Abstract

Most of the Wonosobo area is a mountainous area, therefore the livelihoods of the Wonosobo people are still mostly working in agriculture. In Kejajar District, Wonosobo Regency, farmers/cultivators usually enter into lease agreements with landowners. To use the agricultural land is done orally based on trust and has been passed down from generation to generation by the people of Kejajar District, Wonosobo Regency. This becomes unclear if there is a dispute between the landowner and the cultivator. So this research was conducted to find out how the process of implementing the lease of agricultural land. The research method used in this study is a normative juridical approach, which is carried out through a literature study that examines secondary data in the form of legislation and other legal documents, as well as research results, study results, and other references. The normative juridical method can be supplemented by interviews. The people of Kejajar District still use agricultural land production sharing agreements using customary law, which is only done verbally and based on mutual trust between the two parties, even though the government has provided a legal umbrella related to the agricultural land product sharing system, namely Law Number 2 of 1960 concerning Agricultural Product Sharing. Most of the people of the Kejajar Subdistrict, Wonosobo Regency are also not aware of the existence of Law Number 2 of 1960 concerning Agricultural Product Sharing. The factors that occur in the implementation of agricultural land production sharing agreements in Kejajar District, Wonosobo Regency are due to the large number of farmers who do not own land, agricultural land that has been neglected for a long time, landowners who do not have much time to take care of the land because they are busy trading. Keywords: Profit sharing, Agricultural land, LeasesĀ

Abstract

The issue of abuse of authority by company directors often occurs in companies in Indonesia. Deviations that exceed the authority of the board of directors are known as Ultra Virus. As a result of these deviations, it has the potential to cause losses to stakeholders such as shareholders, the wider community, company partners and even the company itself. In the Limited Liability Company Law, ultra virus acts can be held accountable to the Board of Directors personally, but the problem is, how the directors can fulfill the demands of the injured parties while their assets have been transferred or have been exhausted. In this writing the author uses a normative juridical approach. The result of this study is that the actions of directors who have ultra viruses have the potential to harm many parties, therefore so that these actions are not repeated there needs to be a strict supervision mechanism, because so far the supervision has only been carried out by commissioners. Internal supervision by commissioners is deemed not optimal, so it is necessary to establish by the government an institution in charge of overseeing the performance of directors in the company

Sambirata Village, Cilongok District has natural wealth that has the potential to be developed for the progress of the village and the welfare of its people. This natural potential is in the form of a very beautiful natural environment that is still maintained, and allows it to be developed as a tourist destination. Abstract Indonesia recognize two collateral institutions that can be used by the public, namely pawn and mortgage based on the Civil Code. The development of law in Indonesia then introduced two new collateral institutions, namely mortgage and fiduciary rights. Mortgage rights are security institutions that can be used on objects in the form of land rights. The practice of implementing the execution of the object of mortgage rights collateral that has become the right of the auction winner generally still experiences many obstacles. This research aims to find out and analyse the legal protection for the winner of the auction along with the arrangement of the execution of the auction object which is still controlled by the giver of the mortgage. This research is writtenusing the normative juridical method, namely using the law, and journals relevant to this research. This research describes the legal protection of auction winners who are in good faith over the object of mortgage rights, so that even though the object of mortgage rights is still controlled by the debtor or other parties, the auction winner can still control the auction object by fulfilling the auction requirements and procedures and submitting an application for execution correctly.

Abstract

Many people believe that it cannot be justified to dismiss a Notary dishonorably just for reasons of bankruptcy, as determined by the Court. If we look closely of Article 12 letter a of the Law on the Position of Notaries, it turns out that the meaning of this article is unclear. It is not clear whether the Notary was bankrupted in his personal capacity as an individual (natuurlijk person) or in his official function as a public official. The issues that will be discussed are the procedures for terminating the position of a bankrupt notary and whether the dismissal of the notary's position is in accordance with the principles of justice. The research methodology used is normative juridical research. The findings of this research indicate that a Notary who is declared bankrupt can be temporarily dismissed from his position as intended in Article 9 paragraph (1) letter a. Furthermore, if the bankruptcy statement has permanent legal force, the Notary can be permanently dismissed from his position by the Minister, on the recommendation of the Supervisory Board of the Central Supervisory Board, as intended in Article 12 letter a of Law Number 2 of 2014 concerning the Position of Notaries. The Bankruptcy Law does not explicitly regulate the role of Notaries. However, it can be concluded that persons subject to the regulations outlined in the Bankruptcy Law are limited to legal incompetence and are not permitted to exercise control over their assets.

Abstract

Abstract

Children's use of technology has a significant impact on their physical, cognitive, social and emotional development. One of the technologies that children often use is social media. While social media can provide benefits, there are also negative impacts such as bullying and harassment. Therefore, supervision from parents, educators, and authorities is essential. Technology is not all good or all bad; what matters is how its use is managed to suit children's needs and development, while considering its positive and negative impacts. This research aims to find out and analyze various countermeasures that can be taken against children who experience sexual harassment on social media in accordance with the provisions in the Child Protection Law, as well as identify forms of legal protection provided to child victims of sexual harassment in cyberspace based on applicable regulations. This analysis includes measures for prevention, handling, and recovery of victims, as well as legal implementation to ensure that children's rights are optimally protected in the midst of rampant cases of harassment in the digital realm. Data collected from primary legal materials and secondary legal materials are then analyzed qualitatively. Countermeasures against child sexual abuse on social media according to Law number 35 of 2014 and Law number 12 of 2022 involve integrated preventive and enforcement actions.
