mengintegrasikan kekuatan agraris dan maritim—ketiganya memperlihatkan pola geopolitik yang serupa dalam pemanfaatan pangkalan laut sebagai instrumen negara. Penelitian ini menegaskan bahwa pembangunan pangkalan laut merupakan bagian dari tradisi geopolitik maritim yang telah berkembang sejak lebih dari dua milenium serta memberikan kerangka konseptual bagi pengembangan kajian arkeologi pertahanan maritim di Indonesia.
