Abstract

This study focuses on efforts to improve the ability of human resources through the form of training in producing legal argumentation as one of the strengthening skills of Bawaslu members in Donggala district. Legal Argumentation is essentially made to answer certain issues. This issue generally arises from the client. Therefore, a legal argumentation must be made in a focused, systematic, and proportional manner. Legal argumentation usually only consists of 3-5 pages. For this reason, legal argumentation must focus only on the issue in question, not discussing matters outside of it. Legal argumentation must also be systematic so that the description is easy to understand. There is no standard format for a Legal Argumentation, but at least an LO consists of: (1) the case, (2) identifiable and relevant legal basis, (3) legal opinion, and closed with (5) conclusion, which includes suggestions or recommendations.

Abstract

Almost every stage of the elections leaves the issue of violations dealt with by the Bawaslu of Parigi Moutong district, which allows them to make legal analysis and legal opinions. Abstract

Lake Poso, Indonesia's third-largest lake, faces severe ecological threats that endanger its biodiversity and the livelihoods of local communities. Despite its ecological significance, legal and policy responses remain fragmented, hindering effective conservation. This research employs a normative research method, integrating doctrinal and statutory approaches with qualitative analysis of relevant regulations and scientific literature. Findings highlight critical challenges, including endemic species decline, water quality degradation, climate change impacts, and socio-economic pressures from fisheries decline and unregulated tourism. Governance fragmentation emerges as a central issue, with national laws lacking ecosystem-specific provisions and regional regulations suffering from weak enforcement, limited institutional capacity, and inadequate funding. Drawing on successful conservation models from other Indonesian lakes, this research proposes a framework for integrated legal policies. Key recommendations include watershed management, sustainable fisheries practices, targeted pollution control, climate adaptation measures, and community-based conservation incorporating traditional ecological knowledge. By addressing regulatory gaps and enhancing policy coherence, this research provides a roadmap for Lake Poso’s long-term preservation and sustainable development.

Abstract

The purpose of this study is to analyze the factors that hinder the implementation of government policies against the elimination of minimal capital of legal entities as an effort to develop MSME to improve the regional economy in Palu of Central Sulawesi. This research was an empirical research method using a qualitative descriptive approach. The results showed the factors inhibiting the implementation of government policy on the elimination of minimal capital of legal entity making is the lack of information about Government Regulation Number 29 of 2016 concerning Changes in The Basic Capital of The Establishment of Limited Liability Companies, Constraints on the requirements of making Limited Liability Companies both due to large capital constraints for the manufacture of Limited Liability Companies and Due to Administrative System Constraints that are quite difficult, and the latter is the Orientation of Individualist Thinking.

Abstract

 This research aims to analyze the obstacles in handling election crimes and find the ideal argumentation basis to be used as an improvement to the handling of election crimes. The current handling of election criminal offenses is affected by problems of substance and structure. In terms of substance, there are several articles that regulate elements that are difficult to prove, such as articles related to money politics, political dowries, and unscheduled campaigns, while in terms of structure, the existence of integrated law enforcement centers tends to differ with each other in the process of handling election criminal offenses, which has an impact on the discontinuation of handling election criminal offenses. In addition, there is a change in the personnel of investigators and prosecutors when the process of handling violations is ongoing. This research is normative research. The results of the research illustrate that the redesign of the handling of election criminal offenses is carried out with two approaches, namely first, Article 492, Article 494, Article 495 paragraph (1) and paragraph (2), Article 513, Article 515, Article 518, Article 545. Second, the redesign of the handling of electoral crimes through the enactment of the concept of the provisions of Article 486 paragraph (2) and paragraph (4) expressly in the pattern of handling electoral crimes by the Gakkumdu center by placing the span of control of the termination of the investigation and prosecution process through legal instruments issued by Bawaslu. Penelitian ini bertujuan untuk menganalisis kendala dalam penanganan tindak pidana Pemilu serta menemukan basis argumentasi yang ideal untuk digunakan sebagai perbaikan terhadap penanganan tindak pidana Pemilu. Penanganan pelanggaran tindak pidana Pemilu saat ini dipengaruhi oleh problematika subtansi dan struktur. Dari sisi substansi, terdapat beberapa pasal yang mengatur Unsur-unsur yang sulit dibuktikan semisal pasal terkait politik uang, mahar politik, dan kampanye luar jadwal, sedangkan dari sisi struktur, keberadaan sentra penegakan hukum terpadu cenderung saling berbeda pandangan dalam proses penanganan pelanggaran tindak pidana Pemilu, yang berdampak pada tidak dilanjutkanya penanganan pelanggaran tindak pidana Pemilu. Di samping itu pula, dalam terjadi pergantian personil penyidik dan penuntut di saat proses penanganan pelanggaran tengah berjalan. Penelitian ini merupakan penelitian normatif. Adapun hasil penelitian memberikan gambaran yakni redesain terhadap penanganan pelanggaran tindak pidana Pemilu dilakukan dengan dua pendekatan yakni pertama, Pasal 492, Pasal 494, Pasal 495 ayat (1) dan ayat (2), Pasal 513, Pasal 515, Pasal 518, Pasal 545. Kedua, redesain terhadap penanganan tindak pidana Pemilu melalui dengan memberlakukan konsep ketentuan Pasal 486 ayat (2) dan ayat (4) secara tegas pada pola penanganan tindak pidana Pemilu oleh Sentra Gakkumdu dengan menempatkan rentang kendali penghentian proses penyidikan dan penuntutan melalui instrument hukum yang dikeluarkan oleh Bawaslu.

Abstract

Omnibus law menjadi perdebatan dikalangan masyarakat sejak pemerintah mencanangkan menggunakannya dalam pembentukan undang – undang, pro dan kontra hadir dikarenakan metode Omnibus law cenderung digunakan oleh negara yang bermatra common law sistem. Namun, kehadiran Undang-Undang Cipta Kerja menjadi jawaban bahwa metode ini juga kontekstual dan relevan untuk digunakan pada civil law sistem. Penelitian ini berfokus untuk menjawab (a) Omnibus law Dalam pembentukan Peraturan Perundang-Undangan; (b) Hakekat Peraturan Daerah; (c) Penggunaan Metode Omnibus law dalam Pembentukan Peraturan Daerah. Tujuan dari penelitian ini untuk mengetahui, memahami, dan menganalisa Omnibus law Dalam pembentukan Peraturan Perundang-Undangan, hakekat Peraturan Daerah, dan merumuskan Penggunaan Metode Omnibus law dalam Pembentukan Peraturan Daerah. Metode penelitian yang digunakan ialah penelitian yuridis normatif, dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukan bahwa penggunaan metode Omnibus law dapat diimplementasikan terhadap subtansi materi muatan Peraturan Daerah yang ketentuan pembentukannya didasarkan atas pelaksanaan undang-undang yang juga dibentuk melalui metode Omnibus law.

Abstract

The existence of Covid-19 in Indonesia has now had its status changed from pandemic to endemic. However, its existence still poses a serious threat to the general health of Indonesian citizens. Since 2019, the government still pays close attention to the existence of Covid-19, by implementing various policies to ensure health protection for the citizens as a Constitutional mandate. In the light of that, this research discusses how the concept of protecting the right to health is understood in the Constitution and whether the vaccination policy is in line with the Constitution. This research uses normative methods. This research concludes that, first, the concept of protecting the right to health in the Constitutional takes the form of understanding with a social-solidarity dimension which is based on the protection of human rights as part of human dignity in achieving public benefits. Second, the vaccination policy implemented by the government is in line with Constitutional values considering it includes protection of the right to health.Keywords: Constitution; Covid-19; Policy; Vaccination. AbstrakKeberadaan Covid-19 di Indonesia saat ini telah mengalami perubahan status dari pandemi menjadi endemi, akan tetapi keberadaannya masih memberikan ancaman yang serius bagi kesehatan warga negara Indonesia. Sejak Tahun 2019 hingga saat ini pemerintah masih memberikan perhatian terhadap keberadaan Covid-19, dengan melakukan berbagai kebijakan guna memastikan perlindungan Kesehatan bagi warga negara sebagai amanat konstitusi. Sehingga penelitian ini membahas bagaimanakah konsep perlindungan hak Kesehatan dalam paham konstitusi dan apakah kebijakan vaksinasi telah selaras dengan konstitusi. Penelitian ini menggunakan metode penelitian normatif. Penelitian ini berkesimpulan, yakni, pertama, konsep perlindungan hak Kesehatan dalam paham konstitusi bermatra sosial-solidaritas yang bertumpuh pada perlindungan hak asasi manusia sebagai bagian dari harkat kemanusiaan dalam mengapai kemaslahatan. Kedua: kebijakan vaksinasi yang dilakukan oleh pemerintah telah selaras dengan nilai–nilai konstitusi karena memuat perlindungan terhadap hak kesehatan.Kata Kunci: Covid-19; Kebijakan; Konstitusi; Vaksinasi

Abstract

The purpose of this paper is to find the ideal form of punishment for perpetrators of sexual violence who suffer from deviant sexual behavior. The method in this study is a normative legal research type, where activities are carried out by researching and analyzing the forms of sanctions and punishments regulated in positive law, in addition to conducting a comparative study of the provisions in positive law in Indonesia in the perspective of the types of sanctions against perpetrators of sexual violence crimes. who suffer from deviant sexual behavior. The results show that the ideal form of sanctions imposed on perpetrators of sexual violence who suffer from deviant sexual behavior should not only focus on imprisonment, however, it must be accompanied by other treatments or actions to treat the deviations in sexual behavior he suffers as mandated in the Sexual Violence Criminal Act, which is to combine imprisonment and special rehabilitation to cure his sexual behavior deviations. With the imposition of imprisonment alone, it will not be able to treat the main factor that triggers sexual violence crimes committed by perpetrators who suffer from deviant sexual behavior, so that rehabilitation or treatment efforts are important things that must be done so that there is no repeated or recidive crime.

Abstract

Pemilihan Umum Republik Indonesia, bukan hanya dilaksanakan di Indonesia, namun juga dilaksakan diluar negeri. Keputusan Komisi Pemilihan Umum Republik Indonesia nomor 2030/PL.02.1-Kpt/01/KPU/XII/2018 tentang Perubahan Atas Keputusan Komisi Pemilihan Umum Republik Indonesia Nomor 1801/PL/02.1-Kpt/01/KPU/IX/2018 tentang Rekapitulasi Daftar Pemilih Tetap dan Badan Penyelenggara Untuk Setiap Daerah Pemilihan dalam Pemilihan Umum tahun 2019 menunjukan information bahwa DPT Luar Negeri tersebar di 130 perwakilan Indonesia di luar negeri baik kedutaan besar, konsulat jenderal, konsulat, hingga kantor dagang dan ekonomi, sebanyak 2.058.191 Jiwa. Metode pemungutan suara di Luar negeri berbeda dengan pemungutan suara di dalam negeri. Kasus yang terjadi tahun 2019 di Malaysia yakni adanya surat suara tercoblos di ruko-ruko yang bukan yuridiksi negara Indonesia sebelum pelaksanaan Pemilihan Umum memungkinkan dapat terjadi lagi di tahun 2024 sebab tidak adanya perubahan peraturan signifikan tentang Pemilihan Umum Republik Indonesia di Luar negeri untuk Pemilu 2024. Pada kasus stersebut, Pihak penyelenggara baik Bawaslu-RI maupun KPU-RI sulit menentukan surat suara yang tercoblos adalah surat suara asli atau bukan, karena untuk menentukan keaslian surat suara merupakan kewenangan Ketua Bawaslu dan Ketua KPU yang mana harus melihat langsung dan menyesuaikan kode rahasia yang tertera dalam surat suara. Kasus rusaknya surat suara di Malaysia tahun 2019 mengakibatkan Bawaslu-RI mengeluarkan rekomendasi untuk tidak menghitung surat suara diwilayah rusaknya surat suara, padahal polisi Malaysia belum menyerahkan surat suara yang rusak dan pihak penyelenggara belum mengetahui bahwa surat suara tersebut Asli atau tidak. Keterbatasan waktu dan daya jangkau akibat adanya batasan yuridiksi tentu memerlukan perubahan konsep terhadap penyerahan alat bukti pada yuridiksi yang berbeda. Olehnya konsep Rebuild terhadap ekstradisi barang bukti perlu dilakukan dalam upaya melakukan penyelidikan tindak Pidana Pemilihan Umum, sehingga oleh penyelenggara Pemilihan Umum dapat sedini mungkin mengetahui bahwa perbuatan tersebut termasuk tindak pidana atau bukan. Hal ini berupaya menerobos konsep bahwa selama ini ekstradisi barang bukti dilakukan sebagai upaya pada tingkat penyidikan tindak pidana yakni telah nyata perbuatan tersebut adalah tindak pidana. Pada penelitian ini, melibatkan information empiris dari Bawaslu-RI untuk mendapatkan sinerjitas terhadap perubahan konsep penanganan Tindak Pidana Pemilu Republik Indonesia yang terjadi di luar negeri.
