Abstract

Digital transformation has brought about fundamental changes in the Indonesian civil law system. This study aims to analyze the impacts, challenges, and opportunities of digital transformation in the context of civil law, as well as to formulate an ideal transformation model to accommodate the needs of the digital era. This study uses a normative legal research method with a qualitative approach based on literature studies and analysis of primary and secondary legal documents, including the application of sharia principles in digital transactions. One example of a case raised is the implementation of the murabahah contract in sharia e-commerce transactions that have not received explicit protection and recognition in the Civil Code, especially regarding the agreement clause and non-physical objects of sale and purchase such as digital assets. In practice, this sharia contract clause is often not accommodated by the conventional civil law structure, especially Article 1320 of the Civil Code concerning the valid conditions of an agreement and Article 1457 concerning sale and purchase. The results of the study indicate that digital transformation requires a reinterpretation of the basic concepts of civil law, the development of an adaptive regulatory framework, and the strengthening of digital infrastructure. The ideal legal transformation model should prioritize the principles of neutral technology and international harmonization, while maintaining the characteristics of the national legal system and the values ​​of sharia economic law. Key challenges include the digital divide, cybersecurity, and personal data protection, while opportunities include increasing the efficiency, accessibility, and transparency of the legal system. This study recommends developing a comprehensive regulatory framework, strengthening digital infrastructure, and increasing human resource capacity to support inclusive digital civil law transformation that is in line with sharia principles.

Abstract

Abstrak: Sektor perbankan memiliki posisi yang sangat strategis, sebab sebagai lembaga intermediasi dan penunjang sistem pembayaran merupakan factor yang sangat menentukan dalam proses penyesuaian tersebut. Oleh karena itu, diperlukan penyempurnaan sistem perbankan nasional, sehinga peranan perbankan nasional akan meningkat sesuai dengan fungsinya menghimpun dana dan menyalurka dana kepada masyarakat dengan lebih memperhatikan kegiatan sektor perekonomian nasional dengan prioritas dalam penyaluran dana kepada pengusaha kecil dan menengah koperasi serta kepada lapisan masyarakat tanpa diskriminasi sehingga akan dapat memperkuat struktur perekonomian nasional. Dalam prakteknya perjanjian kredit bank, klausa-klausa perjanjian hingga sekarang masih ditetapkan oleh pihak kreditur, sedangkan pihak debitur hanya menerima saja klausa yang telah ditetapkan tersebut, sehingga bertentangan dengan azas kebebasan berkontrak dalam perjanjian. Kata Kunci : Hukum Perdata, Kredit Perbankan

Abstract

Abstak: Tujuan hidup manusia secara umum adalah demi tercapainya kebahagiaan hidup baik di dunia maupun di akhirat kelak. Tercapainya tujuan hidup manusia tersebut meniscayakan adanya prasarat yang berupa pranata sosial kehidupan manusia. Di antara prasarat yang mesti ada itu adalah hukum. Hukum Islam adalah perangkat aturan yang memiliki tujuan yang sejalan dengan tujuan manusia hidup tersebut. Sebagai perangkat aturan Hukum Islam bisa dilihat dari dua kategori, yakni kategori hukum yang bersifat pokok dan kategori aturan yang bersifat pendukung. Abstract

An agreement is a deal made between somebody or some person with somebody or other people to do a deed certain. If this observed, that the agreement made by the two parties will basically give rise to a right on the one hand, and an obligation on the other. This is closely related to the existing legal aspect. So that is in law if something deed has influence or consequence which related to a law called with deed law (including agreement). The problem in the study is how to form an agreement to work on the same among owner soil with manager House Eat and How View Law Islam to implementation cooperation Build Operate and Transfer (BOT) in development and management House Eat as the place effort. Abstract

Law No. 3 of 2006 concerning Religious Courts (PA) provides significant changes regarding the position and existence of PA in Indonesia. The PA's authority is 1) family law cases, 2) sharia economic cases. Follow up on the authority in the field of Islamic economics. KHES was ratified through Supreme Court Regulation (Perma) No. 2 of 2008 concerning the Compilation of Sharia Economic Law. One of the themes in KHES and which is quite widely used by the community is the Syirkah Agreement. The provisions on Syirkah in KHES are contained in Book II Chapter VI concerning Syirkah and Ownership Syirkah. KHES allows all forms of syirkah contracts which include syirkah inan, syirkah abdan, syirkah mufawadhah, syirkah wujuh and syirkah mudharabah. The Maliki School allows shirkah inan, shirkah abdan, and shirkah mufawadhah but does not allow syirkah wujuh. Syirkah is valid because it is only related to the value of property and work. Meanwhile, there are no two main elements in syirkah wujuh. The Maliki school also does not include syirkah mudarabbah as a form of syirkah. Abstract

The purpose of this research is the legal protection for Termination of Employment in the era of the COVID-19 pandemic according to Islamic law and Indonesian positive law as well as the similarities and differences between the two. The research method used in this research is comparative descriptive, with a content analysis approach. This approach used an in-depth discussion of the contents of written information, systematically and objectively analyzed the facts, characteristics, and the relationship between existing elements or certain phenomena and can then be compared to theory. According to Islamic law, legal protection for workers against layoffs is part of the purpose of Islamic law. Namely to maintain life and property to achieve happiness in the world through a good and honorable life (hayyah thayyibah). Therefore, it must be carried out with principles such as human freedom, human dignity, justice, and anti-discrimination, as well as fair wages. In contrast, according to positive law, workers' legal protection for termination of employment can occur because the company is closed due to force majeure, and the entrepreneur is obliged to pay severance pay, long service pay and compensation rights pay that must be received by the worker. The difference is that Islamic law is not regulated in detail regarding the provision of severance pay, long service pay, and compensation rights pay that should be received as in positive law. However, in Islamic law, it is carried out following the agreement (akad) that has been made and agreed to. Abstract

One of the objectives of this research is to analyze, understand and find out the views of Muhammadiyah Regional Leaders and Nahdlatul Ulama Branch Managers in Bandar Lampung City regarding Zakat Law for those in Debt. The research method seen from this type of research is field research (field research). Data collection methods used in the form of books, journals, and interviews as well as documents and others. This study uses a qualitative method. Based on the results of the study, it was concluded that according to the Regional Leadership of Muhammadiyah, debt was a barrier for someone not to pay zakat. If someone has a debt then he should pay the debt first, if the debt has been paid and there is still remaining assets after paying the debt then he is obliged to pay zakat when it reaches the nisab, if it does not reach the nisab then it is not obligatory to pay zakat while according to the Nahdltul Branch Manager Scholars are of the opinion that if a person has a debt, he is obliged to pay zakat. Abstract

This research reveals the changing sounds of articles in the Job Creation Law and analysis according to Maslahah Mursalah. The purpose of this research is to find out the parts of the Job Creation Law in Indonesia that are detrimental and have a bad impact on one of the parties (labor). Indonesian government has simplified through an omnibus law in which there are several laws that have been trimmed to make it more efficient. The concept of this omnibus law is in the form of a job creation law that has 11 clusters, one of which regulates employment. Then socialization and study are needed to avoid these conflicts and losses. This research uses a normative juridical approach method, namely research by examining library materials (library research). The conclusion of this study is that changes in the regulations of several articles contained in the Job Creation Law still have a bad impact on workers or workers if applied to the company and its employees. This is inconsistent with the theory of maslahah mursalah, which is to attach importance to the lives of many people or more of detriment than benefits to labor.Key words: Maslahah Mursalah, Job Creation Law, Labor Protection

Abstract

The Property Research Institute, Savills Indonesia projects that the supply of apartments will increase by 129,000 units by 2022 , therefore it is certain agents property and marketing will continue to grow but besides that they only think about profit without wanting to deepen their understanding of whether what they are doing is right or not. The purpose of this research is to know the practice profit sharing in marketing as well as the view of sharia economic law on practice profit sharing in marketing at CV Bonzela Property Apartement Grand Kamala Lagoon, Bekasi. This research uses a field study type approach (field research). The sources of data used are primary and secondary data, statements of sources and journals related to the thesis. Data collection techniques carry out by observation, Interview, and documentation. Data processing methods are carried out by editing data, systematizing data, and verification. The data analysis method used is a qualitative analysis approach in the method of inductive thinking.  Based on the research results, it would be stated that the practice of profit sharing in marketing on CV Bonzela Property Apartment Grand Kamala Lagoon there is a fraud committed by marketing to the company by doing secret selling, which is only profitable marketing and harm CV Bonzela Property. as for the practice of profit sharing in marketing at CV Bonzela Property Grand Kamala Lagoon Apartment according to Islamic law is something that is prohibited in Islam, because there are many frauds committed by marketing against the company and it is unlawful or prohibited in Islam. Abstract

The purpose of this study is to discuss diverting payments to other parties in terms of buying and selling credit goods. These cases have recently rampant occurred in the midst of modern society. Therefore, we tried to find out how Islamic law views such practice. The method used in this study is library research, conducted by collecting library materials such as journals, books, and archives of literature documents. We review them with various theories that have a relationship with the problem being investigated. As for sources for primary legal theory in our research, we used the Quran, Hadith, Laws, and Regulations. The result of our study concludes that the practice of diverting payments to other parties in the sale and purchase of credit goods today, in fact, only involves the first and second buyers unbeknownst to the leasing company - which is supposedly the legal owner of the credit goods being traded. Originated from such a problem transaction that ignores the procedural and regulatory aspects of the leasing company, it causes a default in the form of delays in payment of installments and embezzlement credit objects. Even though this is a common issue, however, in the view of Islamic law, diverting payments to other parties in buying and selling credit goods is allowed as long as it meets the requirements and pillars and is based on the correct procedure by involving the leasing party.Keywords: Credit Goods, Islamic Law, Diverting of Payments,
