Abstract

The protection of sensitive notarial information requires optimally integrating traditional and innovative security techniques. This paper analyzes the strengths and weaknesses of established methods like paper documents and seals alongside emerging solutions like encryption and blockchain for safeguarding data. A comparative framework evaluates approaches across dimensions of cost, usability, resilience and compliance. Recommendations are provided for layered security combining physical and digital methods to holistically address evolving threats. The analysis finds that synergistically blending time-tested and novel tools can enhance notarial information protection.

Abstract

This study aims to explore the decision-making process in the Supreme Court and its impact on legal consistency through a normative approach and document analysis. The research focuses on Supreme Court Decision Number 4421/B/PK/Pjk/2023 regarding the Judicial Review of Tax Court Decision Number 000953.16/2022/PP/M.VB in 2022, which granted the Judicial Review request, as well as Supreme Court Decision Number 5201/B/PK/Pjk/2023 regarding the Judicial Review of Tax Court Decision Number 00957.16/2022/PP/M.VB in 2022, which denied the Judicial Review request. Although the subject matter of the disputes was the same, specifically the determination of Value Added Tax (VAT) obligations for the 2016 tax year, the rulings were different. This research adopts a normative approach that examines the applicable legal norms and principles, along with document analysis to evaluate the Supreme Court decisions. The study identifies the factors influencing judicial interpretation and the complexity of achieving legal consistency within the judicial system through an in-depth analysis of the decision texts and legal considerations. The research aims to provide insight into legal consistency, the factors causing differences in rulings, and the decision-making process within the Supreme Court. Additionally, the study highlights the implications for legal stability and public trust while offering critiques and recommendations for improving legal policy and practice in the future. Overall, this research serves to deepen the understanding of the dynamics of court decisions at the highest level and contributes to enhancing the legal system to be more consistent and just.

Abstract

The purpose of this study to examine the legal certainty related to the ownership of land rights by foreign nationals (WNA) through name loan agreements or nominees in Indonesia. The methodology used is normative legal research with a legislative and conceptual approach, as well as analysis of primary and secondary legal materials. The results of the study show that the practice of nominee agreements is often considered illegal and has the potential to cause legal disputes, because it is contrary to Law No. 5 of 1960 concerning Agrarian Principles which only allows Indonesian citizens to have property rights to land. In addition, this agreement can result in losses for all parties involved, including foreign citizens (WNA) who lose their rights and Indonesian citizens (WNI) who lend their names. This research provides an understanding of the need for clearer regulations to protect the interests of all parties and prevent the abuse of the law in land tenure by foreign nationals (WNA) in Indonesia.

Abstract

Corporate Social Responsibility (CSR) is increasingly recognized as more than just a corporate obligation—it is a strategic approach to achieving sustainable development goals. In Indonesia, where regional autonomy gives local governments significant authority, their role in supervising CSR becomes particularly important, especially in ensuring transparency and accountability. Despite this, many CSR programs still suffer from a lack of clear oversight, limited regulatory support, and varying levels of corporate commitment. This study explores how local governments carry out their supervisory role in CSR programs from the perspective of business law. Using a qualitative juridical-normative approach complemented by field data, this research focuses on Klaten, Central Java, as a case study. Data were obtained through interviews with local officials, CSR practitioners, and community members, as well as analysis of regional regulations and corporate CSR reports. The findings reveal that while some local governments have made efforts to regulate CSR through regional policies, the lack of binding legal instruments and standardized monitoring systems poses significant challenges. In many cases, accountability still depends more on voluntary compliance than enforceable obligations. Moreover, transparency in CSR reporting is often limited, making it difficult for stakeholders to evaluate the actual impact. The study concludes that strengthening the legal basis of CSR at the local level—through clearer regulations, transparent reporting standards, and inclusive supervision involving civil society—could lead to more effective CSR governance. This would not only improve corporate accountability but also ensure that CSR efforts align more closely with community needs and sustainable development goals. Abstract

Artikel ini mengkaji perlindungan pekerja perempuan terhadap potensi diskriminasi akibat penggunaan kecerdasan buatan (AI) dalam pelaksanaan hubungan kerja. Kehadiran AI dalam proses produksi menyebabkan perubahan sistem dan cara kerja di perusahaan. Penggunaan AI dalam dunia kerja berdampak signifikan pada representasi perempuan dalam hubungan kerja, karena AI banyak digunakan untuk menggantikan pekerjaan administratif dan rutin yang memiliki pola serupa. Hasil penelitian menunjukkan bahwa sebagian besar pekerjaan tersebut sebelumnya diduduki oleh pekerja perempuan. Penelitian ini merupakan penelitian normatif dengan pendekatan konseptual melalui studi literatur data sekunder. Hasil kajian mengungkapkan beberapa langkah yang dapat dilakukan untuk melindungi pekerja perempuan dari diskriminasi di era AI, yaitu: (1) transformasi regulasi pelatihan kerja yang mendukung pekerja perempuan di bidang STEM untuk meningkatkan kesiapan penggunaan AI; (2) pengaturan penggunaan AI dalam program terkait jalur karier, perhitungan upah, tunjangan, dan kompensasi; (3) transformasi regulasi penggunaan perjanjian kerja bersama oleh serikat pekerja untuk memperjuangkan perlindungan pekerja perempuan di era AI; (4) penetapan regulasi etika teknologi; dan (5) penetapan batasan penggunaan AI dengan analogi serupa seperti penggunaan tenaga kerja asing.   This article examines the protection of female workers against possible discrimination due to using AI in implementing employment relations. This is normative research with a conceptual approach conducted through a secondary data literature study. The result shows that some things which can be done to protect female workers from discrimination in the AI era are: (1) transformation of job training regulation that facilitates female workers in STEM fields to support readiness for use; (2) regulate the use of AI in programs related to career paths, calculation of wages, benefits, and compensation; (3) Transformation of the regulation of the use of collective labour agreements by worker unions to fight for the protection of female workers in the AI era in; (4) stipulate ethical regulation of technology; and (5) setting restrictions on the use of AI by analogy similarly with the use of foreign workers.

Abstract

Penyelenggaraan dan kebijakan pemerintah daerah seringkali menimbulkan kontroversi karena kurangnya partisipasi masyarakat. Adanya perkembangan teknologi dapat dimanfaatkan untuk menunjang penyelenggaraan pemerintah, terlebih saat ini di berbagai daerah telah mengembangkan e-government. Penelitian ini dilakukan untuk menganalisis perkembangan e-government dan integrasinya dengan artificial intelligence. Hal ini berbeda dengan penelitian pada umumnya yang hanya mengulas tentang e-government saja. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan konsep dan perundang-undangan. Hasil penelitian ini menunjukkan bahwa terjadi stagnasi pengaturan dan pemanfaatan e-government yang cenderung hanya sebagai sarana informasi sehingga minim keterlibatan masyarakat dalam penyelenggaraan pemerintahan. E-government dapat dikembangkan melalui pengintegrasian artificial intelligence untuk meningkatkan partisipasi masyarakat yaitu dengan mengembangkan layanan aspirasi, sistem summary and analysis, serta layanan evaluasi kebijakan   Local governance and policies often cause controversy due to lack of public participation. The development of technology can be utilized to support local governance, especially now that various regions have developed e-government. This research was conducted to analyze the development of e-government and its integration with artificial intelligence. It is different from research in general that only reviews e-government. This research uses normative juridical method with concept and legislation approach. The results of this study indicate that there is stagnation in the regulation and utilization of e-government which tends to be only a means of information so that there is minimal public involvement in governance. E-government can be developed by integrating artificial intelligence to increase public participation by developing aspiration services, summary and analysis systems, and policy valuation services.

Abstract

Tujuan penulisan ini untuk menganalisis kebijakan insentif bagi nelayan tradisional untuk peningkatan kesejahteraannya. Metode penelitian yang digunakan adalah metode yuridis normatif menggunakan data sekunder, dan analisis kualitatif. Temuan penelitian ialah Nelayan tradisional sangat memerlukan perlindungan dan insentif. Kebijakan insentif memiliki legalitas dalam peraturan perundang-undangan di Indonesia. Nelayan tradisional memiliki kelemahan permodalan, dan kelemahan alat dalam melakukan penangkapan ikan. Penangkapan ikan oleh nelayan tradisional masih menerapkan perlindungan laut yang optimal. Rumusan masalah yang diangkat adalah Bagaimana model kebijakan insentif yang berbasis keadilan bermartabat dapat dirancang untuk meningkatkan kesejahteraan nelayan tradisional secara berkelanjutan dan memiliki kepastian hukum? Kebaruan penelitian adalah Kebijakan insentif ini memiliki kepastian hukum dan legalitas karena telah diamanatkan dalam Undang-Undang Perikanan, Undang-Undang Nomor 7 Tahun 2016 tentang Perlindungan dan Pemberdayaan Nelayan, Pembudi Daya Ikan, dan Petambak Garam, serta Peraturan Menteri Kelautan dan Perikanan Republik Indonesia Nomor 19 Tahun 2023 tentang Penyaluran Bantuan Pemerintah di Lingkungan Kementerian Kelautan dan Perikanan (Permen KKP 19/2023). Pemberian insentif ini juga dilakukan dengan pendataan dan administrasi yang ketat agar benar-benar tepat guna   This scholarly endeavor aims to meticulously analyze incentive policies for traditional fishers with the objective of enhancing their welfare. The methodology employed for this research is normative juridical, relying on secondary data and qualitative analysis. The findings indicate that traditional fishers are in dire need of protection and incentives. Incentive policies possess legal standing within Indonesian regulatory frameworks. Traditional fishers frequently encounter limitations in terms of capital and fishing equipment. Notably, their fishing practices consistently demonstrate an optimal commitment to marine conservation. The central research question posed is: How can a dignified justice-based incentive policy model be designed to sustainably improve the welfare of traditional fishers and ensure legal certainty? The novelty of this research lies in the fact that this incentive policy is endowed with legal certainty and legitimacy, being mandated by the Fisheries Law, Law Number 7 of 2016 concerning the Protection and Empowerment of Fishers, Fish Cultivators, and Salt Farmers, and the Regulation of the Minister of Maritime Affairs and Fisheries of the Republic of Indonesia Number 19 of 2023 concerning the Distribution of Government Assistance within the Ministry of Maritime Affairs and Fisheries (Permen KKP 19/2023). Furthermore, the provision of these incentives is executed with stringent data collection and administrative procedures to ensure their precise and effective application.

Abstract

This article is a legal research that discusses the legal protection of local tambora coffee products as a product of geographical indications in the province of West Nusa Tenggara (NTB). Writing this article aims to analyze the form of legal protection for local Tambora coffee products as a product of geographical indications in the Province of NTB. Method the method used is normative legal research, with several approaches used, namely, the statutory approach, the concept approach, the historical approach, and the analytical approach. Novelty , from this research it was found that legal facts had not been optimal in legal protection efforts for local Tambora coffee products as a product of geographical indications by the local government in NTB. The discussion from this study found the fact that legal protection efforts for local tambora coffee products as a product of geographical indications by the local government in NTB were not optimal. The local government in NTB needs to guarantee legal protection for Tambora coffee as a geographical indication in order to maintain the uniqueness of local products as a regional identity so as to avoid claims by other regions for local Tambora coffee products to be able to compete nationally and internationally. In conclusion , legal protection for local Tambora coffee products as a geographical indication product in NTB Province is not optimal. The lack of attention and supervision by the regional government in protecting the local Tambora coffee product as a geographical indication is at least indicated by the absence of regional legal products in the form of Regional Regulations (Perda) and/or Perkada which guarantee legal protection for local Tambora coffee products as a geographical indication product. Likewise, the implementation of legal protection and supervision of local Tambora coffee products as a product of geographical indications in the province of NTB still tends to be weak. The local government in NTB neglected to guarantee supervision and legal protection for local Tambora coffee products as a geographical indication. Even though it does not rule out the possibility that Tambora coffee can be branded /marketed as a product that is not only worth selling in the region but can also compete in national and international markets.

Abstract

This study discusses the transformation of civil judgment execution as a crucial step toward achieving Court Excellence in Indonesia. The main issue examined is the persistent challenges in enforcing civil court decisions, which often hinder the execution process. The objective of this study is to identify the core problems in civil execution, elaborate on the role of Court Excellence within Indonesia’s judicial system, and propose concrete measures to improve the efficiency and effectiveness of execution. The research employs a normative juridical method, using an analytical approach to legislation, legal doctrines, and relevant court decisions. The findings reveal that the primary obstacles in execution include unmet costs, third-party resistance, issues in the wording of judgments, the applicant’s inability to identify assets, undiscovered execution objects, and difficulties in executing court decisions. The transformation of civil execution involves improving the drafting of judgments, enhancing inter-agency coordination, implementing strict supervision, providing training and education, and establishing a special unit within the Supreme Court. The results of this study highlight the importance of transforming civil judgment execution as an integral part of the effort to achieve Court Excellence in Indonesia. This transformation is expected to enhance the efficiency and effectiveness of executions, build a more authoritative judiciary, and ensure justice and compliance with the law in society.   Penelitian ini membahas transformasi eksekusi putusan perdata sebagai langkah penting menuju Court Excellence di Indonesia. Isu utama yang diteliti adalah permasalahan pelaksanaan eksekusi putusan pengadilan perdata yang seringkali menghadapi tantangan yang menghambat prosesnya. Penelitian ini bertujuan untuk mengidentifikasi masalah utama dalam eksekusi perdata, menguraikan peran Court Excellence dalam sistem peradilan Indonesia, dan memberikan langkah-langkah konkret untuk meningkatkan efisiensi dan efektivitas eksekusi. Temuan penelitian ini mengungkapkan bahwa kendala utama dalam eksekusi meliputi biaya yang belum terpenuhi, perlawanan oleh pihak ketiga, permasalahan dalam redaksi putusan, ketidakmampuan pemohon eksekusi menunjukkan harta, objek yang ditunjukkan tidak ditemukan, dan kesulitan dalam melaksanakan eksekusi terhadap putusan pengadilan. Transformasi eksekusi putusan perdata melibatkan perbaikan dalam redaksi putusan, koordinasi yang lebih baik, pengawasan yang ketat, pelatihan dan edukasi, serta pembentukan unit khusus di Mahkamah Agung. Hasil penelitian ini menyoroti pentingnya transformasi eksekusi putusan perdata sebagai bagian integral dari upaya mencapai Court Excellence di Indonesia. Transformasi ini diharapkan akan meningkatkan efisiensi dan efektivitas pelaksanaan eksekusi, menciptakan peradilan yang lebih berwibawa, dan memastikan keadilan serta kepatuhan terhadap hukum dalam masyarakat.

Abstract

Perkembangan pesat teknologi finansial (fintech) telah menghadirkan layanan pinjaman dengan syarat yang lebih fleksibel dan mudah diakses dibandingkan dengan lembaga keuangan konvensional seperti bank. Namun, kemajuan ini juga menimbulkan berbagai tantangan, terutama ketika debitur mengalami kredit macet. Kreditur dalam upaya menagih utang terkadang menggunakan metode yang agresif atau bahkan melanggar hukum, termasuk pemanfaatan media sosial untuk menekan debitur, yang sering disebut sebagai persekusi digital. Penelitian ini bertujuan untuk menganalisis implikasi hukum dari perilaku kreditur tersebut dalam pinjaman online serta menilai perlindungan yang tersedia bagi debitur berdasarkan regulasi yang ada. Dengan menggunakan pendekatan yuridis normatif dan metode deskriptif, data dikumpulkan melalui studi dokumen dan analisis data sekunder. Analisis kualitatif menunjukkan bahwa sengketa sering muncul akibat klausul kontrak yang tidak jelas atau kurangnya mekanisme penyelesaian sengketa dalam perjanjian pinjaman online. Ketika upaya penyelesaian secara damai gagal, sengketa akan berlanjut ke proses litigasi. Tindakan paksaan oleh kreditur dapat melanggar Pasal 335 ayat (1) angka 1 dan Pasal 368 ayat (1) Kitab Undang-Undang Hukum Pidana (KUHP) yang mengatur larangan persekusi dan pemerasan dengan kekerasan. Selain itu, regulasi seperti Peraturan Otoritas Jasa Keuangan Nomor 77/POJK.01/2016 menekankan prinsip transparansi, keadilan, keandalan, kerahasiaan, dan penyelesaian sengketa yang mudah diakses untuk melindungi pengguna fintech. Penelitian ini menyimpulkan bahwa penegakan hukum yang lebih kuat dan klausul kontrak yang lebih jelas sangat diperlukan untuk melindungi hak konsumen serta mencegah penyalahgunaan dalam sektor pinjaman fintech.   As Wrong One form financial technology (fintech) is impact from progress technology Which offer loan with condition And provision more easy And flexible compared to with institution finance conventional like bank.
