Abstract

Hukum positif Indonesia membatasi jaminan atas tanah hanya melalui Hak Tanggungan, praktik gadai tanah dan kuasa untuk menjual masih kerap digunakan dan bahkan dilegitimasi melalui putusan pengadilan, sehingga menimbulkan persoalan terhadap kepastian hukum, perlindungan debitur, dan konsistensi penerapan sistem hukum jaminan kebendaan. Tujuan penelitian ini adalah untuk menganalisis keabsahan pemberian kuasa untuk menjual dalam perjanjian hutang piutang berdasarkan ketentuan hukum perjanjian dalam KUHPerdata, khususnya terkait syarat sah perjanjian dan asas kebebasan berkontrak, serta untuk mengkaji kedudukan penggunaan tanah sebagai gadai yang disertai kuasa untuk menjual ditinjau dari Undang-Undang Pokok Agraria dan ketentuan Hak Tanggungan sebagai satu-satunya lembaga jaminan kebendaan atas tanah di Indonesia. Hasil penelitian menunjukkan bahwa pemberian kuasa untuk menjual dalam perjanjian hutang piutang pada dasarnya dapat dinyatakan sah secara formil apabila memenuhi syarat sah perjanjian menurut KUHPerdata, namun secara materiil menjadi problematik ketika digunakan sebagai instrumen jaminan atas tanah di luar mekanisme Hak Tanggungan, karena berpotensi bertentangan dengan ketentuan hukum yang bersifat memaksa; demikian pula penggunaan tanah sebagai gadai yang disertai kuasa untuk menjual, meskipun diakui sah sebagai perjanjian obligatoir dalam Putusan Nomor 97/Pdt.G/2024/PN Bjb, tidak memiliki kedudukan sebagai jaminan kebendaan yang sah menurut UUPA dan UU Hak Tanggungan, sehingga tidak melahirkan hak preferen maupun kekuatan eksekutorial dan berpotensi menimbulkan ketidakpastian hukum dalam sistem jaminan atas tanah di Indonesia.

Abstract

Pendidikan jasmani, olahraga dan kesehatan (PJOK) memberikan kesempatan kepada siswa untuk terlibat langsung dalam aneka pengalaman belajar melalui aktivitas jasmani, bermain dan berolahraga yang dilakukan secara sistematis. Selain aktivitas jasmani, untuk menunjang aktivitas gerak tersebut adalah bagaimana kecukupan gizinya. Kecukupan zat nutrisi akan menunjang perkembangan dan pertumbuhan siswa, baik perkembangan fisik maupun psikologisnya. Status nutrisi merupakan ukuran keadaan nutrisi seseorang, kecukupan nutrisi yang diperoleh dari zat-zat makanan sehari-hari, status nutrisi yang baik akan mencerminkan kualitas fisik yang baik. Status nutrisi yang kurang akan mencerminkan fisik yang rendah dan akan memberikan dampak pada tingkat kebugaran jasmani. Penelitian ini bertujuan untuk mengetahui hubungan antara status nutrisi terhadap peningkatan kebugaran jasmani siswi kelas 1V SDK Santa Theresa Ende 03 dan untuk mengetahui seberapa besar sumbangan status nutrisi terhadap tingkat kebugaran siswi kelas IV SDK Santa Theresa Ende 03. Jenis penelitian ini adalah penelitian kuantitatif dengan metode korelasional. Instrumen yang digunakan untuk mengukur kebugaran jasmani menggunakan MFT dan untuk status nutrisiĀ  menggunakan IMT/U. Analisis data yang digunakan koefisien kontingensi. Berdasarkan hasil penelitian diperoleh hasil bahwa siswi yang mempunyai status nutrisi kurus berjumlah 8 orang dan mempunyai kebugaran jasmani kurang sekali, demikian halnya dengan siswi yang mempunyai status nutrisi gemuk yang berjumlah 12 orang mempunyai kebugaran jasmani kurang sekali, siswi yang mempunyai status nutrisi obesitas berjumlah 2 orang dan mempunyai kebugaran jasmani kurang sekali, sementara itu siswi yang mempunyai status nutrisi normal berjumlah 38 orang. Hasil perhitungan data menggunakan program SPSS 20.0 menunjukkan hasil value sebesar 0,416 dan sig 0,002. Hal ini menunjukkan bahwa sig (0,002) < alpha 0,005, yang berarti H0 ditolak dan H1 diterima. Jadi dari hasil penelitian ini dapat diketahui bahwa dampakĀ  status nutrisi berhubungan dengan kebugaran jasmani khususnya pada siswa kelas SDK Santa Theresa Ende 03.

Abstract

This study aims to identify and analyze the principal's management strategy, describe the steps of its implementation, and determine the strategic role of the principal in improving public trust and the quality of education at SMA Negeri 1 Balen Bojonegoro. The background of this research is based on the phenomenon of fluctuating public trust in the quality of public schools amidst increasingly competitive inter-institutional competition, which demands management innovation at the education unit level. This research uses a qualitative approach with a descriptive case study type. Data collection was carried out through participatory observation techniques, in-depth interviews with the principal, vice principals, teachers, school committee, and representatives of students' parents, as well as documentation studies on the Strategic Plan and School Profile. Data analysis was operated using the interactive model of Miles, Huberman, and Saldana which includes data condensation, data presentation, and drawing conclusions. The results of the study present three main findings. First, the management strategy relies on the implementation of School-Based Management (SBM) through participatory communication, differentiation of flagship programs (tahfidz program and vocational double track), and optimization of excellent service. Second, strategic steps are implemented comprehensively and systematically through the POAC (Planning, Organizing, Actuating, and Controlling) cycle driven by Education Report Card evaluation data. Third, the principal plays an essential role as a manager, innovator, and motivator by promoting a transformational leadership style. Empirically, the transparency of management governance and the improvement of the quality of graduate services have proven to significantly restore, build, and increase participation and public trust holistically in the existence of SMAN 1 Balen Bojonegoro.

Abstract

This study aims to describe and analyze the implementation of Character Education Management (MPK), identify influencing factors, and analyze the implications of MPK implementation on the formation of students' morals at UPT SMPN 5 Gresik and SMP Muhammadiyah 7 Gresik. This research uses a descriptive qualitative approach with a multi-site case study design. Data collection was carried out through in-depth interviews, participatory observation, and documentation study. The results showed that: (1) MPK in both schools is implemented systematically through the functions of planning, organizing, actuating, and controlling. UPT SMPN 5 Gresik integrates the values of the Pancasila Student Profile, while SMP Muhammadiyah 7 Gresik emphasizes the internalization of ISMUBA (Al-Islam, Kemuhammadiyahan, and Arabic) values through a boarding school pattern; (2) The main supporting factors are the visionary exemplary of the Principal and teacher synergy, while the inhibiting factors include the asymmetry of parenting styles and the negative impact of gadgets; (3) The implications of MPK proved significant in increasing discipline, spiritual piety in worship, and strengthening social etiquette by decreasing the rate of bullying in the school environment

Abstract

Education in Madrasah Ibtidaiyah demands an intact balance among intellectual, emotional, and spiritual intelligence. Extracurricular activities play a highly crucial role as a vehicle to develop students' academic and non-academic potentials holistically. However, empirical reality shows that its implementation in various madrasahs is often constrained by suboptimal management governance and the erroneous paradigm assuming these activities consume classroom study time. This qualitative research with a multi-site study design aims to describe and analyze in-depth the extracurricular management strategies at MIN I and MI ICP Nurul Ulum Bojonegoro. The main instrument in this research is the researcher themselves (human instrument). The data collection procedure utilized in-depth interviews, participant observation, and documentation study techniques. Data analysis was conducted through the stages of data condensation, data display, and conclusion drawing, both individually and cross-site. The research findings indicate that extracurricular management strategies have been implemented comprehensively through scientific talent mapping-based planning, professional coach organizing, integrative actuating, and quality-oriented controlling functions. The success of this management implementation is significantly supported by the transformational leadership of the madrasah principal and the synergy of the Three Education Centers (school, family, community) which effectively overcomes the constraints of limited time. Practically, this extracurricular management provides symbiotic implications in the form of a transfer of learning phenomenon, where honed character intelligence is proven to boost students' cognitive academic achievements. This research contributes to offering an integrative and adaptive extracurricular management model for the scientific development of Islamic basic education management.

Abstract

This study aims to produce a product by developing multimedia learning assisted by Google Sites and to determine the level of validity, practicality, and effectiveness on students' cognitive learning outcomes. This study uses a Mix Method research approach with the type of Research and Development (R&D) research using the ADDIE development model consisting of five stages, namely analysis, design, development, implementation, and evaluation. The research subjects were grade XI students at MA Negeri Sidenreng Rappang. Data collection techniques used questionnaires, observations, and learning outcome tests. The results of the study showed that based on expert assessments of media and multimedia learning materials assisted by Google Sites were in the very valid category. The level of practicality was in the very practical category. Meanwhile, the results of the N-Gain test showed a fairly effective category value. Thus, multimedia learning assisted by Google Sites is suitable for use in mathematics learning.

Abstract

This study is motivated by the dominant use of conventional teaching methods, which makes butterfly metamorphosis material difficult for students to understand and results in low creative thinking skills. The purpose of this study is to develop a diorama learning media on butterfly metamorphosis and to examine its feasibility and effectiveness in improving elementary school students' creative thinking skills. This research employed the Research and Development (R&D) method using the ADDIE model, which consists of analysis, design, development, implementation, and evaluation stages. The subjects were 34 third-grade students of SDN 1 Pengkol Jepara. Data collection techniques included interviews, expert validation questionnaires, student responses, and pretest-posttest. The results showed that the diorama media was categorized as highly feasible by media experts (average score of 9.6) and feasible to highly feasible by material experts. Student responses also indicated a very feasible category. Effectiveness testing showed an increase in creative thinking skills with an average score of 80.5. The data were normally distributed and homogeneous, and the paired sample t-test result (0.000) indicated a significant positive difference. Therefore, the developed diorama media is proven effective in enhancing students' creative thinking skills.

Abstract

There has been a growing debate on the differences between native speaker and non-native speaker teachers in English language teaching in Indonesia. The issue of native-speakerism has put non-native teachers in the corner where they feel inferior over native teachers. This native-speakerism issue then make the students and language institution favour the native speakers more than the local teachers. Thus, this research aims to investigate the role of both native and non-native English teachers in Indonesia. This study employs a qualitative literature review method, drawing on scholarly articles, books, and academic publications related to English as a Lingua Franca, and native-speakerism. The data were collected through systematic analysis of relevant literature from reputable academic databases. The findings indicate that the distinction between native and non-native English speakers remains influential but is gradually being redefined. Both native and local teachers have their own strengths and weaknesses. Native speakers teacher may have some benefits on language teaching, however, marginalizing the non-native teacher is also not a good idea. Recognizing the legitimacy and contributions of non-native speakers is essential for developing more inclusive and realistic approaches to English language use and education in a globalized world.

Abstract

Sexual violence against children is a form of human rights violation that has serious impacts on the physical, psychological, and social conditions of victims. Cases of rape against children perpetrated by educators in Islamic boarding schools demonstrate structural vulnerabilities influenced by power relations between educators and students and a culture of strong obedience to authority. This study aims to analyze legal protection for child victims of rape perpetrated by educators in Islamic boarding schools and examine recovery efforts for victims from a victimology perspective. This study uses a normative juridical research method with a statutory regulatory approach and a conceptual approach, analyzed through primary, secondary, and tertiary legal materials. The results show that normative legal protection for child victims of sexual violence has been regulated in various laws and regulations, such as the Child Protection Law and the Law on Sexual Violence Crimes. However, in practice, law enforcement still faces obstacles in the form of power relations, social stigma against victims, and a criminal justice system that is still oriented towards the perpetrator. From a victimology perspective, protection and recovery for victims must be carried out comprehensively through a victim-oriented approach, which includes psychological, social, economic, and legal recovery. Therefore, synergy between law enforcement officials, child protection agencies, educational institutions, and the community is needed to ensure that victims' rights are optimally fulfilled.

Abstract

This study aims to produce a valid and practical Doratoon web-based science learning video media for eighth grade students at UPT SMP Negeri 2 Kulo. The background of this study is the low visualization of abstract science concepts, so it requires innovative media to help students' understanding. The research method used is Research and Development (R&D) with the ADDIE (Analysis, Design, Development, Implementation, Evaluation) development model. Data collection instruments include validation sheets for material experts and media experts, as well as response questionnaires for teachers and students to measure practicality. The results of the study showed that the Doratoon learning video media was declared "Very Valid" by material experts with a score of 92% and media experts with a score of 88%. The results of the practicality test by teachers obtained 90% results and 92% of students also showed the "Very Practical" category. Thus, this Doratoon-based learning video media is valid and practical to be used as a supporting tool for science learning to visualize complex concepts in an interesting and interactive manner.
