Abstract

The aims of this study are: 1) To find out and analyze the legal protection that consumers and business actors get according to the Consumer Protection Act. 2) To find out and analyze the efforts of consumers who have made buying and selling transactions through social media Facebook according to the Consumer Protection Act. Research method: the research method used is normative juridical legal research using statutory approaches, conceptual approaches, case approaches. The results of the research are: 1) Law Number 8 of 1999 concerning Consumer Protection (UUPK) law has provided protection for consumers . But Facebook media is not E-Commerce. So legally consumers need to read specific agreements regulated in civil law. 2) Efforts that can be made by consumers as victims who carry out buying and selling transactions through Facebook social media according to article 4 of the UUPK consumers have the right to receive advocacy, protection, and efforts to resolve consumer protection disputes properly. Can use access through the court or outside the court. There are 3 consumer protection agencies outside the court, namely: the National Consumer Protection Agency, the Non-governmental Consumer Protection Agency, the Consumer Dispute Settlement Agency. Abstrak Tujuan dari penelitian ini adalah: 1)Untuk mengetahui dan menganalisa perlindungan hukum yang didapatkan konsumen dan pelaku usaha menurut Undang-Undang Perlindungan Konsumen. 2)Untuk mengetahui dan menganalisa upaya konsumen yang telah melakukan transaksi jual-beli melalui media sosial Facebook menurut Undang-Undang Perlindungan Konsumen. Metode penelitian: metode penelitian yang digunakan penelitian hukum yuridis normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, pendekatan kasus.. Hasil penelitian adalah: 1) Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen (UUPK) hukum telah memberikan perlindungi bagi konsumen. Namun media Facebook adalah bukan E-Commerce. Sehingga secara hukum konsumen perlu membaca perjanjian-perjanjian yang spesifik yang diatur dalam hukum perdata. 2)Upaya yang dapat dilakukan konsumen sebagai korban yang melakukan transaksi jual-beli melalui media sosial Facebook menurut pasal 4 UUPK konsumen memiliki hak untuk mendapatkan advokasi, perlindungan, dan upaya penyelesaian sengketa perlindungan konsumen secara patut. Dapat menggunakan akses melalui pengadilan maupun diluar pengadilan. Ada 3 lembaga perlindungan konsumen diluar pengadilan antara lain: Badan Perlindungan Konsumen Nasional, Lembaga Perlindungan Konsumen Swadaya Masyarakat, Badan Penyelesaian Sengketa Konsumen.   Kata Kunci : Perlindungan Hukum; Konsumen; Transaksi Jual-Beli; Media Sosial

Abstract

Agrarian conflicts in Jambi Province, particularly those related to compensation for customary land (tanah ulayat), reveal the weak integration between customary law and positive law in protecting indigenous peoples’ rights. This study aims to analyze the implementation of compensation for customary land in Jambi and formulate a model of integrating Malay Jambi customary law values into the national legal system. The research employed a normative juridical method with conceptual and evaluative approaches, supported by secondary empirical data from civil society organizations such as WALHI, BRWA, and AMAN. The findings indicate that compensation practices in Jambi emphasize individual cash payments, disregarding the communal nature and spiritual dimensions of customary land. This situation is often exacerbated by the criminalization of indigenous communities in disputes with corporations, further weakening their bargaining position in conflict resolution. As a solution, this study proposes the HARMONI-ULAYAT Model, a framework for integrating the spiritual, social, participatory, and collective sovereignty values of Malay Jambi customary law into positive law. This model can take the form of local policies, administrative regulations, or hybrid tribunals to institutionalize adat-based conflict resolution. This article contributes to the development of agrarian and customary law studies and provides a reference for more responsive policies toward substantive justice.
