Abstract

This study aims to determine and analyze the prohibition of inter-tribal marriage in the Minangkabau community in Basa Ampek District, Balai Tapan of South Pesisir Regency. The formulation of the problem in this study is: 1) What are the forms of customary sanctions against tribal marriage in Basa Ampek District, Balai Tapan South Coast Regency 2) How effective is customary sanctions on interfaith marriage in Basa Ampek District, Balai Tapan South Pesisir Regency. This study uses an Empirical Juridical approach with primary data obtained through interviews and secondary data obtained from literature studies. The results of the data are processed using qualitative methods. The results of the study found that the form of customary sanctions given to tribal marriage perpetrators is to pay customary fines, slaughter the white kabau saikua, be banished throughout the tribe, and be expelled from the nagari. In this day and age, the existence of customary sanctions has not been able to erase the occurrence of the practice of intertribal marriage in Basa Ampek District, Balai Tapan, South Pesisir Regency.

Abstract

Sengketa kemitraan perkebunan kelapa sawit sering kali bermuara pada kriminalisasi petani akibat ketimpangan struktur kontrak. Penelitian ini bertujuan menganalisis kegagalan mekanisme penyelesaian sengketa dalam Perjanjian Kerjasama antara PT. Produk Sawitindo Jambi dan Koperasi Serba Usaha Pelang Jaya, serta merekonstruksi model penyelesaian berbasis kearifan lokal. Menggunakan metode penelitian socio-legal, studi ini menemukan bahwa hegemoni kontrak dalam sistem manajemen satu atap (single management) menciptakan asimetri informasi terkait hutang pembangunan kebun. Kondisi ini memicu ketidakpercayaan dan tindakan self-help petani yang direspons perusahaan dengan instrumen pidana. Klausul musyawarah (Pasal 15) terbukti tidak efektif karena ketiadaan mediator netral. Penelitian ini menyimpulkan bahwa revitalisasi hukum adat Melayu Jambi melalui prinsip “Kato Seiyo” (musyawarah mufakat) merupakan solusi efektif. Integrasi mekanisme adat ke dalam sistem Keadilan Restoratif (Restorative Justice) diperlukan untuk menghentikan kriminalisasi dan memulihkan hubungan kemitraan yang setara.

Abstract

This research aims to determine and analyze the legal regulations regarding the principle of good faith in the execution auction of mortgage rights according to the Indonesian legal system, as well as the considerations of the Panel of Judges in Decision Number 375/PDT/2023/PT DKI in assessing the application of the principle of good faith in the execution auction of mortgage rights. The method employed is normative legal research, utilizing a statutory approach, a case approach, and a conceptual approach. The research results indicate that the principle of good faith in the execution auction of mortgage rights is not only regulated in Article 1338 paragraph (3) of the Civil Code, but also in the Mortgage Law, the Banking Law, the Minister of Finance Regulation, and SEMA Number 4 of 2016. However, its application still heavily relies on the judicial interpretation. Decision Number 375/PDT/2023/PT DKI affirms that a buyer of an auctioned property who is aware of a dispute is not a bona fide purchaser; thus, the auction is declared void. Conversely, at the appellate levels, the Supreme Court considered that the auction procedure was in accordance with regulations and that the auction buyer was considered a bona fide purchaser. This difference in consideration shows the inconsistency of Judges in applying the principle of good faith. This research suggests that the parameters of the principle of good faith include compliance with procedures and legal regulations, transparency of information regarding the legal status of the auctioned object, and prohibition against profiting from the disadvantages of other parties.

Abstract

Abstract: This study aims (1) to find out and analyze the implementation of inheritance distribution to the Toba Batak Indigenous People in Sungai Kerjan Village, Bungo Regency, Jambi Province; (2) To find out and analyze the factors that influence changes in the process of dividing the Toba Batak customary heritage in Sungai Kerjan Village, Bungo Regency, Jambi Province. This research is descriptive analysis with the type of Juridical Empirical research, which uses primary data sources and secondary data. Primary data collection techniques through observation and interviews with customary leaders and those who have carried out inheritance. Secondary data collection techniques through library research. The discussion of this research is the daughters of the Toba Batak indigenous people in Sungai Kerjan Village who receive inheritance. The results of this study are that inheritance in the Toba Batak Indigenous People in Sungai Kerjan Village has experienced a change in inheritance where daughters get a share of the inheritance. This change is caused by several factors, namely: the factor of justice, the factor of religion, and the factor of compassion.Keywords: Traditional Heritage, Toba Batak, Batak Women
