Abstract

Early marriage completely undermines children's human rights. Previous studies have shown that child marriage is inextricably linked to various adverse impacts, from violated children's rights to obtain education and access to health services to intergenerational poverty. Indonesia is in the 8th highest rate of early childhood marriages internationally and is ranked 2nd in ASEAN. This phenomenon has put Indonesia in the spotlight of The United Nations Children's Fund (UNICEF). This research, which relies on interviews and observations from various related documents, aims to analyze the role implemented by UNICEF in tackling the problem of child marriage in Indonesia for the 2017-2020 period. The theories and concepts applied are the theory of international organizations, role theory, and the concept of child marriage. Furthermore, the author used data analysis model according to Miles, Huberman, and Saldaña, which consists of data condensation, data display, and conclusion drawing/verification. The final results of this study reveal that UNICEF is playing their role in providing information on child marriage, advocating for policies, introducing innovations to address challenges, and supplying technical assistance to improve the quality of social services. In addition, UNICEF partners with governments to ensure that resources are employed to meet the needs of children, create spaces for children to be involved in the development process and strengthen collaboration for child's interests. Keywords: UNICEF; child marriage; international organizations; role theory.

Abstract

Cases of sexual violence against children in Aceh are increasingly worrying. The data collected from SIMFONI-PPA of the Ministry of Women’s Empowerment and Child Protection recorded that in 2021 there were 5,463 cases of violence against children nationally. The impacts felt by the victims of sexual violence who needed psychological assistance included hatred, revenge, rebellion, and trauma. This study, therefore, aimed to investigate the communication patterns used by the facilitators at the Protection of Women and Children of Aceh Province in handling child victims of sexual violence and the obstacles faced in the assistance process. By using a qualitative and phenomenological approach, the study collected the data through in-depth interviews and documentation. The researcher interviewed two lawyers, two counsellors, and one psychologist. At the same time, documentation data was acquired from records and relevant documents in the UPTD PPA Aceh office. The results of the study revealed that there were two patterns of communication used by the facilitators of UPTD. Psychologists and counsellors used primary communication patterns through verbal and non-verbal communication simultaneously. On the other hand, lawyers used a circular communication pattern by having more communication with the victims’ families. Moreover, the obstacles experienced by the facilitators included requiring extra approaches and assistance for child victims with special needs. Other obstacles include frequent threats and terror, the dysfunction of the safe house for victims who needed temporary shelter, and the unavailability of a special treatment section or room in the hospital for victims of sexual violence.

Abstract

This study focuses on efforts made by the Aceh government to protect women and children before and after illegal marriages. The author uses a victimology theory approach to see the efforts made by the government in these cases. The author examines two problems; how the modus operandi of illegal marriage under state law occurs in Aceh and what countermeasures the Aceh Government has taken to protect women and children of Pre and Post-Illegal Marriage in Aceh. This research is a combination of Normative and Empirical research. The results indicate that the modus operandi of illegal marriage under state law occurs in Aceh includes siri marriage (unofficial, unregistered marriage) and its legal consequences, illegal polygamy by civil servants, early marriage, polyandrous marriage, Cina Buta marriage (muhallil or a proponent to reconcile a couple (wife and husband) who had divorced by triple divorce). The countermeasures implemented by the Aceh Government to protect women and children Pre and Post Illegal Marriage in Aceh include: conducting socialization to secondary schools about marriage following state law, issuing Aceh Governor Regulation no.25 of 2017 concerning the implementation of one-day service marriage validation (isbath nikah -marriage legalization- program during the conflict and tsunami), isbath nikah as a benchmark for data on the number of siri marriages, marriage dispensation for early marriage by teenagers, qanun policy on legalizing polygamy through qanun family law in Aceh illegal polygamy, and implementation of The Constitutional Court decisions on civil recognition of the status of children out of wedlock with biological fathers.

Protection is an absolute thing to do, especially for the children who are victims of sexual violence. Data triangulation technique of observation and interview were to firm the trustworthiness. The data were analysed interactively as suggested by Miles and Huberman: data reduction, data display, and conclusion drawing. The findings showed that the majority of the respondents participated in the labour force due to their family financial problem. Though the financial problem was reduced, being a working female in three-time shift system brought about the other problems, such as social and sexual problems. The females could fulfil the family financial needs by sacrificing the social and sexual fulfilments of the family because they had no time and physical energy anymore. These problems were commonly found from the respondents, although it was found several variables that vary the level of the problems from each individual and group.
