Madania: Jurnal Kajian Keislaman is a peer-reviewed international journal focusing on Islamic studies. Madania accepts two types of articles: Research Articles: Scholarly reports presenting the results of quantitative or qualitative studies that contribute to the advancement of knowledge in Islamic studies across the six themes. Conceptual Articles: Papers offering theoretical perspectives, models, or philosophical analyses relevant to Islamic studies, engaging with contemporary theories and frameworks. All submissions to Madania undergo a rigorous double-blind peer-review process to ensure high standards of quality and academic integrity. The journal is committed to publishing original, innovative, and impactful research that addresses contemporary challenges in the Islamic world.

Abstract

The present paper will describe elasticityof Islamic law in responding global and social change. The Islamic law is not only a law given by the will of Lordto all human being, but it has been also a dynamic and flexible law which came gradually in accordance withdevelopment of muslim societies through ijtihad which interpreteds the sacred text, naş, compares analogicallya new case that there is no legal recommended with a legal recommended case based on the mean of Islamiclaw. Abstract

Interfaith marriage is remained a topic of discussion, especially since the appearance of an application to the Constitutional Court (MK/ Mahkamah Konstitusi) for a judicial review of the marriage law. The decision of the Constitutional Court did not satisfy various parties because the application was rejected because the validity of interfaith marriages is the territory of each religion to decide on it. From here, the pros and cons of interfaith marriage reappear. This article aims to examine the pros and cons of the views of Islamic jurists' thoughts on the legitimacy of interfaith marriages, both from classical scholars and from various groups and mass organizations in Indonesia. This article aims to examine the views of the pros and cons of the validity of interfaith marriages, especially in Islam, both from classical scholars and from various groups and mass organizations in Indonesia. The approach used is classical ushul fiqh to analyze and compare the various views and then synthesize and select the most appropriate views. From this study, it was concluded that the view of the majority of scholars who only allow interfaith marriages between Muslims and ahl al-kitab is a view that is more in line with the theory of ushul fiqh. Besides that, marriage between ahl al-kitab men and Muslim women can also be legalized with the qiyas approach, whose illat is wisdom. Perkawinan beda agama masih menjadi wacana yang terus diperbincangkan, apalagi setelah munculnya permohonan ke Mahkamah Konstitusi (MK) untuk melakukan uji materi undang-undang perkawinan. Putusan MK tidak memuaskan berbagai pihak karena permohonan ditolak karena sahnya perkawinan beda agama adalah wilayah masing-masing agama untuk memutusnya. Dari sinilah muncul kembali pro dan kontra pernikahan beda agama. Artikel ini bertujuan untuk mengkaji pro dan kontra dalam pemikiran ahli hukum Islam tentang keabsahan perkawinan beda agama, baik dari kalangan ulama klasik maupun dari berbagai kalangan ormas di Indonesia. Pendekatan yang digunakan adalah ushul fiqh klasik untuk menganalisis dan membandingkan berbagai pandangan kemudian mensintesa dan menyeleksi pandangan yang paling tepat. Dari kajian ini disimpulkan bahwa pandangan mayoritas ulama yang hanya membolehkan perkawinan beda agama antara muslim dengan ahl al-kitab merupakan pandangan yang lebih sejalan dengan teori ushul fiqh. Selain itu perkawinan antara laki-laki ahl al-kitab dengan perempuan muslim juga dapat dilegalkan dengan pendekatan qiyas, yang illatnya adalah hikmah.

Abstract

Misykât Al-Anwâr Al-Ghazali’s Work: Few Controversial Notes and Sufistic Enlightenment Theology. This paper attempts to discuss the book Misykât al­Anwâr as the other side of a theological and philosophical Sufism of Al-Ghazali. Different than the Ihya ‘Ulum al-Din and his other works, Misykât al­Anwâr featuringtheological and philosophical sufism in the high level. In this book, it is similar to the doctrine of Wahdat al-wujûd. Introducing the doctrine that there is no existing in this universe except Allah, because the form of everything other than Him is a shadow or comes from him. Although the book is thin and small, experts aligned this book with the magnum opus books of the sufis such as Futuhat al-Makkiyah by Ibn ‘Arabi, Matsnawi by Maulana Rumi, al-Hikam by Ibn Athaillah and others. Even this book became a milestone in the development of metaphysics of light by thinker after Al-Ghazali.

Abstract

In the realm of methodology of Islamic jurisprudence (ushul al-fiqh), qiyas, a method of deriving Islamic law, holds a prominent position. It entails analogizing a legal ruling from a situation devoid of explicit textual guidance (nash) to a situation with established textual guidance, based on the shared underlying cause (illat). This is a descriptive research with a philosophical approach. The type of research used is library research with primary data referring to the original source, namely the book of logic by Aristotle. While secondary data is taken from works containing Aristotelian logic. This study found that Imam al-Shâfi’i stands as the pioneer in formulating qiyas as a method of ijtihad (legal reasoning). His rigorous formulation of qiyas drew theoretical underpinnings from Aristotelian logic. The incorporation of Aristotelian logic into qiyas imbued the method with a strict and contrapositive nature, adhering to the principles of syllogistic logic. In syllogistic reasoning, the conclusion invariably follows from the major premise, which in qiyas is derived from the sacred text (the Quran). To overcome this intellectual stagnation, a burhani methodology, as championed by Ibn Rushd, Ibn Khaldun, Ibn Hazm, and al-Shâtibi, emerged. This methodology successfully established a liberal rational epistemology grounded in the spirit of burhani logic and contextualized Quranic interpretation. Dalam ranah metodologi yurisprudensi Islam (ushul fiqh), qiyas, sebuah metode untuk memperoleh hukum Islam, memegang posisi yang menonjol. Metode ini melibatkan analogisasi putusan hukum dari situasi yang tidak memiliki petunjuk tekstual yang jelas (nash) ke situasi dengan petunjuk tekstual yang mapan, berdasarkan penyebab dasar yang sama (illat). Penelitian ini merupakan penelitian deskriptif dengan pendekatan filosofis. Jenis penelitian yang digunakan adalah penelitian kepustakaan dengan data primer mengacu pada sumber asli yaitu kitab logika karya Aristoteles. Sedangkan data sekunder diambil dari karya-karya yang mengandung logika Aristotelian. Studi ini menemukan bahwa Imam al-Shâfi'i berdiri sebagai pelopor dalam merumuskan qiyas sebagai metode ijtihad (penalaran hukum). Perumusannya yang ketat tentang qiyas mengambil dasar-dasar teoritis dari logika Aristoteles. Penggabungan logika Aristoteles ke dalam qiyas mengilhami metode tersebut dengan sifat yang ketat dan kontrapositif, yang mematuhi prinsip-prinsip logika silogistik. Dalam penalaran silogistik, kesimpulan selalu mengikuti premis utama, yang dalam qiyas berasal dari teks suci (Alquran). Untuk mengatasi stagnasi intelektual ini, muncullah sebuah metodologi burhani, sebagaimana yang dipelopori oleh Ibnu Rushd, Ibnu Khaldun, Ibnu Hazm, dan al-Shatibi. Metodologi ini berhasil membangun epistemologi rasional liberal yang berlandaskan pada semangat logika burhani dan penafsiran Alquran yang kontekstual.

Abstract

This study aims to examine strategies used by Islamic education teachers to increase learning interest and practice of Islamic education on students of SMPN 1 Lanrisang, Pinrang. Increasing interest to study and practice Islamic education course on public school’s students is important for academics and practitioners. Therefore, a proper design of learning strategies is needed to increase interest and practice of the course. This article employed a qualitative method with a phenomenological approach by looking at the phenomena in the field. The results of interview and data analysis show some factors causing students’ low interest in learning Islamic education, including students’ low awareness during the learning activity, memorization system and indoctrination, tight schedule, national exam, a monotone learning strategy, and lack of family support. In addition, students seldom perform worship of mahdhah, while they often perform mu’âmalah. To increase the learning interest, the teachers of SMPN 1 Lanrisang used specific learning strategies such as lecture, debate, role-play, simulation, demonstration, contextual-based, problem-based, habituation and togetherness.

Abstract

This article discusses the problems surrounding mediation by Religious Court judges in Lampung Province. Mediation can help simplify a dispute so that it can be resolved more cheaply and quickly. Interestingly, mediation allows litigants to find their solutions or settlements, expecting each party to be satisfied and fairly treated. However, this is not the case in real life. Mediation implementation falls short for a variety of reasons. The results of this study show that the mediation carried out by judges at the Religious Court of Lampung has several problems. Judges are unable to provide optimal mediation in divorce cases because mediation is frequently carried out in their respective homes by religious or traditional leaders. As a result, when mediation takes place in court, the mediation is less than optimal, and the divorce process is thought to be complicated or prolonged. Because not all judges hold mediator certificates, their ability to conduct mediation remains limited. When acting as mediators, some judges appear to be trial judges instead of judges who have received mediator training. Policies such as 'one-day minutes, one-day publish' indirectly impact the performance of judge mediators, despite some Religious Courts setting aside special time for mediation. Artikel ini membahas tentang permasalahan mediasi yang dilakukan oleh hakim Pengadilan Agama di Provinsi Lampung. Mediasi dapat membantu menyederhanakan suatu sengketa sehingga dapat diselesaikan dengan lebih murah dan cepat. Menariknya, mediasi memungkinkan para pihak yang bersengketa untuk menemukan solusi atau penyelesaiannya, dengan harapan masing-masing pihak merasa puas dan diperlakukan secara adil. Namun, kenyataan di lapangan tidak demikian. Pelaksanaan mediasi tidak berjalan dengan baik dengan berbagai penyebab.. Hasil penelitian ini menunjukkan bahwa mediasi yang dilakukan oleh hakim Pengadilan Agama Lampung memiliki beberapa permasalahan. Hakim tidak dapat memberikan mediasi yang optimal dalam perkara perceraian karena mediasi sering kali dilakukan di rumah masing-masing oleh tokoh agama atau adat. Akibatnya, ketika mediasi dilakukan di pengadilan, mediasi menjadi kurang optimal, dan proses perceraian dianggap rumit atau berlarut-larut. Karena tidak semua hakim memiliki sertifikat mediator, maka kemampuan mereka dalam melakukan mediasi pun menjadi terbatas. Ketika bertindak sebagai mediator, beberapa hakim tampak seperti hakim pengadilan, bukan hakim yang telah mendapatkan pelatihan mediator. Kebijakan seperti 'one-day minutes, one-day publish' secara tidak langsung berdampak pada kinerja mediator hakim, meskipun beberapa Pengadilan Agama menyediakan waktu khusus untuk mediasi.

Abstract

Gratification in The Constitutional Court and Discourse of Death Penalty. The gratification case doneby an ex-governor and an ex-judge of The Constitutional Court is very irony. As the last gate guard in lowenforcement, the Court which concerns in struggling justice has “fallen off” due to greasing the palm done bythe ex-chief judge. In view of Islamic perspective, the gratification crime belongs to jarîmah ta’zîr, a punishmentrelates to the policy of local government. It does not belong to jarîmah qishâs or hudûd which the punishmentis determinated by the Qur’an and hadîts. Hence, there is discourse of death penalty for the gratification casein The Constitutional Court in order to make wary effect. It is because one of the ta’zîr punishments is deathpenalty that causes big hazard effect for all.

Abstract

The 2019 General Election (Pemilu, Indonesia) divided Indonesian society into two sides, namely the #2019GantiPresiden and the #Jokowi2Periode. The situation between the two sides was tense, which could potentially cause a commotion and worsen the public's situation. Supporters of Jokowi's camp describe the #2019GantiPresiden movement as an attempt to commit makar (treason) against the legitimate government, while the government's opposing side describes the accusation of treason as a violation of democratic freedoms. Based on the foregoing, the question arises as to whether going against the government can be considered makar, which is a criminal act. The type of this study is normative research that uses library research to collect data. This study concludes that opposing the government (Oposisi) or criticizing the government is not makar, but rather the right to free expression. Makar as a negative brand image should not exist in a democratic post-reform environment. It should be used sparingly so that no arbitrariness violates human rights. This corresponds to the definition of al-bughah in Islamic criminal law. Pemilihan umum (Pemilu) pada tahun 2019 telah memecahkan masyarakat dengan dua kubu/ dua gerakan, yaitu gerakan #2019GantiPresiden dan gerakan #Jokowi2Periode. Situasi pun mencekam antara kedua belah pihak yang berpotensi mengarah kepada keributan, dan menyebabkan kondisi masyarakat semakin memanas. Pendukung kubu Jokowi menyebut gerakan #2019GantiPresiden merupakan upaya makar terhadap pemerintahan yang sah, sementara kubu diseberang pemerintah (oposisi) menyebut tuduhan makar tersebut merupakan pelanggaran terhadap kebebasan demokrasi. Berdasarkan latar belakang diatas timbul pertanyaan apakah bersebrangan dengan pemerintah dapat dikatakan sebagai makar yang merupakan tindak pidana?. penelitian ini termasuk jenis penelitian normatif dengan teknik pengumpulan data melalui penelusuran kepustakaan (method of library). Penelitian ini menyimpulkan bahwa bersebrangan dengan pemerintah (oposisi) atau mengkritik pemerintah belum bisa dimaknai sebagai makar melainkan hak kebebasan berpendapat. Makar sebagai brand image negative tidak sewajarnya muncul dalam suasana berdemokrasi pasca reformasi. Seharusnya makar dimakanai secara limitative agar tidak ada kesewenang-wenangan yang merugikan hak asasi manusia. Hal tersebut sejalan dengan makna al-bughah dalam hikum pidana Islam.

Abstract

This article aims to overview some hadith[s] concerning justice and equality among wives in the practice of polygamy. This is literature-based research. In this study, documentation technique was employed in order to collect the data and used takhrij al-Hadith approach. Then, they were analysed by using descriptive analysis method. The result reveals that polygamy might be allowed in certain conditions, especially when a husband could be just and equal in a household among his wives. Practically, this requirement is somewhat challenging. Besides faith and obedience, justice and equality in a family can only be achieved if there is a high optimism, strong confidence, and good paradigm. Although some wives consider it as ‘ain al-sukhty (hatred paradigm), others percieve it as ‘ain al-ridha (pleased paradigm). Unfortunately, to overcome this problematic matter for polygamists in the recent day, justice and equality as the key points in a household should realistically be understood well as what the Prophet Muhammad Peace Be Upon Him (PBUH) had practiced. A positive atmosphere is likely possible to realize in a polygamous household.

Abstract

The Urgency of Entrepreneurial Education among Students in PTKI. This paper describes the reasonsfor the importance of entrepreneurial education in PTKI. This article assumes that entrepreneurial education willencourage students of PTKI to begin to recognize and open a business or entrepreneurship. Those who have anorientation to be employees should be changed to find jobs. Entrepreneurship- minded education is characterizedby applying the principles and methodologies towards developing life skills for learners through an integratedcurriculum developed in PTKI. Entrepreneurs have characteristics such as spirit of achievement, busy to look foropportunities, think big and whole, sharp intuition in business, bold and ready to take risks, tolerance of ambiguity,optimistic and hurry to improve, rapidly count and make decision, and encourage to be more prosperous.
