Abstract

Pinjaman Online saat ini menjadi inovasi baru layanan penyedia jasa keuangan di lingkungan masyarakat. Proses dan syarat-syarat peminjaman yang mudah dengan hanya melalui gadget menjadi salah satu alasan mengapa pinjol begitu diminati oleh masyarakat. Namun, sebagian dari masyarakat masih belum mengetahui terkait perbedaan antara pinjol resmi dengan pinjol ilegal. Kegiatan Sosialisasi Pengabdian Kepada Masyarakat (PKM) dalam Mengatasi Maraknya Pinjam Online Ilegal Pada Era Globalisasi di Samarinda ini bertujuan untuk mengembangkan kemandirian dan kesejahteraan masyarakat dengan meningkatkan pengetahuan mengenai risiko kerugian yang akan didapatkan jika menggunakan pinjol ilegal yang tidak berada di bawah pengawasan oleh OJK (Otoritas Jasa Keuangan). Hasil yang dicapai dalam kegiatan PKM ini adalah meningkatnya pengetahuan serta kesadaran masyarakat tentang pinjol ilegal sehingga kasus masyarakat yang terjerat pinjol ilegal dapat berkurang serta teratasi.

Abstract

The state inherently played a significant role in the defined digital space governed by various regulations related to telematics. From 2008 to 2024, there were three amendments to the Electronic Information and Transactions Law, each of which had implications for the state's role in the digital realm. The purpose of this article was to elucidate the changes in the state's role in the digital space resulting from alterations in the legal framework of the Electronic Information and Transactions Law. This socio-legal research employed a historical legal approach and discourse analysis concerning the periodization of the development of the Electronic Information and Transactions Law. The findings indicated that the background of changes in the state's role in the digital space was a response to various telematics phenomena that had evolved in society. Currently, there has been a strengthening of the state's role in the digital realm, including measures such as digital access termination for violators of digital rights and extensive supervision of electronic system providers.

Abstract

The issue of education and religion is a fundamental issue and is always an issue of discussion among academics and practitioners. The role of parents at home, teachers at school, and lecturers at campus is considered to be the biggest reason that influences the level of education and spirituality in Indonesia. Various approaches have been used to analyze why the level of education in Indonesia is still one of the worst in Asian countries. Even though our constitution clearly states that one of the duties of the state is to make the nation's life intelligent. The importance of education with character as initial capital to live a true life is found in the family environment, school and campus. In this case, the formation of educational character does not only rely on general knowledge, but must be balanced with spiritual knowledge. This article uses a doctrinal research method, namely the author collects material from literature, both hardcopy and softcopy, related to the title of this research using an analysis of the research object. This article focuses on discussing how the Islamic Religious Education Governance system is in Indonesia and the role of law in improving the quality of Islamic Religious education in Indonesia. Because in Islam, one of the best people is one who is able to produce a quality generation with knowledge and spirituality that reflects the Koran and Sunnah of Rasullullah Shallallahu 'Alaihi wa Sallam.

Abstract

The rapid growth of the online training industry (e-course) in Indonesia has created high-value digital economic commodities. However, the current Intellectual Property Rights (IPR) framework tends to view protection objects in silos, whereas an online training product is fundamentally a complex convergence of various digital elements. This study aims to dissect the legal construction of IPR protection regarding the online training ecosystem, which comprises Learning Management Systems (LMS), teaching modules, audiovisual content, and teaching methods (SOPs). This research employs a normative juridical method with statutory and conceptual approaches. The findings reveal that the online training ecosystem involves overlapping legal regimes. While videos and modules receive automatic Copyright protection, LMS intersects with Computer Program Copyright. A critical complexity arises in protecting "teaching methods" and SOPs; Trade Secret claims become weak once the material is taught to the public, while Copyright does not protect ideas or methods (idea-expression dichotomy). This fragmentation renders law enforcement against training product piracy ("access piracy") suboptimal. The study concludes that a hybrid protection strategy integrating various IPR instruments and robust contractual licensing clauses (Terms of Service) is essential to protect creators' intellectual assets comprehensively.

Abstract

Ronggo Warsito, NIM 2108016229, Program studi Ilmu Hukum, Minat Studi Hukum Perdata, Skema Kontrak Elektronik Pada Karya Cipta Yang Ditokenisasi Dan Di Marketplace Non-Fungible Token  di bawah bimbingan Ibu Dr. Emilda Kuspraningrum S.H., Kn, M.H. dan Bapak Sofwan Rizko Ramadoni S.H., M.H. Perkembangan teknologi blockchain menghadirkan Non-Fungible Token sebagai instrumen baru dalam transaksi digital, termasuk perdagangan karya seni. Namun, praktik di Indonesia masih menghadapi problematika yuridis, terutama terkait absennya kontrak elektronik yang sah sebagai dasar legitimasi hukum dalam proses tokenisasi karya. Marketplace seperti OpenSea hanya menggunakan smartcontract untuk mengatur transfer token dan pembayaran, tanpa mengatur substansi hukum penting seperti lisensi hak cipta, identitas para pihak, maupun mekanisme ganti rugi. Kondisi ini menimbulkan ketidakpastian hukum, sebagaimana terlihat pada kasus Kendra Ahimsa (Ardneks) vs Twisted Vacancy, di mana karya ditokenisasi tanpa persetujuan pencipta dan tetap diperdagangkan secara global. Penelitian ini menggunakan metode doktrinal dengan pendekatan peraturan perundang-undangan, teori hukum kontrak, dan perlindungan hukum menurut Utrecht. Analisis difokuskan pada konstruksi hukum ideal transaksi Non-Fungible Token melalui kontrak elektronik yang sah menurut KUHPerdata, Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, serta Peraturan Pemerintah Nomor 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik. Hasil penelitian menunjukkan bahwa smartcontract dalam transaksi Non-Fungible Token sah secara teknologi, tetapi cacat secara yuridis karena tidak memenuhi syarat sah perjanjian sebagaimana Pasal 1320 KUHPerdata dan standar kontrak elektronik nasional. Oleh karena itu, diperlukan rekonstruksi hukum dalam bentuk model “dua lapis kontrak”, yaitu kontrak elektronik tertulis sebagai dasar lisensi dan smartcontract sebagai instrumen eksekusi teknis. Dengan model ini, transaksi Non-Fungible Token dapat menghadirkan kepastian hukum, keadilan, dan kemanfaatan bagi semua pihak.
