Abstract

This study analyzed the issues surrounding zakat distribution. The distribution of zakat is clearly stipulated in Islamic law, specifically in the Qur'an, Surah Al-Taubah, verse 60. The Inisiatif Zakat Indonesia (IZI) Lampung allocated zakat funds for disaster victims, such as those affected by earthquakes, tsunamis, landslides, and the COVID-19 pandemic. This study focused on the perspective of Maslahah regarding the distribution of zakat funds for humanitarian programs by IZI Lampung. The research was conducted as field research related to the distribution of zakat funds for humanitarian purposes. The primary data consisted of observations and interviews about the zakat distribution process for humanitarian programs. The data were analyzed using the Maslahah theory to draw conclusions. The findings indicated that the distribution of zakat funds for humanitarian programs by IZI Lampung was based on a prioritization scale, targeting the poor and needy. For natural disaster victims, IZI Lampung prioritized distribution to the worst-affected areas, coordinating with local governments. This approach brought significant benefits (Maslahah) to zakat recipients (mustahik), who included the poor, needy, debtors (gharimin), and those in the path of Allah (fî sabîlillâh).Keywords: IZI; Maslahah; Humanitarian; Zakat Fund Distribution

Abstract

Grants are tabarru' actions but often cause envy among the parties concerned or indirectly concerned. With several facts and cases regarding the withdrawal of grant assets for various reasons.  As the case of grant disputes in the Kudus Religious Court with case number 314/Pdt.G/2020/PA.Kds. Jo. Number 372/Pdt.G/2020/PTA.Smg. Jo. 658 K/Ag/2021. The purpose of this article is to know and analyse the judge's decision in resolving grant disputes from a maslahah perspective, seen from the type of research using library research or literature study, the primary data source is the decision of the Kudus Religious Court with case number 314/Pdt.G/2020/PA.Kds. Jo. Number 372/Pdt.G/2020/PTA.Smg. Jo. 658 K/Ag/2021, while secondary legal sources are maslahah perspectives both from book sources, journal articles and so on, then data analysis using qualitative analysis techniques.  The results of the study explain that the decisions of the courts of first instance and appeal are cancelled because this case is a case that should be the authority of the religious courts. As the decision of the panel of judges of the Kudus Religious Court Number 314/Pdt.G/2020/Pa.Kds, and the Semarang Religious High Court in its decision Number 372/Pdt.G/2020/PTA.Smg did not apply justice and expediency and even legal certainty. Article 49 of the Religious Courts Law is the basis for legal certainty in this case so that the party who filed the lawsuit did not get justice that the object of the case was the only property that had been owned and also in the two decisions did not achieve happiness for many parties, this is in line with the Supreme Court's decision Number 658 K/Ag/2021. Therefore, the decision of the Indonesian Supreme Court in examining and deciding the case is in accordance with the applicable legal theory and in accordance with the principle of kemashlahatan or maslahah theory in Islamic law.Keywords: Grant; Maslahah; Tabarru' Act

Abstract

The mosque has a function not only as a place of mahdhoh worship but also as a center for Muslim socio-economic activities (social economy center), namely through infaq, and alms productively, as happened at the Nurul Hidayah mosque in Panjang Utara village, one of the programs carried out is to improve the welfare of small micro businesses around the mosque environment. The purpose of this study is to determine and analyze in Islamic law the practice of managing infaq and alms funds in improving the welfare of small micro businesses at the Nurul Hidayah Mosque in Panjang Utara. The method used in this research is qualitative with descriptive method, the object of research is the amil zakat institution, infaq and alms of the Nurul Hidayah Mosque. The data sources used are primary and secondary data sources. The collection techniques are interviews and documentation. Based on the results of the study, it can be concluded that the management of the infaq funds of the Nurul Hidayah Mosque in improving the welfare of small micro businesses by providing loans without any administrative costs, guarantees and interest or margins, this is done so that it is beneficial to customers not only in the short term but more than that, namely in the long term, while the perspective of Islamic law on the management of infaq and alms funds in improving the welfare of small and medium micro businesses at the Nurul Hidayah Mosque in Panjang Utara village is in accordance with Islamic law, but in the future the distribution of infaq and alms should be further expanded to other groups.Keywords: Ibadah Mahdhoh; Micro Small and Medium Enterprises; Management of Infak Funds

Abstract

This study examines the comparative mechanisms of halal certification between Indonesia and Malaysia from the perspective of Sharia economic law. The aim of this research is to analyze the differences and similarities in the halal certification procedures applied in both countries, as well as the legal and economic implications arising from these differences. The research method utilized is a qualitative approach with a literature review technique, where secondary data is obtained from literature, regulations, and documents related to halal certification. The analysis involves examining government policies, certification bodies, and the role of Sharia economic law in promoting the implementation of halal standards. The findings reveal that both countries have a strong Sharia legal foundation for halal certification, yet there are significant differences in implementation and standards. In Indonesia, halal certification is managed by the Halal Product Assurance Agency (BPJPH) with oversight from the Indonesian Ulema Council (MUI). In contrast, Malaysia's halal certification is handled by the Department of Islamic Development Malaysia (JAKIM), which possesses full authority and employs a more centralized and integrated approach. The economic implications of these differences include variations in certification costs, processing times, and consumer trust in halal labels. Based on the perspective of Islamic economic law, this study finds that halal certification is not merely an administrative process but a component of implementing sharia principles in the economy, including: the Principle of Justice, Social Responsibility, Consumer Protection, and Market Integrity.Keywords: Halal certification, Indonesia, Malaysia, Sharia economic law, halal industry

Abstract

This article aims to analyze the optimization of the murabaha agreement form in Baitul Maal Wat Tamwil (BMT) and its relevance in supporting the economic growth of sharia-based communities, especially for micro, small and medium enterprises. With a significant number of middle and lower class people in Indonesia, BMT is present as an alternative Islamic financial institution that provides access to usury-free financing. The murabaha agreement allows BMT to purchase goods at the customer's request and sell them at an agreed profit margin. However, there are challenges in the implementation of this financing, hence the need for optimization for BMT managers in an effort to maintain its existence. This research uses a qualitative method with a literature study approach, identifying the mechanism, dynamics of murabaha financing and the role of murabaha in the economy based on DSN-MUI fatwa No. 04/DSN-MUI/IV/2000. The results showed that transparency, customer education, and technology utilization play an important role in increasing trust in BMT while increasing economic inclusion, thus strengthening its position in the Islamic financial system in Indonesia.Keywords: BMT; Murabaha; Sharia Financing

Abstract

The concept of halal tourism has become a trend and focus of discussion lately. This shows the dynamization of fiqh in the tourism sector. This study aims to explore how the management of Sariater hot springs in Subang responds to fiqh, which is the needs of tourists who implement the concept of halal tourism. The method used is qualitative with primary data from interviews with tourism managers and site observations. Secondary data uses documentation of releases on internet media. As a result, the manager of Sariater responds to the dynamism of fiqh owned by tourists by making policies that lead to the concept of halal tourism. There are three actions that researchers get; first, maintaining cleanliness and preserving trees around tourist attractions, reflecting hifzu al-bi’ah; second, providing special facilities for women (Women Only), demonstrating hifzu al-din; third, monitoring water temperature and mineral content to ensure compliance with hifzu al-nafs. The author recommends that additional facilities be provided in the future, such as halal-certified food and beverages, as well as sharia-compliant massage services, to enhance the overall halal tourism experience and attract more Muslim and non-Muslim tourists

Abstract

Abstract: Halal food decisions by Muslim consumers illustrate complex interactions. In urban and suburban areas, generation Z faces a multicultural and pluralistic environment which influences their perspective, including regarding food consumption. Halal food purchasing decisions by Muslim consumers around the world reflect a complex mix of Halal Food Awareness and Halal Certification. The aim of this research is to look at aspects of halal food awareness and halal certificates in making decisions to purchase halal food for Generation Z Muslim consumers in urban and sub-urban areas. The research methodology used in this research is quantitative using SmartPLS 3.0 software. Primary data collection was carried out by taking a sample of respondents, namely generation Z Muslim consumers in Urban and Sub-Urban areas in Lampung Province using a purposive sampling method. A total of 300 samples were used for this research. Data was obtained through the use of Google Form, with indicator assessment carried out using a Likert Scale. The research results show that awareness of halal food and halal certificates influence the decision to purchase halal food among Generation Z Muslim consumers in urban areas in Lampung Province. Awareness of halal food influences the decision to purchase halal food among Generation Z Muslim consumers in Sub-Urban Areas in Lampung Province. Abstract

This study aims to analyze compensation due to the exchange of original spare parts by rental car renters from the perspective of Wahbah Zuhaili, with a case study on car rental company in Binjai City. The main problem faced by rental companies is financial and operational losses due to the actions of tenants who replace original spare parts with non-original ones. This study uses an empirical juridical approach with a case study method to explore how Islamic law, especially according to Wahbah Zuhaili's view, can be applied in this context. According to Wahbah Zuhaili, the tenant has full responsibility to maintain the rented goods and compensate for losses incurred due to negligence or intentional damage to the goods. In this case, the exchange of original spare parts with non-original ones by the lessee is a form of breach of contract and harms the car rental company. Islamic law stipulates that tenants are obliged to pay compensation equivalent to the value of the losses incurred. The results of the analysis show that the application of Islamic legal principles can provide justice for the aggrieved party. This study also found that the principle of compensation in Islamic law is in line with the positive law that applies in Indonesia. Abstract

Auctions of collateral by Rural Credit Banks (BPR) without going through a credit restructuring process raise legal issues related to debtor protection and the fulfillment of the principle of fairness in banking practices. This study aims to analyze the legality of auctions of collateral by BPR without prior credit restructuring, focusing on Decision Number 260/Pdt.G/2019/PN Dps. The research method used is a normative legal research method, applying the Theory of Statement, Legal Certainty, and Justice to discuss legal issues concerning the validity of collateral auctions without restructuring. This study relies on previously available information (secondary sources). Data collection was conducted through document review and relevant literature, while data analysis techniques were performed using qualitative data analysis. The results of this study include: Credit restructuring is not required in cases of non-performing loans, in accordance with Bank Indonesia Regulation No. 14/15/PBI/2012. This means that banks can auction collateral immediately without restructuring if there is no agreement between the bank and the debtor. Regarding collateral auctioned without prior restructuring, debtors may pursue legal remedies, both non-litigious and litigious. In accordance with Article 21(1) of the Indonesian Financial Services Authority Regulation No. 33/Pojk.03/2018 regarding the Quality of Productive Assets and the Formation of Provisions for the Write-off of Productive Assets of Rural Banks (BPR), the auction conducted by PT. BPR without credit restructuring is valid.

Abstract

The bakery business in Banyumas Regency is quickly growing in line with the increasing public interest in bread and cake products. Seeing as most people in Banyumas Regency are Muslim, halal certification is a really important thing to keep people’s trust and increase sales. Since 2019, halal certification has become mandatory for every business worker, including bakery businesses. Mostly, every bakery that has obtained halal certification must consistently implement the Halal Product Assurance System (SJPH) to ensure the sustainability of its halal status. In reality, many bakeries in Banyumas Regency that have obtained halal certification still aspect challenges in implementing the SJPH. This study aims to analyze the implementation of halal certification in bakeries in Banyumas Regency and its impact on product sales. This study uses a descriptive qualitative approach with interviews, observations, and documentation at the research locations, Mumtaza Cake and Bakery and Shiawasena Pan BakeHouse. The study found that the halal certification in both bakeries was based on regulatory requirements and the owners’ awareness. The implementation followed SJPH principles, including commitment, raw materials, halal production processes, product handling, monitoring, and evaluation. This consistent application positively impacted sales stability, production, and consumer trust
