Abstract

The purpose of this study was to identify and analyze the authority of the Jimbaran Traditional Village regarding efforts to protect the law and preserve the Siat Yeh tradition and efforts to protect the law and preserve the Siat Yeh tradition carried out by the Jimbaran Traditional Village. The type of research used in this article is empirical legal research which is carried out by examining the facts that occur in a problem. As well as using interviews as the main data. Based on the results of the research, the following conclusions can be formulated: Jimbaran Traditional Village has authority in legal protection and tradition preservation based on the provisions of the 1945 Constitution, the Culture Promotion Law, and the Regional Regulations on Traditional Villages in Bali; and With the authority that belongs to the Jimbaran Traditional Village to protect the law and preserve the Siat Yeh tradition in the form of making pararem banjars, taking an inventory of traditions through the cultural service, and invalidating them in inscriptions. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis kewenangan Desa Adat Jimbaran terkait upaya perlindungan hukum dan pelestarian tradisi siat yeh dan upaya perlindungan hukum dan pelestarian tradisi siat yeh yang dilaksanakan oleh Desa Adat Jimbaran. Jenis penelitian yang digunakan dalam artikel ini adalah penelitian hukum empiris yang dilakukan dengan mengkaji suatu fakta-fakta yang terjadi dalam suatu masalah. Serta menggunakan wawancara sebagai data utama. Berdasarkan hasil penelitian, dapat dirumuskan kesimpulan sebagai berikut : Desa Adat Jimbaran memiliki kewenangan dalam perlindungan hukum dan pelestarian tradisi berdasarkan ketentuan UUD 1945, UU Pemajuan Kebudayaan, dan Perda Desa Adat di Bali; dan Dengan kewenangan yang dimiliki Desa Adat Jimbaran melakukan perlindungan hukum dan pelestarian tradisi siat yeh dalam bentuk membuat pararem banjar, menginventaris tradisi melalui dinas kebudayaan, dan mencacatkan dalam prasasti.

Abstract

Personal chat is a personal communication conducted in two directions and concerns privacy in communication. The latest behavior of social media users shows considerable virtual openness. The social media users upload screenshots of their personal chat to their social media accounts and even send them to gossip accounts in social media. In this study, there are three issues discussed namely privacy rights in personal chats uploaded on social media, potential crime of uploading personal chats, and state legal responses to the spread of personal chat screenshot on social media. The right to privacy is basically giving the freedom to publish or not publish personal chat on social media. There are at least two privacies protected in personal chat namely the sender and recipient of the message, but they are not limited to people or things discussed in the personal chat. Uploading personal chat screenshots on social media has the potential to cause doxing (theft of personal data) and cyberbullying. Countries respond to these conditions with legal provisions in their respective countries. The act of spreading personal chat screenshot on social media has a legal consequence of a lawsuit for compensation for violations of personal data, criminal sanctions for defamation and cyberbullying.

Abstract

The purpose of this writing is to determine the functions and authorities of commissioners in limited liability companies and to analyze the position of commissioners in individual companies. The research methods used are normative legal research with a statutory approach and a concept approach. The results showed that the Commissioner is an organ of the Company in charge of carrying out supervision either in general or specifically in accordance with the articles of association and providing advice to the Board of Directors. In an Individual Company that only consists of 1 (one) person and without the role of Commissioner as supervisor, it will tend to be unlimited liability like an unincorporated business entity. Tujuan penulisan ini adalah untuk mengetahui fungsi dan kewenangan komisaris di dalam perseroan terbatas serta untuk menganalisa kedudukan komisaris dalam perseroan perorangan. Adapun metode penelitian yang dipergunakan yakni penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konsep. Hasil penelitian menunjukan bahwa Komisaris merupakan Organ Perseroan yang bertugas melaksanakan pengawasan baik secara umum atau khusus sesuai dengan anggaran dasar dan memberikan nasihat kepada Direksi. Dalam Perseroan Perorangan yang hanya beranggotakan 1 (satu) orang dan tanpa adanya peran Komisaris selaku pengawas maka akan cenderung menjadi tanggung jawab tidak terbatas layaknya badan usaha yang tidak berbadan hukum.

Abstract

This study aimed at defining the forms of disputes resolution conducted by the parties involved in peer to peer lending fintech business. article aims to analyze the forms of dispute resolution that can be taken by the parties in the peer to peer lending fintech business. This article uses normative legal research with statutue approach. The results show that the parties in the dispute on bad loans in the Peer to Peer Lending Fintech business can take two forms of dispute resolution, namely litigation and non-litigation. The litigation route is to file a simple lawsuit or by Parate Executie, while through the non-litigation route, it could yo use the Alternative Dispute Resolution Institution for the Financial Service Sector.

Abstract

The purpose of this study is to explore land consolidation arrangements in Bali and explore in depth the transformation of Tri Hita Karana in land consolidation arrangements in Bali. This research method uses normative legal research. The approach used is the statutory approach, the concept approach and the facts approach. The sources of legal materials in this study are primary, secondary and tertiary legal materials. The result of this research is that land consolidation arrangements in Bali must still refer to the Bali RTRWP Regional Regulation and the Regulation of the Head of the National Land Agency Number 4 of 1991 concerning Land Consolidation. In relation to the transformation of Tri Hita Karana, the regulation of land consolidation in the BPN regulation must pay attention to the philosophical values ??adopted by the community in each region. Thus, land consolidation in Bali is inspired by Tri Hita Karana. Tujuan penelitian ini adalah untuk menelusuri pelaksanaan konsolidasi tanah di Bali dan menelusuri secara mendalam tentang transformasi Tri Hita Karana dalam pelaksanaan konsolidasi tanah di Bali. Metode penelitian ini menggunakan jenis penelitian hukum normatif. Pendekatan yang digunakan adalah pendekatan perundang-undangan, pendekatan konsep dan pendekatan fakta. Adapun sumber bahan hukum dalam penelitian ini adalah bahan hukum primer, sekunder dan tersier. Hasil penelitian ini adalah pelaksanaan konsolidasi tanah di Bali harus tetap mengacu pada Perda RTRWP Bali dan Peraturan Kepala Badan Pertanahan Nasional Nomor 12 Tahun 2019 tentang Konsolidasi Tanah. Terkait dengan transformasi Tri Hita Karana, maka pelaksanaan konsolidasi tanah dalam peraturan BPN tersebut wajib memperhatikan nilai falsafah yang dianut oleh masyarakat di masing-masing daerah. Dengan demikian, konsolidasi tanah di Bali dijiwai oleh Tri Hita Karana.

Abstract

This study aims to analyze the arrangement of Village Owned Enterprises in Indonesia and their management in realizing village Sustainable Development Goals. Village Owned Enterprises as socio-economic institutions in villages can realize sustainable development goals in villages. However, most of the existing Village-Owned Enterprises have yet to function optimally in driving the village economy. This is doctrinal legal research with legal, conceptual, and philosophical approaches. This method seeks to discuss the arrangement of Village-Owned Enterprises in Indonesia and the importance of institutional strengthening of Village-Owned Enterprises as socio-economic institutions with legal status in realizing the Sustainable Development Goals in Villages. The institutional arrangement and strengthening of Village-Owned Enterprises, apart from legal and economic aspects, also require social capital support. Rural local customs in the form of local wisdom and customary law norms that are still relevant can be social capital for the institutional strengthening of Village-Owned Enterprises. Based on local wisdom and customary law norms, the institutional management of Village Owned Enterprises can be optimal in realizing the goals of village sustainable development.

Abstract

The purpose of this study is to determine and analyze the authority to manage assets by Pakraman Village and the new rights and obligations that arise after the appointment of Pakraman Village as the subject of communal (communal) property rights on land. The type of research used in this article is normative legal research conducted by reviewing applicable laws and regulations and using secondary data as primary data. Based on the results of the research, conclusions can be formulated as follows: (1) The authority possessed by Pakraman Village as the holder of Joint (Communal) Property Rights on land, is closer to the authority of use rights without a period of time/as long as they are used; and (2) the appointment of Pakraman Village to be subject to communal (shared) property rights on land according to the Ministerial Decree of ATR/BPN No. 276/2017, to provide protection and legal certainty for the existence of the druwe land position in Pakraman village. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis kewenangan mengelola harta kekayaan oleh Desa Pakraman dan hak dan kewajiban baru yang timbul setelah ditunjuknya Desa Pakraman sebagai subyek hak milik bersama (komunal) atas tanah. Jenis penelitian yang digunakan dalam artikel ini adalah penelitian hukum normatif yang dilakukan dengan mengkaji peraturan perundang-undangan yang berlaku serta menggunakan data sekunder sebagai data utama. Berdasarkan hasil penelitian, dapat dirumuskan kesimpulan sebagai berikut: (1) Kewenangan yang dimiliki oleh desa pakraman sebagai pemegang Hak Milik Bersama (Komunal) atas tanah, lebih dekat kewenangan hak pakai tanpa jangka waktu/selama dipergunakan; dan (2) Penunjukan Desa Pakraman menjadi subyek Hak Milik Bersama (komunal) atas tanah menurut Kepmen ATR/BPN No. 276/2017, untuk memberikan perlindungan serta kepastian hukum terhadap eksistensi dari kedudukan tanah druwe desa pakraman.

Abstract

This study aims to find and examine the implementation of land management in the Kerobokan Traditional Village for tourism industry activities. The issues raised in this study are about mechanisms and procedures for land management and the implementation of land management in traditional villages for the tourism industry. This research is an empirical research with an emphasis on field data as primary data. This study found that the implementation of land management in the Kerobokan Traditional Village for tourism industry activities was carried out by leasing a contract based on an agreement through the relevant Paruman Desa Adat/Banjar Adat. The Kerobokan Traditional Village also has a Perarem Pangele which regulates administrative provisions that must be met by krama tamiu (in this case including investors). The authority to manage this land is strengthened by the Regional Regulation of the Province of Bali Number 4 of 2019 concerning Traditional Villages in Article 1 number 8 which provides autonomy for Traditional Villages to manage their own households. Penelitian ini bertujuan untuk menemukan dan mengkaji terkait implementasi pengelolaan tanah di Desa Adat Kerobokan untuk kegiatan industri pariwisata. Permasalahan yang diangkat dalam penelitian ini adalah tentang mekanisme dan prosedur pengelolaan tanah serta implementasi pengelolaan tanah di Desa Adat untuk industri pariwisata. Penelitian ini merupakan penelitian empirik dengan menekankan pada data lapangan sebagai data primer. Penelitian ini menemukan bahwa implementasi pengelolaan tanah di Desa Adat Kerobokan untuk kegiatan industri pariwisata dilakukan dengan sewa kontrak berdasarkan kesepakatan melalui Paruman Desa Adat/Banjar Adat yang bersangkutan. Desa Adat Kerobokan juga memiliki Perarem Pangele yang mengatur tentang ketentuan administrasi yang harus dipenuhi oleh para krama tamiu (dalam hal ini termasuk investor). Kewenangan pengelolaan tanah tersebut diperkuat dengan Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019 tentang Desa Adat pada Pasal 1 angka 8 yang memberikan otonomi bagi Desa Adat untuk mengurus rumah tangganya sendiri.

Abstract

The research was aimed to examine the authority of Adat village in the management of coastal areas based on Bali Province Regional Regulation No. 4 of 2019 concerning Adat Village and constructing the regulation on forest park in coastal areas from the perspective of ius constituendum. This was normative legal research using statutory approach and conceptual approach. The study indicated that there is a conflict of norm in the authority to manage the coastal areas in Bali, which according to the Article 25 point 1 c and d of the Perda Desa Adat, it can be seen that Adat Village has the authority to manage the coastal areas, which includes Tahura Ngurah Rai, however, according to Article 1 point 10 of the Regulation of the Minister of Environment and Forestry No: P.10/Menhut-II/2009, the authority to manage the forest park is delegated to the UPTD Tahura Ngurah Rai, which was formed and is under the Bali Provincial Environment and Forestry Services as the holder of autonomous forest management rights in Bali. Hence, it is important to harmonize the application of the authority of Adat Village with the national regulation to avoid conflict of norms by taking in to account the Stufenbau Theory and the principles of lex superior derogat legi inferiori in reforming a regulation on forest park in coastal area in the future as ius constituendum

Abstract

The strength of a well-known trademark crosses the various trademark registration classes. Thiis article is intended to discusses the legal protection of well-known trademarks in the jurisdiction of all the Association of Southeast Asian Nations (ASEAN) member states. This research is normative juridical- research by conducting a literature study to obtain legal materials. In the first part, it will be explained the definition of a well-known trademark that has been known in the world. Next, it will be discussed the criteria for a trademark to be considered well-known internationally. The last section discussed about the legal protection of well-known trademarks at the international level and at the national level in the ASEAN member countries. There are 3 types of well-known trademarks protection found in ASEAN member countries. First, the well-known trademarks are distinguished to be registered or unregistered. Registered well-known trademarks will be protected in all classes of goods or services, while well-known trademarks that are not registered only receive protection in the same classes of goods or services like those well-known trademarks. Countries that apply this kind of protection are the Philippines, Cambodia, Malaysia, and Myanmar. Second, the protection of well-known trademark is only in the same class of goods or services, regardless of whether the trademark is registered or not in the country. This type of protection is in Indonesia. Third, protection of well-known trademarks in all classes of goods or services without distinguishing whether the well-known trademark is already registered or not in the country. This kind of protection is known in Brunei, Laos, Thailand and Vietnam. Kekuatan suatu merek terkenal melintasi berbagai kelas pendaftaran merek. Tulisan ini bertujuan untuk membahas mengenai perlindungan hukum atas merek terkenal pada yurisdiksi seluruh negara anggota the Association of Southeast Asian Nations (ASEAN). Penelitian ini merupakan penelitian yuridis normatif dengan melakukan studi pustaka untuk menemukan bahan hukun. Pada bagian pertama akan dijelaskan mengenai definisi merek terkenal yang selama ini dikenal di dunia. Selanjutnya akan dibahas mengenai kriteria keterkenalan suatu merek terkenal secara internasional. Pada bagian terakhir dibahas mengenai perlindungan merek terkenal di tingkat internasional dan pada tingkat nasional di negara anggota ASEAN. Dapat disimpulkan terdapat 3 jenis perlindungan merek terkenal yang terdapat di negara-negara anggota ASEAN. Yang pertama adalah, merek terkenal dibedakan menjadi terdaftar atau tidak terdaftar. Merek terkenal yang terdaftar akan mendapat perlindungan di semua kelas barang atau jasa, sedangkan merek terkenal yang tidak terdaftar hanya mendapat perlindungan di kelas barang atau jasa yang sejenis dengan merek terkenal tersebut. Negara yang menerapkan perlindungan semacam ini adalah Filipina, Kamboja, Malaysia dan Myanmar. Yang kedua, perlindungan atas merek terkenal hanya di kelas barang atau jasa yang sama, terlepas dari apakah merek terkenal tersebut sudah terdaftar atau tidak di negara tersebut. Perlindungan jenis ini terdapat di Indonesia. Yang ketiga, perlindungan atas merek terkenal di semua kelas barang atau jasa tanpa membedakan apakah merek terkenal tersebut sudah terdaftar atau tidak di negara tersebut. Perlindungan semacam ini dikenal di Brunei, Laos, Thailand dan Vietnam.
