The purpose of this writing is to find out the substance that can be applied to a Notary’s statement and the reason for a Notary’s statement being labeled as a cover note. This study uses normative research methods with the problem of voidness in norms with statutory, conceptual, and analytical approaches. The sources of legal materials used consist of primary legal materials that come from laws and regulations related to legal issues, secondary legal materials obtained from journals, expert views and the results of previous research as well as tertiary legal materials obtained from legal dictionaries and language dictionaries which are described qualitatively. The results of the research show that the substance that can be applied to a Notary’s statement is a statement that explains the facts about events that actually happened and not as a guarantee for something. A notary statement with cover note label is a term used in practice that has been going on continuously. The cover note labeling describes the condition of the notary's statement containing the substance of protecting, guaranteeing and promising. This substance has the potential to cause legal problems for notaries and consequences for civil law liability, administrative law, and criminal law. Tujuan penulisan ini yaitu untuk mengetahui substansi yang dapat diterapkan pada surat keterangan notaris dan penyebab surat keterangan notaris yang dilabeling Cover Note menimbulkan permasalahan hukum. Penelitian ini menggunakan metode penelitian normatif dengan adanya permasalahan kekosongan norma dengan jenis pendekatan perundang-undangan, konseptual dan pendekatan analisis. Sumber bahan hukum yang digunakan terdiri dari bahan hukum primer yakni peraturan perundang-undangan yang berkaitan dengan isu hukum, bahan hukum sekunder yang didapatkan dari jurnal, pandangan ahli maupun hasil penelitian terdahulu dan bahan hukum tersier dididapatkan dari kamus hukum maupun kamus bahasa yang diuraikan secara kualitatif. Hasil penelitian menunjukkan bahwa substansi yang dapat diterapkan pada surat keterangan adalah pernyataan yang menerangkan fakta terhadap peristiwa yang benar terjadi menyangkut kewajiban dan kewenangannya, serta bukan sebagai jaminan/penanggungan terhadap sesuatu. Surat keterangan notaris yang dilabeling covernote merupakan istilah dalam praktek yang telah berlangsung terus menerus. Labeling covernote tersebut menggambarkan keadaan surat keterangan notaris mengandung substansi melindungi, menjamin dan menjanjikan. Substansi ini berpotensi menimbulkan permasalahan hukum bagi notaris dan berkonsekuensi pertanggungjawaban perdata, administratif, dan pidana.

The discourse on the mandatory requirements for a Covid-19 vaccine certificate in the management of population administration has become a polemic in the community. The purpose of this research is to find out about the policy regarding the mandatory requirements for the Covid-19 vaccine certificate, which is reviewed through the principle of equality before the law. This research method uses normative legal research. The results of the research study in the discussion are that the regulation of vaccination implementation is regulated in the President of the Republic of Indonesia Number 99 of 2020 concerning Vaccine Procurement and Vaccination Implementation in the Context of Combating the Corona Virus Disease 2019 (COVID-19) Pandemic as amended by Presidential Regulation of the Republic of Indonesia Number 14 of 2021 concerning Changes on Presidential Regulation of the Republic of Indonesia Number 99 of 2020 concerning Vaccine Procurement and Vaccination Implementation in the Context of Combating the Corona Virus Disease 2019 (COVID-19) Pandemic. The discourse on the mandatory use of the Covid-19 vaccine certificate in the administration of population administration and the presidential regulation sanctioning the termination of government administration services cannot be enforced because the policy is a discriminatory measure that will later be able to distinguish between those who have been vaccinated and those who have not been vaccinated and is not in accordance with the principle of Equality before. the law contained in the Indonesian constitution, namely the 1945 Constitution. Wacana syarat wajib sertifikat vaksin covid-19 dalam pengurusan administrasi kependudukan menjadi polemik dalam masyarakat. Tujuan penlitian ini untuk mengetahui wacana kebijakan syarat wajib sertifikat vaksin covid-19 di tinjau melalui asas equality before the law. Metode penelitian ini menggunakan penelitian hukum normatif. Hasil kajian penelitian dalam pembahasannya ialah Pengaturan pelaksaan vaksinasi diatur dalam Presiden Republik Indonesia Nomor 99 Tahun 2020 tentang Pengadaan Vaksin dan Pelaksanaan Vaksinasi Dalam Rangka Penanggulangan Pandemi Corona Virus Disease2019 (COVID-19) sebagaimana telah diubah dengan Peraturan Presiden Republik Indonesia Nomor 14 Tahun 2021 tentang Perubahan atas Peraturan Presiden Republik Indonesia Nomor 99 Tahun 2020 tentang Pengadaan Vaksin dan Pelaksanaan Vaksinasi Dalam Rangka Penanggulangan Pandemi Corona Virus Disease 2019 (COVID-19). Wacana syarat wajib penggunaan sertifikat vaksin covid-19 dalam pengurusan administrasi kependudukan dan sanksi perpres tentang penghentian layanan adminsitrasi pemerintahan tidak dapat diberlakukan karena kebijakan tersebut merupakan tindakan diskrimintaif yang nantinya dapat membedakan golongan yang sudah divaksin dan yang belum divaksin serta tidak sesuai dengan asas equality before the law yang terdapat dalam kosntitusi Indonesia yaitu UUD 1945.

Nowadays, the use and transfer of personal data in various countries have increased. ASEAN has formed a regional instrument called ASEAN Framework on Personal Data Protection that is expected to become a standard legal system in cross-border data transfer. Indonesia has just ratified Law Number 27 of 2022 on personal data protection, which in this law also regulates the transfer mechanism of personal data outside the Indonesian territory. The more personal data flows outside the territory of Indonesia, the more important it should get adequate protection. This research aims to identify whether ASEAN has provided a sufficient legal system to protect the flow of international data transfers and to explore an adequate legal system in Indonesia that are compatible with the ASEAN framework on PDP towards cross-border data transfer. This is doctrinal legal research with a conceptual and statutory approach The research shows that ASEAN has faced the issues of asymmetric legislation in the region by proposing any acts that could strengthen the cyber system in Southeast Asia, especially in the cross-border data flow. One of the mechanisms that have been proposed is ASEAN Model Contractual Clauses (MCC). By applying MCC, countries including Indonesia can carry out the personal data transfer across borders with the countries that do not yet have laws that are equal to the PDP Law. Indonesia can also harmonize the contents of the contract in line between domestic laws and regional instruments.

Tulisan ini membahas isu tentang kewenangan konkuren di daerah dalam kaitan dengan perangkat daerah yakni dinas daerah dan badan daerah yang menggunakan pendekatan konseptual dan pendekatan perundang-undangan. Tulisan ini berpandangan bahwa pada praktik penyelenggaraan pemerintahan di daerah masih menimbulkan kekaburan atas pemahaman terhadap penentuan nomenklatur lembaga teknis daerah yang menggunakan diksi ‘badan’ dan ‘dinas’ yang terkadang tidak selaras dengan orientasi dari lembaga daerah tersebut. Oleh karenanya, tulisan ini bertujuan memberikan kejelasan penafsiran atas kewenangan dua nomenklatur perangkat daerah sehingga pemerintah daerah lebih mudah mengklasifikasikan struktur pemerintah di daerahnya secara tepat. Selanjutnya, tulisan ini menjelaskan tentang indikasi perbedaan antara dinas dan badan yang memiliki fungsi dan kewenangan yang berbeda secara signifikan yaitu dinas daerah sebagai pelaksana urusan pemerintahan di daerah sedangkan badan sebagai penunjang urusan pemerintahan di daerah.

The purpose of this study is to determine the regulation of traditional drinks as intangible cultural heritage and to analyze the protection of Balinese Arak as one of the traditional knowledge that is used commercially in the context of intangible cultural heritage. This article uses normative legal research with statute, analytical, and conceptual approaches. The results showed that the regulation of traditional drinks as intangible cultural heritage, specifically traditional knowledge, is regulated in several laws and regulations such as the Convention for the Safeguarding of the Intangible Cultural Heritage, Law No. 5 of 2017 on Advancement of Culture, Bali Regional Regulation Number 4 of 2020 on Strengthening and Promotion of Balinese Culture as well as Bali Governor Regulation Number 1 of 2020 on the Management of Balinese Fermented and/or Distilled Drink. Although IHC is for preservation, however, it can be interpreted that Law No. 5 of 2017 on Advancement of Culture is more than just preservation as it already regulates in general the commercialization of the object of cultural advancement. The protection of Balinese Arak as one of the traditional knowledge that is used commercially is protected under Articles 37 and 38 of Law No. 5 of 2017 on Advancement of Culture where the Indonesian Government gives permission to big industry and/or foreign parties who want to take advantage of Indonesian cultural advancement objects on the condition that they must meet the principle of benefit sharing as a form of protection.

This study aims to understand and analyze related changes to the provisions in the Law on Notary Office and the urgency of Reconstructing the Legal Reconstruction of Attaching Fingerprints in Minutes of Deeds for Persons with Physical Disabilities. The research method used in this study is a normative legal research method with a statutory and conceptual approach. The results of this study explain that there have been several changes in the UUJN. The points that have changed in the latest UUJN are: the existence of a Special Substitute Notary; notary candidate apprentice; notary retirement age and its relation to the extension of retirement age; Notary authority in making deeds related to land; the authority of the Notary in making the minutes of the auction deed; Notary who is appointed as a State Official; and Implementation of notary position supervision. The urgency of the need for legal reconstruction is in order to achieve legal certainty from the implementation of the contents of Article 16 paragraph 1 letter (c). By reconstructing the contents of this article, the implementation can be carried out properly by a notary who is required to attach his fingerprints, especially for appearers at a notary who has physical limitations, namely the disabled. Studi ini bertujuan untuk untuk memahami dan menganalisis terkait perubahan pada ketentuan-ketentuan dalam Undang-Undang Jabatan Notaris serta urgensi Rekonstruksi Hukum Pelekatan Sidik Jari Dalam Minuta Akta Bagi Penyandang Tuna Daksa. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini menjelaskan bahwa Terdapat beberapa perubahan dalam UUJN, Adapun point-point yang ada perubahan dalam UUJN terbaru yakni: keberadaan Notaris Pengganti Khusus; magang calon Notaris; usia pensiun Notaris dan kaitannya dengan perpanjangan usia pensiun; kewenangan Notaris dalam membuat akta yang berkaitan dengan pertanahan; kewenangan Notaris dalam membuat akta risalah lelang; Notaris yang diangkat menjadi Pejabat Negara; dan Pelaksanaan pengawasan jabatan Notaris. Urgensi diperlukannya rekonstruksi hukum ini adalah agar mencapai kepastian hukum dari pelaksanaan isi pasal 16 ayat 1 huruf ( c ). Dengan di rekonstruksi isi dari pasal ini maka dalam pelasanaannya dapat dijalankan dengan baik oleh notaris yang diwajibkan melekatkan sidik penghadap nya, khususnya bagi penghadap di notaris yang memiliki keterbatasan fisik yakni tuna daksa.

The problem of equating the concepts of dispute and default results as legal practitioners tending to assume that every case with an arbitration clause is a dispute that must be examined at an arbitration institution even though the case is not necessarily a dispute because cases, disputes and default have different concepts, nature and causes. According to international instrument, arbitration clause is mandatory for cases that submitted to the arbitration. It shall have clearly regulated under agreement of the parties to the dispute. Thus if there a dispute when implementing their agreement then the settlement brought before arbitration. Unfortunately in the reality is different. This research is used normative legal research methods with approaches: (1) Analitical and Conceptual Approach, and (2) The Statue Approach. The result of this research is between arbitration institutions and general justice must implimentated in harmony and must contribute to each other in creating justice, certainty and benefit of the law in carrying out their duties. Only with this harmony will creating a suitability of judicial competence which is fair to all parties. Regulation regarding the definition of arbitration dispute should be clearly and explicitly stipulated in the general provisions of the Arbitration Law and Alternative Dispute Resolution so that all parties may understanding to and the justice, legal certainty in determining in related cases of the competence of arbitration can be achieved.

The presence of an imbalance in the partnership between sugar mills and sugarcane farmers under the agricultural land leasing system has an impact on national sugar productivity. This study was based on the speculative hypothesis that existing partnerships frequently harm sugarcane farmers. The goal of this study is to examine a type of partnership that occurs in sugar cane farming in Indonesia using a new method based on sharia economic law known as the mukharabah bil mudharabah contract. The research method employed in this study is normative-juridical, including statutory and conceptual methods. This research yielded findings in the form of a new concept that depicts the characteristics of sugarcane farmer partnerships based on the mukharabah bil mudharabah contract and provides policy input for the government regarding sugarcane farmer partnerships with financing institutions based on the mukharabah bil mudharabah contract. In relation to this, the researchers proposed the concept of a "mukharabah bil mudharabah" contract to replace the partnership concept that has been implemented thus far in the hope that it will not be detrimental to sugarcane farmers. Adanya ketidakseimbangan pada kerja sama kemitraan di antara pabrik gula dan petani tebu yang dilakukan dengan sistem sewa lahan pertanian mempengaruhi produktivitas gula nasional. Penelitian ini dilakukan dengan dasar hipotesa sementara bahwa kemitraan yang ada saat ini sering kali merugikan petani tebu. Objek penelitian ini adalah bentuk kemitraan yang terjadi pada pertanian tebu di Indonesia dengan metode baru berdasarkan konsep hukum ekonomi syariah yang dikenal dengan nama akad mukharabah bil mudharabah. Metode penelitian yang digunakan dalam penelitian ini yaitu yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Penelitian ini menghasilkan temuan berupa konsep baru yang menunjukkan karakteristik mengenai kemitraan petani tebu berdasar akad mukharabah bil mudharabah, dan masukan kebijakan bagi pemerintah terkait kemitraan petani tebu dengan lembaga pembiayaan dengan berdasar konsep akad mukharabah bil mudharabah. Terkait hal tersebut maka peneliti mengajukan konsep akad mukharabah bil mudharabah guna menggantikan konsep kemitraan yang selama ini dijalankan dengan harapan tidak merugikan petani tebu.

This paper is a normative research that tries to decipher the differences regarding changes to the provisions of the execution of fiduciary guarantees after the decision of the Constitutional Court. The debate is based on the opinion that the Constitutional Court's decision changes the characteristics of executing fiduciary guarantees to become more complicated because it costs more and takes a longer time. The data source for this paper is in the form of Constitutional Court Decisions and laws and regulations. The author uses interpretation techniques to examine and analyze the problems in this article. As a result, the reformulation of the provisions on the execution of fiduciary guarantees carried out by the Constitutional Court is by the principles of justice, benefit, and legal certainty. The Constitutional Court has determined that the execution of a fiduciary guarantee object can only held if there is an agreement regarding the breach of contract and there is a willingness to surrender the fiduciary guarantee. They are regulated so that debtors are not treated arbitrarily by creditors. The decision provides options to maximize simple lawsuits and utilize electronic court and trial administration. Tulisan ini merupakan penelitian normatif yang mencoba menguraikan perbedatan mengenai perubahan ketentuan eksekusi jaminan fidusia pasca putusan Mahkamah Konstitusi. Perdebatan tersebut didasarkan pada pendapat bahwa putusan Mahkamah Konstitusi mengubah karakteristik eksekusi jaminan fidusia menjadi lebih rumit karena mengeluarkan biaya lebih besar dan waktu yang lebih lama. Sumber data tulisan ini berupa Putusan Mahkama Konsitusi maupun peraturan perundang-undangan. Penulis menggunakan teknik interpretasi untuk menalaah dan menganalisa masalah dalam artikel ini. Hasilnya reformulasi ketentuan eksekusi jaminan fidusia yang dilakukan oleh Mahkamah Konsitusi sudah sesuai dengan prinsip keadilan, kemanfaatan dan kepasatian hukum. Mahkamah Konsitusi telah menetapkan bahwa eksekusi objek jaminan fidusia hanya dapat dilakukan apabila ada kesepakatan mengenai cidera janji dan ada kerelaan menyerahkan jaminan fidusia. Hal ini diatur agar Debitur agar tidak diperlakukan secara sewenang-wenang oleh Kreditur. Putusan tersebut memberi pilihan untuk memaksimalkan gugatan sederhana dan memanfaatkan administrasi perkaran dan persidangan secara elektronik.

Article 46 of Law No. 44 of 2009 on Hospitals regulates corporate counterclaims involving hospitals as legal entities under the vicarious liability doctrine. However, these regulations do not fully align with hospitals' distinct characteristics. Hospitals have a unique structure with three functional units: the supervisory board, the board of directors, and various professional groups, each with distinct responsibilities. This writing examines issues surrounding Article 46, including whether hospitals should be held accountable for damages caused by healthcare human resources. It explores when hospital corporations should face litigation and when healthcare human resources should assume liability based on professional responsibility. Despite the clarity of Article 46's text, its application doesn't entirely consider hospitals' organizational uniqueness. The objective is to establish regulations and legal principles to address challenges in applying Article 46, contributing to an ideal concept of corporate counterclaims involving hospitals. The research adopts a normative juridical approach, including legislative analysis, conceptual exploration, case study, and comparative law. The research suggests a concept of hospital liability as a legal entity, contingent on four conditions: the hospital has an obligation based on the corporate negligence doctrine, breach of these obligations occurs, quantifiable losses result, and a demonstrable causal connection exists between the breach and resulting damages.
