Abstract

This study aims to elaborate the maslahah mursalah theory in responding to differences in the determination of the beginning of the Hijri month in religious moderation and examining the idea of wujū al - hilāl, rukyat al-hilāl and Imkān al-Rukyat theory in the analysis of religious moderation. The research method employes comparative study. A comparative study is comparing one idea to another and the results of one research with other tasks. The results showed that  hisab and rukyah combination is possible to practice in Indonesia to create benefits based on maslahah mursalah. The maslahah mursalah approach is used to formulate laws based on maslahat considerations, a priority in maqasid al-sharia. The use of maslahah mursalah can be agreed upon. Besides, the Indonesian Muslim Ummah should be together in the implementation of worship for the sake of achieving a strong Islamic ukhuwah. Religious moderation is crucial to bridge the differences in determining the beginning of the Hijri month. The Falak science experts in charge of this issue are responsible for formulating the criteria for determining the beginning of the Hijri month, mainly related to fasting. 01 Ramadan, Eid on 01 Shawwal and 10 Zulhijjah, which can be accepted by those who use the criteria of rukyat al- hilāl and wujūd al-hilāl. In this way, efforts towards the unification of the Hijriyah calendar can be realized.

Abstract

This study aims at examining the use the principle of i`tibar al ma'alat in the MUI fatwa number 14 of 2020 concerning the organization of worship in situations of the Covid-19 outbreak. MUI fatwa number 14 of 2020 forced most Muslims in Indonesia to worship out of the box. the results of the study it was found that the MUI in issuing fatwa number 14 of 2020 had considered the principle of i'tibar al ma'alat, the prohibition of worshiping in congregation in areas with high distribution potential was determined in order to anticipate the spread of the Covid-19 outbreak. However, the MUI does not generalize all regions, this is also done based on the principle of i'tibar al ma'alat to avoid the practice of tafrith to religious orders in the midst of society

Abstract

The main problem in this research is regarding the application of Article 504 – 505 of the Criminal Code and Regional Regulation Number 2 of 2008 against the Homeless in Makassar City, then formulated into a sub-problem or research question, namely what factors cause the emergence of homelessness in Makassar City and how to apply Article 504 – 505 of the Criminal Code against the Homeless? This research uses qualitative field research. The results of this study indicate that the factors that cause the emergence of homelessness are Poverty Problems, Education Problems, Work Skills Problems and Social Cultural Problems and Social Cultural Problems Consisting of Low Self-Esteem, Surrender to Physical Conditions, Health Problems. The application of Articles 504 – 505 of the Criminal Code has been implemented but has not been maximized, so this effort is not optimal enough, this is what makes the homeless still carry out their activities for economic needs. The implication of the research is that the South Sulawesi Provincial Social Service Government is expected to collect data on the homeless who do not have a place to live, build rehabilitation homes or develop work skills. It is advisable for the Makassar City DPRD Government to strengthen the sanctions given to the homeless in accordance with Articles 504 – 505 of the Criminal Code and Regional Regulation Number 2 of 2008.

Abstract

Along with the development of increasingly modern times, there is a growing trend of asking for marriage. Many of them are mired in this young marriage tren's problematics for various reasons, both positive and negative. Being too young does not become an obstacle to getting married. Even though marriage is not just a physical matter, it must be viewed from mental readiness. This research focuses on the implications of the trend of youth marriage requests. This research uses a qualitative analysis descriptive-analytical method. The study results show that the trend of young marriage will impact these parties, on the other hand, to avoid adultery and not fall into promiscuity.

Abstract

Gagasan pembaharuan hukum Islam lebih dipandang sebagai tantangan sekaligus ancaman yang perlu diwaspadai. Keadaan yang demikian ini hampir menjadi model pemikiran sebagian besar Muslim di Indonesia, yang tentu saja pada akhirnya memimbulkan kegelisahan bagi para penggiat pemikiran Islam, untuk berusaha melakukan rekonstruksi pemikiran, terutama bagi kalangan muda Muslim dari berbagai ormas Islam. Gesekan pemikiran, baik yang muncul dikalangan umat Islam maupun yang diimpor dari Barat, tentunya membawa pada wajah gerakan pemikiran Islam menjadi sangat variatif Obsesi Harun, yaitu ingin melihat ummat Islam Indonesia maju. Kemajuan tersebut menurutnya akan tercapai jika pemikiran umat Islam juga maju, dan pikiran maju tersebut bertitik tolak pada pandangan ideologi rasionalnya yang menurutnya sangat cocok dengan perkembangan dan tantangan kemajuan ketika itu. Atas dasar itulah Harun membawa pemikiran-pemikiran yang diintrodusir di IAIN, sehingga ketika memperkenalkan Islam, Harun mencoba menggunakan pendekatan filosofis dalam buah pikirannya seperti antara lain dalam buku Islam ditinjau dari Berbagai Aspeknya, Pembaharuan dalam Islam, Sejarah Pemikiran dan Gerakan, serta Islam Rasional, Gagasan dan Pemikiran Harun Nasution. Harun Nasution adalah seorang pembaharu pendidikan tinggi Islam di Indonesia, yang kontribusinya terhadap perkembangan pemikiran Hukum Islam di Indonesia, adalah hasil dari dialog antara dia dengan lingkungan.

Abstract

This research aims to educate children in ordering prayers in Islam and then analyze it in the child protection law. However, in general, Islam places more emphasis on gentleness, patience, and compassion than on violent ways in educating children, although in some instances showing disbelief and opposing children's mistakes is necessary, of course, correctly and appropriately. In the concept of Islamic law, violence has become an enjoyable theme to discuss. On the one hand, there is a hadith from the Prophet about educating children, which, if understood textually, raises the public perception of the necessity of violence in educating children. The Child Protection Law aims to guarantee and protect children and their rights to live, grow, develop and participate optimally following human dignity and protection from violence and discrimination.Keywords: Islamic Law; Prayer; Child Protection Act

Abstract

The purpose of this research is to 1) determine the factors that influence the employees of Bank Axa Mandiri Makassar City to carry out Bulimia Nervosa. 2) To formulate the prevention and treatment of bulimia nervosa. 3) To indetify the harm of bulimia nervosa behavior in terms of health and Islamic law aspects. Answering these problems, the author uses the health and syar'i approach. The health approach is used because it refers to the scope of Islamic law. This type of research is qualitative research (field research), then a sociological (community) approach technique by examining the field's facts. This study's results indicate the factors that cause the employees of the Makassar City Axa Mandiri Bank to commit Bulimia nervosa, namely because of the demands of their work and wanting to satisfy their appetite. In terms of health aspects, the harmful behavior of bulimia nervosa can cause various diseases. As for the behavior of bulimia nervosa in terms of Islamic law, it is an act that is prohibited and makes the perpetrator will get a sin. Bulimia nervosa prevention can be done with gratitude, increased self-confidence, being realistic, adjusting eating patterns, and socializing. Several steps can be taken to take action to treat bulimia nervosa with psychologist therapy.

Abstract

This paper aims to analyze QS al-Nū/24: 22, from text to context. Historically, the text of QS al-Nū/24: 22came down related to the occurrence of the ḥadīṡ al-ifkī, incident that hit 'Aisyah radiyallahu 'anha. That event predicted by historians took place after the Bani Musthaliq war around 5 or 6 H. Some of the social aspects of Islamic law which contained in this text are ethical principles in social interaction, individual attitudes in dealing with slander or hoaxes, and the legal consequences stipulated by the Shari'a against perpetrators and spreaders of fake news or hoaxes.Keywords: Asbāb Nuzūl, historical context, social law, hoax.
