In the view of sharia, prospering and building mosques is a sacred commandment and includes noble practices, as well as ta'awun and mutual aid are true forms of implementation of sharia. Therefore, the problem faced by partners is that the condition of the mosque is small and made of wood, worthy of renovation and the community is given guidance to be aware of the importance of ta'awun and prosper the mosque. So this construction took a big theme, namely how to build the community with the guidance of the concept of ta'awun and mutual aid syariah in prosperity and the establishment of a new Darus Salam mosque in Griya Salam Boyolali. The method used in this study is qualitative, a type of field study, with phenomenological, descriptive, and normative approaches to religion. The results of this guidance show that the concept of ta'awaun, cooperation, and mutual help, is a practical and effective concept for realizing socio-religious programs, especially in the construction of the Darus Salam Mosque in Griya Salam housing.

Abstract

This study aims to investigate the law of mu’athah buying and selling transactions by referring to the rules of fiqhiyyah Al Istihsanu bil 'urf that occur in supermarkets. A qualitative approach with library research methods was used in this study, where data were obtained from books and journals. The data collection method used is descriptive analysis, with content analysis techniques. Research findings show that in business transactions, contracts have a vital role in people's lives, becoming the basis for various human activities. Akad becomes the framework of transactions in the Islamic economy, enabling the implementation of various business and economic activities. The Islamic view of the contract has no particular limitations, as long as it meets the requirements and pillars of the contract. However, with the progress of the times, the contract can be made directly, without using words, writing, or gestures, but rather through the actions of both parties that reflect the agreement, known as bai' mu’athah transactions. These transactions generally occur in supermarkets, using modern methods such as electronic media in the form of barcodes that can only be read by machines. Although this bai' mu’athah transaction does not fully meet the conditions and pillars of the contract, according to Maliki, the most basic is the custom that shows the agreement and willingness of both parties. Some Shafi'i scholars also allow bai' mu’athah transactions.

Abstract

An increasingly complex financial system requires Muslim scholars to closely observe the limits of what Sharia allows. The scholars of Fiqh agreed that Ar-Rahn could be done on the way and in a state of presence on the spot. As long as the collateral can be directly held/legally controlled by the receivable. This study used a descriptive qualitative method. In this case, the Rahn contract is analyzed using regulations, as well as the postulates underlying the formation of the contract to develop to this day. Financing accompanied by al-Rahn (al-Tamwil al-Mautsuq bi al-Rahn) is the permissibility of Rahn contracts only for accounts receivable (al-dain) which include factors of (1) qard contracts, (2) non-cash buying and selling (al-bai) and (3) lease contracts (ijarah) whose ujrah payments are non-cash or tajil.

Abstract

This study aims to evaluate financing practices with murabahah contracts carried out by Islamic Banks in Indonesia. While this practice can generate significant profits, there are risks of adherence to sharia principles. The main issue involves the use of the wakalah contract and the existence of murabahah objects. Research shows that wakalah contracts are still made at the same time as murabahah contracts, and the existence of murabahah objects is not always ascertained by Islamic banks. In overcoming this dilemma, Islamic banks need to maintain a balance between seeking maximum profit and complying with Islamic financial principles. Strategies such as ensuring compliance with Sharia principles, product diversification, employee and customer education, building partnerships, developing technology, and maintaining transparency and accountability can be adopted. By implementing this strategy, Islamic banks are expected to achieve adequate profitability while still adhering to Sharia principles, strengthening their position in increasingly competitive financial markets.

Abstract

The management of zakat funds for education can be realized in the form of an education care program by providing education costs to students who come from poor families. However, zakat institutions that distribute aid for education are still widely used by the community for their own operational needs. Research was conducted to gain an understanding of the management of zakat funds in education at the Yatim Mandiri zakat institution, as well as the perspective of Sharia economic law in managing zakat at this institution. The research method used is qualitative with a descriptive approach through interviews and observation.  The research results show that there are five fund management procedures implemented by schools, as determined by the Yatim Mandiri Foundation, namely: financial planning, receiving funds, disbursing funds, accountability for funds, and financial control. The distribution of zakat funds for education by Yatim Mandiri is included in the productive zakat given directly by mustahik, namely schools, as a real investment which is considered to be on target.

Abstract

Allah Almighty has fully established the Sharia laws relating to the field of worship and creed. Establishing the Shari'a is always based on the general principles of Shari'a actions, not burdensome, not increasing the burden, and gradually. Establishing laws is also in line with the good of the crowd. The establishment of Islamic law is divided into two forms, namely dhanny, and qatiiyah. Dhanni is a law whose nature has not been able to fulfil its one hundred per cent capacity of truth in a matter. This problem is not closed to the possibility for jurisprudence scientists to differ in views on the legal status. The so-called qat’iyah is a law that is true and also has a clear purpose, so there is no way for dissent. Problems arise with the development of time. Man needs protection that can protect himself or one's soul. It is necessary to have a company that can provide guarantees or guarantees for oneself or one's soul. The company is in the form of insurance. The research aims to analyze insurance laws that are developing today. This article is classified as literature research with a qualitative approach. The methodology used is an empirical juridical study. The results of the study concluded that as long as the insurance is applied there is no element of usury, element of maisir, and element of fraud, it is permissible in Islam.

Abstract

This study aims to explore the implementation of the salam contract in the view of Sharia and analyze its prospects in the context of practice in the field. The research method used was a survey study involving participants consisting of religious experts, Islamic finance practitioners, and the general public. Data was collected through questionnaires and interviews to gain a comprehensive understanding of their views on the greeting contract. A qualitative analysis was conducted to understand the implications of sharia and the practical prospects of implementing the salam contract. The results showed that the Salam contract can be implemented by taking into account relevant sharia principles, such as fairness and clear legal provisions. However, challenges may arise regarding uniform understanding and the need for appropriate regulation to facilitate widespread practice in the field. The prospect of implementing the contract of greetings in financial and trade transactions promises more inclusive and sustainable economic sustainability under Sharia principles. This research provides a deeper understanding of the relevance and potential of the salam contract in the context of Islamic economics and provides a foundation for further development in its practice in the field.
