Abstract

ABSTRACT This paper is underlain by Decision Number 251/Pdt.Sus-PKPU/2020/PN.Niaga.Jkt.Pst which rati ed the homologation agreement in the case of suspension of debt payment obligations. The creditors led this case against PT Tebo Indah and PT Pratama Agro Sawit. The panel of judges rati ed the homologation agreement based on a report from the supervisory judge which stated that a peace agreement was reached between PT Tebo Indah, PT Pratama Agro Sawit, and their creditors. This agreement caused a problem for the Indonesia Eximbank Financing Agency as a separatist creditor. The main issue of this study is that the suspension of debt payment obligations decision, which is nal and binding, leads to various interpretations regarding the substance of the guaranteed document in the rati cation of the homologation agreement. The substance of the guaranteed document that is not speci ed concretely in the rati cation of the homologation agreement makes a balance position and protection for the bank as the separatist creditor cannot be provided. This study uses a normative juridical method. The author took the data through a literature study and veri ed them deductively. The study indicates that if the homologation agreement is used as a base for composing additional guarantee documents, then its substance becomes uncertain because it is not speci ed in the homologation agreement. Clauses of granting special guarantees and conditions for payment of receivables are the main part of the peace agreement, which will be rati ed in the homologation process in the commercial court. The two main parts must be set speci cally. Keywords: homologation; suspension of debt payment obligations; separatist creditors.

Abstract

Abstract

The determination of state losses in corruption cases involving Persero State-Owned Enterprises (SOEs) shows conceptual weaknesses that have a direct impact on legal certainty and the proportionality of punishment. Law enforcement practices exhibit a systemic tendency to equate corporate losses with state losses without operational normative limits, thus expanding the space for overcriminalization of legitimate business decisions. This research aims to analyze these distortions and reconstruct state losses as a precise and measurable element of delicacy. The research uses a normative legal approach based on doctrinal-critical analysis, combined with conceptual approaches and functional comparisons to test the coherence between criminal law, state finance, and corporate law regimes. The findings show that the determination of state losses is still dominated by a formalistic and outcome-oriented approach, without adequate testing of causality, governance, and fiscal verification. This condition blurs the line between business risk and unlawful acts and triggers disparity in judgments. This study proposes a tiered legal reasoning model that requires three cumulative elements, namely normative deviations, measurable actual losses, and accountable causal relationships. The originality of the research lies in the formulation of an integrated analytical framework that operationalizes the validation of state losses normatively and systematically. The contribution of this research strengthens the doctrine of state losses as an element of material crime while providing analytical instruments to improve the consistency of evidence and limit disproportionate criminalization in the enforcement of corruption laws in Persero SOEs.

Abstract

The national cooking oil industry experienced a price crisis in 2022, influenced by fluctuations in raw material prices in the global market. This condition prompted the government to implement a Maximum Retail Price policy as an effort to control prices and protect consumers. However, the policy created distortions in the domestic market equilibrium and affected cooking oil production and distribution activities. Several business entities responded to these conditions by limiting production volumes and supply. These actions subsequently became the basis for the competition authority to impose administrative sanctions based on indirect evidence. This study aims to analyze the legal considerations of the Supreme Court in overturning the sanctions through Decision Number 85 K/Pdt.Sus-KPPU/2025. This study employed a qualitative method using statutory and judicial case study approaches. The findings indicate that the Supreme Court did not accept the standard of proof applied by the Business Competition Supervisory Commission and emphasized the importance of evidence capable of demonstrating the existence of a cartel agreement. Supply restrictions under certain circumstances may be considered a rational economic response to market conditions. Legal certainty is therefore necessary to protect legitimate business activities while supporting supply chain stability and maintaining fair and healthy business competition.

Abstract

The lowest echelons of society have been affected by the global spread of the coronavirus epidemic, which has infected people from all walks of life and altered regional lives and cultural practices. In addition to causing a recession in the national economy, this issue has also decreased peoples' purchasing power and ability to withstand the rising cost of living. This study outlines the efforts made by the Bandung Regency government to provide good guarantees for street children through preventive measures, financial education assistance, fostering enthusiasm and shelter supervision, developing regulations and policies, and providing freedom of choice for street children in the medium term through playing, direct support, approaches to tackling social issues, and suggestions for revenue management. the enhancement of human resources, research into the growth of street children, and evaluation of good street child conduct are all attempts to better society. The problem is that because of spiritual issues, many of them try to escape and destroy necessities of life. Despite having a sizable state budget, it is impossible to employ street children in suitable jobs. Additionally, there is still a dearth of assistance and backing from many organizations.
