Abstract

This study aims to analyze the factors influencing the choice between Lampung customary law and Islamic law in inheritance distribution among inter-ethnic couples in the Pepadun community of Padang Ratu, Central Lampung Regency. Lampung customary law, which emphasizes family values and cooperation, is often the main guideline in inheritance distribution. However, in the context of inter-ethnic couples, tensions between the application of customary law and Islamic law often arise, especially in the distribution of inheritance rights which are more proportional according to Islamic law. This research employs a qualitative approach with in-depth interviews with customary leaders, religious leaders, and local community members, as well as field observations to explore inheritance practices. The results indicate that although customary law is dominant, customary deliberations involving family members and customary leaders play a significant role in integrating both legal systems. Moreover, Islamic law offers a fairer perspective in inheritance distribution, considering the rights of men, women, and children in a proportional manner. This study is expected to provide a deeper understanding of the dynamics of inheritance law in the Pepadun community and highlight the importance of deliberation in achieving social justice for all parties involved. Keywords: Lampung Customary Law, Islamic Law, Inheritance Distribution, Inter-Ethnic Couples, Customary Deliberation, Pepadun Community.

Abstract

Psychologically, men in marriage are active in biological needs, while women tend to be more passive and are more likely to seek affection and protection. Conflicts that occur in marriage are often caused by the unmet needs of both parties. The question is how urgent are biological needs in a marriage? This study aims to uncover the importance of awareness among both husband and wife in fulfilling each other's rights, particularly in the context of sexual relations. This is qualitative research in the form of a literature review that examines the importance of biological relations in marriage from the perspectives of religious scholars and medical professionals, then analyzes it from an Islamic perspective to form a sexual ethics within the family. This study shows that biological relations are a key factor in achieving a peaceful family (sakinah), where the true meaning of marriage is to make the relationship between husband and wife lawful in fulfilling biological needs, which is tied to a legitimate marriage bond, resulting in legal and quality offspring

Abstract

In the past, slavery coult not be separated from the influence of history, culture, and traditions of societies in various part of the world that recognize slaves. There is an assumption, especially among Western orientalists that slavery is a result of Islamic culture. This article provides an in depth review and understanding of the relationship between slavery and Islam in reality. This literature study used an analytical approach by examining texts supported by four historical methods, namely heuristics, criticism, interpretation, and historiography. This study produced three finding. First, the slavery system in not the result of Islamic ijtihad but has developed universally in various parts of the world long before Islam emerged. Second, Islam has good treatment of slavery, especially in its concept of equality. Abstract

This article examines al-Raniri’s views on spirit. In Islamic thought, spirit is an important matter discussed by Muslim theologians, Muslim philosophers and Sufis. They argue with each other about the nature of spirit. Using content analysis, this library research attempts to portray how al-Raniri navigates the complexity of the Islamic thought regarding spirit. This study found that al-Raniri seeks to synthesize various views. Nonetheless, he was more inclined towards the views of the Sufis than the theologians and philosophers. Al-Raniri views the spirit as a subtle substance that is located in the heart and will last forever even if the body is destroyed. Keywords: Al-Raniri, Islamic thought, the human spirit, the nature of the spirit.

Abstract

False hadiths (ḥadîts mauḏhû’) are those deliberately fabricated by liars (al-kadzâb) and falsely attributed to the Prophet Muhammad saw. These hadiths are created without a clear foundation and often accompanied by fabricated chains of transmission (sanad). Ibn Ṣalâh and Imam Jalâluddîn al-Suyûṭî classify false hadiths into two types: (1) those deliberately fabricated without a valid chain of transmission (lâ aşla lahu), and (2) those where the error in transmission occurs unintentionally, but with a clear sanad. This research employs a hadith criticism analysis approach by tracing the chain of transmission and examining the content (matan) of the relevant hadiths. The study is based on a literature review of classical works by hadith scholars and critics. The analysis focuses on hadiths categorized as false and applies established hadith criticism principles. The research findings show that the main issues of fabricated hadiths include the absence of a clear foundation (lâ aşla lahu), the lack of a valid chain of transmission (lâ isnâda lahu), and content that contradicts the principles of Shari’ah and logical reasoning. Additionally, false hadiths often lack asbâb al-wurûd (the reasons for the revelation of the hadith), possessing only a vague historical origin. Therefore, the narration of false hadiths must be stopped and should not be spread to the public. Keywords: False Hadiths, ḥadîts mauḏhû’, Fabrication of Hadith

Abstract

Sustainable finance has become a global concern as the need for a more inclusive and socially and environmentally responsible economic system increases. In the context of Islamic finance, the principles of maqashid syariah provide a strong normative foundation for developing sustainable finance concepts based on ethics, justice, and balance. This study aims to analyze how maqashid syariah can serve as a foundation for implementing sustainable finance by examining Islamic financial instruments such as green sukuk, productive waqf, as well as mudharabah and musyarakah schemes. The method used in this research is library research with a qualitative approach, where data is collected from various academic sources such as books, journals, and research reports related to Islamic finance and sustainability. The study’s findings indicate that the principles of maqashid syariah align with the objectives of sustainable finance, particularly in economic justice, equitable wealth distribution, and socially and environmentally responsible investments. The implementation of Islamic financial instruments supporting sustainable development has been observed in several countries, such as Malaysia and the United Arab Emirates, which have adopted Environmental, Social, and Governance (ESG)-based regulations. However, challenges such as a lack of Islamic financial literacy, regulatory limitations, and insufficient innovation in financial instruments remain major obstacles to implementing sustainable Islamic finance. Therefore, this study recommends strengthening policies, improving Islamic financial literacy, and fostering innovation in syariah-compliant financial instruments to enhance the integration of maqashid syariah into the sustainable finance system. Abstract

The development of digital technology has brought significant changes in social interaction patterns, especially in kinship relationships. This study aims to understand how kinship dynamics change in the digital era using the symbolic interaction perspective introduced by Herbert Blumer. This study uses a qualitative approach with a document study method to analyze various secondary sources related to changes in social interaction in families. The results of the study indicate that the use of social media and communication technology has changed the form of family communication from face-to-face to digital-based. This allows geographically separated families to stay connected, but also presents challenges in maintaining emotional closeness. The use of digital symbols such as emojis, stickers, and video calls replaces physical expressions in communication, which can affect the depth of social interaction in kinship relationships. This study also found that shifts in communication patterns in families can affect solidarity and social support between family members. Digital technology can be a means to strengthen or weaken kinship relationships depending on how individuals interpret it in their daily lives. Thus, this study provides important insights for academics and social practitioners regarding the impact of technology on social interaction and family dynamics in the digital era.
