Abstract

This article aims to explain commendable attitudes and actions or good behavior referred to in law as a condition for modifying the death penalty and aims to understand the concept of commendable attitudes and actions from the perspective of Islamic criminal law. The problem focuses on the commendable attitudes and actions referred to in Article 100 of Law Number 1 of 2023 concerning the Criminal Code. This is ambiguous because the indicators and benchmarks for the commendable attitudes and actions in question have not been clearly regulated so they are very subjective. The writing method uses a normative approach and data collection techniques use library research. This research is descriptive and aims at problem-solution. The results of the research show that the concept of commendable attitudes and actions in Islamic Criminal Law towards death row inmates for the crime of premeditated murder has several indicators, namely: 1. Feeling of regret; 2. Responsible for his actions; 3. There is a desire to repent; 4. Get forgiveness from the victim's family. The achievement of this commendable attitude and action is to obtain forgiveness from the victim and pay compensation to the victim's family. The concepts exemplified by Islamic criminal law should be adapted into positive criminal law to explain the meaning of commendable attitudes and actions in order to achieve justice, certainty and usefulness of the law.

Abstract

The second Vice Presidential Candidate Debate in the 2024 General Election has the potential to cause polarization due to plural citizens/differences in society. Digital Communication, which has an educational function, is projected to be a mediator so that polarization can be minimized as much as possible. This research is a qualitative research with a descriptive approach regarding the role of digital communications in overcoming polarization following the debate for vice presidential candidates in the 2024 general election. The data that researchers use here is secondary data that researchers obtained from credible websites, books, scientific articles, and various other sources. which is commonly used in every other scientific research. The data in this research was analyzed using the stages of data collection, data selection, data reduction, and drawing conclusions. The result in this research show 1. Digital Communication can have a negative impact, namely causing polarization due to a society that is plural/full of differences if used in incorrect ways, provoking social rifts and conflicts, insulting each other, and so on. 2. Digital Communication can have a positive impact in order to minimize polarization in three ways, namely being used to create positive, non-provocative content, focusing on vision and mission, and debating substantive matters.

Abstract

Researchers believe that Institutional Ownership can have a positive relationship and a significant influence on a company's Financial Performance because more and more companies, government institutions, and so on as external parties owning shares in a company can increase the value of the company and ultimately have a good impact on Financial Performance. Therefore, this research aims to analyze the influence of institutional ownership on financial performance. Different from a number of previous studies, this research adds the Intellectual Capital variable as a moderating variable. This research is quantitative research with an explanatory approach. The data used in this research is secondary data that researchers obtained from PT's financial reports. Gudang Garam is spread throughout Indonesia. These data were analyzed using the smart PLS 4.0 analysis tool. The result in this article show the Institutional Ownership variable has a positive relationship and a significant influence on the Financial Performance variable because the p-values are below the significance level of 0.042. Apart from that, the Intellectual Capital variable can moderate the influence of the Institutional Ownership variable because the P-Values are also below the 0.05 significance level, namely 0.005. Thus the first and second hypotheses in this research can be accepted.

Abstract

This research aims to determine (1) the paradoxical influence of ethnocentrism in fostering multicultural identity as an attraction for super priority destinations; and (2) the paradoxical influence of ethnocentrism increases local tourists' interest in visiting super priority destinations. This research is qualitative-descriptive research. The results of this research show that (1) the ethnocentrism paradox has a positive influence on the development of super-priority tourism through multicultural identity, the government can take advantage of a society's ethnocentrism attitude at the right level to introduce local culture and customs, through tourist visits to local residential areas which generally still maintain tribal customs or through performances that introduce local regional arts in super priority destination areas in Indonesia; and (2) the paradox of ethnocentrism has a positive effect on local tourists' interest in traveling to super-priority destinations, tourists who have a high ethnocentrism attitude become more concerned about the existence of super priority destinations as domestic tourism.

Abstract

This research examines the influence of ethical and emotional leadership on employee motivation and job performance to measure intentions to leave work. This research is a deductive-quantitative research with a correlation-causal approach, using primary data obtained from an online survey using Google Form. Measurement of all variables used in this research uses a 1-5 Likert scale. The sample for this research is the entire population of Civil Servants at the Tangerang Regency Education Office, totaling 54 people, and using 28 indicators. Confirmatory Factor Analysis (CFA) was carried out to test the quality of the indicators used using pretest data. The data was then processed using the PLS-SEM method to test the hypothesis. The results of this research show that there are 2 related hypotheses, namely the relationship between emotional leadership and employee motivation and the relationship between employee motivation and job performance. Meanwhile, there are 4 hypotheses that have no effect, namely the relationship between ethical leadership and employee motivation, the relationship between ethical leadership and job performance, the relationship between emotional leadership and job performance, and the relationship between job performance and intention to leave work. It can be concluded that none of the Civil Servants intend to stop working, but instead motivate themselves to improve their performance to get more results, and leaders do not have a direct influence on motivation, work performance, and intention to stop working.

Abstract

Researchers believe that government spending that is good, measurable, based on research, efficient and effective can increase the Human Development Index in terms of improving the quality of education, quality of health and other things which in the end can have a good impact on the Human Development Index. Therefore, this research aims to analyze the influence of government spending on the Human Development Index. Different from previous studies, this research adds the Gross Domestic Product variable as a moderating variable which is believed to strengthen the influence of the Independent variable on the Dependent variable. This research is quantitative research with an explanatory approach which uses previous research as a benchmark/reference for finding new variations. The data used in this research is secondary data originating from the annual report of the Central Statistics Agency from 2018-2023. The data used in this research were analyzed using the smart PLS 4.0 analysis tool. The result in this research show the Government Expenditure variable can have a positive relationship and a significant influence on the Human Growth Index variable because the P-Values value is positive and is below the significance level of 0.05, namely 0.023. Apart from that, researchers also believe that the Gross Domestic Product variable can strengthen the influence of the Government Expenditure variable on the Human Growth Index. The researcher's confidence can be proven from the results of the second row of the third table of the Path Coefficient which shows the direction of a positive relationship and a significant influence. This is indicated by the results of the second line of the Path Coefficient which shows that the P-Values value is below the 0.05 significance level, namely 0.023. This means that the Gross Domestic Product of each province in Indonesia is good, continues to be stable, and even continues to increase every year, which can make the influence of the government budget and government expenditure stronger so that it has a good impact on the Human Growth Index. Thus, the first and second hypotheses in this study can be accepted.

Abstract

In today's era filled with digital technology, business-to-business (B2B) sales forces are driven to strengthen relationships with customers through social media platforms. This aims to build a high level of trust. This research aims to test and analyze the factors influencing customer loyalty in the B2B context of Micro, Small, and Medium Enterprises (MSMEs), which include the use of social media, especially Instagram, and the level of trust in customer loyalty. This study uses a causal explanatory approach. The sample consists of MSMEs that have relationships with suppliers and actively use Instagram as part of their business activities. Data collection methods involve surveys with questionnaires distributed to 171 respondents. Data collection techniques use purposive sampling method and are then analyzed using PLS-SEM. This research concludes that social media usage significantly affects customer trust, customer trust significantly affects customer loyalty, and Instagram usage significantly affects customer loyalty mediated by customer trust.

Abstract

Lemon (Citrus limon) is a fruit that is very popular with Indonesian people, with a fresh taste, contains vitamin C and has high marketability and economic value. Efforts to increase production cannot be separated from the problem of plant pests (OPT) in lemon plants, so it is necessary to seriously handle the pest problem. This research aims to determine the types of pests that attack lemon plants and the intensity of pest attacks on lemon plants at PT. Al Fatih Porang Indonesia. The research was conducted using a survey method with a population of 1,020 citrus plants that had reached the generative phase and the sample used was 51 plants (5% of the total population in accordance with Yount's theory, 1999) and each sample consisted of 4 sub-samples based on cardinal directions, so that the total the research unit was 204. The sampling pattern used a diagonal line pattern with a distance between sample plants of ± 6 m. The research procedure that will be carried out in this research is a pest inventory which is carried out in three stages, namely direct observation of sample plants, collecting insect pests found, and identification of the results of the collection in the laboratory. Observations were made on plant damage caused by pests in each sample unit by determining four branches as sample sub-units. The branches selected were branches that headed north, south, east and west by observing from the tip of the branch to all parts of the sample sub-unit (leaves, fruit, twigs). Apart from that, the main stem is also observed to see whether there is a stem borer attack or not. The damage observed was recorded in a table, then the presentation was calculated and the pests on the sample sub-unit branches and stems were collected and labeled, then identified in the laboratory with the help of the book Borror et al. (1992) and the book Key to Insect Determination translated by Achmad Sulthoni, et al. (1991). The output of this research is the final research report and scientific article with Accepted status in the Sinta 4 accredited journal.

Abstract

Researchers believe that the combination of two brands will make consumers more interested in the products offered and will ultimately decide to make a purchase kuantitatif. Therefore, this research aims to analyze the influence of CO-Branding strategies on Purchasing Decisions. Different from previous studies, this research adds the Brand Trust variable as a moderating variable. This research is quantitative research with an explanatory approach, namely research that uses a number of previous studies as a reference and basis by analyzing them more deeply until finding new novel elements. The main data used in this research is primary data that researchers obtained from credible and accountable respondents in the form of Oke Oce employees and consumers spread throughout Indonesia. This data is classified as primary data which was distributed using a questionnaire method to 150 employees and 150 oke-oce consumers spread across Indonesia. These data were analyzed using the smart PLS 4.0 analysis tool. The result in this research show the Co Branding Strategy variable can have a positive relationship and a significant influence on Purchasing Decisions because the T-Statistics value is above 1,960, namely 8,987 and the P-Values value is below The significance level is 0.05, namely 0.007. This is because the Co Branding Strategy can make consumers more interested, more curious, and ultimately consumers make purchasing decisions. In line with the results of the first line Path Coefficient, the results of the second hypothesis which the researcher believes can moderate the influence of the Dependent variable on the Independent variable in this study show similar results because the T-Statistics value is above 1,960, namely 14,540 and the P-Values value is below the level. significance is 0.05, namely 0.000. Thus, the first and second hypotheses in this research can be accepted and proven.

Abstract

The development of digital technology has significantly influenced the dynamics of the constitution and changes in constitutional law in the modern era. This article aims to provide an in-depth overview of constitutional changes that have occurred in the context of the digital era. A country's constitution acts as a legal basis that regulates the government system and the rights of its citizens. However, constitutional changes in the digital era involve new aspects that need to be carefully considered. In the digital era, the transformation of information technology has changed the way people communicate, interact and participate in the process of forming public policy. The internet and social media have become important means for individuals to convey their aspirations and influence the political decision-making process. This impact has prompted demands for constitutional changes to accommodate these new developments. Technological advances also bring new challenges related to the protection of human rights and privacy. In the digital era, safeguarding freedom of opinion, freedom of expression and access to information has become more complex. The Constitution is expected to be able to adapt to these changes to safeguard the freedom of citizens. However, constitutional changes in the digital era also present various challenges. Careful regulation is needed to achieve a balance between freedom of expression and protection against issues such as the spread of dangerous content, cybercrime and privacy violations. In this context, a deep understanding of constitutional changes in the digital era is crucial to ensure that constitutional law remains relevant and provides adequate protection in the face of continuously developing technological challenges. The process of constitutional changes in the digital era must involve broad community participation and careful consideration. wisely in order to achieve the goal of balance between technological innovation and the protection of citizens' rights. A deep understanding of the dynamics of the constitution in the digital era is very important to maintain the sustainability, relevance and effectiveness of the constitution in facing the reality of dynamic technological developments.
