Abstract

Penelitian ini bertujuan untuk mengkaji model usaha dan strategi kemandirian ekonomi yang dikembangkan oleh Pondok Pesantren Darul Hijrah Cindai Alus, Martapura. Sebagai lembaga pendidikan Islam, pesantren ini tidak hanya berfokus pada pembinaan keagamaan, tetapi juga aktif dalam mengelola berbagai unit usaha produktif sebagai bentuk pemberdayaan ekonomi lembaga. Menggunakan pendekatan kualitatif deskriptif, data diperoleh melalui wawancara mendalam, observasi langsung, dan dokumentasi. Hasil penelitian menunjukkan bahwa pesantren mengembangkan beragam unit usaha, seperti tambak ikan, greenhouse pertanian, DH Mart, DH Water, DH Bakery, travel, bank wakaf mikro, serta koperasi guru dan santri. Seluruh unit usaha dikelola berdasarkan filosofi “Dari Pondok untuk Pondok”, “Dari Guru untuk Guru”, dan “Dari Santri untuk Santri”. Model ini tidak hanya menopang pembiayaan operasional pesantren, tetapi juga menanamkan nilai-nilai kewirausahaan kepada civitas pesantren. Strategi pengelolaan dilakukan secara kolektif dan berbasis nilai keislaman. Kontribusi unit usaha mencakup aspek finansial, edukatif, dan sosial, termasuk pelatihan kewirausahaan dan pemberdayaan masyarakat sekitar. Meskipun menghadapi kendala seperti keterbatasan SDM dan modal, unit-unit usaha ini terbukti efektif dalam memperkuat kemandirian ekonomi pesantren secara berkelanjutan. Temuan ini memberikan kontribusi bagi pengembangan model ekonomi berbasis pesantren dan komunitas keagamaan.

Abstract

The advancement of digital technology has significantly transformed how Muslims access, study, and disseminate Islamic knowledge. This transformation requires an ethical and epistemological framework to ensure that digitalization processes remain grounded in Islamic values. This study aims to address three main research questions: how Islamic digitalization is understood within the context of Islamic scholarship and civilization; how the legal maxim “Man ista‘jala qabla awānihi ‘uqiba bi ḥirmānih” (Whoever rushes before its time will be deprived of it) relates to the phenomenon of digital acceleration; and how the principle of Itqān Raqmī (Digital Perfection) can serve as a moral and academic foundation for developing an ethical and civilized Islamic digitalization. Employing a qualitative library research method, this study uses descriptive and hermeneutic analyses of both classical and contemporary Islamic literature, including works by al-Suyūṭī and al-Syāṭibī, as well as modern academic discussions on digital ethics and Islamic epistemology. The findings reveal that Islamic digitalization is not merely a technical process but an epistemological transformation that requires patience, precision, and scholarly responsibility. The maxim “Man ista‘jala qabla awānihi ‘uqiba bi ḥirmānih” provides a moral warning against hasty adoption of technology without proper validation and adab, while the principle of Itqān Raqmī promotes a paradigm of digital excellence emphasizing accuracy, professionalism, and barakah (divine blessing) in every process of digitalization. Therefore, integrating the values of patience and digital perfection forms the ethical foundation for realizing an Islamic digitalization that is scholarly, ethical, and civilizational. Abstract

Fenomena pengajuan uji materi Pasal 2 ayat (1) UU No. 1 Tahun 1974 tentang Perkawinan oleh seorang pemuda terkait perkawinan beda agama menimbulkan pertanyaan mengenai implementasi norma hukum positif di Indonesia. Kasus ini menyoroti ketegangan antara kepastian hukum yang dijamin oleh prinsip Rechtsstaat dan tuntutan perubahan sosial dari masyarakat plural. Analisis dilakukan dengan pendekatan hukum normatif, menggabungkan studi perundang-undangan (statute approach) dan studi kasus (case approach), serta penunjang pemahaman melalui literatur hukum terbaru. Temuan menunjukkan bahwa penegakan norma yang konsisten penting untuk menjaga kepastian hukum dan keteraturan administratif, sementara edukasi hukum kepada publik menjadi kunci untuk mengoptimalkan pemahaman masyarakat tanpa mengubah norma yang berlaku. Dengan demikian, kasus ini menekankan bahwa hukum positif berfungsi tidak hanya sebagai aturan formal, tetapi juga sebagai instrumen untuk memastikan keteraturan dan keadilan dalam praktik perkawinan lintas agama.

Abstract

Law formation is a state function carried out by the executive, legislative and judicial bodies to form laws, both written and unwritten. By using the method of analysis, exploration, explanation, and exposure. In this context, it is important to design a scenario of national legislation politics that is oriented towards understanding the concept of a national legal system. The goal is to realize a state of law that is just, democratic, and based on justice and truth that serves the interests of the people and the nation. In addition, the formation of law is also influenced by the political configuration behind it, where law acts as a means of dominant political power. Thus, an understanding of legal politics and its relationship with legal formation is very important in the context of responsive and equitable legal development.

Abstract

The transformation of Indonesia’s electoral legal politics reflects a long trajectory from authoritarianism toward a more open democracy. This article examines how electoral law functions within shifting political configurations from the Old Order to the 2024 general election. The study aims to analyze the transformation of legal politics from rule by law to rule of law, focusing on the influence of political configuration on electoral legislation and administration. This research employs a normative, historical-descriptive, and philosophical approach, integrating Mahfud MD’s theory of political configuration, Lawrence M. Friedman’s legal system framework, and the concepts of substantive democracy and institutional authoritarianism. The findings reveal that the transformation of electoral legal politics directly correlates with changes in political power which is before reform, electoral law served as an instrument of authority; the transitional period marked the rise of independent institutions; and the reform consolidation era demonstrated procedural progress yet lacked substantive democracy. The novelty of this study lies in its integrative historical-periodization analysis that connects legal and political dimensions to assess the direction of Indonesia’s post-2024 electoral democracy. Abstract

This article analyzes the phenomenon of "lag time" or the temporal gap in Indonesia's socio-legal transformation post-1998 Reformation. Lag time is defined as the misalignment between the progressive ambition of law as a tool of social engineering and the reality of adaptation and internalization at the level of societal legal culture. The study employs a juridical-sociological methodology to identify the determinant factors causing the slow acceptance of new regulations. The findings indicate that lag time manifests from the failure to synchronize the structural dimension and the cultural dimension of the legal system. Structural factors include the weak capacity of law enforcement, regulatory inconsistency, and the failure of top-down socialization. Meanwhile, cultural factors encompass the legacy of authoritarian legal culture based on fear, resistance from living law, and public pragmatism. The conclusion urges the necessity of systemic reform that focuses not only on improving the substance of the law but also on transforming the legal culture through participatory education to achieve compliance rooted in ethical awareness and justice. Abstract

Sexual violence crime (TPKS) is a crucial issue in Indonesia, which received a significant response through the enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes (UU TPKS). This research aims to critically and deeply compare the concept of TPKS in Indonesian Positive Law (UU TPKS) and Islamic Law (Fiqh Jinayah), reinforced by the foundation of Islamic Social History. Positive Law, through the UU TPKS, adopts a progressive and victim-centered framework, expanding the definition of offense to include non-physical harassment and sexual exploitation, and emphasizing the principle of lack of consent. This Law guarantees the rights to recovery, restitution, and assistance, although its implementation still faces structural and cultural obstacles, including the risk of secondary victimization and issues in proof. Meanwhile, Fiqh Jinayah classifies sexual violence into several categories: Jarimah Hudud (such as zina or fornication, though the victim of rape is exempted from the hadd punishment due to coercion), Ightishab (rape) which can be equated with Hirabah (brigandage), and Jarimah Ta’zir (for broader offenses). Although the standard of proof for zina in classical view is very strict (four witnesses), modern scholars tend to accept non-traditional evidence for ightishab (such as medical examination/visum and victim's testimony) to impose a firm ta’zir punishment. The analysis of Islamic Social History affirms that Islamic legal norms regarding sexual protection are dynamic, stemming from efforts to eliminate pre-Islamic patriarchal practices, and are oriented towards the protection of honor (hifz al-‘ird). The harmonization of these two systems is possible through the integration of the principle of Maqashid Syariah (the objectives of Sharia), which provides theological legitimacy for the contemporary efforts to combat TPKS. By optimizing the flexible Ta’zir punishment, Islamic Law can accommodate a more adaptive model of proof and victim recovery, aligned with the spirit of contemporary restorative justice.

Abstract

Konsep moralitas hasan wa qabih (baik dan buruk) memiliki urgensi sebagai dasar etika fundamental dalam pembentukan dan penetapan hukum Islam. Hukum Islam ditegaskan tidak boleh bersifat value-free (bebas nilai), melainkan harus merefleksikan keadilan dan kemaslahatan Ilahi. Secara metodologis, penelitian normatif-doktrinal ini menganalisis posisi hasan wa qabih melalui perdebatan teologis antara Mu'tazilah (al-hasan wa al-qabih bi al-'aql) dan Asy'ariyah (al-hasan wa al-qabih bi al-naql), serta fungsinya dalam ushul fiqih. Hasil penelitian menunjukkan bahwa terlepas dari sumber penetapannya, hasan wa qabih bertindak sebagai pilar etika dan filter moral yang wajib dipatuhi oleh mujtahid. Konsep ini dioperasionalisasikan melalui maqashid syariah, yang mendefinisikan hasan sebagai tercapainya perlindungan agama, jiwa, akal, keturunan, dan harta, serta qabih sebagai setiap tindakan yang merusaknya. hasan wa qabih berfungsi sebagai filter etis yang memandu metode ijtihad rasional (seperti istihsan, mashlahah mursalah, dan sadd al-dzarā'i') untuk memastikan hukum yang ditetapkan senantiasa mewujudkan keadilan ('adl) dan kemaslahatan (maslahah). Relevansi kontemporer konsep ini terlihat jelas dalam isu hukum keluarga, khususnya poligami, di mana status hukum yang mubah (boleh) harus tunduk pada pertimbangan moral hasan wa qabih, menuntut verifikasi ketat kemampuan adil sebagai pencegahan terhadap qabih (kezaliman).

Abstract

Penelitian ini membahas urgensi dan peran ijtihad dalam konteks hukum Islam di era modernisasi, terutama dalam menjawab berbagai persoalan kontemporer yang belum diatur secara eksplisit dalam nash Al-Qur'an dan Hadis. Di tengah tantangan eksternal seperti globalisasi, perkembangan teknologi, pluralisme, dan keberadaan hukum positif, ijtihad tidak lagi efektif dilakukan secara individual (fardi), melainkan harus dilakukan secara kolektif (jama’i) melalui lembaga-lembaga ijtihad. Di Indonesia, Majelis Ulama Indonesia (MUI) berfungsi sebagai manifestasi dari ijtihad kolektif ini, yang bertujuan untuk membimbing umat dan mengeluarkan fatwa sebagai alternatif hukum dalam memberikan solusi atas persoalan kehidupan. Proses penetapan fatwa oleh MUI mencerminkan praktik ijtihad kolektif, dengan menggunakan prinsip-prinsip seperti maslahah (kemaslahatan umum) dan 'urf (adat istiadat). Metodologi ijtihad yang digunakan MUI meliputi pendekatan nash qath’i, qauli, dan manhaji, serta metode ijtihad bayani, ta’lili, dan istishlahi untuk problematika kontemporer. Meskipun fatwa MUI tidak memiliki status hukum yang mengikat dalam sistem hukum positif Indonesia, fatwa tersebut terbukti memiliki pengaruh signifikan terhadap pembentukan kebijakan hukum nasional. Fatwa MUI berperan sebagai instrumen moral dan religius yang menjembatani agama dan hukum positif negara, memastikan bahwa hukum nasional responsif terhadap kebutuhan umat Islam dan menciptakan harmoni sosial.

Abstract

Badan Penyelesaian Sengketa Konsumen (BPSK) punya peran krusial sebagai lembaga di luar pengadilan untuk atasi masalah antara konsumen dan pelaku usaha. Dibentuk dari Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK), BPSK tangani sengketa lewat tiga cara utama: konsiliasi, mediasi, dan arbitrase. Prosesnya cepat, murah, serta adil, tanpa perlu pengacara atau sidang panjang. BPSK bisa beri sanksi administratif seperti ganti rugi hingga Rp200 juta, atau sanksi perdata berupa pengembalian uang dan barang, tapi urusan pidana diserahkan ke pengadilan. Artikel ini uraikan tugas BPSK, wewenangnya berdasarkan Pasal 52 UUPK, prinsip aksesibilitas-fairness-efisiensi, serta jenis putusan seperti perdamaian atau penolakan gugatan. Tujuannya, konsumen lebih gampang dapat haknya tanpa ribet.
