Abstract

Inheritance is a law that regulates the transfer of assets inherited from people who have died and also the rights of heirs. It should be noted that the process of distributing inheritance assets should be immediately distributed to the heirs, but what is happening in the Semen Village community is the opposite, many of them are delaying the distribution of inheritance assets, which is far from the existing provisions. The research method used is a qualitative method, with this method it is much easier for researchers to produce descriptive data, namely trying to understand and comprehend an event and problem that occurred, where research data is taken from notes, books, journals, interviews and other literature. The delay in distributing inheritance in the Semen Village community is caused by several factors, including: 1) one of the parents of the heir is still alive 2) the tradition of waiting 40 to 100 days after the death of the parent 3) one of the heirs is still outside City 4) there was a dispute regarding the share obtained by each heir. As for the postponement of the distribution of inheritance that has occurred in Semen Village, so far it is not in conflict with the Shari'a, although there are still some families who do not comply with the method of distribution, the majority of the people of Semen Village have complied with the existing provisions due to several reasons for the delays that have occurred in the Village. This cement is a reason that is legalized by the Shari'a.

Abstract

The Aceh customary courts play a pivotal role in resolving societal conflicts, particularly those not addressed by the formal justice system. The formal system often remains inaccessible due to remote locations, high costs, and the complexities of judicial administration, posing significant challenges for communities, especially in Kota Lhokseumawe. This study examines two key issues: the authority of gampong customary courts in addressing customary criminal cases and the resolution models employed by these courts to reduce such cases in Kota Lhokseumawe. Using a descriptive qualitative method based on field research with a normative-empirical juridical approach, this study reveals that the authority of gampong customary courts represents a form of local wisdom that remains highly relevant in Indonesia, particularly in regions with strong customary traditions like Kota Lhokseumawe. This authority is confined to 18 types of cases as stipulated in Article 13 of Aceh Qanun No. 9 of 2008 on the Development of Customary Life and Customs and Aceh Governor Regulation No. 60 of 2013 on the Settlement of Customary Disputes. Through deliberation (musyawarah) and consensus (mufakat), these courts effectively restore social harmony and resolve conflicts peacefully. However, challenges such as the formalization and documentation of customary decisions, training for customary leaders in formal legal procedures, and the inconsistent application of customary law persist. Addressing these challenges is essential to ensure that customary courts continue to contribute to maintaining social order and justice at the local level.

Abstract

The intersection of spirituality and neuroscience is a growing area of research that examines the impact of spiritual practices on the brain. This study focuses on the connection between spiritual experiences and neuroscientific perspectives, explicitly concerning pilgrimage tradition among Indonesian Muslims. The research aims to bridge the gap between science and spirituality and provide insights into how spiritual practices influence brain function and human behavior. This study uses a qualitative approach with a multi-site study type with interactive data analysis at the tombs of Sunan Kuning and Syekh Basarudin in Tulungagung. The data source comes from the results of interviews with the caretakers of the tombs and pilgrims. The results of this study found several spiritual experiences of pilgrims that increased faith and closeness to Allah. These experiences consist of five aspects of spiritual experience: connection, joy transcendent sense of self, divine guidance, perception of divine love, and divine help. In conclusion, this research highlights the overlapping between spiritual practices and neuroscientific insights, showing how they can shape brain function and enhance well-being. Integrating neuroscientific approaches with spiritual understanding could lead to innovative strategies in mental health therapy.

Abstract

This article discusses the influence of Sufism on Indonesian music and its role in the spread of Islam within Indonesian society. Initially, Indonesia was primarily associated with traditional religions like Buddhism and Hinduism until Sufism, introduced by Yemeni traders, helped facilitate the acceptance of Islam. Sufism and Islam became intertwined, significantly shaping Indonesian identity. Key figures, such as the Nine Saints, propagated Islamic values through various means, including music, which serves as a universal art form transcending sects. This integration led to a significant transformation in Indonesian music, incorporating Islamic themes that resonate during religious occasions like Eid and Ramadan. The current research aims to further explore the specific impact of Sufism on Indonesian music, using a combination of deductive and analytical methods, differing from the previous studies' methodologies. This comprehensive approach seeks to elucidate the nuanced relationship between Sufism and the musical landscape in Indonesia.

Abstract

Islamic boarding schools that implement economic independence require cooperative relationships from outside parties or government institutions in financing the needs and requirements of the Islamic boarding school unit so that it continues to run and progress, while Islamic boarding schools are synonymous with the impression of being closed. To achieve Islamic boarding school economic independence, openness and innovation are needed so that the students who graduate have ownership skills apart from the religious knowledge obtained. This research aims to describe the implementation process, impact of implementation and sustainability of the Islamic Boarding School economic independence program under the guidance of Bank Indonesia. This research uses a qualitative method with a phenomenological approach. The research is located at the Darul Fikri Islamic Boarding School. Abstract

This study aims to evaluate the implementation of Building Permit (IMB) services in achieving orderliness in spatial planning in Pangkalpinang City. Using a qualitative descriptive method, the research examines the effectiveness of the service process based on key implementation criteria: communication, resources, disposition, and bureaucratic structure. The results indicate that the implementation of Building Permits in Pangkalpinang City remains suboptimal. Several internal inhibiting factors were identified, including weak communication among policy implementers, insufficient technical staff at DPMPTSP and NAKER, inadequate supporting facilities and infrastructure, the absence of an Electronic Licensing System (PSE), lack of transparency in permit issuance, ineffective collaboration between DPMPTSP, NAKER, and the PU and City Planning Office, as well as low employee discipline within DPMPTSP and NAKER. Additionally, external factors such as community behavior further hinder the effectiveness of implementation. Theoretically, this study underscores the importance of strengthening inter-agency collaboration, enhancing human resources, and incorporating digital licensing systems to improve service efficiency. These findings contribute to the broader discourse on public service management and provide practical insights for policymakers aiming to optimize spatial planning governance.

Abstract

This article examines the role of local wisdom in the protection and enforcement of Human Rights (HR) in Indonesia, focusing on how local customs, cultural values, and customary laws contribute to a more holistic approach to HR. The study aims to explore how local wisdom can enhance HR protection and address challenges in aligning traditional values with universal HR principles. Employing a qualitative research design, this study utilizes a case study approach across multiple regions in Indonesia, analyzing specific instances where local wisdom has been integrated into HR practices. The findings reveal that local wisdom, including community-based conflict resolution mechanisms, traditional justice systems, and cultural norms, significantly contributes to HR enforcement by ensuring the inclusion of indigenous perspectives in legal frameworks. However, challenges arise in harmonizing local practices with national and international HR standards, particularly when local values conflict with universal rights. The research highlights that a participatory approach, which incorporates both local and global HR principles, is essential in crafting an inclusive legal system. The theoretical implication of this study suggests that integrating local wisdom into HR frameworks could lead to a more contextualized and culturally sensitive approach to HR, thereby fostering greater social cohesion and respect for diversity while safeguarding fundamental human rights. This integration requires cooperation from multiple stakeholders to maintain a balance between honoring cultural traditions and upholding universal HR norms.
