Abstract

The mechanism for resolving land rights disputes in the District Court is always handled by a judge, and before reaching an examination with an evidentiary agenda, the parties to the case will carry out efforts at peace or mediation. The judge/judicial panel, clerk/substitute clerk, and bailiff/substitute bailiff together with the parties present go to the location of the object to be inspected and carry out the inspection. The first thing that is asked for information is from the plaintiff in accordance with the contents of the lawsuit. The local inspection carried out by the judge has the function of assisting the judge in making his decision. The problems that arise are related to the role and function of the local inspection of the disputed object in the form of land if it is related to the construction of evidence in civil cases The problem formulation in this research is (1) Has the local examination of the object of a land dispute in a civil case provided legal certainty? (2) What are the legal implications of a local examination of a civil case object? and (3) What is legal certainty in future arrangements for local inspections of land objects in civil cases. From the results of the research carried out, it was found that local inspections were based on Article 153 HIR, Article 180 RBg and Articles 211 – 214 Rv and SEMA No. 7 of 2001 does not yet reflect legal certainty because it does not regulate in detail the local inspection mechanisms in the field, giving rise to multiple interpretations. Apart from that, the local examination is still ambiguous as to whether it is evidence whose evidentiary value is left to the judge or whether the local examination is not included in the category of evidence, it is an examination tool or method to obtain evidence. The results obtained in the local inspection are valid evidence. The legal implications of a local examination of a civil case object are (1) on the costs of the case if the judge desires a local examination, (2) on the evidentiary strength of the local examination. These two things contain legal consequences that need to be clarified in future regulatory aspects. Legal certainty in the future regulation of local inspections of land objects in civil cases is that all cases involving immovable objects such as land must be carried out locally and preferably carried out after further examination of evidence to overcome differences in the practice of carrying out local inspections. Uniformity of these arrangements is very important to create legal certainty regarding local inspections. Regulations regarding local examinations must be established at the statutory level so that they have strong binding power on all parties involved in the case, including judges, clerks and all.

Abstract

Bureaucratic politicization refers to introducing bureaucratic reform in the management of regional government. The regional head and deputy regional head posts are political roles that oversee administrative positions within a region, so political influence is inherently intertwined with the bureaucracy. Dharmasraya Regency exhibits signs of bureaucratic politics, as seen by a vacancy in the position of deputy regent. This vacancy has resulted in numerous examples of non-job ASN inside the government of Dharmasraya Regency. This thesis seeks to analyze the political dynamics involved in the transition of bureaucratic positions in Dharmasraya Regency, particularly after the vacancy of the deputy regent position. This study employs a qualitative research methodology utilizing a case study approach. This thesis uses the theory of bureaucratic politicization pioneered by Barbara Geddes. The findings of this study suggest that there are indicators of the techniques employed by the regent in his role as PPK to determine bureaucratic positions. The regent also has a vested interest in the bureaucracy, as he desires a loyal and efficient bureaucratic system to ensure continued control until the end of his term. The regent's politicization of the bureaucracy is seen in the ambiguous enforcement of heavy sanctions against ASN.

Abstract

Physicians and dentists knowingly practising medicine without a practice license are subject to penalties under Article 76 of Law Number 29 of 2004 concerning Medical Practice. These penalties can include up to three years in prison or a fine of up to IDR 100,000,000..00 (one hundred million rupiah). The defendant, Putri Regita Yuniar, was referred to as Putri Binti, the late Edward Sebastian, in Decision Number 598/Pid.Sus/2022/PN.Pdg. The problem is formulated as follows: First, based on Decision Number 598/Pid.Sus/2022/PN.Pdg, what factors does the court consider when rendering a criminal decision for offences in the medical practice area? Second, according to Decision Number 598/Pid.Sus/2022/PN.Pdg, what is the criminal liability of defendants who commit offences in the medical practice area? This research's specifications are descriptive. This thesis was written using a normative juridical method. This study exclusively employed secondary data sources. The collected data was given descriptively after undergoing qualitative analysis. The following conclusions can be drawn from the research and discussion: first, the judge's factors when rendering a criminal decision for criminal acts in the medical practice area are classified as non-juridical factors, which include the defendant's aggravating and mitigating circumstances, and juridical factors, which are based on information presented during the trial, including the public prosecutor's indictment, witness statements, and the defendant's statements. Second, the defendant Putri Regita Yuniar, also known as Putri Binti, the late Edward Sebastian, was condemned by Law Number 29 of 2004 concerning Medical Practice, Article 78 in connection with Article 73 paragraph (2).

Abstract

The problems of Simarasok UMKM were identified: (1). The products have not been maximized due to marketing weaknesses, capital, and the purchasing power of woven/songket products tends to decrease, (2). Embroidery UMKM are part-time livelihoods for unmarried women and housewives, (3). There is no group of innovative skilled workers, (4). Marketing strategies are more on personal relationships, close proximity and less online sales, (5). Product quality/quantity can be improved, but constrained by external internal factors. The research used qualitative techniques and descriptive analysis; informants were collected by purposive sampling. Data findings, there are specialties of UMKM: 1). The embroidery industry has developed and is carried out by almost half of the female population, 2). Sugarcane and tobacco processing industry, conducted by men. There is a difference between the type of industry and the gender of the actors, which is not interchangeable. 3). Based on scale, the industries are small. Interestingly, UMKM development is carried out through an integrated information system. Although located in rural areas, Nagari Simarasok has utilized spatial technology as an integrated information system in mapping the condition of its UMKM. In this Nagari, a complete map with specifications such as maps of industrial asset ownership, maps of agricultural land potential, maps of economic potential and maps of natural resource potential can be accessed. With the completeness of the map, access to buyers, consumers and or other parties can more easily access it.  This Nagari breakthrough has not even existed in urban villages in the city center.

Abstract

The National Commission Against Violence against Women, also known as Komnas Perempuan, was established over a decade ago in Indonesia. The ratification of numerous policies to protect women also applies in this situation. Paradoxically, there continues to be a significant number of crimes targeting women, with one such crime being the act of trafficking women. The problem is being defined as follows: 1. What is the legal framework governing the offence of human trafficking in women in Indonesia? The implementation of legal policy against the crime of trafficking in women in Indonesia is assessed. Indonesia's legal policy on criminal trafficking of women has been regulated, but its implementation has not been optimal. This is evident from the increasing number of trafficking cases in the country. The Indonesian government needs to take appropriate measures to reduce or minimize these criminal acts. This can enhance underlying variables, such as economic, social, cultural, and political advancements.

Abstract

One of the activities an organization performs involves providing services to both internal units and external parties. Within an organization or institution, administration serves as a hub for the exchange of goods and services. Teacher satisfaction within the personnel administration process of the South Sumatra Provincial Education Service holds significant importance, as it can yield considerable impacts. The research employs a quantitative descriptive analysis technique with percentages to analyze data, effectively portraying and elucidating the collected data. The data analysis results reveal that teacher satisfaction with personnel administration services indicates a 54.6% overall satisfaction rate across five aspects and 30 service indicators. Among the aspects studied, the highest satisfaction level pertains to reliability, while the lowest satisfaction level belongs to empathy and assurance aspects, albeit remaining within the satisfaction range. This demonstrates that the services delivered by the Manpower Division at the South Sumatra Provincial Education Office are categorized as good, resonating with a notably high level of teacher satisfaction.
